This is in response to your February 17, 1999, memo asking the City Attorney's
Office to outline the procedure for issuance of revocable permit for use of publiC
property by Yves Hubert. Before considering whether it is in the best interest of
the City to abandon the site in question or grant Mr. Hubert any type of permit,
please consider the following:
Rrst, there is concern by staff that Mr. Hubert may currently be carrying on a
business and maintenance activities on his property in violation of city code,
despite the fact that his application for an occupational license was denied.
Second, there is also a concern that Mr. Hubert, who failed his environmental
review process may be using the property in violation of the conditions outlined
in that environmental review.
Thus, before we can proceed on this matter, staff should investigate the
possibility of existence of code violations on the property and also ascertain the
status of his compliance with the conditions outlined in his environmental review
process.
