The City is currently reviewing two variance requests subIIlltted by our office on behalf
of Altman Development for the Bay Vista property Please accept this request to
withdraw those requests for relief. SpecIfically, please withdraw our request for relief
from.
1 Chapter 2, Section 4.J.l, regarding a maximum front yard wall height of four
feet. In its place, we are requesnng that staff cOllduct a code review of the cited
requirement with the intention of revising the regulations to allow for a six (6)
foot maximum front yard wail heigbt. Such lUl ~end.ment will allow for greater
flexibility U1 deSIgn for large multi-family rental ancl condominium
developments. It will permit design entrance features at a scale in keeping with
those developments.
2. Chapter 2, Section lJ.H.16c (12). whicb governs the parking requirements for
recreation facilities for condominiums and housmg developments. AgaIn, we are
requestini that staff review this provision of the Land Development Regulations.
The current parlcing requirements for multi..family developments already require
more spaces than will normally be reqwed for reSIdents and guests. The
additional parking requirements for the clubhouse and pnvate recreational
facilities are uanecessary Providing the additional parkins, spaces required per
the current Code reduces the amount of area available for Landscaping, vegetation
preservation. and open space. It also increases the total amount of impervious
area on the property, which adversely impacts on-site stormwater retention
requirements as well as off-site stonnwatcr runoff. The current Code bases
parking Its parking reqUIrements on the square footage of the recreational
facilities provided. As a result. developers are discouraged from providing more
ab1.lI1dant recreation facilities and are in fact, penalIzed for proVlding
extraordinary on-site recreational amenities.
