BELMONT - ENTIRE PROJECT

The above referenced project is nearing completion. Prior to the Building Division issuing the
Certificate of Occupancy, I would like to ensure that you do not have any outstanding or pending
conditions concerning this site that must be rectified (excluding issues that are covered entirely
with a City approved surety).
If any outstanding conditions are related to permits issued by the Building Division, please
provide this division a memorandum containing a description of the unresolved conditions. If
the unresolved conditions are not permit related, please notify the owner or the owner's agent to
ensure that the matters are rectified.
Please respond to me, within ten (10) days, in order that we may proceed in a timely manner to
issue the Certificate of Occupancy. No response is necessary if your department is satisfied with
the current state of the above referenced site. Thank you for your cooperation.

Dear Mr. Berdugo:
In response to your request for the administrative review and approval of modifications proposed to the
above-referenced, approved site plan, please be informed that the proposed change shown on the revised
plans regarding relocation of the dumpster is "minor", as defined within the Land Development
Regulations, Chapter 4- Site Plan Review.
This project may continue to be processed by the Building Division as a permit application, with the
following conditions:
1. Pursuant to Chapter 7.5, Article II, Section 5, Paragraph J of the Land Development Regulations,
provide accent shrubs along the compactor screen wall.
2. Color of compactor screen wall must be compatible with the approved colors for the Building.
3. Public Works may need to review the revised plans for turning radius capabilities.
Be advised that the proposed change may require a modification to the building permit. Please contact

After preliminary review of the submitted documentation for the above mentioned project, I have
determined that this can be reviewed as a minor modification. One condition should be placed
on the approval, stating that a note should be added to the plans based on the Land Development
Regulations, (L.D.R.) Chapter 7.5, Section 5, Paragraphs J, requiring accent shrubs along the
compactor screen wall. Public Works and the Building Dept. will need to review the plans for
turning radius capabilities and screen wall paint compatibility.

DRAINAGE AGREEMENT

This three way Drainage Easement made this <~b day of ~Q ~-t , 19J:.,f
between Belmont at Boynton Beach Inc., (fka Hamptons at Boynton ch) a Florida
Corporation, 7025 Beracasa Way, Suite 107 Boca Raton, FI. 33433 (hereinafter referred
to as "BELMONT"), the Corporation of the Presiding Bishop of The Church of Jesus
Christ of Later-Day Saints, a Utah Corporation (hereinafter referred to as "CHURCH"),
and the CTIY OF BOYNTON BEACH, a Florida municipal corporation (hereinafter
referred to as "CTIY"). '
WHEREAS, Belmont owns a tract of land consisting of 14.2 acres (hereinafter
referred to as "BELMONT PROPERTY'') situated in Palm Beach County, Florida, and
more specifically described in Exhibit A attached hereto and incorporated herein; and
WHEREAS, Church owns a tract of land consisting of approximately 3.9 acres
abutting Belmont property to the south (hereinafter referred to as "CHURCH
PROPERTY'') situated in Palm Beach County, Florida, and more specifically described in
Exhibit B attached hereto and incorporated herein; and
WHEREAS, Belmont desires to construct 192 residential dwelling units on the
Belmont Property; and
WHEREAS Church desires to construct a building on Church property in the
future; and
WHEREAS, Belmont desires to construct a private drainage system on its border
with Church (approximately one half of the private drainage system to be located on
Belmont property and the other half on Church property), to handle runoff water from
both properties; and
WHEREAS Church desires to discharge runoff water from its property unto the
private drainage system located on both Properties; and

WHEREAS, City owns the public right-of-way fronting both Belmont and Church
Properties, more specifically described as the Knuth Road area as described in Exhibit C
attached hereto and incorporated herein; and
WHEREAS City desires to discharge runoff water from Knuth Road to the private
drainage system located on both Properties; and
WHEREAS, as a condition of site plan approval for construction of the 192
residential dwelling units (approved by the City Commission on June 2, 1998) Belmont
was required to permit the City to discharge runoff water from Knuth Road unto the
private drainage system;
NOW, THEREFORE, for and in consideration of the premises and conditions
contained herein, and for other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, the parties agree as follows:
The foregoing whereas clauses are hereby ratified and confirmed as being true
and incorporated herein by this reference;
CITY shall, have the right to discharge runoff water from Knuth Road right-of-
way between the L-25 canal to Woolbright Road unto the private drainage system
located on the properties in perpetuity;
CITY reserves the right to perform emergency maintenance on the private
drainage system without notice when necessary to maintain satisfactory drainage of
Knuth Road and prevent roadway flooding;
CITY reserves the right to restrict any development or alteration on the
Properties if such development or alteration will diminish drainage capacity;
Primary responsibility for maintenance of the private drainage system rests with
Belmont;
This instrument shall be binding on, and shall inure to the benefit of the heirs,
legal and personal representative, successors and assigns of the parties hereto;
Upon execution of this Agreement CITY shall record same in the Public records
of Palm Beach County, Florida.
