I stressed my concern with further reducing the total parking spaces for the project and Bob said he could accommodate it
along the row of spaces across the alley. They are to resubmit revised plans that show this change. This last
conversation with Bob Katz was on or about last Wednesday or Thursday. You say us together in the office on Tuesday;
he was here to ask of the status and I responded that we had not received the revised plans from Jose Aguila. Let me
know if you hear anything. MR.

Dear Lusia:
Following our meeting of March14, 2000, and by means of this letter we are requesting your
review and concurrence that the proposed modifications, as per the attached plans, is in fact a
minor site plan modification of the previously approved project. Our basis for this request is
detailed in our responses to the following seven findings per City of Boynton Beach Land
Development Regulations Part III, Chapter 4, Section 9C:
1. Does the modification increase the buildable square footage of the development by
more than five percent.
No. The proposed modification represents slightly less than a 5% increase in the
buildable square footage over the previously approved plan. The previous approval was
for 6,096 square feet and the proposed revision represents 6,397 square feet.

2. ') Does the modification reduce the provided number of parking spaces below the
required number of parking spaces.
The City Commission approved this project waving the parking requirements based on
their belief that this project would be a great asset to the downtown redevelopment
process, and understanding that there is no possible way to comply with current codes.
The eight parking spaces on the south side of the alley are still provided, and the new
improvements to Ocean Avenue and SE 4th. Street will define on street parking.
3. Does the modification cause the development to be below the development
standards for the zoning district in which it is located or other applicable standards
in the Land Development Regulations.
The proposed modification of the project is an improvement to the existing condition
and is in line with the previously approved site plan.
4. Does the modification have an adverse effect on nearby property or reduce required
physical buffers, such as fences, trees or hedges.
No. All exterior areas will be tastefully landscaped and buffered in compliance with Code.

Dear Mike:
With regards to our conversation of a few days ago, herewith please find two copies of the
proposed plan indicating the work to be completed in two phases. The first phase will provide
for the improvement of the exterior of the building and site, including parking, as well as the
interior of the ground floor.
The ground floor will include a lounge with approximately 60 seats with a "visual" opening to the
second floor - with no public access. Also a small kitchen for the preparation of sandwiches,
and new restrooms. The dumpster enclosure will be included in phase I as well.
On the second floor there will be a small efficiency apartment. No public access will be allowed in
the area above the lounge below. Phase 2 will open this level up to public use and the elevator
will be constructed at that time.
I am enclosing a check in the amount of $100.00 to cover the cost of your review and
determination that this project will be allowed to be constructed in phases as indicated herein.
