Removal of Awnings
Dear Mr. Levy:
In response to your request for administrative approval to eliminate the awning features from the Riverwalk
Shopping Center, I must respond negatively, in part, due to the lack of details and information that will ensure the
continued compliance with conditions on which the Community Design Plan Appeal was granted on September 16,
1996. Furthermore, the changes that you propose affect a very visible design element that could have been
considered an attribute and a valuable part of the project when site plan approval was granted by the city.
For your information, the drive-thru windows are prohibited from facing U.S.1 unless certain design requirements
are met, which essentially disguise the drive-thru window. An appeal to specific code requirements was requested,
and granted conditional upon providing awning features that would blend in with the remainder of the shopping
center. By removing the related elements, the drive-thru window and fa<;ade no longer blend in with the greater
shopping center, and the basis and conditions on which the original appeal was granted are no longer honored.
Therefore, based on the impacts described herein, this request cannot simply be granted administratively; it
potentially represents a "major modification" to the existing site plan.
In conclusion, your options are as follows:
a) complete the project as originally approved;
b) submit an application for a major site plan modification in order to allow the Planning and
Development Board and City Commission to review and ultimately respond to this request; or
c) provide a more detailed description of the request including the extent of the awnings and shopping
center affected ( the submitted plans, only show that portion containing Winn-Dixie and the letter
only generally describes the modification) and provide documentation (both written and graphic)
verifying that plan changes would not negatively affect project appearance nor jeopardize
compliance with the conditions on which the Community Design Appeal were granted (see
attached copies of documents describing the appeal).

All building designs shall be based on the consistency of the architectural pattern, its relationship
to the site, and its unifying design elements. The proposed changes of the awnings are not
compatible with the design of the plaza. Awnings should be continuous along with the
pedestrian walkway, especially at building fayade.
Please either submit a version of the modified plans showing the corrections of the above
comments, or manually place corrections on the plans previously submitted for this request.

On June 16, 1998, at the regular City Commission meeting, you will be asked to ratify
the action of the Planning & Development Board. This was postponed from last months
regular meeting to give the owner time to acquire additional engineering data to further
support the request for a variance.
We find that we must request an additional postponement of sixty days, The owner is
preparing an offer to purchase the property from the Florida Inland Navigation District
which, if accepted will require us to submit a request for a zoning change and possibly
a land use amendment in which case the variance will become moot requiring no
further action.
If, at the end of the sixty day postponement, the purchase is nor completed or at least
eminent. the owner will erect the wall with no further discussion.

On November 24, 1998, I copied you with a letter sent to Mr. Michael Carey of the Riverwalk
Plaza. The intent of this letter was to put Mr. Carey on notice and have him respond to complete
the site work for Riverwalk Plaza. To date, the Riverwalk Shopping Center has not received a
complete fInal for site permit #96-4225 which I made a condition of the permanent CertifIcate of
Completion for Walgreens as \Valgreens was the last large structure to be improved. Walgreens
also had a drive-through pharmacy and site improvements that went along with their building.
!vir. Carey has never received a complete fInal for the building portion, landscaping and
irrigation for the entire Riverwalk Plaza site. One of the outstanding items was to construct a
masonry buffer wall between his site and the adjacent property to the south which he has not
begun. Walgreens' temporary CertifIcate of Completion was initially issued on July 31, 1998
and has received fIve months of extensions. His last successfully passed inspection was for
paving and drainage and was approved on 10/21/98. Since that time, there has been no
construction activity at this site.
Please notify me at your earliest convenience of what remedies we may legally take to bring this
site into compliance.

Mr. Lambert moved to elect Ms. Patti Hammer as Vice Chairperson of the Board.
Motion seconded by Mr. Rossi, which carried unanimously.
Chairman Delisa instructed Mr. Blasie to call the roll.
Mr. Blasie requested that all persons who were present this evening please
respond by raising their hand and stating "present".
IV. SWEARING IN OF WITNESSES AND INTRODUCTION
Chairman DeLiso instructed the Recording Secretary to administer the oath to all
persons who would be testifying this evening.
V. NEW BUSINESS
Chairman Delisa stated that this Board follows Florida State Statute 162 and is a
quasi-judicial Board. When a respondent takes the podium he should state his
name and address for the record and plead "not guilty" if he feels that the
violation on the property does not exist. In that case, the City would put on their
case and the respondent will present his case. The Board would then determine
if a violation exists. A reasonable amount of time will be given if you are found
guilty to bring the property into compliance. If not guilty, the case would be
dismissed. If you feel that the violation does exist, but you need more time to
bring the property into compliance, you can plead "no contest" and request a
reasonable amount of time. Usually the Board will grant the requested amount of
time. When the violation has been corrected within the allotted amount of time, a
respondent will not need to appear before this Board again. However, if the
violation is not corrected, a fine will begin to accrue and the respondent will have
to re-appear before this Board.

Inspector Pete Roy iook the podium and stated the case was originally cited on June
23. 1999 and was a."referral from the Development Department. The violation was a
punchlist with approximately 20 items that needed to be fulfilled and never were. The
case was tabled two months ago to allow for the City's Building Official to be present
tonight. Inspector Roy stated that the landscaping is almost completed. The City
recommends 30 days.
Mr. Robert Levy, Riverwalk Plaza, 1608 Federal Highway took the podium and pled no
contest. The respondent requested 60 days to complete the punch list.
Chairman DeLiso asked Mr. Johnson if the City would agree to 60 days and Mr.
Johnson stated the City is recommending 30 days.
Assistant City Attorney Igwe asked the respondent if the fence has been constructed
and Mr. Levy replied it has not. Mr. Johnson stated the fence could be put up in 30
days.
Vice Chair Hammer inquired why the respondent needed 60 days and Mr. Levy stated
they were posting a surety bond for the fence, since they are not planning to build the
fence right now. The respondent stated they submitted plans for the awnings, but
because they were not engineering plans, the City would not accept them. The plans
will be resubmitted shortly. Also, a contractor has been hired to build the dumpsters
and will be starting next week. Mr. Levy said that he was under the impression that if
this were accepted tonight, they would put up the surety for the wall.
Mr. Don Johnson, the City Building Official, took the podium noted this case has a long
history and entered into evidence correspondence with Mr. Michael Carey, the project
manager for Riverwalk Plaza Joint Venture, copies of which were distributed to each
Board member for their review. Mr. Johnson said the correspondence dates back to
1998. Many permits for interior completions did go through, such as Winn-Dixie and the
City worked diligently with the developers to get C.O.s on certain building and
temporary C.O.s were offered to Winn-Dixie. Winn-Dixie would not accept a temporary
C.O. and would only accept a full C.O.
Mr. Johnson asked the Board to refer to a letter dated May 22, 1998 to Mr. Michael
Haag from Michael Carey that stated Riverwalk Plaza Joint Venture agrees that it will
complete all site work items required by the City of Boynton Beach within 30 days. On
July 31, 1998 the last building in the project was issued a temporary C.O., which is
normally good for 30 days. The City has granted one or more extensions of temporary
C.O.'s if the applicant shows good faith in moving forward to complete the project. They
were offered the opportunity to post a cash surety for all the remaining site work in the
amount of 110% and the full C.O. would be issued to Walgreens. Walgreens had
nothing to do with the site issues and it was all the responsibility of the Riverwalk Plaza

Joint Venture. The r.espondent was issued one more extension and the site work was
still not completed.
Mr. Johnson referred the matter to the legal department. After speaking with Attorneys
Igwe and Cherof, they suggested the matter be referred to the Code Compliance Board.
Sixty days is too long and a cash surety for the wall, awnings, dumpster, and other
items could be put up so that the full C.O. could be issued to Walgreens.
Chairman DeLiso inquired why the Planning and Development Board denied the
variance? Mr. Johnson was not aware of this.
Mr. Haag, Deputy Building Official took the podium and stated when the issue came
before the City Commission, the applicant did not appear and was withdrawn from the
agenda.
Mr. Levy said that almost all the landscaping has been done, but there is a problem with
the irrigation system.
Mr. Foot asked to see a copy of the punchlist. Copies were not available for the Board.
Mr. Levy said there was approximately 20 items on the punchlist, three-quarters of
which pertain to landscaping, which has been replaced. With regard to the variance of
the wall, Mr. Levy said there was a date discrepancy on the meeting date and they
missed the meeting. There is a difference of opinion as to whether or not the awnings
are required. Mr. Levy said the reason it has taken so long is there are a great many
issues that had to be resolved. He said they are not neglecting the project as they have
a major investment in it.
Chairman DeLiso restated that the City has worked diligently with the respondent and
feels the respondent should be able to complete the remaining items within 30 days.
Mr. Levy did not think they could get all the work done in 30 days because of all the
permits that would be required. Chairman DeLiso said that this case has been pending
for two months and the respondent knew what needed to be done.
Mr. Lambert asked if December 1 st would be agreeable to the City. Mr. Johnson said
they would agree to this, but noted some of the items will take time. He noted that the
respondent has been offered the opportunity to post a cash surety that would be put into
an escrow account. When the work is completed and the project passes all inspections,
the full C.O. can be issued to Walgreens; the bond could then be released. Therefore, if
the respondent needed six months, he could take that much time. Mr. Johnson said he
could issue a full C.O. if he received the cash surety.
Mr. Johnson noted further that the respondent has had over three years to make
changes and revisions and the City has given them a tremendous amount of time.

Inspector Roy said that the awnings were a separate case and would be heard as a fine
certification.
Motion
Based on the testimony and evidence presented in Case No. 99-1157, Mr. Lambert
moved that this Board find, as a matter of fact, and as a conclusion of law that
Riverwalk Plaza Joint Venture, is in violation of Code Sections SBC ED 104.6.1 of the
City Code of Ordinances. Mr. Lambert moved to order that the Respondent correct the
violations on or before December 1, 1999. If the Respondent does not comply with this
Order, a fine in the amount of $250.00 per day, plus administrative costs shall be
imposed. The Respondent is further ordered to contact the City of Boynton Beach
Code Compliance Division to arrange for re-inspection of the property to verify
compliance with this Order. Motion seconded by Mr. Foot.
Assistant City Attorney Igwe suggested that Mr. Lambert amend his motion to include
posting of the cash bond.
Mr. Foot inquired if the case would be coming back to this Board. Mr. Rossi said the
developer has the option at any time to deliver the bond if he cannot comply within the
40 days for compliance.
Mr. Johnson said that when the respondent posts the bond, he would request that the
respondent state how many days it will take to complete the project and this would be
stated on the surety. If they haven't completed the project, Mr. Johnson would call in
contractors to complete it.
After discussion, it was determined to leave the motion as is.
Motion carried 7-0.

Dear Mr. Levy;
On April 29, 1999, we met in the City Manager's Conference room together with your partner
Martin Sadkin, Michael Haag, Building Code Permit Administrator, and Wilfred Hawkins,
Interim City Manager.
During the course of that meeting, several issues were brought forth to be addressed. Of
those items, the City has responded to your request to re-hear the variance for removal of the
south east wall, and, as an attachment with this package, your most recent request to make a
minor modification for removal of the awnings. The first issue was addressed by our City
Attorney, who confirmed that by code, that variance cannot be heard again for a period of
one year from its last denial. This information was relayed to you verbally by me in a
telephone conversation on May 7ti1, 1999. The second request for a minor masterplan
modification has also been denied, and altemate options outlined in the attached letter from
Michael Rumpf, Planning & Zoning Director.
Of those items to be addressed by the developer which were also discussed at that April 29ti1
meeting, I am quite dismayed to find out that none have been completed. Attached is a list
from Mike Haag outlining the items still remaining to complete the site.
As of this point in time, it appears that we are no further ahead in completing your project than
when we met four months ago. I look forward to your assistance in resolving the remaining
items quickly.

Status of permit 96-4225 - RIVER\V ALK PLAZA
Permit #96-4225 is the site permit for the Riverwalk project. On December 21, 1998, I
forwarded to Martin Sadkin a copy of the list of deficiencies which are unresolved with respect
to the permit. Attached is a copy of the list. The list describes deficiencies with respect to
landscaping, irrigation, awnings, dumpster enclosures and a buffer wall. To resolve the
outstanding issues, the property owner is required to complete the work as depicted on the permit
drawings. Once the work is completed, the property owner must request and receive final
inspection approval. The applicant has the option of following the appropriate procedures to
request relief from completing the items. Mike Rumpf would be the best person to describe the
appropriate procedures to Mr. Sadkin. .
Attached is a fax from Mr. Sadkin requesting that the City void permit #98-2199. This permit
would allow Hoover Canvas to install the decorative awnings along the west and north faces of
the building that Winn Dixie is located within. From previous discussions with Mike Rumpf, the
awnings are an integral part of the design of the City Commission approval of the project.
Therefore, the permit should not be voided without input from Mike Rumpf. I will forward a
denial to Mr. Sadkin with respect to his request and direct him to contact Mike Rumpf.

Attached please find a copy of a violation for Riverwalk Plaza permit #98-2199.
The permit is for Hoover Canvas which they never picked up for the installation of the
awnings. Riverwalk Plaza was going use Hoover to install the awnings, at this time we
are not installing the awnings and we are not having Hoover do the work. We would like
to void this permit.

Removal of Awnings
Dear Mr. Levy:
In response to your request for administrative approval to eliminate the awning features from the Riverwalk
Shopping Center, I must respond negatively, in part, due to the lack of details and information that will ensure the
continued compliance with conditions on which the Community Design Plan Appeal was granted on September 16,
1996. Furthermore, the changes that you propose affect a very visible design element that could have been
considered an attribute and a valuable part of the project when site plan approval was granted by the city.
For your information, the drive-thru windows are prohibited from facing U.S.1 unless certain design requirements
are met, which essentially disguise the drive-thru window. An appeal to specific code requirements was requested,
and granted conditional upon providing awning features that would blend in with the remainder of the shopping
center. By removing the related elements, the drive-thru window and fa~ade no longer blend in with the greater
shopping center, and the basis and conditions on which the original appeal was granted are no longer honored.
Therefore, based on the impacts described herein, this request cannot simply be granted administratively; it
potentially represents a "major modification" to the existing site plan.
In conclusion, your options are as follows:
a) complete the project as originally approved;
b) submit an application for a major site plan modification in order to allow the Planning and
Development Board and City Commission to review and ultimately respond to this request; or
c) provide a more detailed description of the request including the extent of the awnings and shopping
center affected ( the submitted plans, only show that portion containing Winn-Dixie and the letter
only generally describes the modification) and provide documentation (both written and graphic)
verifying that plan changes would not negatively affect project appearance nor jeopardize
compliance with the conditions on which the Community Design Appeal were granted (see
attached copies of documents describing the appeal).

On July 31, 1998, your contractor for the interior renovation and exterior drive-thru pharmacy
for \Valgreens (permit 97-2370) received a Partial Certificate of Completion (copy attached) with
the following conditions to be corrected within 30 days:
Site permit 96-4225 to have all full finals requested aild approved and all revisions
necessary for site permit 96-4225 to be secured and final inspections requested and
approved.
To date, you have not constructed the buffer wall between your property and your neighbor's
property to the south nor have you received complete landscaping and irrigation inspections for
permit 96-4225.
On May 22, 1998, so that you could receive a permanent Certificate of Occupancy for Winn
Dixie, you issued a letter to the Building Division that was approved stating that you would
complete all site work items required by the City of Boynton Beach within 30 days (copy of
letter attached).
Your Planning and Zoning consultant previously requested a variance concerning the buffer wall
and, as it is stated in the June 15,1998 letter (attached) to Mayor Taylor, ifat the end of the 60
day postponement period the purchase of the property to the south has not occurred, the owner
\vill erect the wall with no further discussion.

granted you numerous extensions allowing you time to complete your site issues. As it clearly
states on the Partial Certificate of Completion, signed by both you and the contractor, if the
above conditions are not met, the City of Boyton Beach retains the right to revoke permission of
this extension of Partial Certificate of Completion. I am hereby notifying you that your most
recent extension of Certificate of Completion will expire on December 2, 1998 and, if necessary,
I will grant you only one additional extension of this partial Certificate of Completion for this
premises and then I will be forced to refer this matter to our Legal Department for necessary
action.

Site Improvement Permit # No. 96-4225
Dear Sirs:
Permit number 96-4225 was issued on October 9, 1996. The description of work
included with this permit was as follows: storm drainage, water, paving, stnpmg,
dumpsters, outside concrete, demolition, facade work, store fronts, stucco, painting,
landscaping and irrigation.
Permit number 96-4225 received its last final inspection to complete the site
improvement permit on August 3, 2001. This permit was done in phases coordinating
construction of the various interior improvements to coincide with the portion of the site
adjacent to the store or space being improved.
It has been the policy of the Building Division to tie the final phase of site improvement
to the Certificate of Occupancy or the Certificate of Completion for the last interior
completion of the project.
Walgreens, located at 1608 S. Federal Highway (permit # 97-2370), secured a permit for
interior and exterior renovations on September 19, 1991. W a1greens' renovation
included an exterior canopy and drive through window. This permit was the last phase of
renovation for the shopping center.
The City of Boynton Beach issued a thirty-day Temporary Certificate of Completion for
Walgreens on July 31,1998.
It has been the City's policy to grant a Temporary Certificate of Completion for thirty
days and grant a maximum of two extensions for a total of ninety days. Walgreens
totally completed the requirements of their permit, but the site issues would prevent them
from receiving a full Certificate of Completion.

I issued six months of Temporary Certificates of Completion, and when it appeared that
completion of the project was not being accomplished I stopped the Temporary
Certificate of Completion in hopes of bringing compliance to the project. It was at this
time that this matter was forwarded to City Attorney, Jim Cherof. Mr. Cherof responded
that we should proceed through the Code Enforcement process.
Please refer to the attachments concerning the City's on-going efforts to work with this
developer and the length of time that it took to bring this site into compliance. If you

Dear Mr. Carey:
On July 31, 1998, your contractor for the interior renovation and exterior drive-thru pharmacy
for \Valgreens (permit 97-2370) received a Partial Certificate of Completion (copy attached) with
the following conditions to be corrected within 30 days:
Site permit 96-4225 to have all full finals requested and approved and all revisions
necessary for site permit 96-4225 to be secured and final inspections requested and
approved.
To date, you have not constructed the buffer wall between your property and your neighbor's
property to the south nor have you received complete landscaping and irrigation inspections for
permit 96-4225.
On May 22, 1998, so that you could receive a permanent Certificate of Occupancy for \Vinn
Dixie, you issued a letter to the Building Division that was approved stating that you would
complete all site work items required by the City of Boynton Beach within 30 days (copy of
letter attached).
Your Planning and Zoning consultant previously requested a variance concerning the buffer wall
and, as it is stated in the June 15,1998 letter (attached) to Mayor Taylor, ifat the end of the 60
day postponement period the purchase of the property to the south has not occurred, the owner
will erect the wall with no further discussion.

granted you numerous extensions allowing you time to complete your site issues. As it clearly
states on the Partial Certificate of Completion, signed by both you and the contractor, if the
above conditions are not met, the City ofBoyton Beach retains the right to revoke permission of
this extension of Partial Certificate of Completion. I am hereby notifying you that your most
recent extension of Certificate of Completion will expire on December 2, 1998 and, if necessary,
I will grant you only one additional extension of this partial Certificate of Completion for this
premises and then I will be forced to refer this matter to our Legal Department for necessary
action.

3. Specific problems concerning the Paving and Drainage Final arc: I. Concrete Dollards need to be installed as
per reviewed plans shown on revision of 4/20/98, 2. Concrete Plume by west entrance to Woolbright Road
needs to be installed. 3. Clean-up and properly plant and irrigate landscape area west of Walgrcens Drive
through, 4. Parking lot area where sewer sub station repairs arc needed to be completed immediately so a life
safety hazard docs not occur. 5. [-inal documents that have been requested numerous times are to be provided.
Documents that are required Letter of certification signed and sealed from engineer of record. As-builts-I
copy needs to be signed and sealed and Imylor print. Signed and scaled density reports for entire parking lot
areas. 6. Landscape and irrigation inspections have never been requested for the Walgreen area and these
inspections shall be requested as soon as possible.

the action of the Planning & Development Board. This was postponed from last months
regular meeting to give the owner time to acquire additional engineering data to further
support the request for a variance,
We find that we must request an additional postponement of sixty days, The owner is
preparing an offer to purchase the property from the Florida Inland Navigation District
which, if accepted will require us to submit a request for a zoning change and possibly
a land use amendment in which case the variance will become moot requiring no
further action.
If, at the end of the sixty day postponement, the purchase is nor completed or at least
eminent, the owner will erect the wall with no further discussion.

AT THE RIVERWALK PLAZA
On November 24, 1998, I copied you with a letter sent to Mr. Michael Carey of the Riverwalk
Plaza. The intent of this letter was to put Mr. Carey on notice and have hi~ respond to complete
the site work for Riverwalk Plaza. To date, the Riverwalk Shopping Center has not received a
complete fInal for site permit #96-4225 which I made a condition of the permanent CertifIcate of
Completion for Walgreens as Walgreens was the last large structure to be improved. Walgreens
also had a drive-through pharmacy and site improvements that went along with their building.
Mr. Carey has never received a complete fmal for the building portion, landscaping and
irrigation for the entire Riverwalk Plaza site. One of the outstanding items was to construct a
masonry buffer wall between his site and the adjacent property to the south which he has not
begun. Walgreens' temporary CertifIcate of Completion was initially issued on July 31, 1998
and has received five months of extensions. His last successfully passed inspection was for
paving and drainage and was approved on 10/21/98. Since that time, there has been no
construction activity at this site.
Please notify me at your earliest convenience of what remedies we may legally take to bring this
site into compliance.

On April 29, 1999, we met in the City Manager's Conference room together with your partner
Martin Sadkin, Michael Haag, Building Code Permit Administrator, and Wilfred Hawkins,
Interim City Manager.
During the course of that meeting, several issues were brought forth to be addressed. Of
those items, the City has responded to your request to re-hear the variance for removal of the
south east wall, and, as an attachment with this package, your most recent request to make a
minor modification for removal of the awnings, The first issue was addressed by our City
Attorney, who confirmed that by code, that variance cannot be heard again for a period of
one year from its last denial. This information was relayed to you verbally by me in a
telephone conversation on May 71t1, 1999. The second request for a minor masterplan
modification has also been denied, and alternate options outlined in the attached letter from
Michael Rumpf, Planning & Zoning Director,
Of those items to be addressed by the developer which were also discussed at that April 291t1
meeting, I am quite dismayed to find out that none have been completed. Attached is a ~st
from Mike Haag outlining the items still remaining to complete the site,
As of this point in time, it appears that we are no further ahead in completing your project than
when we met four months ago. I look forward to your assistance in resolving the remaining
items quickly.

Permit #96-4225 is the site permit for the RiveIWalk project. On December 21, 1998, I
fOIWarded to Martin Sadkin a copy of the list of deficiencies which are unresolved with respect
to the permit. Attached is a copy of the list. The list describes deficiencies with respect to
landscaping, irrigation, awnings, dumpster enclosures and a buffer wall. To resolve the
outstanding issues, the property owner is required to complete the work as depicted on the permit
drawings. Once the work is completed, the property owner must request and receive final
inspection approval. The applicant has the option of following the appropriate procedures to
request relief from completing the items. Mike Rumpfwould be the best person to describe the
appropriate procedures to Mr. Sadkin. .
Attached is a fax from Mr. Sadkin requesting that the City void permit #98-2199. This permit
would allow Hoover Canvas to install the decorative awnings along the west and north faces of
the building that Winn Dixie is located within. From previous discussions with Mike Rumpf, the
awnings are an integral part of the design of the City Commission approval ofthe project.
Therefore, the permit should not be voided without input from Mike Rumpf, I will fOIWard a
denial to Mr. Sadkin with respect to his request and direct him to contact Mike Rumpf.

Dear Mr. Levy:
In response to your request for administrative approval to eliminate the awning features from the Riverwalk
Shopping Center, I must respond negatively, in part, due to the lack of details and information that will ensure the
continued compliance with conditions on which the Community Design Plan Appeal was granted on September 16,
1996. Furthermore, the changes that you propose affect a very visible design element that could have been
considered an attribute and a valuable part of the project when site plan approval was granted by the city.
For your information, the drive-thru windows 9re prohibited from facing U.S.1 unless certain design requirements
are met, which essentially disguise the drive-thru window. An appeal to specific code requirements was requested,
and granted conditional upon providing awning features that would blend in with the remainder of the shopping
center. By removing the related elements, the drive-thru window and fac;:ade no longer blend in with the greater
shopping center, and the basis and conditions on which the original appeal was granted are no longer honored.
Therefore, based on the impacts described herein, this request cannot simply be granted administratively; it
potentially represents a "major modification" to the existing site plan.
In conclusion, your options are as follows:
a) complete the project as originally approved;
b) submit an application for a major site plan modification in order to allow the Planning and
Development Board and City Commission to review and ultimately respond to this request; or
c) provide a more detailed description of the request including the extent of the awnings and shopping
center affected ( the submitted plans, only show that portion containing Winn-Dixie and the letter
only generally describes the modification) and provide documentation (both written and graphic)
verifying that plan changes would not negatively affect project appearance nor jeopardize
compliance with the conditions on which the Community Design Appeal were granted (see
attached copies of documents describing the appeal).

Correct the following deficiencies and call the inspec .

1. Within the landscape island that is located east of the exit, drive-through lanes of
the adjacent bank property brace the new tree. Install the groundcover that is
missing from the landscape island.
2. Install the missing buffer hedge material and irrigation along the east property
line of the site. The spacing and size of the material shall match the
specifications listed on the approved plans.
3. Replace the two-(2) dead trees that are located along the landscape strip that
borders US NO.1 south of the site sign.
4. Add sod to the area were the asphalt was removed and the construction signs
were located along US NO.1.
5. Add hedge material to fill-in the voids within the landscape strip that borders US
No. 1 north of the site sign. The hedges shall form a continuous hedgerow with a
spacing of two (2) feet on center with a minimum height of 18" at the time of
planting.
6. Add the ground cover that is missing from the planting bed at the site sign that is
located along US No.1.
7. Fill-in the hedges that are missing from the landscape strip that borders the south
property line of the site. The plants are missing where the subject site abuts the
McDonalds site. The hedges shall form a continuous hedgerow with a spacing of
two (2) feet on center with a minimum height of 18" at the time of planting.
8. Fill-in the hedges that are missing from the landscape strip that borders the south
property line of the site. The landscape strip is located between the east edge of
the McDonaJds site and the dumpster enclosure that is located in the southeast
corner of the site. The hedges shall form a continuous hedgerow with a spacing
of two (2) feet on center with a minimum height of 18" at the time of planting.
9. Plant the required number of vines and 1 A' to 12' tall palms in the landscape
planting beds that are located adjacent to the east and west side of the building
that houses Walgreeris.
10. Place mulch in the planting beds to cover exposed soil.
11. Move the construction debris from the stone planting bed located along the east
property line.

Dear Mr. Sadkin:
At your request, we have reviewed the proposed wall along a portion of the south
property line and offer our opinion of the cost.
Our opinion is based on a 6 foot high precast concrete wall supported on augercast piles
or a spread footing. The 1999 edition of RSMeans Building Construction Cost Data as
well as recent bids from contractors have shown this type of construction to cost
approximately $45.00 per linear foot. The wall is shown to be approximately 275 feet in
length. Therefore, our opinion of the cost of this construction is $12,3750.00.
The actual cost of the construction must take into account several factors, including site
conditions, existing soil, conflicts with existing utilities, and others, all of which could
have a substantial impact to the cost of constructing the wall. The cost of the wall can
only be obtained through the soliciting proposals from qualified contractors who have
examined the site and are willing to commit to the construction after reviewing these and
other factors.

I am responding to the letter you wrote to Michael E. Haag since Mr. Haag has left the employment of
the City of Boynton Beach.
Per your request, I am granting you a sixty-day extension in order for you to make application for your
wall variance and move forward in securing the variance or constructing the wall. I will expect that
you have your variance application submitted to the Planning & Zoning Division by December 13,
2000 so that it will be heard by the Planning & Development Board on January 23,2001. Otherwise, I
will have no recourse than to move this item to the City Attorney's office concerning forfeiture of your
cash bond.
Your letter of December 1, 1999, stated that within 90 days ofthe June 2000 Planning & Development
Board meeting, you would have either had your variance approved or the wall constructed. Currently,
your site permit #96-4225 for the Riverwalk Shopping Center still remains open and has not received a
full building final.

Commissioner Ferguson said he believed a decision was due on the plan to move the library
expansion ahead. He believed sooner would be better than later. City Manager Bressner said
that the Commission was considering a Resolution that would authorize the City Manager to
submit an application for a Public Library Construction Grant. This was a program offered
through the State of Florida that provided funds for governments to use for constructing public
libraries. The issue was the timing for the application. The reason that staff asked the
Commission to consider it was the amount of staff work necessary to complete the application.
If the Resolution went through, the soonest the dollars would be available would be July 2002.
This would move up the construction project by one year to a year and a half. A 50-50 match
of local funds was required and the City would be expected to have the funds available in a
reasonable amount of time for the construction. Commissioner Ferguson said it was his
understanding that if the application were not completed by April 1, the entire project would be
delayed a year and Mr. Bressner affirmed that this was so. Commissioner Ferguson said he
would like to see the City move ahead on it.
Motion
Commissioner Ferguson made a motion to authorize the City Manager to submit an application
for a Public Library Construction Grant by April 1, 2001. Commissioner Fisher seconded the
motion that was carried unanimously.

Commissioner Rsher did not have faith in the developer putting up a concrete wall in years to
come if the abutting residential property were to be developed. Mike Rumpf, Planning and
Zoning Director, said Staffs recommendation was based on the fact that staff believed that the
vacant or wetland use of the adjoining property might not be permanent. It was based on the
fact that the City did not want to be put in a position of having to monitor the situation in the
years to come. Commissioner Rsher asked if the developer had a hardship? Mr. Rumpf said
the developer had a very limited space and a severe grade differential between the two
properties that would make the task of erecting a foundation for a wall difficult.
Joe Lelonek, Land Design South, stated that the property to their south was heavily populated
with mangroves and other wetland species. He also believed it would be likely that at some
point, someone may try to develop the property. However, he said that since the area was a
wetlands area, any use would be subject to review by the court and by South Florida Water
Management. They are directly adjacent to waters of the State and any developer must
mitigate any impact made to those wetlands. The mitigation cost would be prohibitively high.
In their opinion it was highly unlikely that it would be developed in the short term, up to twenty
years. They had a narrow strip 2.6 feet wide along the south edge of the property. There was
an existing four-foot high chain link fence that separated their property from the adjacent
property. It was planted now with ficus hedge. The City Forester indicated that any kind of
wall being placed along that side would impact the root systems and the grade differential
between their property and the wetlands. The City Forester's recommendation was that they
not have a hard barrier. Their plan was to keep the soft barrier, the chain link fence and a ficus
or, as agreed to, a hedge of native plant material between their property and the

(~sidentially zoned property beside it. They had also accepted a condition that if the adjoining
residentially zoned property were to be developed, the City had a right to enforce their building
of the concrete wall. He said their recognition of the condition and acceptance of it was a part
of the record and that the City would have every right to enforce the building of the wall if the
property were to be developed.
Commissioner Fisher asked how wide a wall was being considered? Mr. Lelonek said the
landscaped area they had was 2.6 feet and the wall would be a precast with columns at least
one foot wide. To make a hole for the footings would probably exceed the 2.6 feet. The
concrete curbing and the root systems of the mangroves would definitely be affected. Mr.
Rumpf stated that the urban horticulturist was Kevin Hallahan and that his recommendation
was taken into consideration, but not as far as the true hardship for the developer.
Vice Mayor Weiland said that considering the developer's promise of record to construct the
concrete wall if the adjacent property were ever to be developed, he would support the
variance.

Vice Mayor Weiland made a motion to accept the request for variance to allow a six (6) foot
high chain linked fence along the south property line in lieu of the required six (6) foot concrete
block buffer wall to separate the Riverwalk Plaza from the abutting residential district.
Commissioner Ferguson seconded the motion that carried unanimously.
Consent Agenda Item "I"
Vice Mayor Weiland stated that if he approved this it would be under the condition that there
was not enough business to have two meetings a month. He did not want the Board saddled
with having extraordinarily long meetings due to only meeting once a month and having to
cram everything into one meeting. If the business to come before the Board was on the lighter
side then one meeting would be fine. If staff and the Planning & Development Board or the
Commission deemed there was enough business for two meetings a month, he wanted to see it
go back to two meetings a month.
Commissioner Ferguson commented that this was the fourth unfortunate situation to come up
concerning the Planning & Development Board (P & D). He referred to a vote to oust a
member that had occurred in the recent past that was later rescinded. Then, the P & D Board
were banished to the second floor of the West Wing for their meetings. Recently the CRA took
authority over its planning and development issues in the 16% of the area it covers. He said he
had voted against that. The fourth issue was this one that cut the number of meetings down
due to the work pressures of the Planning & Development Department. He said that the CRA
still only had 16% of the volume. He thought it would be better for the professionals on the P
& D Board to elect themselves to cancel a meeting in any given month if it did not have
sufficient reason to meet. This would take part of the workload from the Planning &
Development Department.
Commissioner Rsher stated that the City had to adapt and be able to move quickly in order to
stay ahead and compete with its neighboring cities. If approved, he would like the issue to be
