Dear Mr. Feldman:
I just received your fax answering some of the questions to my letter dated September 7, 1999.
It turn out that the answers are insufficient and, therefore, making it difficult for Planning and Zoning
Division staff to include your request for extension in the October 12, 1999, Planning and Development
Board meeting as scheduled initially.
I request that you review your faxed letter dated today and provide me with more complete answers,
including: extension time period requested; management company; funding institutions. I urge you to
provide the information as soon as possible so I can include your project for the next Planning and
Development Board meeting on October 26, 1999, and the subsequent City Commission meeting on
November 3, 1999.
In answering those questions please keep in mind that some Commission members could oppose
granting the requested extension.

On June I, 1999, the City Commission granted a 120-day extension of the Palm W::llk conditional use

In order to process the Palm Walk conditional use ex1t::lIMUlI appncanon, aaomonal mformation is needed.
That information will be incorporated in the application and staff report for the Board and Commission
meetings.
At the previously mentioned, June 1, 1999, City Commission meeting, Mr. Joe Lelanic, of Land Design
South and agent for Palm Walk Associates, provided documentation on the efforts made by the client to
acquire funding and contractors; he mentioned that Ocean Bank and Melon Bank were targeted for
funding of the project and outlined a time schedule. This information was to show good faith, and
progress of the approved project.
City regulations require that progress following conditional use approval include completion of at least
twenty-five (25) percent ofthe total cost of all improvements within one year. For the application, we
need to know what percentage of improvements has been done? What is the current bank negotiation
status? What is the tentative development schedule? What has been accomplished during the 120-day
extension period?
To allow for the timely processing of this request, please respond as quickly as possible. Please fax your

In responding to your letter dated August 25, 1999, please allow me to offer the following
advises:
On June 1, 1999, the City Commission granted a conditional use extension for 120 days for the
Palm Walk Alzheimer facility in the City of Boynton Beach. The grating was construed to be
retroactive from May 5, 1999, expiration date of the previously approved conditional use on May
5, 1998. The 120 day extension are to be counted from May 5, 1999, September 2, 1999.
City of Boynton Beach Land Development regulations requires that an application for an
extension of a conditional use shall be submitted to the Planning and Zoning Director not less
than forty-five (45) days prior to its expiration. Being September 2, 1999, the current conditional
use expiration date, that means that July 19, 1999, was the dead line to submit the conditional use
extension application. However, I will forward your application to the Planning and Zoning
Board and to the City Commission for their consideration.
In order to process the Palm Walk conditional use extension application, I need some
information to evaluate it. That information will be incorporated in the application and staff
report for the Board and Commission meetings.

Dear Mr. Rumpf:
Our representatives for the above referenced project were before the City
Commission in May of this year.
Recent correspondence received by our counsel at McDermott Will & Emery in
Miami would indicate or imply that the 120 day extension granted to us was
retroactive to a prior date - not commencing as of the date of the hearing as we
understood it to be.
As the financing for our project is proceeding well and in course, the effect of this
discrepancy could be cataclysmic and would result unavoidably in problems for
all parties involved.
We respectfully request therefore, a clarification of this matter from you or the
applicable party as both we and our perspective lenders are moving forward with
great effort and at great expense based on our understanding as I described.
