1. The west portion of building 21 is outside the 200 foot radius from the X
nearest fire hydrant. Relocate or add a fire hydrant as appropriate. (LDR
Chap. 6, Article IV, Sec. 16)
2. The fire flow calculations submitted demonstrate a fire flow of 704.53 X
g.p.m., whereas the city code requirement is 1500 g.p.m. as stated in
LDR Chap. 6, Art. IV, Sec 16. Submit revised, corrected calculations
with HRS permit submittal.

3. The hydrants shall be spaced no more than three hundred feet (300') X
from the center of any building (LDR Chapter 6, Sec. 16). A hydrant

any other permitting agency shall be included with the first request for
permits.

6. Traffic control signage and markings shall be shown on plans at all X
necessary locations (stop bars, stop signs, one-way arrow signs, etc.)

BUILDING DIVISION
Comments:
II. At time of permit submittal show compliance with section I and 7, X
Article IV of the Sign Code by changing the sign height from eight (8)
feet, identified on the site plan, to six (6) feet. Six (6) feet is the
maximum height allowed by the sign code. Also, dimension the height
of the entry wall sign on sheet 2 of 2. The height shall comply with the
code regulations. On the paving & drainage plan and water & sewer
plan label the entry wall signs and perimeter fence.
12. At time of permit submittal show on the site plan, water & sewer plan X
and paving & drainage plan the accessible route extended to the
accessible entrance of both recreation building(s), basketball court and
pool area. Place a note on the paving & drainage plan next to the labeled
symbol in.1icating that the accessible route complies with the regulations
specified in the Florida Accessibility Code for Building Construction.
Note: Following site plan approval the subsequent working drawings
that are required to be submitted for permit review shall include
identifying the location, width, type of material, slope and surface finish
texture for the required accessible route. The permit plans, where
applicable, shall include detail drawings of accessible ramps. The
drawings shall depict the location of the ramp(s) including specifying the
type of material, surface finish, width, length, slope, size of landing
required at the top and bottom of the ramp and where required, the
appropriate handrails. The illustration of the accessible route that is
required to be shown on the drawings submitted for site plan review may
be general in nature, however, the subsequent permit drawings shall
contain specific information to determine that the accessible route

complies with the fegulations specified in the accessibility code.

13. At time of permit submittal add to the site plan drawing the distance X
between all buildings. Where applicable, add to the elevation view
drawing computations that would verify walls of abutting buildings
comply with Table 600 of the Standard Building Code.
14. At time of permit submittal add to the site plan drawing the distance X
(setback) from the leading edge of each building to the adjacent property
line. The setback dimensions shall tag the location of each building by
providing two dimensions on one side of the building and one dimension
on an adjacent side of the building. [Chapter 4 - Site Plan Review,
Section 7.B.1.]
15. At time of permit submittal explain why the floor area identified in the X
Building Coverage figures does not match the combined I st floor area
identified in the Typical Building Tabular chart. Correct the plans
accordingly.
16. At time of permit submittal submit for review a plan that identifies the X
addresses of all buildings.
17. At time of permit submittal change the building type 2 symbol found on X
sheet I of 2 from Arabic to Roman numeral. This will provide
consistency with the other drawings.
18. At time of permit submittal add to sheet 2 of 2 the height of the fence. X
The maximum height allowed is six (6) feet.
19. At time of permit subrr ;ttal provide a copy of the South Florida Water X
Management District permit that verifies the proposed floor elevations
identified on the paving and drainage plan.
20. It is recommended that the sign copy proposed for the entry wall sign be X
approved administratively.
21. Permit plans for the proposed project shall comply with the applicable X
building codes, energy code, accessibility code and other applicable
codes and regulations identified in Chapter 20 - Building, Housing and
Construction Regulations of Part III of the city's code of ordinances.

22. In the site data provide F.A.R calculations, including in parentheses, that X
the 20.16 gross PUD acreage is used for calculations. This F .A.R.
calculation must match the master plan calculation. Ch.2.5 Sec.4.
23. Correct the parking detail on the paving and drainage plans, sheet 4 of X
10. This detail must match the detail provided on site plan sheet 1 of 2.
24. All shrubs (see CI and CES in the plant list) to be planted as hedges must X
be installed at a maximum 24" on center. Chapter 7.5.
25. The plant list on sheet 1 of 8 has overwrites on the remarks data for the X

26. The proposed plant materials do not meet the native requirement that is X
stated in the landscape data, sheet 1 of 8. The plant lists on sheet 1 of 8
and 7 of 8, show an overall count of native trees at 46% and native
shrubs at 19%. As per the City of Boynton Beach Comprehensive Plan
requirements, the note in the landscape data is correct and the plans
should be amended.
27. Required interior landscape area as listed in the landscape data, sheet 1 X
of 8, shall match the square footage as stated in the site plan data sheet I
of2.
28. Proper dead-ending of the public road to the east shall be the X
responsibility of the apartment developer. This shall include signage and
turn around area. If an approved turn around area is not provided, the
plans must reflect a note stating that the western 90 foot pavement stub
of SW. Congress Blvd. is to be removed by the developer.
29. As per previous approvals for this PUD and the Boynton Beach X
Boulevard PCD and Knuth Road PCD, provide plans for construction of
Knuth Road from the north side of the L.W.D.D. L-25 canal south to
Woolbright Road to include both canal crossings.
30. Provide a note on the site plan that the developer will screen all roof- X
mounted and ground mounted, air conditioning equipment. Show
location of such equipment and the method of screening.

31. Delete buildings 20 and 21, south of S.W. Congress Avenue as their X
location is inconsistent with the 1990 rezoning approval.

The clubhouse unit of measurement for this element is shown in Chapter
I, Article V, Section 3 .A(2)( e)( 6). Indicate this # change in all relevant

S. Add a note requiring dedication of Knuth Road RJW that is missing, X
according to survey, along church parcel to be consistent with (width
entity) R/W dedicated for Knuth Road north of the church parcel.
6. Provide a boundary line extension of the north property line of Lakes of X
Tara PUD, across the site to the west, designating the limits of the
multifamily development, based on the parcels 1990 approved plan. If
inconsistent with this limit, modify accordingly or obtain consent to
deviate from the Lakes of Tara Homeowner's Association.
7. Correct the building coverage calculation to reflect 3.84 acres in the site X
data site area break down and in the building coverage data. The number
must include all building square footage.
8. Correct the permitted F.A.R. acreage shown in the LVI calculations to X

20.16. Total site ~including dedications are used in the F.A. R.

9. Provide in the site data. under the total net acreage, a breakdown of the X
acreage for Pod I, Pod II, Pod m. These must total 18.717 as shown on
the site survey.

stated that the Conditions of Approval have been amended at the Planning and Development
Meeting.
Mayor Taylor asked if staff had any comments. Mike Rumpf, Acting Planning and Zoning
Director stated staff had no comments. but informed the Commission that it has already
approved the Application for Site Plan on the Consent Agenda this evening.
Mayor Taylor asked if there were any comments from the audience. There being none. closed

comments as amended as follows:
Condition #1, add the words at the end thereof "if required by Code".
Condition #2, delete "prior to initiating platting" and inserting in place thereof
"prior to issuance of the first building permif
Condition #3, delete the words "indicating that the apartmentn and after the word

Mr. Kilday stated he will begin with the Conditions of Approval and would like to address
Condition #9 with regard to parking spaces. There are two types of parking involved.
One is parking lot parking in outer areas, which provided for the full 27' and the other
parking is garage parking. For garage parking, 27' or more has been provided. Mr.
Kilday stated he has two single loaded garages which did not back up to another garage
and are on the side of the unit. The back up distance is 22' and Mr. Kilday requested
that this condition be changed to add the word "lot" between "parking" and "spaces" will
be 27 feet. And add the sentence "Single loaded garages shall be allowed a minimum
22' back up distance.
Mr. Dube requested that the word "buildings" rather than the words "loaded garage" be
used, otherwise all the garages could be changed to loaded garages and would be 22'.
Mr. Kilday agreed to this wording. This issue pertains to the south garages in buildings
16 and 19. Mr. Kilday pointed out the area on the map to the Board and staff.
Mr. Rumpf stated this change is agreeable to staff.
The next condition Mr. Kilday addressed was condition #28 and requested that the
words "If an approved turn around area is not provided" be deleted and make the "t"
capital"r.
Lastly, Item 31 as it relates to the two south buildings, delete the buildings in their
entirety as this issue was addressed in the Master Plan.
Mr. Rumpf requested that the same language regarding landscaping that was a
condition of the Master Plan apply to this approval as well (condition #6 in Item A.1.4).
These are the only changes that the Petitioner is requesting.
Chairman Wische asked if there were any further comments from the Board. There
being none, the public hearing was opened.

Mr. Kilday took the podium and stated he does not have any problems with any of staffs
comments. Mr. Kilday stated that when reviewing the Boynton Beach City Codes with
regard to self-storage facilities, there are two types of facilities that are usually
addressed. One is the traditional multi bay self-storage facility and that type of storage
is permitted under City Code within the M-1 district. The second type of storage is

Kieran Kilday took the podium and stated he represents the Applicant.
Chairman Wische informed Mr. Kilday that there are eleven staff comments and asked
the Agent which of the eleven staff comments the Agent agrees or disagrees with and
wishes to address.
Mr. Dube inquired what the changes have been made to the project since the last time
the Applicant appeared before this Board?
Mr. Kilday stated that there have been significant changes. Mr. Kilday also stated the
Applicant was seeking approval for the parcel of p,roperty that is located just north of
Woolbright Road between Quail Ridge and Apartments of Tara Lakes to the east. (Mr.
Kilday pointed out the area on the drawings that he presented to the Board). Part of the
parcel will use Knuth Road and is a condition of approval, connecting Woolbright Road
to Congress Avenue. That is a joint project of Mr. Winchester, the owner and developer
of this property to the north, and the developer of this site.
Mr. Kilday also handed out a brochure that illustrates what is envisioned for the
property. Mr. Kilday also stated that this project has appeared before this Board three
times and the Applicant feels this is the best of the projects. This project has been built
in other placea-- and the applicant is w~ing the same architect and is duplicating the
project in Boynton Beach. The apartments will be built to look more like houses and will
include garages. One type of building has ten units and the other type has seven units.
Mr.Kilday pointed out the differences between the plan being presented this evening
and previous plans. which was essentially row houses by Pulte Homes, with the same
number of units. The site plan was fully approved, plats were submitted and Pulte
walked away from the project and pursuant to numerous extensions, the master plan
expired because the utility fees were not paid.

Although it appears on the agenda as a new master plan, it is in effect replacing an old
expired master plan. Mr. Kilday had the following comments to make regarding the
conditions:
Condition #1 :
Please add at the end thereof "if required by code".
Chairman Wische asked Mr. Rumpf for his comment on this addition. Mr. Rumpf stated
comment #1 originated from engineering. After discussion with engineering, it was
determined it might not be required.
Condition #2:
Delete "prior to initiating platting" and replacing the language with
"prior to issuance of the first building permit".
Mr. Kilday requested this if it is determined a plat is not required, they would have the
plans.
Mr. Rumpf stated that several of the conditions were worded in accordance with regular
assumption platting. Mr. Rumpf stated staff agreed with this change.
Condition #3:
Delete the middle of the second line so that the condition would
read "Revise the existing note on the master plan drawing that
reads "Western RIW Stub To Be Removed. Developer shall be
responsible for installation of proper dead-end signage. n
Mr. Kilday stated that initially Congress Boulevard was going to go through the property
and the residents of the subdivision did not want this to become a through way.
Currently there is a small stub built by the previous developer and the Applicant is
willing to remove the stub, so that no turn around will have to be provided, as this will be
the end of the road. Mr. Kilday pointed out this area on the drawings.
Mr. Rumpf stated that this change would make it more consist with the comparable
comment in t"'e site plan.
Condition #6:
Petitioner asks that this item be deleted.
Mr. Kilday stated that when the original master plan was approved, the residential units
were to remain north of the northem right-of-way line of S.W. Congress Boulevard, or
otherwise consent from adjacent homeowners would be required. The recreation
portion of the project ended in the south area. The recreation has been taken out and
has moved mid-way up on the site, evenly distributed among the units. There is no

parking on the south side of the b:..Jildings and there are no openings. Actually all that is
going in now are sidewalks and some doors on the south units.
Mr. Kilday stated that notice has been sent out. To make the project work properly with
these neighborhoods leeway is necessary on the south two buildings to be positioned
as shown on the plan.
Mr. Rumpf stated that on the previous approval, staff was only receiving part of the
recommendations. The petitioner previously was requesting higher density than what
staff was recommending.
Mr. Rosenstock inquired what was the difference in density. Mr. Rumpf replied that it
was the difference between 9.68 and 7.26 density. The difference was between
medium density and moderate density residential classification.
Mr. Myott inquired what the nature of the calls was from residents of the adjacent
communities. Mr. Rumpf stated he did not receive any calls.
Mr. Rosenstock asked Mr. Rumpf if there was any reason why this condition should not
be eliminated?
Mr. Rumpf stated that the deviation being discussed is not that significant. The City
approved the project. Mr. Rumpf further stated that PUD have landscaping buffers and
if the City did compromise at this point, Mr. Rumpf stated buffers should be added as a
condition.
Mr. Rosenstock inquired if the Planning Department can specifically state what
landscaping they require. Mr. Rumpf said this can be worked out with the Petitioner.
The remaining other item is Condition #10.

approved the Favorite Food Court application excluding the Planning & Development's
additional condition that restricted the uses to restaurant uses only.
When Chainnan Wische questioned whether the Commission was aware of the fact that the applicant
had agreed to that condition, Mr. Rumpf explained that he did not have an answer to that question.
Boynton Beach Mall - The amendment of the Development Order was approved.
Barrera Annexation Ordinances were approved on second reading.

Mr. Rumpf further reported that additional information was requested regarding the Development
Award Program. No progress has been made on that program. However, Mr. Rumpf located the
Ordinance regarding this program. There is a deadline of October/November. He spoke with the
Director of Development about this program and it is believed that the deadline can be met. A
concept of program details will be brought forward with respect to program details at a future
meeting.
With respect to the issue of landscaping and signs, Mr. Rumpf reported that Ms. Heyden was
formalizing recommendations to the Commission and they have referred this to a task force.
Mr. Dube thanked Mr. Rumpf for his quick response on the LOR and zoning maps.
