'':'::: r ~:_ r .-; } :_;~ :i; ~ Fi: r,o, i I JJN\2 ORDINANCE NO. 0 00- /$ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING THE APPLICATION OF BETHESDA MEMORIAL HOSPITAL, LOCATED ON SOUTHEAST 24TH AVENUE, + 100 FEET EAST OF ITS INTERSECTION WITH SEACREST BOULEVARD; AMENDING ORDINANCE 89-38 OF SAID CITY BY AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY ADOPTING THE PROPER LAND USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREINAFTER; SAID LAND USE DESIGNATION IS BEING CHANGED FROM LOW DENSITY RESIDENTIAL TO OFFICE COMMERCIAL; PROVIDING FOR CONFLICTS, . SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted a Comprehensive Future Land Use Plan and as part of said Plan a Future Land Use Element by Ordinance No. 89-38 in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the procedure for amendment of a Future Land Use Element of a Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and WHEREAS, after public hearing and study, the City Commission deems it in the best interest of the inhabitants of said City to amend the aforesaid Element of the Comprehensive Plan as adopted by the City herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1: Ordinance No. 89-38 of the City is hereby amended to reflect the following: That the Future Land Use of the following described land shall be designated as Office Commercial. Said land is more particularly described as follows: LQts 29 and 30 of HIGH POINT, Section 33, Township 45 South, Range 43 East, Boynton Beach, Palm Beach County, Florida. Section 2: That any maps adopted in accordance with the Future Land Use Element shall be amended accordingly. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5: This Ordinance shall become effective 31 days after adoption, unless challenged. If challenged, it becomes effective upon the issuance of a final order finding it in compliance. ',.,;,. .~_.,_ t __J WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted Ordinance No. 91-70, in which a Revised Zoning Map was adopted for said City; and WHEREAS, Russell Morrison, Kimley-Horn and Associates, Inc., as agent for Bethesda Memorial Hospital, owner of the property more particularly described hereinafter, has heretofore filed a Petition, pursuant to Section 9 of Appendix A-Zoning, of the Code of Ordinances, City of Boynton Beach, Florida, for the purpose of rezoning a certain tract of land, said land being more particularly described hereinafter, from Single Family Residential (R-1AA) to Office and Professional Commercial (C-1); and WHEREAS, the City Commission deems it in the best interests of the inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter set forth. He stated that due to some wording in the back-up he had some concerns that the City Manager was not able to answer, Mr. Dale Sugerman was on vacation. Since his concerns could not be addressed at this time he asked that it be tabled until the June 6 meeting pending clarification. Commissioner Fisher asked if it were tabled until the next meeting would the applicant lose it? Mr. Bressner stated that as long as Mr. Sugetman was able to file on the day following the Commission meeting, they would still meet the deadline. Motion Vice Mayor Weiland moved to approve Proposed Ordinance No. 000-14. The motion was seconded by Commissioner Black. City Clerk Sue Kruse polled the vote. The vote was 5-0. 2. Proposed Ordinance No. 000-15 Re: Amending the Comprehensive Plan Future Land Use Map from Low Density Y< Residential to Office Commercial (Bethesda Memorial Hospital Parking Lot) Attorney Cherof read the Proposed Ordinance No. 000-15 by title only. Motion Mayor Pro Tern Sherman moved to approve Proposed Ordinance No. 000-15. Vice Mayor Weiland seconded the motion that carried 5-0. 3. Proposed Ordinance No. 000-16 Re: To rezone ~ from Single-Family Residential District (R-lAA) to Office/Professional Commercial District (C-l) (Bethesda Memorial Hospital Parking Lot) Attorney Cherof read the Proposed Ordinance No. 000-16 by title only. 20 MEETING MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA April 25, 2000 Chairman Wische opened up the subject for the public hearing. There being none, the public hearing was closed. Motion Vice Chair Dube moved to approve the request for conditional use by Kingdom Hall Jehovah's Witnesses, 1512 N.E. 4th Street and Site Plan Approval to construct a 5,917 square foot church on 1.001 acres subject to all staff comments with the addition of changing the handicapped ramp to 15 feet from 12 feet 10 inches. Mr. Hay seconded the motion. Applicant wished to make a correction on the square footage stating that 5,917 was an incorrect number and that the final number submitted was 4,680 square feet. The Board noted this correction for the record. Motion carried 7-0, 3. Project Name: Agent: Owner: Location: Mr. Rod Wallen, 4431 Embarcadero Drive, West Palm Beach, representing the agent Russell Morrison, Kimley-Horn & Associates, Inc, took the podium. Mr. Myott asked if this were a temporary use that would be changed into a building later and Mr. Wallen replied that it was not intended for use of a building at any time but was for permanent parking for the employees. Mr. Myott wondered why a parking garage was not considered and Mr, Wallen replied that it would be cost prohibitive. Mr. Myott stated that he lived near there and he did not see any provisions for pedestrians crossing the road. Mr. Wallen stated that the pedestrians would come down Sea crest along the east to the existing signalized intersection, Mr. Myott asked if a trolley or golf cart could transport the employees to and from the lot to the main site. Mr. Wallen had no knowledge of a plan to do that. Mr, Myott raised a safety concern for the persons crossing the street into fast-moving traffic on a street that had a history of accidents. Mr. Wallen asked how the Board would feel about a traffic-calming device just east of the site. The Board said that a left-turn only sign would be helpful. Mr. Wallen said 6
