Landscape Code Appeal (interior landscape strips)
NATURE OF REQUEST
charles DeSanti and Julian Bryan, agents for Dr. WaIte Lanke and
Ms. Auce Fay are requesting approval to appeal Chapter 7.5,
Article II - Landscape Code, Section 5.E. of the Land Development
Regulations (see Exhibit "A" - letter of request). The appeal, to
omit all interior landscape strips along the interior lot lines
of five abutting parcels, is in connection with a concurrent
master plan approval for subdivision of a commercial property
(see Exhibit "B" - location map) .
BACKGROUND
The master plan being processed concurrently with this request
depicts a parcel which will consist of 18,000 square feet of
general retail, 3,600 square feet of bank with a drive-through
and 7,200 square feet of fast food restaurant with drive-through
(see Exhibit "C" - Naster Site plan). The appeal to the Landscape
Code is to maintain a portion of the required perimeter landscape
barrier between the parcels, but to also allow the cross access
corridors for vehicular traffic travelling internally from parcel
to parcel within the development. The landscape code does not
allow the proposed breaks ln the perimeter landscaping, hence the
appeal. Individual site plan approval will be required as each
parcel is indivldually developed. Since approval of this appeal
affects how the property can be subdivided, processing of the
appeal is necessary concurrently with subdivision master plan
approval.
ANALYSIS
The requested appeal pertains to the perimeter landscape strips
that would normally run between individual adjacent properties.
Chapter 7.5, Article II Section 5.E. states the following:
Perimeter landscaping relating to abutting propertles.
On the slde of the building or structure or open lot use
providlng an off-street parking area or other vehicular use
area, such area shall be provided with a landscaped barrier,
perferably a hedge not less than four (4) feet nor greater
than SlX (6) feet in helght to form a continuous screen
between the off-street parking area or other vehicular use
area and such abutting property. Such landscape barrier
shall be located between the common lot line and the off-
street parking area or other vehicular use area in a
planting strip of not less than two and a half (2 1/2) feet
in width. The provisions of this subsection shall not be
appllcable in the followlng situations:
1. When a property line abuts a dedlcated alley.
2. Where a proposed parking area or other vehicular use
area abuts an existing hedge, said existlng hedge
may be used to satisfy the landscape requirements of
thlS subsection provlded that such existing hedge
meets all appllcable standards of thlS article.

The applicant 1S requesting that the landscape barrier be amended
to allow the proposed cross access corridors between the interior
parcels. The remaining areas defining the perimeter of the
parcels will meet or exceed landscape code requirements.
RECOMMENDATION
The impact of the proposed cross access corridors is limited to
those areas where adjoining parcels allow 1ngress and egress
between them. The problem occurs with property lines between the
parcels running down the middle of the accessways instead of down
one side or the other. This problem could be remedied by
shifting the location of the interior property lines and thereby
negating the need for an appeal. Therefore, the Planning and
Zoning Department recommends denial of this request.

Dear Mr. Haag,
Please accept this request for approval of the attached Master Landscape Plan. which locates the required
perimeter landscape barrier adjacent to the access corridor at the entranCes to the development, in ten (10)
foot landscape strips, which is four (4) times the size of the minimum required landscape strips. The code
literally requires that the "landscape barrier be placed between the common lot line and the off-street
parking area or other vehicular use area in a planting strip of not less than two and one-half (2 1/2) feet in
width" .
The development is of unified design and will be controlled by an association of all property o~ners,
required by the platting process. Therefore, proper maintenance is assured The development will
provide for meeting the intent of the Ja(lds=pe code by providing landscape barriers from parking and
access ways and will provide at a minimum of between 50% and 100% more landscaping than required by
the code as a minimum.
By approving our request , the Board uill be setting higher standard than is othenvise provided by the
Code minimums. We therefore respectfully request approval of our request to adjust the location of the
required landscape barrier.

After reviewing the supposedly rectified master plan for this project, we noted
that two of our original comments have not been addressed. We therefore repeat
our request for the following items to be included on the r~ctified plan:
1. Chapter 3, Article IV, section 3(0) of the Land Development Regulations
requires Master Plans to show all utilities on or adjacent to the tract. The plan
must therefore show the point of service for water and sewer, and the
proposed off-site utilities construction needed in order to service this site.
2. Chapter 3, Article IV, section 3(P) of the Land Development Regulations
requires a statement be included that utilities are available and will be
provided by appropriate agencies. This statement is lacking on the submitted
plans.

Boynton Beach as the permittee.

Grove Plaza is an 8.228 acre retail commercial project located in the southeast quadrant
of the intersection of Hypoluxo and Lawrence Roads.
A Drainage System consisting of exfiltration trench, catch basins and storm sewer pipes
will collect storm runoff and convey it to the Lake Worth Drainage District (LWDD)
canal L-18 located on the north line of the Grove Plaza Site. The LWDD canal L-18 is
culverted by means of a 72" Rep in this area.
Water quality will be accomplished on site by means of dry retention in grass areas and
exfiltration trench. Furthermore to enhance water quality inlets will be located in
"Grassed" areas.
Benning and perimeter road elevations will be utilized to contain the twenty five year
three day event on site. #
Finally finish floor elevations will-be set above the one hundred year three day zero
discharge event.

Please be advised of the following comments relative to the review
of the master plan for the above-referenced project, pursuant to
Chapter 2 and Chapter 3, Article IV, Section 3 of the Land
Development Regulations:
1. Master plan approval is based on premise that site plan
approval must be obtained for each of the six parcels as
they are developed.
2. A buffer wall along the south property must be shown on
plan to screen the residential area to the south.
3. The traffic analysis should be expanded to include left
hand turning lane for Hypoluxo Road into entrance into
development median break. Due to phasing of project, at
time of site plan review of each parcel, additional
reviews must be made to determine impact of turning lane,
interior traffic, signage, and one way traffic proposed
that connects the back of the parcel.
4. The necessary landscape appeals must be submitted
immediately to rum concurrently with Master plan approval
by Planning and Development Board and city Commission.
The outcome of these appeals impact interior property
lines.
5. A master storm water management plan (sec. 3,T) must be
submitted showing impact of phasing as proposed. (This
plan is required regardless of whether phasing is
proposed. )
6. Show loading zones for each parcel to ensure at time of
site plan approval that all parcels proposed are large
enough to accommodate loading zones as required.
7. Computations for required number of handicapped parking
spaces shall be shown along with location of the
handicapped parking spaces being delineated on the master
plan. (see # 1 )
8. Show on the master plan the buildable area within each of
the six (6) parcels including the setback dimensions.

9. A reference to phasing the project shall be noted on the
plan.

BUILDING DIVISION

4. Building elevations and floor plans, with all exterior colors, will be shown on plans
accompanying detailed site plans submitted with each phase.
5. Inasmuch as the phase lines may change slightly based upon the final order of site
plan submittals, the final parking layouts may also vary. In any case, each phase or
use will meet minimum parking requirements when submitted.
CITY UTILITIES
1. Palm Beach County Health Department permits will be obtained for the site
concurrent with building permit applications.
2. Landscape irrigation will not utilize City water.
FORESTER/ENVIRONMENT ALlST
A detailed site survey accompanied this submittal. No additional trees remain on the
site. Each phase or use will provide detailed landscape and irrigation plans for its
portion of the site and the adjacent Hypoluxo Road median.
PUBLIC WORKS DEPARTMENT
The master plan has been revised to redirect the dumpsters located along the rear
drive. The rear drive has also been made one way, west bound only. Should additional
location refinements for dumpster pads be necessary, they will occur with detailed final
site plans submitted for each use.

POLICE DEPARTMENT (TRAFFIC UNIT)
A detailed discussion of this departments concerns occured at the TRC Meeting. The
applicant has revised the rear access drive to be one qay, west bound only. In addition
dumpster locations were revised to facilitate traffic flow. Final site plans submitted with
each use may show additional internal traffic control pavement details should they
prove necessary.
CITY ENGINEER
1. In the normal course of pre development permitting the parcel will be platted. It is not
certain at this time of it will be a boundary plat or subdivided into two or as many as
six lots.
2. A written explanation of the storm drainage system has been provided with this
resubmittal.
3. The south landscape buffer has been corrected to accurately reflect its 20' width.
4. The south service road has been revised to one way west bound only. This was the
consensus of other staff members at the TRC Meeting. The applicant does not share
the staff opinion that internal vehicular circulation will be improved with one way
traffic, however we will continue to work with the Committee inan attempt to reach a
reasonable and functionally safe solution.
5. A letter from the Surveyor of record is attached with this resubmittal. That document
verifies the fact that no poles, overhead lines or utility easements exist north of the
south property line of this tract.
6. Phase lines have been added to the revised master site plan. It should be noted,
however that these lines may vary depending upon the order in which uses are
submitted.

The sketch you left for us to look at appears to subdivide a
property at the corner of Hypoluxo Road and Lawrence Road into
three lots. LDR Chapter 5, Article II, Section 1, page 5-1
entitled "Waiver" specifies when platting can be waived. This
sketch does not fit the waiver conditions because it is subdivided

Please place the above-referenced request on the September 19, 1995
City Commission agenda under Development Plans.
DESCRIPTION: Charles W. Desanti and Julian Bryan, agents for Dr.
Wal ter Lanke and Ms. Auce Fay, proper1:y owner, are requesting
master plan approval to initiate subdivision of a commercial site
into six (staff report incorrectly indicates five) separate
parcels. The 8.23 acre site is located at the southeast corner of
Hypoluxo Road and Lawrence Road.
RECOMMENDATION: The Planning and Development Board, with a 4-3
vote, recommended approval of this request subject to statt
comments (Utilities Department Memorandum No. 94-243, Engineering
Division Memorandum No. 95-323, BUilding Division Memorandum No.
95-233, Parks and Recreation Memorandum No. 95-394, Planning and
Zoning Department Memorandum No. 95-482 and the September 12, 1995
comments from Palm Beach County Traffic Division regarding
dedication of rights-of-way for the expanded intersection at
Lawrence Road and Hypoluxo Road and phasing of construction to the
widening of Gateway Boulevard from Military Trail to Congress
Avenue and to the widening of Lantana Road from Militay Trail to
congress Avenue). The September 12th letter from Palm Beach County
supersedes their August 4th letter and indicates that traffic
concurrency can now be certified sUbject to compliance with their
right-of-way dedication and phasing comments.

The Palm Baach County Traffic Division has reviewed the revised traff1c 1mpact
study for the proje~t entitled G~ove Plaza, pursuant to the Traffic Performance
Standards in Article 1.9 of t~e Palm Beach County Land Development Code. The
proposQd project will consist of 18,000 square feet of general retail. 3,600
square feet of bank with dt"ive-through and 7,200 square feet of fast food
restaurant with drive through. The build-out has been rcv1sed from m1d year 1996
to the end of 1996. The pt"cposed proje~t will generate 4,788 da1ly trips. given
a 5% inte~nal;zation ~ate.
The traffic study corrects the def1t1ency Of the earl1er traffic stUdy. It
addressed the t~affic on Gateway Boulevard. The project 1s required to phase to
the widening of Gateway Boulevard from M1l1tary Trail to Congress Avenue. The
project can bllild development generat1ng up to 1,083 external daily trips before
the contrlct is let for th1s roadway improvement. This roadway improvement is
schedll-l ed for FY 96/97. .
The projet:t is aho requ1red to phase to the widen1ng of lantana Road from
Military Trail to Congress Avenue. The project can build development generating
up tu 3,492 external daily tr1ps before the contract is. let for this roadway
improvement. Th1s roadway 1mprovement is a requirement of the Winston Trails
PUD. They are requ1re to pay for the lmprovement by the end of 1995. I do not
have the proposed contract letting date at this time.
The Traff1c D1v1s1on has determined that, based on the phasing of the project to
the w1den1ng of Gateway Boulevard from Military Trail to Congress Avenue and the
widen1ng of Lantana Road from Military Trail to Congress Avenue, the project
meets the requ1rements of the Traff1c Performance Standards of Palm Beach County.

Palm Beach County has programmed the widening of Lawrence Road for FY 97/987.
This will be a S-lane roadway within a rjght-Df-w~ of 80 feet. Hypoluxo Road
is shown to have an ultimate right-of-way of 110 feet. This will accommodate a
6-1ane roadway, although the widening ;s not scheduled at this time. Palm Beach
County request that the City of Boynton Beach require the development to dedlcate
or reserve the right-or-way necessary for the ultimate cross $ection for Lawrence
Road and Hypo 1 uxo Road, and an expanded i ntersett i on at Lawrence Road and
Hypoluxo Road.

a. Traffic - The Palm Beach County Traffic Division has
reviewed the traffic impact study for the
proj ect pursuant to the Traff ic Performance
Standards in Article 7.9 of the Palm Beach
county Land Development Code. The proposed
project will consist of 18,000 sq ft of general
retail, 3,600 square feet of bank with drive
through and 7,200 square feet of fast food
restaurant with a drive through. The build out
is 1996. The proposed project will generate
4,788 daily trips, given a 5% internalization
rate.
The Traffic Division has determined that the
project does not meet requirements of the
Traffic Performance Standards of Palm Beach
county. However, phasing or up to 23\ of the
project can be build up to 1,108 trips. Because
of the project's proximity to Gateway Boulevard
and the eXisting traffic volumes on Gateway
Boulevard, from Lawrence Road to Congress, the
project would be required to be phased in
conjunction with the widening of Gateway
Boulevard that is now scheduled for FY 96/97.
(see Exhibit "e")
b. Drainage - A drainage system consisting of an
exfiltration trench, catch basins and storm
sewer pipes will collect storm runoff and
convey it to the Lake Worth Drainage District
(LWDD) canal L-18 located on the north line of
the Grove Plaza site. The LWDD canal L-18 is
culverted by means of a 72 inch Rep in this
area. (see Exhibit "0")
Driveways:
Fou~ entrances into the proposed commercial
development are proposed. One entrance on
Lawrence Road that will allow northbound
traffic onto the site. Traffic will be one way
at this point. No traffic will be allowed to
re-enter Lawrence Road from the development.
Three entrances into the site will be on
Hypoluxo Road. The question of a pos2ible
traffic signal for one of these entrances onto
Hypoluxo Road will need to be addressed at
time of site plan review (see comment #1
Planning and Zoning Department Memorandum No.
95-482) .
Parking Facility:
The proposed parking facilit~; =:.:: ~'-_~_ _.:. _.._
five parcels shall contain the spaces required
for the uses located on the parcel. Each
individual parcel will undergo further review
at the time of actual site plan approval.
Landscaping:
An appeal to the city's landscape code is to be
filed to run concurrently with this master plan
application. The appeal is to the required
perimeter landscape strip adjacent to the
access corridors between the individual parcels
within the development.

Congress Avenue, exceed the LOS D traffic volumes for both daily and peak hour,
peak direction traffic. The project would be required to phase to the widening
of Gateway Boulevard. The roadway improvement is scheduled for FY 96/97.
The Traffic Division has determined that the project does not meet requirements
of the Traffic Performance Standards of Palm Beach County. Phasing to the
widening of Gateway Boulevard is required to meet the Traffic Performance

Grove Plaza is an 8.228 acre retail commercial project located in the southeast quadrant
of the intersection of Hypoluxo and Lawrence Roads.
A Drainage System consisting of exfiltration trench. catch basins and storm sewer pipes
will collect storm runoff and convey it to the Lake Worth Drainage District (LWDD)
canal L-18 located on the north line of the Grove Plaza Site. The L WOO canal L-18 is
culverted by means of a 72" RCP in this area.
Water quality will be accomplished on site by means of dry retention in grass areas and
exfiltration trench. Furthermore to enhance water quality inlets will be located in
"Grassed" areas.
Benning and perimeter road elevations will be utilized to contain the twenty five year
three day event on site.
Finally finish floor elevations will be set above the one hundred year three day zero
discharge event.

Master Plan Second Review
Staffhas reviewed the above referenced project and offer the following comments:
I. Gravity sanitary sewer system does not show connection to an existing system.
Please show on your plans that in fact you can reach an existing gravity
sanitary sewer system, (Sec. 26.16 (a)).
2. Once approved for use the developer shall provide unobstructed stabilized
access to the water and sanitary sewer mains and appurtenances at all
times. (Sec. 26.33(a)).
It is our recommendation that the plan proceed through the review process.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Division for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS
1. The traffic analysis should be expanded to include left
hand turning lane for Hypoluxo Road into entrance into
development mediap break. Due to phasing of project, at
time of site' plan review of each parcel, additional
reviews must be made to determine impact of turning lane,
interior traffic, signage, and one way traffic proposed
that connects the back of the parcel.
2. Approval of a landscape appeal is required to develop the
property as shown on the Master Plan. The plans should be
modified to show the results of the final determination
of the landscape appeal and reference on the plans the
landscape appeal file number 95-004.
3. A master storm water management plan (section 3,T) must
be submitted showing impact of phasing as proposed.
(This plan is required regardless of whether phasing is
proposed. )
4. Computations for required number of handicapped parking
spaces shall be shown along with location of the
handicapped parking spaces being delineated on the master
plan.
5. Show on the master plan the bUildable area within each of
the six (6) parcels including the setback dimensions.
6. Requirements relating to the city's Community Design Plan
must be addressed for all six parcels at the time of
submission for site plan approval for the first parcel to
be developed.

11. A master property owners' assoc iation agreement/documents
for maintenance of common infrastructure will be
necessary for review by staff, prior to recording and
prior to platting.
12. The applicant shall pay the additional fee required for
the extra (third) review requested, prior to the city
Commission meeting of September 19, 1995.
13. Pla~e phasing lines on the master plan that reflect the
phasing ot the construction of the development required
by Palm Beach County.
14. Submit three copies of a rectified master plan to the
Planning and Zoning Department prior to submitting for
platting.

The project will require future site plan or

commercial, restaurant and retail uses. The
six buildings will be located on five parcels

Concurrency:
a. Traffic - The Palm Beach County Traffic Division has
reviewed the traffic impact study for the
project pursuant to the Traffic Performance
standards in Article 7.9 of the Palm Beach
County Land Development Code. The proposed
project will consist of 18,000 sq ft of general
retail, 3,600 square feet of bank with drive
through and 7,200 square feet of fast food
restaurant with a drive through. The build out
is 1996. The proposed project will generate
4,788 daily trips, given a 5% internalization
rate.
The Traffic Division has determined that the
project does not meet requirements of the
Traffic Performance Standards of Palm Beach
County. However, phasing or up to 23% of the
project can be build up to 1,108 trips. Because
of the project's proximity to Gateway Boulevard
and the existing traffic volumes on Gateway
Boulevard, from Lawrence Road to Congress, the
proj ect would be required to be phased in
conjunction with the widening of Gateway
Boulevard that is now scheduled for FY 96/97.
( see Exhibit "C")
b. Drainage - A drainage system consisting of an
exfiltration trench, catch basins and storm
sewer pipes will collect storm runoff and
convey it to the Lake Worth Drainage District
(LWDD) canal L-18 located on the north line of
the Grove Plaza site. The LWDD canal L-18 is
culverted by means of a 72 inch RCP in this
area. (see Exhibit liD ")
Driveways:
Four entrances into the proposed commercial
development are proposed. One entrance on
Lawrence Road that will allow northbound
traffic onto the site. Traffic will be one way
at this point. No traffic will be allowed to
re-enter Lawrence Road from the development.
Three entrances into the site will be on
Hypoluxo Road. The question of a possible
traffic signal for one of these entrances onto
Hypoluxo Road will need to be addressed at
time of site plan review (see comment #1
Planning and Zoning Department Memorandum No.
95-482) .
parking Facility:
The proposed parking facility for each of the
five parcels shall contain the spaces required
for the uses located on the parcel. Each
individual parcel will undergo further review
at the time of actual site plan approval.
Landscaping:
An appeal to the city's landscape code is to be
filed to run concurrently wi th this master plan
application. The appeal is to the required
perimeter landscape strip adjacent to the
access corridors between the individual parcels
within the development.

Dear Ms. Hayden:
The Palm Beach County Traffic Division has reviewed the traffic impact study for
the project entitled Grove Plaza, pursuant to the Traffic Performance Standards
in Article 7.9 of the Palm Beach County Land Development Code. The proposed
project will consist of 18,000 square feet of general retail, 3,600 square feet
of b~nk with drive-through and 7,200 square feet of fast food restaurant with
drive through. The build-out is 1996. The proposed project will generate 4,788
daily trips, given a 5% internalization rate.
The traffic study identifies Gateway Boulevard as being within its 2 mile study,
area, but fails to address the traffic volumes on this roadway. As you are
aware, the existing traffic volumes on Gateway Boulevard, frQm Lawrence Road to
Congress Avenue, exceed the LOS D traffic volumes for both daily and peak hour,
peak direction traffic. The project would be required to phase to the widening
of Gateway Boulevard. The roadway improvement is scheduled for FY 96/97.
The Traffic Division has determined that the project does not meet requirements
of the Traffi c Performance Standards of Palm Beach County. Phasing to the
widening of Gateway Boulevard is required to meet the Traffic Performance

Grove Plaza is an 8.228 acre retail commercial project located in the southeast quadrant
of the intersection of Hypoluxo and Lawrence Roads.
A Drainage System consisting of exfiltration trench, catch basins and storm sewer pipes
will collect storm runoff and convey it to the Lake Worth Drainage District (LWDD)
canal L-18locBted on the north line of the Grove Plua Site. The LWDD canal L-18 Is
culverted by means of a 72" RCP in this area.
Water quality will be accomplished on site by means of dry retention in grass areas and
exfiltration trench. Furthermore to enhance water quality inlets will be located in
"Grassed" areas.
Berming and perimeter road elevations will be utilized to contain the twenty five year
three day event on site.
Finally finish floor elevations will be set above the one hundred year three day zero
discharge event.

access to the water and sanitary sewer mains and appurtenances at all
times, (Sec. 26.J3(a)).

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Division for permits for the proposed project.

Please place the above-referenced request on the September 19, 1995
City Commission agenda under Development Plans.
DESCRIPTION: charles W. Desanti and Julian Bryan, agents for Dr.
Wal ter Lanke and Ms. Auce Fay, proper'ty owner, are requesting
master plan approval to initiate subdivision of a commercial site
into six (staff report incorrectly indicates five) separate
parcels. The 8.23 acre site is located at the southeast corner of
Hypoluxo Road and Lawrence Road.
RECOMMENDATION: The Planning and Development Board, with a 4-3
vote, recommended approval of this request subject to staff
comments (utilities Department Memorandum No. 94-243, Engineering
Division Memorandum No. 95-323, Building Division Memorandum No.
95-233, Parks and Recreation Memorandum No. 95-394, Planning and
Zoning Department Memorandum No. 95-482 and the September 12, 1995
comments from Palm Beach County Traffic Division regarding
dedication of rights-of-way for the expanded intersection at
Lawrence Road and Hypoluxo Road and phasing of construction to the
widening of Gateway Boulevard from Military Trail to congress
Avenue and to the widening of Lantana Road from Militay Trail to
congress Avenue). The September 12th letter from Palm Beach county
supersedes their August 4th letter and indicates that traffic
concurrency can now be certified subject to compliance with their
right-of-way dedication and phasing comments.

Concurrency:
a. Traffic - The Palm Beach County Traffic Division has
reviewed the traffic impact study for the
proj ect pursuant to the Traff ic Performance
standards in Article 7.9 of the Palm Beach
county Land Development Code. The proposed
project will consist of 18,000 sq ft of general
retail, 3,600 square feet of bank with drive
through and 7,200 square feet of fast food
restaurant with a drive through. The build out
is 1996. The proposed project will generate
4,788 daily trips, given a 5% internalization
rate. .
The Traffic Division has determined that the
project does not meet requirements of the
Traffic Performance standards of Palm Beach
County. However, phasing or up to 23b of the
proj ect can be build up to 1,108 trips. Because
of the project I s proximity to Gateway Boulevard
and the existing traffic volumes on Gateway
Boulevard, from Lawrence Road to Congress, the
proj ect would be required to be phased in
conjunction with the widening of Gateway
Boulevard that is now scheduled for FY 96/97.
(see Exhibit "C")
b. Drainage - A drainage system consisting of an
exfil tration trench, catch basins and storm
sewer pipes will collect storm runoff and
convey it to the Lake Worth Drainage District
(LWDD) canal L-18 located on the north line of
the Grove Plaza site. The LWDD canal L-18 is
culverted by means of a 72 inch RCP in this
area. (see Exhibit "Oil)
Driveways:
Fou~ entrances into the proposed commercial
development are proposed. One entrance on
Lawrence Road that will allow northbound
traffic onto the site. Traffic will be one way
at this point. No traffic will be allowed to
re-enter Lawrence Road from the development.
Three entrances into the site will be on
Hypoluxo Road. The question of a posElible
traffic Signal for one of these entrances onto
Hypoluxo Road will need to be addressed at
time of site plan review (see comment #1
planning and Zoning Department Memorandum No.
95-482) .

application. The appeal is to the reqUired
perimeter landscape strip adjacent to the
access corridors between the individual parcels
within the development.

Dear Ms. Hayden:
The Palm Beach County Traffic Division has reviewed the traffic impact study for
the project entitled Grove Plaza, pursuant to the Traffic Performance Standards
in Article 7.9 of the Palm Beach County Land Development Code. The proposed
project will consist of 18,000 square feet of general retail, 3,600 square feet
of bank with drive-through and 7,200 square feet of fast food restaurant with
drive through. The build-out is 1996. The proposed project will generate 4,788
daily trips, given a 5% internalization rate.
The traffic study identifies Gateway Boulevard as being within its 2 mile study
area, but fails to address the traffic volumes on this roadway. As you are
aware, the existing traffic volumes on Gateway Boulevard, from Lawrence Road to
Congress Avenue, exceed the LOS 0 traffic volumes for both daily and peak hour,
peak direction traffic. The project would be required to phase to the widening
of Gateway Boulevard. The roadway improvement is scheduled for FY 96/97.
The Traffic Division has determined that the project does not meet requirements
of the Traffic Performance Standards of Palm Beach County. Phasing to the
widening of Gateway Boulevard is required to meet the Traffic Performance

Grove Plaza is an 8,228 acre retail commercial project located in the southeast quadrant
of the intersection of Hypoluxo and Lawrence Roads.
A Drainage System consisting of exfiltration trench, catch basins and storm sewer pipes
will collect storm runoff and convey it to the Lake Worth Drainage District (LWDD)
canal L-18 located on the north line of the Grove Plaza Site. The LWDD canal L.18 Is
culverted by means of a 72" RCP in this area.
Water quality will be accomplished on site by means of dry retention in grass areas and
exfiltration trench. Furthermore to enhance water quality inlets will be located in
"Grassed" areas.
Berming and perimeter road elevations will be utilized to contain the twenty five year
three day event on site.
Fi.nally finish floor elevations will be set above the one hundred year three day zero
discharge event.

2. Once approved for use the developer shall provide unobstructed stabilized
access to the water and sanitary sewer mains and appurtenances at all
times, (Sec. 26.33(a)).

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Division for permits for the proposed project. .
I. SITE PLAN REVIEW COMMENTS
1. The traffic analysis should be expanded to include left
hand turning lane for Hypoluxa Road into entrance into
development me~iap break. Due to phasing of project, at
time of si te plan review of each parcel, additional
reviews must be made to determine impact of turning lane,
interior traffic, signage, and one way traffic proposed
that connects the back of the parcel.
2. Approval of a landscape appeal is required to develop the
property as shown on the Master Plan. The plans should be
modified to show the results of the final determination
of the landscape appeal and reference on the plans the
landscape appeal file number 95-004.
3. A master storm water management plan (section 3,T) must
be submitted shOWing impact of phasing as proposed.

4. Computations for required number of handicapped parking
spaces shall be shown along with location of the
handicapped parking spaces being delineated on the master

proj ect can be build up to 1,108 trips. Because
of the project's proximity to Gateway Boulevard
and the existing traffic volumes on Gateway
Boulevard, from Lawrence Road to Congress, the
proj ect would be required to be phased in
conjunction with the widening of Gateway
Boulevard that is now scheduled for FY 96/97.

Driveways:
FOUL entrances into the proposed commercial
development are proposed. One entrance on
Lawrence Road that will allow northbound
traffic onto the site. Traffic will be one way
at this point. No traffic will be allowed to
re-enter Lawrence Road from the development.
Three entrances into the site will be on
Hypoluxo Road. The qUlist10n of a p08siblli
traffic signal for one of these entrances onto

The Palm Beach County Traffic Division has reviewed the traffic impact study for
the project entitled Grove Plaza, pursuant to the Traffic Performance Standards
in Article 7.9 of the Palm Beach County Land Development Code. The proposed
project will consist of 18,000 square feet of general retail, 3,600 square feet
of bank with drive-through and 7,200 square feet of fast food restaurant with
drive through. The build-out is 1996. The proposed project will generate 4t788
daily trips, given a 5% internalization rate.
The traffic study identifies Gateway Boulevard as being within its 2 mile study
area, but fails to address the traffic volumes on this roadway. As you are
aware, the existing traffic volumes on Gateway Boulevard, from Lawrence Road to
Congress Avenue, exceed the LOS D traffic volumes for both daily and peak hourt
peak direction traffic. The project would be required to phase to the widening
of Gateway Boulevard. The roadway improvement is scheduled for FY 96/97.
The Traffic Division has determined that the project does not meet requirements
of the Tra ffi c Performance Standards of Pal m Beach County. Phas i ng to the

Grove Plaza is an 8.228 acre retail commercial project located in the southeast quadrant
of the intersection of Hypoluxo and Lawrence Roads.
A Drainage System consisting of exfiltration trench, catch basins and storm sewer pipes
will collect storm runoff and convey it to the Lake Worth Drainage District (L WOO)
canal L-18 located on the north line of the Grove Plaza Site. The L WOO canal L-18 Is
culverted by means of a 72" RCP in this area.
Water quality will be accomplished on site by means of dry retention in grass areas and
exfiltration trench. Furthermore to enhance water quality inlets will be located in
"Grassed" areas.
Berming and perimeter road elevations will be utilized to contain the twenty five year
three day event on site.
Finally finish floor elevations will be set above the one hundred year three day zero
discharge event.

Please show on your plans that in fact you can reach an existing gravity

2. Once approved for use the developer shall provide unobstructed stabilized
access to the water and sanitary sewer mains and appurtenances at all
times, (Sec. 26.33(a)).

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Division for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS

The traffic analysis should be expanded to include left
hand turning lane for Hypoluxo Road into entrance into
development mediap break. Due to phasing of project, at
time of site' plan review of each parcel, additional
reviews must be made to determine impact of turning lane,
interior traffic, signage, and one way traffic proposed
that connects the back of the parcel.

Approval of a landscape appeal is required to develop the
property as shown on the Master Plan. The plans should be
modified to show the results of the final determination
of the landscape appeal and reference on the plans the
landscape appeal file number 95-004.

A master storm water management plan (section 3,T) must
