purchase contract agreement. If an aqent is submittinq the petition. a
notarized COpy of a letter designatinq him as such must accompany the
petition.
5. Statement of special conditions, hardships or reasons justifying the
requested exception or variance. Respond to the six (6) questions below

An application fee in the amount of $400.00, payable to the City of
Boynton Beach, must accompany a completed application. The $400.00
application fee covers a request to vary one (1) section of the Code.

payment of $100.00 for each additional Code section.

We are proposing to build a first class local distribution center for the Sun Sentinel on
the above lot. This facility will service and improve the newspaper delivery for the
residents of the City of Boynton Beach. We are requesting a variance from the required
distance between driveways. Below please find the answers to questions 1-5 on the
variance application.
Question:
A) Special conditions and circumstances exist which are peculiar to the land.
These circumstances/conditions are as follows: 1) it is the last undeveloped lot along
the south portion of Park Ridge Road. It has a total of only 1.5 acres, and is the last lot,
at the end of the street (Palm Beach School Board is closing the west loop of Park
Ridge Road). In order to have the required traffic flow and accessability required by the
Fire Department and the Engineering Department, two means of ingress and egress
are required. We are planning to have one access point on Alpha Drive, and another is
required on Park Ridge Road.
B) These special conditions are not the result of the applicants action, but
are the result of an accumulation of land sales over the past few years. The request of
the applicant will complete the development of the southern portion of Park Ridge Road
with a first class facility, with safe means of ingress and egress, occupied by a top
quality tenant-SUN SENTINEL.

C) The granting of the variance will not confer any special privileges to other
lands because this is the last undeveloped lot along the southern portion of Park Ridge
Road, with no adjacent lots to the west. Other lots to the north/south/east are already
developed and will not be adversely affected by the applicants request.
D) Literal Interpretation of the provisions of this chapter would deprive the
applicant of the rights commonly enjoyed by other properties in the same zoning district
and create undue hardship on the applicant because other properties alonq this road
(i.e, Flowers Bakery) were previously qranted the same variance that is being
requested by the applicant. Other properties were allowed to have a shorter distance
between driveways because it is not a busy street and shorter driveway distances are
the only way to accommodate smaller lot ingress/egress and fire department
requirements.
E) The variance granted is the minimum variance that will make possible the
reasonable use of the land because it is the only way to achieve an acceptable lot
coverage and met the ingress/egress requirements of the engineering and fire
department. A dual means of ingress/egress with a drive around the facility is clearly
the preferred design by all parties because it achieves the safest traffic flow, and
enhances the fire departments ability to fight any potential fires.
F) The granting of the variance will be in harmony with the general intent
and purpose of this chapter and would not be injurious to the area involved or
detrimental to the public welfare because:
I) this lot is the last undeveloped small lot, on the southern portion of
Park Ridge Road.
II) the original intent of Quantum Park was to develope large lots for
large users having heavy traffic requirements, thereby requiring 150 feet between
driveways. What has occured i'n the southern section of Quantum Park, is the
development of smaller, quality, facilities having minimal traffic. These smaller facilities
still require two (2) means of ingress/egress, and typically have driveway seperation of
less than 150 feet.
III) this lot requires two means of ingress/egress to achieve proper
traffic flow and to aid the fire departments ability to fight any potential fires.
IV) this lot will not have any traffic coming from the west end of Park
Ridge Road because the west loop of Park Ridge Road is being closed as a result of
the purchase of the land by the Palm Beach County School Board.

V) The applicants main tenant, the Sun Sentinel, only occupies the facility in
off peak hours, 3 a.m. - 7 a.m. each morning. No other traffic is generated during the
more common business hours 9 a.m. - 5 p.m.
VI) Similar variances from other property owners along that same street have
been previously obtained because it is the only way to develop smaller lots (which are
a part of all business parks) and achieve the required traffic flow.
