PETITION TO THE ClTY OF BOYNTON BEACH, PLANNING AND ZONING DEPARTMENT
WE, THE UNDERSIGNED, are the abutting property owners, immediately to the South and
West of the proposed development by Grove Partners Umited.
This petition is in response to the request by the City of Boynton Beach, on behalf of Grove
Partners limited, of Orangeburg, New Yark, to amend the Comprehensive Plan and Zoning
Ordinances to allow a ultra-high density development of the property located at the NorthweSt
comer of Federal Highway and Old Dixie Highway.
Our neighborhood, estabJished nearly 50 years ago, with several historically signiflCaflt 1950's
Deco structures, is primarily a single family, single story, neighborhood. Ownership is in some
cases originaIJownerlbuilder and in other cases second and third owners. In the past three years
there has been an influx of neN owners \I\Iho see the value of maintaining what is basically a
quiet, sociologicaiiy batanced community and who have improved their properties.. We are
multi-cultural and mostly lower-middle and middle dass. We all are looking forward to increasing
property values as the gentrifICation of Defray Beach progresses Northward. This will not occur if
this ultra-high density development is allowed.
WE, strongly object. to the proposed changes for the fonowing ~easons:
1. The insertion of possibly 725 neN neighbors, ( 14.5 acres x 20 units per acre x 2-5 persons per
unit ), with a minimum of 320 vehicles, the attendant noise from the resultant traffIC, ( already 00
the increase and intense during rush hours ), 320 air conditioning units, 320 televisions and
_ radios, and the usual clamor of human- habitation. y,ftU totally destroy any possibmty of our
enjoyment of our rights to privacy and our peaceful pursuit of happiness on our property. This of
oourse foUowing a year and a half of constructioo noise, dust and traffIC.
_ 2. There is- 00- need for additional- multi-family units in this area, witness the Seagate
development and its several hundred units, Colonial Club Condominiums With its nearly 500
_ hundred units and Los Mangos with -its60 plus units. AU of which- have high 4eveJsof absentee
ownership and none of which could be descnDed as High-income housing. This is a middle-class
_ neighbortlood and already overdeveloped under any intemgent Comprehensive Plan's defIDition.
_ 3. Additionally, the site is- envifonmeAtaUy sensitive; harboring scrub laYs, evidence of gopher
tortoise and even a foxes den. It is also the resting site of numerous flOCks of endangered and
threatened species of migrating song mros. It is- also cfosety adjacent to the klterooastaI-
. Waf.ervaJ. The U.S. Oepartment of Fish and Wildlife has been alerted.
4.The Claims of the Developers and their supporters at the City of Boynton Beach, ( which would
obviously benefit in terms of the tax coffers) are overlooking the obvious in their haste. This
neighborhood has existed for almost half a century and our individual rights should not come
second to- any corporate rights. The market in this- area wiU not support this- daimed high-inoome
development. A specific figure of $1,800.00 a month for a 3 bedroom unit was mentioned by a
member of the City staff. A market survey y,ftU show this to- be unrealistic, especiaUy when- one
takes the freight trains into consideration.
Keep this property's zoning Commercial, at least a shopping center doses at night. and let the
devetopers be patient. Let we, the 00me0Y.cners in Too Trade Winds preseJVe our rights to- enjoy
our property.

Tropical Storm Mitch Discussion Number 50 as of 4:00 pm EST on November 04, 1998
The center is not well-defined and is elongated along a northeast to southwest Axis. The 18z
intermediate advisory position appears to have been pushed ahead a little too fast along the
track... however...and the current position is consistent with the latest ship observations. As noted
earlier...the system may already have lost some tropical characteristics with the strongest winds
and heaviest precipitation well-removed from the center. A little strengthening...mainly due to
baroclinic processes...could occur during the next day or two. Mitch is likely to become
extratropical by 48 hours or sooner.
With the shearing environment. ..some severe thunderstorms and isolated tornadoes may occur in
portions of the warning area during the next 12 hours or so. Areas of heavy rain will continue
spreading over the warning area through tonight. Tropical storm force winds will likely occur only in
a few of the rainbands well east of the center.
Current movement is northeast near 20 knots. Most numerical models show further acceleration
and the current official forecast...which is somewhat faster than the previous one...is a blend of all
available guidance. This is roughly in between the nogaps and avn model output at 48-72 hours.

Dear Mike:
As we discussed, attached please find 12 sets of the plans showing the building and
canopy signage for submittal to the City Commission for the meeting on March 2nd.
We are requesting that the canopy signage as shown on the plans be approved for
the front and sides of the canopy. In addition, we want to confirm that the original
building height of 20'4" and the subsequent matching canopy height of 20'4" is
acceptable based on the approved concept of a 20' overall project height.
We will bring a colored elevation of the revised canopy elevation to the Commission
meeting for presentation. You already have the colored building elevations with the
prior canopy elevations for comparison.
Should you have any questions or need anything further at this time, please feel free

pumps- Please find enclosed a page from the Palm Beach County Traffic Perfcnnance Standards

The Palm Beach County Traffic Division has reviewed the latest revised
traffic impact study, dated November 20, 1997, for the project entitled
Grove Plaza. pursuant to the Traffic Performance Standards in Article 15
of the Palm Beach County Land Development Code. The study was
received by this office on December 2, 1997. Please excuse the untimely
review of the traffic study.
The latest revised traffic study includes the following plan of development:
Retail 15,500 square feet
Bank 3,800 square foot
Fast food restaurants 7,200 square feet
Gas station 1
Convenience store 2,940 square feet
Trips 6,035 net daily trips
Build-out 1998

The earlier traffic studies showed the need to phase to two roadway
projects. Gateway Boulevard from Military Trail to Congress Avenue has
been widened to 6-lanes. This condition can be removed. Growth rates
have decreased on Lantana Road from Military Trail to Congress Avenue.
This condition can be removed.
When the traffic study was prepared, the trip generation for a gas station
was calculated on a per station basis. Since then, the trip generation for
a gas station has been changed to a per fueling position basis. The trip
generation calculation will be different at the time that impact fees are
collected.

I appreciate the time you took as well as the o~ staff members to meet with us today regarding the
above-reterenced projca. As indic:ated. by copy of this letter I am requesting that Donna West contact
you to make sure that everything is up to date in the file and that all issues have been addressed 30 we
may move ahead through the approval process.
The main i9/JU& we wantoo to review wa~ to be able to allow the project to move ahead. install the gas
tanks, but refrain ftum installing 8M pump3 until the contract for the widening of Lawrence R.oad ill let.
The infonnation we have is that the contract will be let in April of 1999. My client IIgreell to assume the
risk should that date be delayed. Yau indicated your concurrence with the condition.

Re: 7-11 Convenience Store and Gas Station at Southeast Comer of Lawrence Road and
Hypoluxo Road - Grove Plaza
Dear Ms. West:
As a follow-up to my previous letter (attached) to you regarding the above and to your questions
resulting from my letter, please be advised that I have received a response from our City
Attorney regarding this matter. Since it is common for road widening projects to be delayed for
fiscal reasons and since the earliest Palm Beach County will widen Lawrence Road is almost 1 Y2
years in the future, the City Attorney has concluded that the City cannot accept a conditional use
application for a convenience store/gas station for furthering processing until Palm Beach
County has let the contract for widening Lawrence Road. Only then will the referenced location
meet the zoning code requirements for locating such uses. In addition, this time frame exceeds
the maximum time an approval is valid before it expires. Such approvals expire if there is not a
building permit and in this case the City could not issue a permit sooner.

Lawrence Road is only a two lane road at this time. It is not proposed to be widened from its
current two lanes to four lanes until the fourth quarter of 1999. Therefore, the above gas station!
convenience cannot be approved until then. See attached Chapter 2, Section 11.1.L.3 .a.(2) of our
Land Development Regulations, which requires this use to be located on a four lane road
intersection.
