I:"~ , '- I To The Planning & Development Board: The attached notification states that a representative of Hampshire Gardens be present in order for this matter to be considered. This is the third date given to us for scheduling this hearing. Because of a prior commitment, made over one year ago, I will not be able to attend this meeting. As the majority of those familiar with this project, board members have not yet returned from the north, it is impossible to substitute any other person from Hampshire Gardens that is familiar with this project. I ask that Bill Hartman of Bulldog Fence Company, our fence contractor, be our spokesman and answer any questions you may have. At this time I would like to bring this board up to date on the process that we have had to go through. Needless to say, it has been a very frustrating experience for Hampshire Gardens and feel we have been placed at the mercy of the Planning Department of Boynton Beach. . In January 1999 we requested information from the Planning & Zoning Department on requirements to construct a fence to enclose the perimeter of our community, Hampshire Gardens. At that time we were told to submit our plans and then they would tell us what we could do or not do. If our questions were answered at that time we would not be here tonight as we would have planned our project differently. . At that time we were made aware of a Neighborhood Assistance Program. Through Hank Ackerman's help we applied, received approval and were given a grant from the City Commission to plant hedges on the south border of our property and to install a fence along the west side on Federal Highway. . Our resident volunteers planted the hedge portion and in good faith we contracted the fence portion of this project to the proper contractors. . The construction of concrete columns to support the fence was permitted through the Planning Department and the height was never questioned. _'n T"----'------"-'--- ..". . Once that portion of the work was done the fence contractor applied for the permit needed to install the fence. After 3 weeks of getting utility easements, proper documentation from the Hampshire Gardens Board of Directors, we were told that the fence we were installing was 5' high and not within the building code that calls for 4' and we would have to apply for a variance. . On July 7th we submitted this application with all the proper papers. According to the Planning Department's schedule, the time frame would put this hearing on the August 24th agenda. (See attached) In August, Mr. DeCarlo called and informed me that the hearing would not be until September 14th. No reason, just that the office was busy and they were just writing the staff report. . On September 10th, Mr. DeCarlo called me again and informed me that the meeting had to be postponed until September 28th, because the variance asked for a 5' fence (which it is) and the columns that were installed were 5' 6" and the variance needed to be changed accordingly to match the first permit. A permit that was granted, work inspected and signed off on without any question on the height. I question the validity of back peddling to cover up the mistakes made by this office and delaying this hearing further. Because I had previous plans for this week, that were made long before this fence project was even started, I am not able to attend. I explained this to Mr. DeCarlo at the time he called to tell me they had changed the date. He informed me that the change was already advertised as the~ (his office) had made that decision three days prior and did not notify me until the 10 . (Please note the "Publish Date" on the bottom of attached notice.) Needless to say that we are very disappointed in the performance of the Planning & Development Department. This whole project has been in the works since February, seven (7) months counting our application to Mr. Ackerman, and still has not been resolved. In addition, we still have to go back before the City Commission for approval on a project that they already allocated grant money for back in April. I ask for your approval of this variance tonight without any further delay, or table it until can be in attendance. Federal Hwy #15, I hereby petition that the variance requested by Diamond Beach Development, Inc. be denied based on the following observations: 1. It would set a precedent for future variances and thereby jeopardizing zoning standards; 2. Allowing a reduction of 75% from the 100 foot minimum frontage would reduce the minimum to 25 feet. This is a huge reduction; 3. A 25 foot frontage could only be used for two way ingress and egress. Additional construction might narrow this strip to less than 25 feet, and large service vehicles could find it hard to navigate; 4. Adding another entrance and exit unto US1 will contribute greatly to the already existing heavy traffic on that road and the immediate intersection at 23rd S1.; 5.
