Community Redevelopment May 28, 2002 Mr. Bob Katz Bob Katz Properties, Inc. 306 Southeast 1 st Avenue Boynton Beach, FL 33435 Re: The Shipwreck - Reduction in Building Area MMSP 02-041 Dear Mr. Katz: In response to your request for the administrative review and approval of the modifications proposed to the above-referenced, approved site plan for the restaurantlbar, please be informed that converting the proposed changes as shown on the revised plans date stamped OS/21/02 are "minor", as defined within the Land Development Regulations, Chapter 4- Site Plan Review. The following changes to the plan are approved as follows: . Building area reduction . Fac;ade changes . Landscape changes . Redesign of outside bar . Addition of 2 extra seats . Interior (floor space) modifications . Elimination of parking spaces. Since 196 seats are proposed, a total of 49 parking spaces would have been required based on the ratio of one (1) parking space per four (4) seats. According to Chapter 2, Section 5.EA however, the required parking may be reduced by 50% because the project is located within the Central Business District (CBD). Therefore, the restaurant is required to provide 25 parking spaces. The project is in compliance with current parking requirements pursuant to Ordinance No. 01-030, which allows a payment to be paid in lieu of parking. This project may continue to be processed by the Building Division as a permit application subject to the following conditions: 1. A revised plan showing the landscape changes must be approved by the Planning & Zoning Division prior to the issuance of the certificate of occupancy; 2. The outside stairwell (west building fayade) must be in compliance with Chapter 2, Section 4.J. 4. The proposed buildings colors must be consistent with the colors approved from the November 2000 approval. Be advised that the proposed changes to the restaurantlbar may require a modification to the building permit. In addition, if the principle use discontinued to function as a restaurant, the modifications proposed to the outside patio area (the stage) may result in the project being considered as a "night club". This characteristic or aspect of the project would require Conditional Use approval from the City Commission.
