Please place the above-referenced item on the April 15, 1997 City Commission agenda
under Development Plans.
DESCRIPTION: Julian T. Brian III, agent for Dr. Walter Lanke and Ms. Alice Fay,
property owners of an 8.23 acre site located at the southeast corner of Hypoluxo Road
and Lawrence Road, is requesting a one (1) year time extension for subdivision master
plan approval and concurrency to expire March 19, 1998 for the Grove Plaza
Subdivision Master Plan. The property is zoned Community Commercial (C-3) and will
be divided into six separate parcels. For further details pertaining to this request,
please see attached Planning and Zoning Department Memorandum No. 97-132.
RECOMMENDATION: The Planning and Development Board, with a 7-0 vote,
recommended approval for a one time only, 12 month time extension (see attached
comments in Exhibit "D" - Conditions of Approval). The Board briefly discussed
aesthetics and utilization of good planning principles, however no further
recommendation was concluded by the Board.

NATURE OF REQUEST
Julian T. Brian III, agent for Dr. Walter Lanke and Ms. Alice Fay, property owners of an 8.23 acre
site located at the southeast corner of Hypoluxo Road and Lawrence Road, is requesting a time
extension for approval of the Grove Plaza Subdivision master plan. The property is zoned
Community Commercial (C-3) and will be divided into six separate parcels (see attached Exhibit "A"
- location map). Find attached Exhibit liB" - letter of request submitted by the agent. If approved,
the request would extend the expiration date of the Subdivision Master Plan to March 19, 1998.
BACKGROUND
On September 19,1995, the City Commission approved the Grove Plaza - Subdivision Master Plan
(file no. SBMP 95-001), subject to staff comments. The master plan proposes six separate parcels
containing the following uses:

. bank
. retail
. retail
. restaurant, and
. restaurant,

Chapter 2, Section 9.C.13 of the City's Land Development Regulations indicates that the City
Commission, at its discretion, may extend the approval of a subdivision master plan for a one year
period or indefinitely, provided a request for extension is filed prior to the expiration of the original
18 month period. In granting such extensions, the City Commission may impose additional
conditions to conform the subdivision master plan to the current development standards.
The subject property was annexed into the city and zoned C-3 in 1993 after the property was
changed from residential to commercial in 1990 in Palm Beach County. There were no
development applications submitted for the property until the master plan application in 1995.
ANALYSIS
The time extension request was filed prior to the expiration of the 18 month life of master plan
approval. This approval expired March 19, 1997, and the extension request was filed February 28,
1997. An extension is being requested because the property has not been platted within the
required time frame to demonstrate a good faith construction intent. The applicant indicates in his
letter of request that he needs the subdivision master plan time extension to complete all necessary
design work and procedures leading to commencing the proposed development.
RECOMMENDATION
On March 11, 1997, the Technical Review Committee met to discuss the request and the majority
vote of the Board was to grant a one (1) year extension of the subdivision master plan approval.

Dear Ms. Heyden,
On behalf of the above referenced project I herewith request an extension of approval for the valid
Subdivision Master Plan for Groves Plaza. This plan was initially approved by the City Commission on
September 19, 1995. That approval Is valid for 18 months and would expire on March 19, 1997. The plat
has not been recorded nor has a Final Site Plan been approved for any of the six parcels, therefore this
extension Is requested.
Attached are three copies of the rectified Master Plan for the parcel. Revisions have been made in
response to final staff comments by Dan DeCarlo, dated September 12, 1995. In the second paragraph of
that staff memorandum, Mr. DeCarlo states that, "All comments and recommendations can be rectified on
the plans at time of permitting If the site plan request is approved." He has recently advised me, however,
that these items must be addressed before an extension of time is granted. It is based upon this
information that the enclosed revised plans are submitted with this request.
It Is unclear whether this request meets the requirement for a valid extension or whether the item must be
considered by the City Commission. I would appreciate your written response to this with, if necessary, the
date in early March the matter would be considered by the Commission

1. It is recommended that the City Commission deny this request for the
following reasons:
a) this property represents speculative development as it has had a
commercial land use designation for almost seven years without
building construction;
b) the proposed uses do not minimize negative impacts on the
adjacent large lot, single family neighborhood to the south;
c) the proposed lot arrangement (numbers of Jots) and building layout
(lack of unified structures with architectural, landscape and signage
controls) reflects strip commercial and does not employ planning
principles that will ensure an attractive, quality development and,
d) development of this type will encourage similar development on the
vacant parcel on the southwest corner of Lawrence Road and
Hypoluxo Road.
2. If the City Commission approves the subdivision master plan
extension, it is recommended that the previous conditions of approval
and all applicable, current land development regulations apply to the
project.
