Dear Ms. Heyden:
Pursuant to my conversation with Mike Rumph of your department on Feb. 18, my client
hereby requests a time extension of 1 year to the master plan approval for Grove Plaza
(City file no. SPMD 95-(01) that currently expires on March 19, 1998. Along with this
request is a check in the amount of $400.00 to cover the fee.
Our request is made in that we have acted in good faith in advancing ourselves on both
the plat level and site plan level. Our efforts began with this office proceeding on the plat
and engineering based upon the original master plan a short time after it was originally
approved. These efforts were slowed and changed when one of the parcels went under
contract with 7-Eleven stores. At that time the decision was made that the proper and
efficient way of proceeding with the project, now that a parcel was under contract, was to
proceed with obtaining a site plan approval for the 7-Eleven project which involved
revising the master plan, engineering, and plat. These efforts proceeded and much of the
work was accomplished until it became apparent that coordinating the goals of 7-Eleven
versus the requirements of the City were becoming too time consuming in order to assure
ourselves that a revised master plan and site plan approval would be reached by the
deadline of March 19, 1998.

For this reason, the 7-Eleven site plan and the corresponding modified master plan were
put on hold and we went back to the original master plan approval approximately 2 - 3
months ago. We completed the final engineering and plat and subsequently made the
submittals to the City and all applicable pennitting authorities.
Once this extension is granted, this office will continue with the revised master plan and
site plan processing with the City on the 7 -Eleven site. As you can tell, our client has
expended a significant amount of effort and dollars and is diligently trying to start the
first phase of this project.
In my conversation with Mr. Rumph (from his conversations with yourself), it is my
understanding that the plat, being scheduled for approval at the Council's first meeting in

March, will proceed, and that if any unforeseen conditions arise that may prevent the plat
from being approved and recorded, this request will be placed before the Council at that
meeting so that the original master plan approval may be extended. The placement of this
item at that council meeting would be substantiated by the fact that this request and fee
was made to the City in the proper manner and time requirement. Should the plat proceed
and be approved, then this request will simply not be presented and fee returned.
Should any understandings herein be misrepresented or should staff feel that additional
information needs to be provided, please do not hesitate to call. Your help and
understanding in this matter is acknowledged and greatly appreciated.
