RECOMMENDATION:
Please place the requests below on the August 5, 1997 City Commission agenda under Public Hearing. The Planning and
Development Board, with 7-0 votes, recommends approval of both requests, subject to Florida Power and Light's comments
relative to the utility easement abandonment only (see attached Exhibit D), For further details pertaining to these requests,
see attached Planning and Zoning Department Memorandum No. 97-330.
Also, since there are no conditions of approval for the buffer easement abandonment and the above conditions for the utility
abandonment have been addressed since the Planning and Development Board meeting, adoption of the attached resolutions
is recommended, which is the last step in, and fmalizes, the abandonment process.

NATURE OF REQUEST
J. Richard Harris, Esq., agent for Condor Investments of Palm Beach County, Inc., the
property owner of High Ridge Commerce Park PIO, where the subject easements are
located, is requesting abandonment of portions of the following easements:
. 25 foot wide landscape buffer easement, from the western property line of lot 20 to the
eastern property line of lot 11, of Block 2, of the High Ridge Commerce Park PIO
. 10 foot wide utility easement, from the western property line of lot 20 to the eastern
property line of lot 11, of Block 2, of the High Ridge Commerce Park PIO
The attached Exhibit "A" is a location map that shows the general vicinity of the High Ridge
Commerce Park PIO. The attached Exhibit "B" contains legal descriptions of the portions
of the easements to be abandoned, and Exhibit "C" is a survey of the High Ridge
Commerce Park PIO.
BACKGROUND
Both easements, the 25 foot wide landscape buffer easement and the 10 foot wide utility
easement were established within High Ridge Commerce Park PIO at the time of platting
the PID in 1983. The landscape buffer easement is required by code as a peripheral buffer
for all planned industrial developments. The utility easement was necessary to encompass
utility lines.

ANALYSIS
The need to abandon portions of both easements emerged when a section of the
unimproved Miner Road right-of-way, located immediately south of the High Ridge
Commerce Park PID was recently abandoned. The northern half of this abandoned right-
of-way was combined with lots 11 through 20 of Block 2 of this subdivision, This action led
to the buffers no longer being located in a peripheral location. In order to increase the
buildable areas of the lots, the applicant is requesting that the buffer easement be
abandoned. A new PID buffer easement was established along the new south PIO
boundary when the Miner Road abandonment was finalized on May 6, 1997. The
applicant also wishes to relocate and/or abandon the utility easement due to its non-
peripheral location within the referenced lots. Public notice has been given to the property
owners that abut the right-of-way to be abandoned and has been advertised in the
newspaper. The utility companies and the City departments' responses to the
abandonment requests are as follows:

North -
High Ridge Commerce Park PID
East -
Interstate 1-95 right-of-way and farther east is residential
development, zoned R-1
South -
Waste Management of Palm Beach facility, zoned M-1
West -
High Ridge Road right-of-way, and farther west is undeveloped
land in unincorporated Palm Beach County.
RECOMMENDATION
Staff recommends approval of both abandonment requests subject to FPL's comments
included in Exhibit 0 - Conditions of Approval.

Commission of the CITY OF BOYNTON BEACH, FLORIDA, will conduct PUBLIC

Development Board and the City Commission with respect to any matter considered at
this meeting will need a record of the proceedings and for such purpose may need to

testimony and evidence upon which the appeal is to be based.
