As a follow up to my telephone calls, I am trying to find out the status of the advertisement of the
triangulcr pcrcel that my client, First Baptist Church, would like to incorporate into the development
plans to expand their church facilities. We provided you with a legal description for the parcel
after the City Commission approved the abandonment application. The church's architect is
proceeding under the assumption that the pcrcel can be acquired and included in development
plans. The church's attorney is also waiting for the advertisement so he can assist with the
acquisition and continue with title work. Once the parcel is acquired and plans are finalized, I will
be submitting and processing a site plan application.
The bottom line here is that the delay in the advertisement of this parcel is holding up the planning
and legal work that needs to be done on our end so the church can continue their planning for
the desred expansion. They have gone to considerable lengths (not to mention costs) to acquire
all of the other surrounding private property and now cre waiting for this remaining parcel. So that
we can continue with our wcrk, we ask that you expedite the necessary advertisement and notify
me when the advertisement is going to be placed so we can act accordingly.

Sale of surplus land - ad/process requirements
I am trying desperately to get rid of a piece of property that the city commission has deemed "surplus". Lana was not able
to put closure to this issue, and the Purchasing Department, in her absence, has advised that I look to the City Attorney.
The piece alone is useless and is only of value to the adjacent First Baptist Church who would like to acquire. They have
already abandoned the adjacent ROW for ultimate use in a church expansion project. I have a legal ad prepared but it
does no indicate if they are to state a dollar value nor does it give it a deadline. Any help that Jim and staff can provide

The attached survey and legal description describe a triangular-shaped, City-owned parcel flanked on
two sides by NW 3rd Court and a short roadway link to NW 3rd Avenue. Said right-of-way is to be the
subject of an abandonment application planned by the First Baptist Church of Boynton Beach. This
amendment is part of the church and school campus expansion plan.
To create a squared-off, regular parcel, the Church logically desires to also include this triangular-shaped
parcel within their site plan. The agent for the school has contacted me to communicate their expansion
plan and desire to acquire the subject parcel. Given the simplicity and limited value of this parcel, which
is particularly limited to the First Baptist Church, I am hoping that the method by which the land can be
sold, including determination of value, is equally simplistic,
Please use this information to confirm that the subject parcel can be offered to the First Baptist Church
without a formal bid process, but instead by an act by the City Commission following proper notification
using a " Notice ofIntent To Sell Real Property" advertisement, similar to that process followed by
Community Redevelopment.

Accompanying this memorandum please find information on a small parcel of land that is located just
north of the First Baptist Church. The church desires to purchase this property consistent with their
Church/School campus expansion plan. You will recall that this is the City-owned property that I was
evaluating to determine the simplest sales route. A short time ago their attorney had thought that it was
no longer City-owned and subsequently conducted further research to confirm it. As indicated by his
correspondence date May 15, 2000, the property was acquired by the City through a reverter clause (he
provides no specific details on this event).
Nick, could you review this matter and advise as to how this property can be transferred to the church.
Please advise if the typical abandonment process would be sufficient and I will react accordingly.

You have asked whether abandonment would be the proper procedure to transfer the
above referenced property to the church. Please consider the following:
Part III, chapter 22 of the City's LDR sets out the procedure for vacation and
abandonment of city streets, alleys, special purpose easements and other nonfee
interests of the city. Because I am not sure whether the property at issue could be
construed as an alley or easement, I would advise that it be disposed as provided under
article IV, chapter two of the Code, which sets out the procedure for purchases or sales
of City property.
I attach a memo that I wrote earlier on this topic for guidance. In my opinion, the City
should at a minimum appraise the property to determine fair market value and
advertise the sale. I have communicated my opinion to the Church's Attorney, Jeff
Tomberg, who suggested that you advise him of your final decision on this matter.
Please let me know if I may gssist you further on this matter.

Procedure for sale of municipally owned property

You have asked us to research the procedure for the sale of municipally owned
property. Please consider the following:
The Attorney General has expressed through several opinions that the broad
home rule statute permits a governing body of a municipality to sell and convey
municipally owned property for the benefit of the city by any reasonable and
practicable procedure it may determine.
Chapter 2, article IV, section 2-56 of the City Code provides that all purchases or
sales of city property shall be subject to the approval of the city commission and
shall conform to such regulations as the commission may from time to time
prescribe. With regard to the sale of any real estate owned by the city,
regardless of its value, section 2-56 provides that no such sale shall be
conducted or consummated until such time as the subject property has been
appraised by a disinterested qualified appraiser to be designated by the
Commission for the purpose of establishing a fair market value thereon. After
the appraisal and placement of fair market value on the property, the sale of the
same shall be advertised in accordance with the provisions of section 2-56 and
competitive bids thereon received with the established fair market value being
the minimum acceptable to the city. Under section 2-56 all purchases or sales
involving amounts in excess of $2,000.00 shall be made only after the publishing
of an advertisement for bids in a Newspaper of general circulation in the city at
least one time, not less than eight days prior to the date set for reception of such
bids, together with such other notices that the commission may direct. The
commission shall have the power to reject any and all bids submitted and
received and to waive any informalities with such bidding.
Under the procedure established by our Code, the offer for purchase of the
subject property must first be presented to the Commission with a request for
the Commission to designate a disinterested appraiser for the purpose of
establishing a FMV. Next, the city shall publish advertisement for bids on the
property and make recommendation to the Commission on the bids submitted.

I have reviewed the documents relating to this property that the church
wants to acquire, and apparently the reversionary rights were conveyed,
as I have indicated to the church in the past, so that the City really has no
rights remaining. All we're asking you to do is a perfunctory abandonment
of any claims so that the reverter rights of record have been triggered, and
I can go ahead and issue a title insurance policy.
Any assistance that you can provide us in that respect would be
appreciated.

You have asked us to research the procedure for the sale of munidpally owned
property. Please consider the following:
The Attorney General has expressed through seve"al opinions that the broad
home rule statute permits a governing body of a municipality to sell and convey
municipally owned property for the benefit of the city by any reasonable and
practicable procedure it may determine.
Chapter 2, article IV, section 2-56 of the City Code provides that all purchases or
sales of city property shall be subject to the approval of the city commission and
shall conform to such regulations as the commission may from time to time
prescribe. With regard to the sale ny real estate owned by the city,
regardless of its value, section 2-56 rovides th +- "" slIcr 'ia1p. shall be
cond ed or consummated until 'm +- . pertv has been
raise by a disinterested alifled appraiser to be designated by the
\5510n or the purpose of establishing a fair market value thereon. After
the appraisal and placement of fair market value on the property, the sale of the
same shall be advertised in accordance with the provisions of section 2-56 and
competitive bids thereon received with the established fair market value being
the minimum acceptable to the city, Under section 2-56 all purchases or sales
involving amounts in excess of $2,000.00 shall be made only after the publishing
of an advertisement for bids in a Newspaper of general drculation in the city at
least one time, not less than eight days prior to the date set for reception of such
bids, together with such other notices that the commission may direct. The
commission shall ha'1e the power to reject any and all bids submitted and
received and to waive any informalities with such bidding.
Under the procedure established by our Code, the offer for the purchase the
subject property must first be presented to the Commission with a request for
the Commission to designate a disinterested appraiser for the purpose of
establishing a FMV. Next, the city shall publish advertisement for bids on the
property and make recommendation to the CommissIon on the bids submitted.

The city commission shall appoint an officer or employee of the city, other than a
member of the city conunission, as purchasing agent for the city who shall be responsible for the
purchase, storage. and distribution of all supplies, materials, equipmeni and other articles used by
an office, depamnent or agency of the municipal government. All purchases or sales of city
property shall be subject to the approval of the city com.rnission and shall conform to such
regulations as the city commission may from time to time prescribe. Except as provided in
section 2-56.1 all purchases or sales involving amou.'lts in excess of two thousand dollars
(52,000.00) shall be made only after the publishing of an advertisement of bids thereon in a

Mike: I am not sure if the code allows that. I think the key issue whether the strip of land has some value. If the land is
worth something, it would be a hard burden to determine why a public land is being leased for a $1.00 for 99 years. What
would be the public purpose then? The lease may well be an option that the administration may consider, but first,
someone has to ascertain the value of the property.

I asked Jim Cherof today about you inquiry on the parcel at First Baptist. Jim stands firm behind the current procedure.
Therefore, he recommends that you move forward with a declaration to declare the land as surplus and subsequently
place an ad advertising it's availability for sale. (He did mention however that the ad could appear anywhere in the paper-
even some obscure, unlikely location.)

Sale of City Land-First Baptist Church & NW 3rd Court right-of-way
The attached survey and legal description describe a triangular-shaped, City-owned parcel flanked on
two sides by NW 3rd Court and a short roadway link to NW 3rd Avenue. Said right-of-way is to be the
subject of an abandonment application planned by the First Baptist Church of Boynton Beach. This
amendment is part of the church and school campus expansion plan.
To create a squared-off, regular parcel, the Church logically desires to also include this triangular-shaped
parcel within their site plan. The agent for the school has contacted me to communicate their expansion
plan and desire to acquire the subject parcel. Given the simplicity and limited value of this parcel, which
is particularly limited to the First Baptist Church, I am hoping that the method by which the land can be
sold, including determination of value, is equally simplistic.
Please use this information to confirm that the subject parcel can be offered to the First Baptist Church
without a formal bid process, but instead by an act by the City Commission following proper notification
using a "Notice ofIntent To Sell Real Property" advertisement, similar to that process followed by
Community Redevelopment.

Dear Mr. Rumpf,
The Baptist Church Congregation appreciates the "Vote of Confidence" shown
recently by the Boynton Beach Planning and Zoning Board and by the Boynton
Beach City Commission. We sincerely believe that changing the zoning on the
Baptist Church property to HDR ( 14.18 Acres on S. W. 8 th street) was the
right decision. For the past three years, every effort was made to find an inves-
tor to develop the medical center, with no success.
We are confident that the City of Boynton Beach and it's residents at Leisure-
ville will be pleased with the multifamily complex planned for the site by the de-
veloper Wood Partners, who has a proven record in building Class A apartments
communities. Under the supervision of Boynton Beach Building and Planning
Department and with the cooperation of Wood Partners, the citizens of Boynton
Beach will be pleased with and proud of the results.
Also, another plus for our community, the funds from the sale of the property
will be used for the Baptist Church Campus located directly across from the City
Hall which will enhance the Community Redevelopment Agency objectives.
