D Use of each structure (or uses within multiple occupancies)
E Use of adjacent properties including right-of-way lines for all streets and alleys,
sidewalks, turn lanes and driveways
F Elevations of the lowest finished floor of all structures on the site
3 Certified list of names and post office addresses of property owners and legal descriptions of
their property within 400 feet of subject property, as recorded in the County Courthouse,
including a tax map showing placement of 400 feet boundary Such list shall be accompanied
by an Affidavit (see attached) stating that to the best of the applicant's knowledge, said list is
complete and accurate, as well as labels or addressed envelopes and postage (1st class--
stamps or payment for required postage)
4 Proof of ownership of property by petitioner(s), such as deed or purchase contract agreement.
If an agent is submitting the petition. a notarized copy of a letter designating him as
such must accompany the petition.
5 Statement of special conditions, hardships or reasons justifying the requested exception or
variance Respond to the six (6) questions below (A-F) on a separate sheet (Please print or

A. That special conditions and circumstances exist which are peculiar to the land, structure
or building involved and which are not applicable to other lands, structures or buildings
in the same zoning district;
B That the special conditions and circumstances do not result from the actions of the
applicant;
C That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Ordinance to other lands, buildings or structures in the
same zoning district;
D That literal interpretation of the provisions of this chapter would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the terms
of the Ordinance and would work unnecessary and undue hardship on the applicant;
E. That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure,
F That the granting of the variance will be in harmony with the general intent and purpose
of this chapter and that such variance will not be injurious to the area involved or
otherwise detrimental to the public welfare
6 An application fee in the amount of $40000 plus postage, payable to the City of Boynton
Beach, must accompany a completed application The $40000 application fee covers a
request to vary one (1) section of the Code Seeking relief from more than one section of the
Code will require payment of $10000 for each additional Code section

The apphcant IS requesting vanance rehef from three (3) City of Boynton Beach Land
Development Regulations The property IS undergoing TRC sIte plan approval for a 286-
umt multI-famlly luxury rental commumty The exact vanance requests are as follows
1 Ch. 2, Sect 4. J.l Fences, hedges and walls shall not exceed SIX (6) feet m
height, above fi11lshed grade, m resldentzal zones, except that from the
buzldmg lme to the front lme the ma..r:lmum height shall be four (4) feet
The Bay Vista sIte plan includes a decoratIve wall along ItS US 1 frontage
PortIOns of that wall are eight (8) feet in heIght. ThiS request IS for a
vanance of four (4) feet from the Code reqUIrement.
2 Ch. 2, Sect. 5. G. 1.(2). For multlple-famlly dwellmgs, rooming and
boardmg houses, and commu11lty resldentzal homes mmimum front yard
setback IS 40 feet. The Bay Vista sIte plan includes several shade pavllIOn
structures that are proposed WIthin the front setback. These structures are
setback eIght feet from the front property line The other structures on sIte
are eIther outsIde the reqUIred setback line or perITlltted to encroach into
the setback. ThiS vanance request IS to permIt these pavlhons to encroach
into the front setback.

spaces for the exclUSive use of the clubhouse The request IS for a
vanance of 27 spaces

as Vanance #1, Vanance #2, and Vanance #3

the requested exception or variance. Respond to the six (6) questions below (A-F)
A. That speczal conditIOns and circumstances exist which are peculzar to the land,
structure or buzldmg mvolved and which are not applzcable to other lands, structures or
bUildings in the same Z011lng district.
SpeCIal condItIOns and circumstances do eXIst WhIch are pecuhar to the land involved and
which are not apphcable to other lands ThIS sIte IS generally square WIth a 3 5 acre
mangrove that WIll be preserved by the developer ThIS preserve area essentIally bisects
the sIte ThIS umque CIrcumstance dIrectly effects the layout of the clubhouse locatIOn.
The recreatIOn bUIldmg or "clubhouse" for thIS housmg development IS located adjacent
to the Intercoastal Waterway and the mangrove/natural area for aesthetIc purposes.
SectIOn 11.H.12.a of the off-street parkmg chapter permIts a reductIon m parkIng
reqUIrements for housmg development recreatIOn bUIldmgs by allowmg, "no parkmg
spaces reqUIred for all dwellIng umts wIthm a 500 foot radIUs" and a reductIOn of parkIng
reqUIrements at the rate of "one parkmg space reqUIred for every four dwellIng umts
wIthm a 500 to 800 foot radIUs However, due to the speCIal geographIC features of thiS
site (a mangrove preserve), the clubhouse IS located m the southeast comer of the site
The mangrove mtrudes mto the radll that the Code reqUIres to be used to detefffilne the
number of parkmg spaces reqUIred. Because of thIS there are very few umts WIthm the
500 foot radIUs and no housmg umts WIthm the 500 foot or 800 foot radll
Vanances #1 and #2 are necessary due to the umque CIrcumstances of the locatIOn of thiS
property Bay Vista's sole frontage IS located along US 1 In order to meet the mtent of
the developer's and the CIty of Boynton Beach's goal of creatmg a pedestnan fnendly
roadway with exceptIOnal architectural features, both of these vanances are necessary
The US 1 comdor has been recently renovated by the City of Boynton Beach with bnck
pavers, upgraded median landscapmg, and refurbished hardscape features ThIS
development mtends to further thIS theme wIth desIgner pedestnan paVIlIons and an
enhanced entrance feature mto the commumty Both of these Items reqUIre mmor
vanances to the Zomng Code Vanance #2 WIll pefffilt the applIcant to proVIde the publIc
with shelter from the elements close to the US 1 SIdewalk. It IS the umque locatIOn and
recent CIty mltIated Improvements along thIS comdor that make these vanances
necessary
Therefore, speCIal CIrcumstances do eXIst on thIS property that are peculIar to thIS
property and are not applIcable to other lands m the same zomng dlstnct.
B That the special conduzons and circumstances do not result from the actzons of the
applzcant.
The speCIal condItIOns and CIrcumstances do not result from the actIOn of the applIcant.
The mangrove located on 25% of the property IS not a result of actIOns of the applIcant,
nor IS the upgrades that have been Implemented along US 1 There IS a great demand for
reSIdentIal developments on waterfront property, unfortunately there IS a very lImIted
supply of thIS land. Vanance #3 helps to ensure that the new development IS desIgned m
a way that prOVIdes all the reSidents of such a development a means to enJoy thIS pnzed
scenery It IS benefit to the commumty to have upscale waterfront housmg that preserves
eXlstmg wetlands and furthers the City sponsored Improvements along US 1
The subject SIte Will accomplIsh these goals by provIdmg a recreatIOn bUIldmglclubhouse
With a large sun deck as well as a boardwalk traversmg the length of the property dIrectly
adjacent to the Intracoastal Waterway In addItIOn, the enhanced entry feature WIth
pedestnan pavIhons WIll establIsh a precedent for future developments m the comdor
The eXIstmg mangrove and the newly designed Improvements along US 1 are not the
result of the applIcant, but these vanances are requested to ensure both are preserved and
enhanced.
C That granting of the variances requested would not confer on the applicant any
speclal privilege that lS denzed by thls ordmance to other lands, buildmgs or structures
in the same zonmg dlstrzct.
The grantmg of this vanance will not confer on the applIcant any special pnvIlege that IS
demed to other properties m the same zomng dlstnct. Vanance #3 IS reqUired because
other properties can benefit from SectiOn 11.H.12 whIch grants condommIUms and
housmg developments with recreatIonal bUildmgs the abIlIty to reduce the overall parkIng
reqUirements for the development. The mangrove that IS bemg preserved by the applIcant
precludes hIm from enJoymg thIS benefit. Rather than confemng a speCIal pnvIlege, thIS
will allow the applIcant the same pnvIleges as other developers.
Vanances #1 and #2 are necessary because of the recent upgrades that the City has
undertaken along thIS stretch of the US 1 comdor Other eXIstmg developments m thiS
area along thIS comdor have benefited from these Improvements, but have not had to
mcur the expenses that the applIcant wIll Future developers on thiS comdor wIll have to
meet the same hIgh standards bemg establIshed by thiS property
D That literal interpretatzon of the provlszons of this chapter would deprive the
applicant of rights commonly enjoyed by other propertles m the same zoning distnct
under the tenns of the ordmance and would work unnecessary and undue hardshlP on the
applzcant.
LIteral mterpretatiOn of the provlSlons of the Land Development RegulatiOns would
depnve the applIcant nghts enjoyed by other propertIes m the same zomng dIstnct
because thiS site must compensate for the peculIar CIrcumstances of the SIte If the
provlSlon of Vanance #3 were to be mterpreted literally, the clubhouse would have to
proVide over 35 additiOnal parkIng spaces above what IS necessary ThIS IS not desIrable
to the City, neIghborhood, or the developer As descnbed m Item 'A', the mangrove to
be preserved on SIte prevents the applIcant from takIng advantage of parkIng reductiOns
permItted m the Land Development RegulatiOns that other propertIes can enJoy LIteral
mterpretatiOn of the reqUirements of Vanance #2 would prevent the applIcant from bus
shelters adjacent to the sIdewalks Demal of Vanance #1 wIll prevent the applIcant from
provldmg a grand entrance that IS compatIble with the renovatiOns made to US 1 by the
City
The umque charactenstIcs of thIS SIte and ItS proximity on US 1 have created a situatIon
whereby the applIcant IS bemg depnved of nghts commonly enjoyed by other propertIes
E. That the varzance granted is the minimum varzance that wlll make posslble the
reasonable use of the land, buildmg or structure.
These vanances wIll make possIble the reasonable use of the land. Waterfront property
in the CIty of Boynton Beach IS very scarce In additIOn, the applIcant IS assembling SIX
separate parcels to be developed as one The indIVIdual parcels are not of a SIze that
would make multI-famIly development feasible These factors have resulted in an very
