This is in response to Department of Development Memorandum No. ENG 98-032, dated March
3, 1998. This office has no objection to the articles or by-laws, as submitted with your
memorandum, as they do not appear to have any existing or potential adverse affect on the City,
city staff, or the city budget.
With respect to the Declaration of Covenants and Restrictions, I have the following comments
that must be rectified prior to this office giving its approval:
1. The document should be proofread to remove typographical errors that may affect
interpretation ofthe document.
2. Article VITI, Section 3 should be revised to add to the end of the paragraph, "Under no
circumstances shall land be withdrawn from this Declaration or any amendment thereto that
would result in any maintenance responsibility for the City of Boynton Beach, a Florida
municipal corporation."
3. Article IX, Section 6 should be amended to add to the end of the paragraph, "Under no
circumstances shall the City of Boynton Beach be responsible for any maintenance or repair
responsibilities in the Common Areas should the Association be dissolved."
4. With respect to the drainage system referenced in Article XI, Section 1, who is
responsible for the installation, maintenance and cost or expense? This section says that the
Declarant and Association have no responsibility for these. Is this correct?
5. The following should be added to the end of Section 1 of Article XII: "Under no
circumstances shall the City of Boynton Beach be responsible for any maintenance or repair
responsibilities in the Common Area should the term of these covenants and restrictions expire."
6. The following should be added to the end of Section 2 of Article XII: "Under no
circumstances shall the City of Boynton Beach be responsible for any maintenance or repair
responsibilities in the Common Area as a result of an amendment to this declaration of covenants
and restrictions."

the land development permit. Documents shall cover, at a minimum the maintenance of
the ingress/egress easements and landscape easements and any other improvements
within easements dedicated to the P.O.A. (e.g. lighting).
