E Use of adjacent properties including right-ot-way lines for all streets and alleys,
sidewalks, turn lanes and driveways
F Elevations of the lowest finished floor of all structures on the site
3 Certified list of names and post office addresses of property owners and legal descriptions of
their property within 400 feet of subject property, as recorded in the County Courthouse,
including a tax map showing placement of 400 feet boundary Such list shall be accompanied
by an Affidavit (see attached) stating that to the best of the applicant's knowledge, said list is
complete and accurate, as well as labels or addressed envelopes and postage (1st class--
stamps or payment for required postage)
4 Proof of ownership of property by petitioner(s), such as deed or purchase contract agreement.
If an aQent is submittinQ the petition, a notarized copy of a letter desiQnatinQ him as
such must accompany the petition.
5 Statement of special conditions, hardships or reasons justifying the requested exception or
variance Respond to the six (6) questions below (A-F) on a separate sheet (Please print or

A. That special conditions and circumstances exist which are peculiar to the land, structure
or building involved and which are not applicable to other lands, structures or buildings
in the same zoning district;
B That the special conditions and circumstances do not result from the actions of the
applicant;
C That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Ordinance to other lands, buildings or structures in the
same zoning district;
D That literal interpretation of the provisions of this chapter would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the terms
of the Ordinance and would work unnecessary and undue hardship on the applicant;
E That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure,
F That the granting of the variance will be in harmony with the general intent and purpose
of this chapter and that such variance will not be injurious to the area involved or
otherwise detrimental to the public welfare
6 An application fee in the amount of $40000 plus postage, payable to the City of Boynton
Beach, must accompany a completed application The $40000 application fee covers a
request to vary one (1) section of the Code Seeking relief from more than one section of the
Code will require payment of $100 00 for each additional Code section

The applIcant IS requestmg vanance relIef from three (3) CIty of Boynton Beach Land
Development RegulatIOns The property IS undergomg TRC sIte plan approval for a 286-
UnIt multI-famIly luxury rental communIty The exact vanance requests are as follows
1 Ch. 2, Sect 4. J .1 Fences, hedges and walls shall not exceed six (6) feet m
helght, above fimshed grade, m reSldentlal zones, except that from the
blllldmg lme to the front lme the maxlmum helght shall be four (4) feet.
The Bay Vista SIte plan mcludes a decoratIve wall along ItS US 1 frontage
PortIOns of that wall are eIght (8) feet m heIght. ThIS request IS for a
vanance of four (4) feet from the Code reqUIrement.

the setback. ThIS vanance request IS to permIt these paVIlIons to encroach
mto the front setback.

whIch are not applIcable to other lands ThIS sIte IS generally square WIth a 3 5 acre
mangrove that wIll be preserved by the developer ThIs preserve area essentIally bIsects
the sIte ThIs umque CIrcumstance dIrectly effects the layout of the clubhouse locatIOn
The recreatIon bUIldIng or "clubhouse" for thIS hOUSIng development IS located adpcent
to the Intercoastal Waterway and the mangrove/natural area for aesthetIc purposes
SectIOn I1.H.12.a of the off-street parkIng chapter pernuts a reductIOn In parkIng
reqUIrements for hOUSIng development recreatIon bUIldIngs by allOWIng, "no parkIng
spaces reqUIred for all dwellIng UnIts WIthIn a 500 foot radIUS" and a reductIOn of parkIng
reqUIrements at the rate of "one parkIng space reqUIred for every four dwellIng UnIts
WIthIn a 500 to 800 foot radIUs" However, due to the speCIal geographIC features of thIS
SIte (a mangrove preserve), the clubhouse IS located In the southeast comer of the SIte
The mangrove Intrudes Into the radIl that the Code reqUIres to be used to determIne the
number of parkIng spaces reqUIred. Because of thIS there are very few UnIts WIthIn the
500 foot radIUS and no hOUSIng UnIts WIthIn the 500 foot or 800 foot radIl
Vanances #1 and #2 are necessary due to the unIque CIrcumstances of the locatIOn of thIS
property Bay Vista's sole frontage IS located along US 1 In order to meet the Intent of
the developer's and the CIty of Boynton Beach's goal of creatIng a pedestnan fnendly
roadway WIth exceptIOnal archItectural features, both of these vanances are necessary
The US 1 comdor has been recently renovated by the CIty of Boynton Beach WIth bnck
pavers, upgraded medIan landscapIng, and refurbIshed hardscape features ThIS
development Intends to further thIS theme WIth deSIgner pedestnan paVIlIons and an
enhanced entrance feature Into the communIty Both of these Items reqUIre nunor
vanances to the Zoning Code Vanance #2 WIll pernut the applIcant to proVIde the publIc
WIth shelter from the elements close to the US 1 SIdewalk. It IS the unIque locatIOn and
recent CIty InItIated Improvements along thIS comdor that make these vanances
necessary
Therefore, speCIal CIrcumstances do eXIst on thIS property that are peculIar to thIS
property and are not applIcable to other lands In the same zOnIng dIstnct.
B That the specwl condltzons and circumstances do not result from the actzons of the
applzcant.
The speCIal condItIons and CIrcumstances do not result from the actIOn of the applIcant.
The mangrove located on 25% of the property IS not a result of actIOns of the applIcant,
nor IS the upgrades that have been Implemented along US 1 There IS a great demand for
reSIdentIal developments on waterfront property, unfortunately there IS a very lImIted
supply of thIS land. Vanance #3 helps to ensure that the new development IS deSIgned In
a way that prOVIdes all the reSIdents of such a development a means to enJoy thIS pnzed
scenery It IS benefit to the communIty to have upscale waterfront hOUSIng that preserves
eXIstIng wetlands and furthers the CIty sponsored Improvements along US 1
The subject SIte WIll accomplIsh these goals by prOVIdIng a recreatIon bUIldIng/clubhouse
WIth a large sun deck as well as a boardwalk traversIng the length of the property dIrectly
adjacent to the Intracoastal Waterway In addItIOn, the enhanced entry feature wIth
pedestnan pavIlIOns WIll establIsh a precedent for future developments In the comdor
The eXIstIng mangrove and the newly desIgned Improvements along US 1 are not the
result of the applIcant, but these vanances are requested to ensure both are preserved and
enhanced.
C That granting of the varzances requested would not confer on the applzcant any
special privilege that lS demed by this ordl1lance to other lands, buildings, or structures
in the same zomng dlstrict.
The grantIng of thIS vanance wIll not confer on the applIcant any specIal pnvIlege that IS
denIed to other propertIes In the same zOnIng dIstnct. Vanance #3 IS reqUIred because
other propertIes can benefit from SectIOn I1.H.12 whIch grants cOndOmInIUmS and
hOUSIng developments with recreational bUIldIngs the abIlIty to reduce the overall parkIng
reqUIrements for the development. The mangrove that IS beIng preserved by the applIcant
precludes hIm from enJoYIng thIS benefit. Rather than confemng a speCIal pnvIlege, thIS
WIll allow the applIcant the same pnvIleges as other developers.
Vanances #1 and #2 are necessary because of the recent upgrades that the CIty has
undertaken along thIS stretch of the US 1 comdor Other eXIstIng developments In thIS
area along thIS comdor have benefited from these Improvements, but have not had to
Incur the expenses that the applIcant WIll Future developers on thIS comdor WIll have to
meet the same hIgh standards beIng establIshed by thIS property
D That lIteral l1lterpretation of the provlsLOns of this chapter would deprzve the
applicant of rzghts commonly enjoyed by other properties 11l the same zomng dlstrzct
under the terms of the ordinance and would work unnecessary and undue hardship on the
applzcant.
LIteral InterpretatIOn of the proVISIOns of the Land Development RegulatIOns would
depnve the applIcant nghts enjoyed by other propertIes In the same zonIng dIstnct
because thIS site must compensate for the peculIar CIrcumstances of the site If the
proVISIOn of Vanance #3 were to be Interpreted lIterally, the clubhouse would have to
prOVIde over 35 addItIOnal parkIng spaces above what IS necessary ThIS IS not deSIrable
to the City, neIghborhood, or the developer As descnbed In Item 'A', the mangrove to
be preserved on SIte prevents the applIcant from takIng advantage of parkIng reductIOns
penrutted In the Land Development RegulatIOns that other propertIes can enJoy LIteral
InterpretatIon of the reqUIrements of Vanance #2 would prevent the applIcant from bus
shelters adjacent to the SIdewalks DenIal of Vanance #1 WIll prevent the applIcant from
prOVIdIng a grand entrance that IS compatible WIth the renovations made to US 1 by the
CIty
The unIque charactenstlcs of thIS site and Its prOXImIty on US 1 have created a situatIon
whereby the applIcant IS bemg depnved of nghts commonly enjoyed by other propertIes.
E. That the variance granted is the minimum varzance that will make posslble the
reasonable use of the land, bUllding or structure.
These vanances wIll make possIble the reasonable use of the land. Waterfront property
In the CIty of Boynton Beach IS very scarce In addItIOn, the applIcant IS assemblIng SIX
separate parcels to be developed as one The mdIvIdual parcels are not of a SIze that
would make multI-famIly development feasIble These factors have resulted m an very
tIght market for SImIlar propertIes, mcreasmg the pnce of the land sIgmficantly In order
to make Its development financIally feasIble, the property must be developed as a hIgh
qualIty, hIgh rent commumty The amemtIes that Vanances #1 and #2 wIll penrut are
necessary to create a hIgh-end commumty Vanance #3 IS the mimmum amount possIble
to adequately park the clubhouse faCIlIty
F That the grantmg of the varzance wlll be m hannony wlth the general mtent and
purpose of thIS chapter and that such varzance wlll not be mJurzous to the area involved
or otherwlse detrimental to the pubhc welfare.
These vanances are consIstent WIth the mtent and purposes of thIS chapter Vanance #1
and #2 wIll result m the contmuatIon of the upgrades that the CIty has ImtIated on US 1 m
thIS area. Vanance #2 m partIcular wIll penrut the constructIOn of pedestnan pavIlIons
along the SIdewalk that can be used by the publIc at large Vanance #3 wIll help to
preserve the mangrove wetland on SIte WIthout overparkmg the clubhouse faCIlIty
Rather than be a detnment to the general publIc, these vanances WIll be a benefit the
pubhc by creatmg an enhanced entryway along the very VISIble US 1 comdor,
estabhshmg seatmg areas avaIlable to the publIc on US 1 m pedestnan pavIlIOns, and by
not creatmg unnecessary ImpervIOus paved parkIng areas on the subject property
