The following is a list of comments regarding the rectification of the above-referenced
master plan.
COMMENTS REGARDING RECTIFIED MASTER PLAN REVIEW.
1. The traffic analysis should be expanded to include left hand turning
lane for Hypoluxo Road into entrance into development median
break. Due to phasing of project,.....lll.,lv VI :SIU:~ plan review or eacn I

turning lane, interior traffic, signage, and one way traffic proposed
that connects the back of the parcel.
2. A master storm water management plan (section 3,T) must be
submitted showing impact of phasing as proposed (this plan is
required regardless of whether phasing is proposed).
3. Computations for required number of handicapped parking spaces
shall be shown.

landscape plan which was discussed at that meetine. The revised landscape plan has not yet been
completed. W:"len we appear before the City Conunission we want to be able to discuss and resolve all
of the issues and cancans. Based on the foregoing, plcax consider this my request for postponement
at' both the master plan modification and the 7~ 11 requests to the next regularly scheduled meeting of
the City Commission. At your convenience will you please confum that date. I will attend the meeting

Dear Mr. Rumph:
The Palm Beach County Traffic Division has reviewed the latest revised
traffic impact study, dated November 20, 1997, for the project entitled
Grove Plaza. pursuant to the Traffic Performance Standards in Article 15
of the Palm Beach County Land Development Code. The study was
received by this office on December 2, 1997. Please excuse the untimely
review of the traffic study.
The latest revised traffic study includes the following plan of development:
Retail 15,500 square feet
Bank 3,800 square foot
Fast food restaurants 7,200 square feet
Gas station - 1
Convenience store 2,940 square feet
Trips 6,035 net daily trips
Build-out 1998

The earlier traffic studies showed the need to phase to two roadway
projects. Gateway Boulevard from Military Trail to Congress Avenue has
been widened to 6-lanes. This condition can be removed. Growth rates
have decreased on Lantana Road from Military Trail to Congress Avenue.
This condition can be removed.
When the traffic study was prepared, the trip generation for a gas station
was calculated on a per station basis. Since then, the trip generation for
a gas station has been changed to a per fueling position basis. The trip
generation calculation will be different at the time that impact fees are
collected.

Performance Standards of Palm Beach County. This approval does not
constitute approval to connect driveways to any County roadway. If you

Dear Ms. West:
As a follow-up to my previous letter (attached) to you regarding the above and to your questions
resulting from my letter, please be advised that I have received a response from our City
Attorney regarding this matter. Since it is common for road widening projects to be delayed for
fiscal reasons and since the earliest Palm Beach County will widen Lawrence Road is almost 1 ~
years in the future, the City Attorney has concluded that the City cannot accept a conditional use
application for a convenience store/gas station for furthering processing until Palm Beach
County has let the contract for widening Lawrence Road. Only then will the referenced location
meet the zoning code requirements for locating such uses. In addition, this time frame exceeds
the maximum time an approval is valid before it expires. Such approvals expire if there is not a
building permit and in this case the City could not issue a permit sooner.

Beginning 'with the week of June 8, 1998, I called to set up a meeting with you and perhaps Jim Cherof,
if appropriate, to discuss Tambri Heyden's letter of April 15th, a copy of which is anached,
I received a telephone call from Dan DeCarlo on June 17th. He indic,ated he was leaving town but that
Dons in your offic:e would set up such a. meeting. When I didn't hear fi-om Doris, I called her on June
22nd to schedule the meeting, I called her back today. She indicated that such a meeting was not
appropriate and that I would have to schedule a pre.application meeting, and that Linda was in charge
of that, I now ha.ve a pre-application meeting scheduled for July 6, 1998 at 10:30 a.m,
The purpose oftbis Jetter is to confirm thea.t the appropriate way to discuss Tam.bri's April 15th letter is
at the pre.appli.cation meeting scheduled for July 6th. I do not want to arrive at the meeting to learn that
is not the appropriate avenue, The application for this matter has been in the process for some time and
there have been previous pre-application meetings; most recently, March 31, 1998.
Unless I hear from you to the contrary, I will be at the July 6th pre-application meeting to discuss this

As requested, we have reviewed the proposed southwest entrance to the Grove
Plaza and the 7-Eleven at Hypoluxo Road and Lawrence Road to insure that the
design meets all of the code requirements. We are proposing that the addition of a
traffic separator in the center f:I the south drive, which wHI prohibit access directly into
or out of the 7-Eleven site onto the east-bound lane of the south drive, will bring this
site plan into oonfolTTlance with the city code.
I am attaching for your review the site plan showing the revised entrance area and a
blowup of the revised entrance area. I would appreciate it if you would review this
change to confirm that it win provide code compliance. Also, if you would elther
forward it to all other city departments that will need to review it for approval, or let me
know which departments need to review it and I will forward It to them myself. If you
agree that this layout meets the city codes, I wiD request approval from the client to
change the final site plan accordingly.
We feel that this proposed layout meets the code requirements, more specifically:
1. The south drive and the east drive are located more than 110' (gasoline
sales code) and more than 180' (parking lot code) from the intersection of
the right-ot-way lines of Hypoluxo Road and Lawrence Road.
2. We have redesigned the en1rance so that there is no access between the
eastbound lane of the south access drive and the west drive serving the 7-
Eleven parcel. Since there is no longer any direct traffic onto the
eastbound lane, the parking lot code requirement that the minimum
distance from the street right-at-way line at any major driveway to any

interior access aisle having direct access to such driveway shall be 100
feet should no longer be applicable.
3. The gasoline sales code requires that driveways shall not be located less
than 30 feet from any interior property line. Since this gas station Is part of
a previously approved master plan 'Nhich controls the co-Iocatlon of
driveways and specifically locates them on the Interior property lines in
order to eliminate excess driveways onto Lawrence Road and Hypoluxo
Road, we believe that the master plan should take precedence and
override this code requirement. It would appear that the code requirement
was designed for stand-alone sites.

- The traffic study uses 94/95 traffic volumes and growth rates.
They are no longer appropriate. The 96/97 data should be used.
- The level of service standard volumes have changed since
1995, The study uses the latest standard volumes for daily traffic
and the old standard volumes for peak hour volumes. The latest
standard volumes should be used throughout.
The Traffic Division has determined that the project does meet the
Traffic Performance Standards of Palm Beach County, based on
methodology errors in the traffic study. If you have any questions,

recently for the above-referenced application. Please review the enclosed information for
conformance with the County's Traffic Performance Standard Ordinance. This study has been
submitted in connection with a subdivision master plan modification (see attached copy of the
revised master plan). This request includes a change in the southerly access drive from one-way
to two-way and includes turn lanes on Hypoluxo and Lawrence Roads. Also, please let me know
