Landscaping: A set of landscape plans have been submitted and reviewed. The plan provides the
appropriate plantings required of all projects in the Central Business District.
Landscape regulations will be fully met when staff comments are incorporated into
the permit drawings.
Regulations: The existing building is currently listed in the 1996 edition of the City of Boynton
Beach Historic Sites Survey.' -Since this building is not listed in the national
register of historical buildings, and since the city does not currently have
regulations applicable to historic structures, all proposed improvements are
allowed. Building and site regulations will fully meet code when staff comments
are incorporated into the permit drawings.
Community Design: The proposed building facade, as viewed from E. Ocean Avenue and SE 4th
Street, will enhance the character of the intersection. The upgraded structure will
receive Teal Bahama shutters, one wall sign facing each right-of-way, a second
floor patio eating area with a yellow railing, and a Copula. The proposed surface
treatment will be to restore the existing building siding and match any new
additions to preserve the visual integrity of the historic structure. The proposed
building renovations will be distinctive and will complement the E. Ocean A venue
corridor through an interesting contrast with the adjacent historic commercial
buildings. This project will provide the significant renovations required to be
consistent with the Visions 20120 Plan.
Signage: A proposed signage detail was not submitted as part of this site plan review.
Future signage shall be designed to be consistent with the Visions 20/20 Plan.
RECOMMENDATION:
The Planning and Zoning Division recommends that this request for site plan approval be approved,
subject to the comments included in Exhibit "C" - Conditions of Approval. Staff also recommends that
the deficiencies identified in this exhibit be corrected on the set of plans submitted for building permit.

The site is currently a flat, previously developed, 0.25-acre lot with historical
significance. The building is surrounded on three sides by eight feet to ten feet
wide sidewalks, with the east side being adjacent to a 28 foot wide alley, closed off
from E. Ocean Avenue by a 6 foot wood shadow box fence. Existing vegetation
consists of overgrown grasses in the alley, three 25 foot Sabal Palms at the
northwest corner of the building, four Christmas palms and one Cuban Royal Palm
(street tree) located at the front of the building that is facing E. Ocean Avenue.
There is no other vegetation of any significance on the site.
The developer is proposing the renovation of the existing Beane building built in
1910. The project will increase the building size to 6,096 square feet, and will
provide a two-story sit down restaurant with 136 seats. (see Exhibit "B" -
proposed site plan).
A traffic statement was not submitted. Although preliminary evaluation
shows a reduction in the traffic generation rate for the proposed use, the
agent, prior to permit approval, must still provide a traffic analysis

verifying same and that levels of service standards are not lowered. The
city relies on the Palm Beach County Traffic Division for review for
compliance with the county's traffic performance standards.
b. Drainage - Conceptual drainage information was provided for the city's review. The
city's concurrency ordinance requires drainage certification at time of site
plan approval. The Engineering Division is recommending that the review
of specific drainage solutions be deferred to time of permit review.
Driveways: Proposed on-site traffic circulation consists of three parking spaces at the south of
the building, directly accessed from SE. 1st Street. Three rights-of-way (E. Ocean
Avenue, SE, 4th Street, SE. 1"t Street), will provide on street parallel parking
adjacent to the building.
Parking Facility: The parking areas proposed include 2 spaces on site at the south of the building,
an additional 8 proposed spaces to be provided on the adjoining parcel to the south
of SE. 1st Street, parallel parking spaces on E. Ocean Avenue and SE. 4th Street as
well as existing public parking spaces located in a lot west of SE. 4th Street. The
standard 9 feet by 18 feet parking spaces will be provided in all proposed parking
areas. When both the adjacent on-street and off-street spaces are included, over 30
spaces are immediately accessible to the use. Central Business District zoning
allows the required parking count to be reduced by 50 % if all spaces provided
(excluding handicapped spaces) remain unrestricted and available to the public.
According to the standard methodology, 55 parking spaces are required, which is
reduced to 28 per CBD parking provisions. On site parking, based on the total
required, includes the required number of two (2) spaces designated as
handicapped accessible. All parking needs cannot be satisfied on site, as similar to
the circumstance with the former use of the property. The code allows as an
alternative to a variance process, a "payment in lieu of" option. However, if the
city has not adopted a formula and methodology for calculating this fee, the
minimum parking requirements, either on or off-site, shall be the subject of an
agreement and placed as a condition of project approval. This code provision
contains flexibility as to how the parking needs may be represented, location of
parking sources, and time frame for providing the facilities. In part, using the
concept presented in this parking agreement provision found in Section 6. E.
Central Business District, paragraph "g. Payment in lieu of provisions", staff
recommends that the city defer the net parking need for this project to the shared
parking study to be soon underway, and require participation into any shared
parking program ultimately implemented. To accommodate redevelopment within
the Community Redevelopment Area, the city is pursuing implementation of a
downtown parking study which will lead to a comprehensive parking program,
based on the shared concept, and will include the plan for additional public
parking facilities and methods for raising revenue for related facilities and
improvements. Consultant proposals have been received, and following selection
of one of the two reports, the study will be initiated and completed within
approximately 4 months. According to shared parking concepts, this restaurant use
would be a welcomed use in this vicinity, as its peak hour characteristics would
differ from the use characteristics of other nearby (predominantly retail or office)
uses.

PUBLIC WORKS
Comments:
I. Waste removal in connection with construction process must be serviced
by City of Boynton Beach. Place note on dumpster detail to indicate
same.
2. As per section 10-25 in the City Code, free dumping access to containers
at all times shall be provided by the user.
UTILITIES
Comments:
3. Fire flow calculations will be required demonstrating the City Code
requirement of 1500 g.p,m. as stated in LDR Chap. 6, Art. , Sec. 16, or
the requirement imposed by Insurance underwriters, whichever IS
greater. (See Sec. 26-16(a)). Please submit these calculations with your
Health Department permit application and plans.
4. Sec. 26-34(E) of the City Code requires that a capacity reservation fee be
paid for this project either upon my request for signature on the Health
Department application forms or within 30 days of site plan approval,
whichever occurs first. This fee will be determined based upon final
meter size, or expected demand above existing.
5. Provide an engineer's written certification that drainage will conform
with all rules of the City and the South Florida Water Management
District. (LDR Chap. 4, Sec. 7F). There does not appear to be any
provision for the required on-site pretreatment.
6. This office will not require surety for installation of the water and sewer
utilities, on condition that the systems be fully completed, and given to
the City before the first permanent meter is set. Note that setting of a
permanent water meter is a prerequisite to obtaining the certificate of
occupancy.
7. A building permit for this project shall not be issued until this office has
approved the plans for the water and/or sewer improvements required to
serve the project. (Sec. 26-15)

agencies, such as FDOT, PBC, SFWMD, DERM, L WDD, DEP and any
others, shall be included with your permit request.

16. At time of permit review, provide detail drawings of the handrails that
are required for the 1 :20 ramps identified on the plans. Also show, label
and dimension the landings that are required at the bottom of all ramps.
The accessible route that is required from the accessible parking spaces
to the accessible entrances of the building shall be shown in compliance
with the regulations specified in the Accessibility Code for Building
Construction, Section 4.3 and 4.6.

17. Show and label on the floor plan drawing the level platforms that are
required at the accessible entrances to the building. Also dimension the
clear space that is required at the handle side of the accessible doors
located on the west side of the building.
18. On the floor plan and the site plan drawing, indicate the proposed finish
floor elevation,
19. Place a note on the elevation view drawings indicating that the wall
openings and wall construction shall comply with Table 600 of the
Standard Building Code.
20. At time of permit review, add the following building specifications to the
plans: occupancy classification, type of construction and the flood zone

21. Considering detail drawings of the site and building signage were not
submitted, place a note on the site plan and elevation view drawings
indicating that separate site plan approval is required for site and
building signage. The signage shall comply with the sign regulations
specified in the Sign Code and the Design Guidelines Boynton Beach
Central Business District. [Chapter 9, Section I].
22. At time of permit review, submit a current survey of the project. Also,
submit a recorded Unity of Title form that combines the subject parcel of
land with the parcel of land that contains parking spaces and is located
south of the City alley shown on the site plan.
23. Compliance with the building codes will be evaluated at time of permit
review. The permit fee, water and sewer facility fees, county fees and
