Dear Mike,
In response to your letter of February 2, 1999, regarding the abandonment
of SE 1st Avenue, between SE 3rd Street and the FEC railroad, I contacted the Palm
Beach County Property Appraisers Office and I spoke with Jim Waldeck. He reviewed his
records and confirmed the abandonment of said right-of-way and he stated the road will
be properly shown on the next printing of that particular map as being abandoned. I told
him you might call him, so he confirmed he would verify the above to you if you called
him ( Jim Waldeck's phone no. is 561- 355-3481 )
If you are satisfied by the above, I would appreciate your confirmation in
writing , so I can correct my Survey of the above area.

Dear Mr. Gentry:
After reviewing City records, contacting Palm Beach County Right-of-Way Division, and
analyzing the tax map for the subject area, I have come to the conclusion that the portion of SE
1st Ave. (formerly known as Jessamine Street) between blocks 8 and 11, Plat of Town of
Boynton as recorded in Plat Book 1, Page 23, Palm Beach County Public Records, is not
currently abandoned.
In despite of the abandonment record for Jessamine Street, recorded in ORB 769, Page 695, that
you forwarded to me, I assume there should be another document perhaps reversing the previous
abandonment, otherwise it would be reflected in the tax map, as you can see in the attached
copied portion from the current tax map for the subject street. Notice, please, that portion of said
SE I st Ave. abandonment between blocks 15 and 16, Plat of Sawyers Add, Plat Book 1, Page 69,
Palm Beach County Public Records, is annotated accordingly.

NOTICE OF REZONING
NOTICE IS HEREBY GIVEN that the Planning and Development Board of THE CITY OF BOYNTON
BEACH, FLORIDA, will conduct a PUBLIC HEARING at CITY HALL COMMISSION CHAMBERS, 100
East Boynton Beach Boulevard, on Tuesday, April 13, 1999 at 7:00 p.m., to consider this request
submitted by Martin L. O'Shea, agent, for Robert Katz, property owner, for property located at 306 S.E.
1st Avenue. The City Commission of THE CITY OF BOYNTON BEACH, FLORIDA, will also hold a
public hearing to consider this request on April 20, 1999 at 7:00 p.m., or as soon thereafter as the
agenda permits at the City Hall Commission Chambers.
NATURE OF REQUEST:
Amendment to the Future Land Use Map of the Comprehensive Plan from Low Density Residential
(LOR) to Local Retail Commercial (LRC) and rezone the property from R1A to C2 to allow for adaptive
reuse of historic home and parking facilities.
LEGAL DESCRIPTION:
Lots 4, 5, and 6, Block 11, Town of Boynton, a subdivision as recorded in Plat Book 1, Page 23, in the
public records of Palm Beach County, Florida.
All interested parties are notified to appear at said hearings in person or by attorney and be heard. Any
person who decides to appeal any decision of the Planning and Development Board or City
Commission with respect to any matter considered at these meetings will need a record of the
proceedings and for such purpose may need to ensure that a verbatim record of the proceedings is
made, which record includes the testimony and evidence upon which the appeal is to be based.
