Robert Katz Alley Abandonment ABAN 98-008
NATURE OF REQUEST
Martin O'Shea, Agent for Robert F. Katz is requesting abandonment of the following alley located between SE 3rd
Street and the FEC railroad tracks, south of SE 1st Avenue:
. Existing alley between lots 4,5 &6, block 11, and lots 7,8,9 block 11, Town of Boynton, a subdivision as
recorded in Plat book 1, page 23, of the Public Records of Palm Beach County, Florida.
A historic structure currently being restored occupies the property abutting the alley. The attached Exhibit "A" is
a location map that shows the general vicinity of the alley to be abandoned. Exhibit "B" is the survey of the existing
alley. Approval of this request will allow the applicant to effectively implement a redevelopment plan for the
properties adjoining this easement, which he owns, including relocation of a historic house and buffering of
residential areas to the south.
The city's Utilities Department requires easement rights to the alleyway once it is abandoned. This is effectively
dealt with in the conditions of approval, whereby the applicant must show that this easement is recorded prior to
final approval of this request.
ANALYSIS
Public notice has been given to the property owners that abut the right-of-way to be abandoned, and has been
advertised in the newspaper. Relevant city departments and utility companies have been notified and responded
regarding their interest in the subject alley. Of all reviewers, only the City Utilities Department has need for
continued access to this alley due to the existence of a sewer main. Therefore, a condition of approval will be the
reservation of an easement to ensure the continued access, maintenance and repair of the sewer line.
The following is a description of the zoning districts and land uses of the properties that surround the subject
request (see Exhibit "A" - Location Map).

RECOMMENDATION
Staff recommends approval of this request, subject to the comment included in Exhibit "C" - Conditions of
Approval, based, in part, on the lack of need for this alley and on the benefit this may have by increasing
redevelopment potential on these lots along this portion of U.S. #1.
