We provided you with a legal description for the parcel after the City Commission approved the abandonment application. The church's architect is proceeding under the assumption that the pcrcel can be acquired and included in development plans. The church's attorney is also waiting for the advertisement so he can assist with the acquisition and continue with title work. Once the parcel is acquired and plans are finalized, I will be submitting and processing a site plan application. The bottom line here is that the delay in the advertisement of this parcel is holding up the planning and legal work that needs to be done on our end so the church can continue their planning for the desred expansion. They have gone to considerable lengths (not to mention costs) to acquire all of the other surrounding private property and now cre waiting for this remaining parcel. So that we can continue with our wcrk, we ask that you expedite the necessary advertisement and notify me when the advertisement is going to be placed so we can act accordingly. Please consider the following: Part III, chapter 22 of the City's LDR sets out the procedure for vacation and abandonment of city streets, alleys, special purpose easements and other nonfee interests of the city. Because I am not sure whether the property at issue could be construed as an alley or easement, I would advise that it be disposed as provided under article IV, chapter two of the Code, which sets out the procedure for purchases or sales of City property. I attach a memo that I wrote earlier on this topic for guidance. In my opinion, the City should at a minimum appraise the property to determine fair market value and advertise the sale. Please consider the following: The Attorney General has expressed through several opinions that the broad home rule statute permits a governing body of a municipality to sell and convey municipally owned property for the benefit of the city by any reasonable and practicable procedure it may determine. Chapter 2, article IV, section 2-56 of the City Code provides that all purchases or sales of city property shall be subject to the approval of the city commission and shall conform to such regulations as the commission may from time to time prescribe. With regard to the sale of any real estate owned by the city, regardless of its value, section 2-56 provides that no such sale shall be conducted or consummated until such time as the subject property has been appraised by a disinterested qualified appraiser to be designated by the Commission for the purpose of establishing a fair market value thereon. After the appraisal and placement of fair market value on the property, the sale of the same shall be advertised in accordance with the provisions of section 2-56 and competitive bids thereon received with the established fair market value being the minimum acceptable to the city. Under section 2-56 all purchases or sales involving amounts in excess of $2,000.00 shall be made only after the publishing of an advertisement for bids in a Newspaper of general circulation in the city at least one time, not less than eight days prior to the date set for reception of such bids, together with such other notices that the commission may direct. The commission shall have the power to reject any and all bids submitted and received and to waive any informalities with such bidding. Under the procedure established by our Code, the offer for purchase of the subject property must first be presented to the Commission with a request for the Commission to designate a disinterested appraiser for the purpose of establishing a FMV.
