Deer Mike:
On behalf of Frst Baptist ChlKCh, this application requests the abandonment of the remaining
portion of NW ~d Cout to allow for expansion of the ChlKCh's existing facilities located at the
northwest caner of Boynton Beach BouIevcrd and Seacrest Boulevcrd. The chlKch has acqured
all the property west of Seaaest Boulevcrd, east of NW 1- Sfreet, north of Boynton Beach Boufevcrd
and south of NW ~ Avenue. NW ~d CoLri bisects the property on a diagonal from the northwest
corner to the southeast comer of the property and interferes with the proposed expansion. The
eastern 2/3 of NW ~d CoLri was abandoned in 1994 (Resolution No. 94-53). With the acquisitions
made by the chl.fch, NW ~ Cout does not access any other property other than chlKch property
and therefore is no longer needed. This application requests the remaining ROW to be
abandoned.
The abandonment wouk:::t cIoN the chl.rch to expand ther existing facilities. Attached is a Master
Plan prepcred by Maddox & Associates depicting the proposed expansions that will include new
construction of buildings, pa1dng and landscape buffering. Sepaate application(s) will follow this

Those parcels adjacent to the subject right-of-way have been purchased and assembled for the
ultimate expansion of the church. A conceptual site plan for the project, showing the planned
establishment of all required easements and necessary relocations, was provided as part of this
abandonment application (See Exhibit "B"). The attached Exhibit "C" is a survey that shows the
location of the subject right-of-way and includes a legal description for that portion of the right-of-
way to be abandoned.
BACKGROUND
The subject request represents a further abandonment of this right-of-way, which first began in
1994, by Resolution No. 94-53, when a three-hundred-seventy-four (374) foot segment of NW 3rd
Court was abandoned and closed to Seacrest Boulevard. The subject request is for the
abandonment of the remaining portion of this right-of-way located southeast of its intersection with'
NW 1 st Street. It is logical to request this abandonment which will allow the church to square-off its
property and plan for the expansion of its facility. The Church owns all the surrounding properties
on both sides of NW 3rd Court, south of NW 3rd Avenue.
Florida Power and Light, and City of Boynton Beach Utilities Department require easement rights
adequate to preserve utilities within this area. This is effectively dealt with in the conditions of
approval, whereby the applicant must show that such easements are establi~hed prior to final
approval of this request.
ANALYSIS
Public notice has been given to the property owners that abut the right-of-way to be abandoned,
and has been advertised in the newspaper. A summary of the review by the utility companies and
city staff as follows:

Application for Abandonment of NW 3rd Court
Dear Mike:
On behalf of First Baptist Church, this application requests the abandonment of the remaining
portion of NW '3d Court to allow for expansion of the church I s existing facilities located at the
northwest caner of Boynton Beach Boulevcrd and Seacrest Boulevard. The church has acquired
all the property west of Seacrest Boulevad, east of NW 1 $I Street, north of Boynton Beach Boulevard
and south of NW '3d Avenue. NW:!d Court bisects the property on a diagonal from the northwest
corner to the southeast corner of the property and interferes with the proposed expansion. The
eastern 2/3 of NW '3d Court was abandoned in 1994 (Resolution No. 94-53). With the acquisitions
made by the chu"Ch, NW :!d Coui does not access any other property other than church property
and therefore is no longer needed. This application requests the remaining ROW to be
abandoned.
The abandonment would allow the church to expand their existing facilities. Attached is a Master
Plan prepcred by Maddox & Associates depicting the proposed expansions that will include new
construction of buildings, pcrking and landscape buffering. Separate application(s} will follow this
abandonment application to request the necessary approvals for the expansion.
