'-- t/'~ Michael W Rumpf Acting Director of Planning and Zoning TO: DATE: September 3, 1998 SUBJECT: Golfview Harbour 3rd Section Plat - Abandonment of Utility and Drainage Easements ABAN 98-008 NATURE OF REQUEST The City of Boynton Beach is processing an abandonment application for utility and drainage easements located at the southeast comer of south Congress Avenue and S.W. 23'" Avenue (see Exhibit "A" - Location Map). '!be easements are described as follows: . Utility and drainage easements lying in block 18, together with the utility easemem lying between lots 35 and 36, and drainage easement lying between lots 28 and 29, both of block 16, located in a ponion of the plat of "Golfview Harbour 2nd Section" , as recorded in Plat Book 27, Page 47, and recorded in the replat as Golfview Harbour 3rd Section, as recorded in Plat Book 30, Pages 119 and 120, of the Public Records of Palm Beach County, Florida. The subject property is the planned site for the A.R.C. adult living facility, and in advance of constrUCtion, it has been determined that original easements existing under the former plat, "Golfview Harbour 2nd Section" (see Exhibit "B"), still exist despite recording of the "Golfview Harbour 3rd Section" replat in 1971. To ensure that old easements are properly abandoned, the City Attorney has initiated this abandonment process (the subject property was the subject of litigation and a court order between the city and propeny owner, and therefore, the city must ensure the developability of the property). The purposes of this article are to establish unilonn procedures for the application to the city for the vacation and abandorunent of city streets, alleys, special purpose easements and other nonfee interests of the city; to designate those individuals who shall have the responsibility for the processing of such applications; and to provide the methods and procedures for processing said applications. All requests for vacation and/or abandonment of city streetS, alleys, special purpose easements and other nonfee interests which the city may have in real property shall be in writing and executed in triplicate by the party or parries requesting the same. The application shall be filed with the city clerk and shall include. but not be limited to, the following; A. The name and address of the applicant or applicant.. B. A complete and accurate leBaI description of the street, alley, special purpose easement or other nomee interest of the city or any portion thereof sought to be abandoned or vacated. Where possible, the legal description shall be accompanie<1 by a plat, map or drawing sbowina the aeneral area involved and the location oCthe specific property interest to be abandoned or vacated. C. Whetber title or interest of the city and the public in and to the property sought to be abandoned Of vacated wu acquired by deed, dedication or preacription, and if recorded in the public records, the book and page number thereof. D. The reason for the request of the abandonment or vacation. E. The names and addresses of the owners and occupants of abutting real property. F. Certification that the property was not acquired or dedicated for state or federal highway purposes and will not adversely affect other property owners or unreasonably limit access to their property. G. Verification from each affected or potentially atT"ted utility company that they have no interest in the vacation/abandonment, or, if they have present or future interest, proposed easement documents protectina their interests.
