TO WHOM IT MAY CONCERN This district has received an
application for a Department of the Army permit pursuant to
Section 10 of the Rivers and Harbors Act of 1899 (33 U S C 403)
and Section 404 of the Clean Water Act, as described below

WATERWAY & LOCATION The project impacts are located in tidal
and adjacent freshwater wetlands, in Section 33, Township 45
south, Range 43 east, Palm Beach County, Florida To reach the
site from Interstate 95, exit east on Woolbright Road to U S
Highway 1, go south on U S Highway 1 to SE 23rd Avenue The
project is located on the east side of U S Highway 1 at the
intersection of SE 23rd Avenue

WORK & PURPOSE The total project is 14 33 acres, of which, the
applicant proposes to place fill material in 0 24 acres and
temporary impact 0 21 acres of degraded tidal/freshwater
wetlands The work would consist of the construction of 286
apartment units, a 6-foot by 510-foot boardwalk, and installation
of 192 linear feet of riprap The proposed 0 24 acre impact site
can be characterized as tidal/freshwater mixed wetlands dominated
by melaleuca (Melaleuca quinquenervia), Brazilian pepper (Schinus
terebinthifolius) and sparse white mangro~es (Laguncularia
racemosa) Temporary impacts to 0 21 acres of Brazilian pepper
(Schinus terebinthifolius) and Australian pine (Casurina
equisetfolia) will occur during the construction of a retaining
wall along the perimeter of the wetland After installing the
retaining wall, the temporary impact area will be replanted with
native wetland species A seagrass survey conducted by the
applicant in April 2000, concluded that no seagrasses would be
impacted by the proposed project For further details, see
attached project drawings, sheets 1-8, dated 8/15/00 A complete
set of project drawings is available for viewing at the West Palm
Beach Regulatory Office The applicant's proposed mitigation for
wetland impacts consist of onsite enhancement of 3 04 acres of
tidal mangrove wetlands A overall Estuarine Wetland Rapid
Assessment Procedure (E-WRAP) score of 0 29 was calculated by the
applicant for impacts to 0 24 acres of tidal/freshwater wetlands
which would create a total of 0 07 debit units A E-WRAP score
credit lift of 0 15 was calculated by the applicant for the
onsite restoration of 3 04 acres totaling 0 46 credit units
Therefore, a total of 0 46 credit units would be provided by the
proposed mitigation to offset the loss of 0 07 debit units
RESOURCES OF SPECIAL CONCERN The Corps of Engineers has made a
determination that the proposed work will impact sparse white
mangroves (Laguncularia racemosa) which are areas designated as
essential fish habitat This notice initiates the Essential Fish
Habitat (EFH) consultation requirements of the Magnuson-Stevens
Fishery Conservation and Management Act Our initial
determination is that the proposed action will not have a
substantial adverse impact on EFH or Federally managed fisheries
in the South Atlantic Potential impacts to managed species
caused by impacts to EFH include penaeid shrimp complex, red
drum, reef fish, stone crab, spiny lobster, migratory/pelagic
fish, snapper/grouper complex and callico scallop Our final
determination relative to project impacts and the need for
mitigation measures is subject to review by and coordination with
the National Marine Fisheries Service Project site information
will also be forwarded to the State Historical Preservation
Office, to be reviewed for the presence of any resources listed,
or eligible for listing on the National Resister of Historic
Places
The Corps of Engineers, has made a determination that the
proposed work will have no adverse effect on any threaten and/or
endangered species, or critical habitat areas This public
notice is being forwarded to the U S Fish and Wildlife Service,
and the National Marine Fisheries Service for concurrence with
this determination
NOTE This public notice is being issued based on information
furnished by the applicant The total amount of tidal/freshwater
wetlands onsite has been verified by a member of my staff

IMPACT ON CULTURAL RESOURCES: Review or the latest published version or Ihe

unknown archeological, sclentlnc, prehistorical, or historical dala may be losl or deslroyed
by the work to be accomplished.
EVALUATION: The decision whether to Issue a permit will be based on an evaluallon
of the probable Impact Ineludlng cumulative Impacts of the proposed activity on the public
Interest. That decision will renect the natlonal concern for bolh prolectlon and utlllzatlon
of Important resources. The beneOts which reasonably may be expected to accrue from the
proposal must be balanced against Its reasonably roreseeable detriments. All raclors wblch
may be relevant to the proposal will be considered Indudlng cumulative Impacis thereori
among these are conservation, economics, esthetics, general environmental concerns,
wetlands, historic properties, nsh and wlldllre values, nood hazard., noodplaln value., land
use, navigation, sborellne erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, rood and nber producllon, minerai needs, considerations
or property ownership, and, In general, the needs and welfare of Ihe people. EvaluaUon of
the Impact of the activity on the public Interest will also In elude application of the guidelines
promulgated by the Administrator, EPA, under authority of Section 404(b) of the Clean
Water Act of the erllerla eslabllshed under authority of SecUon 101(a) or the Marine,
Protecllon, Research, and Sanctuaries Act of 1971. A permit will be granted unless Its
Issuance Is found to be contrary 10 the public Interest.
The Corps of Engineers Is solldtlng comments from the publiCi Federal, slate, and
local ageneles and omelals; Indian Tribes; and other Interested parUes In order to consider
and evaluate the Impacts of this proposed activity. Any comments receIved will be considered
by tbe Corps of Engineers to determine wbether to Issue, modify, condition or deny a permit
for tbls proposal. To make or deny this decision, comments are used to assess Impacts on
endanlered species, hIstoric properties, water quality, general environmental effects, and
the other public Interest factors listed above, Comments are used In the preparation of an
Environmental Assessment and/or an EnvIronmental Impact Statement pursuant to Ihe
NaUonal EnvIronmental Polley Act, Comments are also used to determine Ihe need for a

Development RegulatIOns The property IS undergoing TRC sIte plan approval for a 286-
umt multI-famIly luxury rental commumty The exact vanance requests are as follows,
1 Ch, 2. Sect 4. J.l Fences, hedges and walls shall not exceed six (6) feet m
helght, above finished grade, m residential zones, except that from the
buildmg lme to the front line the maximum helght shall be four (4) feet.
The Bay Vista sIte plan Includes a decoratIve wall along ItS US 1 frontage
PortIOns of that wall are eIght (8) feet In heIght. ThIS request IS for a
vanance of four (4) feet from the Code reqUIrement.

mangrove that wIll be preserved by the developer This preserve area essentIally bIsects
the sIte ThIS umque CIrcumstance dlfectly effects the layout of the clubhouse locatIOn,
The recreatIOn bUIldIng or "clubhouse" for thIS hOUSIng development IS located adjacent
to the Intercoastal Waterway and the mangrove/natural area for aesthetIC purposes
SectIon I1.H,12.a of the off-street parkIng chapter penruts a reductIOn In parkIng
requirements for hOUSIng development recreatIOn bUIldIngs by allOWIng, "no parking
spaces reqUIred for all dwellIng umts WIthIn a 500 foot radIUS" and a reductIOn of parkIng
reqUIrements at the rate of "one parkIng space reqUIred for every four dwellIng umts
WIthIn a 500 to 800 foot radIUS," However, due to the specIal geographIc features of thIS
SIte (a mangrove preserve), the clubhouse IS located In the southeast corner of the sIte
The mangrove Intrudes Into the radll that the Code requlfes to be used to detenrune the
number of parkIng spaces reqUIred, Because of thIS there are very few umts WIthIn the
500 foot radIUS and no hOUSIng umts WIthIn the 500 foot or 800 foot radll
Vanances #1 and #2 are necessary due to the umque CIrcumstances of the locatIOn of thIS
property Bay Vista's sole frontage IS located along US 1 In order to meet the Intent of
the developer's and the CIty of Boynton Beach's goal of creatIng a pedestnan fnendly
roadway WIth exceptIOnal archItectural features, both of these vanances are necessary
The US 1 comdor has been recently renovated by the CIty of Boynton Beach WIth brick
pavers, upgraded medIan landscapIng, and refurbIshed hardscape features. ThIS
development Intends to further thIS theme WIth deSIgner pedestnan paVIlIons and an
enhanced entrance feature Into the commumty Both of these Items reqUIre minor
vanances to the Zomng Code Vanance #2 WIll permit the applIcant to proVIde the public
WIth shelter from the elements close to the US 1 SIdewalk. It IS the umque locatIOn and
recent CIty InItIated Improvements along thIS comdor that make these vanances
necessary
Therefore, speCIal circumstances do eXIst on thIS property that are peculIar to thIS
property and are not applIcable to other lands In the same zomng dIstnct.
B That the speczal conditions and Circumstances do not result from the actlOns of the
applrcant,
The speCIal condItIons and Clfcumstances do not result from the action of the applicant.
The mangrove located on 25% of the property IS not a result of actions of the applIcant,
nor IS the upgrades that have been Implemented along US 1 There IS a great demand for
reSIdentIal developments on waterfront property, unfortunately there IS a very IIrmted
supply of thIS land. Vanance #3 helps to ensure that the new development IS deSIgned In
a way that proVIdes all the reSIdents of such a development a means to enJoy thIS pnzed
scenery It IS benefit to the commumty to have upscale waterfront hOUSIng that preserves
eXIstIng wetlands and furthers the CIty sponsored improvements along US 1
The subject SIte WIll accomplIsh these goals by proVIdIng a recreatIOn bUIldIng/clubhouse
WIth a large sun deck as well as a boardwalk traversIng the length of the property directly
adjacent to the Intracoastal Waterway In additIOn, the enhanced entry feature with
pedestnan pavIlIOns WIll establIsh a precedent for future developments In the comdor
The eXIstmg mangrove and the newly desIgned Improvements along US 1 are not the
result of the apphcant, but these vanances are requested to ensure both are preserved and
enhanced.
C That grantmg of the variances requested would not confer on the applicant any
speczal pnvilege that lS demed by thls ordinance to other lands, buildmgs, or structures
m the same zoning district.
The grantmg of thIS vanance wIll not confer on the apphcant any specIal privIlege that IS
demed to other propertIes m the same zomng dIstnct. Vanance #3 IS reqUIred because
other propertIes can benefit from SectIOn 11.H,12 WhICh grants condommmms and
housmg developments WIth recreatIOnal bUIldmgs the abIlIty to reduce the overall parkmg
reqUIrements for the development. The mangrove that IS bemg preserved by the applicant
precludes hIm from enJoymg thIS benefit. Rather than confemng a speCial pnvIlege, thIS
wIll allow the apphcant the same pnvIleges as other developers,
Variances #1 and #2 are necessary because of the recent upgrades that the CIty has
undertaken along thIS stretch of the US 1 comdor Other eXIstmg developments m thIS
area along this comdor have benefited from these Improvements, but have not had to
mcur the expenses that the apphcant wIll Future developers on thIS comdor wIll have to
meet the same hIgh standards bemg estabhshed by thIS property
D That literal mterpretatlOn of the provisions of this chapter would depnve the
applicant of nghts commonly enjoyed by other properties in the same zoning district
under the terms of the ordmance and would work unnecessary and undue hardship on the
appllcant,
Literal mterpretatlon of the provlSlons of the Land Development RegulatIOns would
depnve the apphcant nghts enjoyed by other propertIes m the same zomng dIstnct
because thIS SIte must compensate for the pecuhar CIrcumstances of the SIte, If the
provlSlon of Vanance #3 were to be mterpreted hterally, the clubhouse would have to
proVIde over 35 addItlonal parkmg spaces above what IS necessary ThIS IS not deSIrable
to the CIty, neIghborhood, or the developer As described m Item 'A', the mangrove to
be preserved on SIte prevents the apphcant from taking advantage of parkmg reductIOns
permItted m the Land Development RegulatIOns that other propertIes can enJoy LIteral
mterpretatIOn of the reqUIrements of Variance #2 would prevent the applIcant from bus
shelters adjacent to the sidewalks Demal of Vanance #1 will prevent the applIcant from
provIdmg a grand entrance that IS compatible WIth the renovatIons made to US 1 by the
City
The umque charactenstlcs of thIS site and ItS proXllTIlty on US 1 have created a situatlon
whereby the apphcant IS bemg depnved of nghts commonly enjoyed by other propertIes,
E. That the variance granted lS the minimum variance that will make possible the

These vanances wIll make possIble the reasonable use of the land, Waterfront property
In the CIty of Boynton Beach IS very scarce In addItIOn, the applIcant IS assemblIng SIX
separate parcels to be developed as one The IndIVIdual parcels are not of a size that
would make multI-fanuly development feasIble, These factors have resulted In an very
tight market for SImIlar propertIes, Increasing the pnce of the land sigmficantly In order
to make Its development finanCIally feasible, the property must be developed as a hIgh
qualIty, hIgh rent commumty The amemties that Vanances #1 and #2 WIll perrrut are
necessary to create a hIgh-end commumty Vanance #3 IS the rmmmum amount possIble
to adequately park the clubhouse facIlIty
F That the grantzng of the varzance will be zn harmony wlth the general zntent and
purpose of this chapter and that such varzance wlll not be injurious to the area znvolved
or otherwlse detrzmental to the public welfare.
These vanances are conSIstent WIth the mtent and purposes of thIS chapter Vanance #1
