Solid waste is not anticipated to increase significantly as a result of proposed expansion of facilities 4 UtilitIes, With reference to locatIOns, availability, and compatIbility The Utility Department comments have been incorporated, utilities are available and provided, consistent with Comprehensive Plan policies and city regulations 5 Screening, buffering and landscaping With reference to type, dimensIOns, and character The screening. buffering and landscaping will conform to the Code requirements after the Planning and Zoning Division s comments are incorporated The site is fully landscaped with palm (Palmetto and Coconut) tree (J.\1ahogany Live Oak and Gumbo Limbo) and shrub species, and properly maintained The property is enclosed by a six (6) foot high chain linkfence and a landscape buffer No new landscaping will be added except for required buffering around the dumpster 6 Signs, and proposed exterior lighting, WIth reference to glare, traffic safety, economic effect, and compatibIlity and harmony WIth adJacent and nearby propertIes No additional signs are proposed at this time No additional exterior lighting will be placed on site. 7 ReqUired setbacks and other open spaces. The site meets the setback requirements for the 1'1,1-1 zoning district. 8 General compatibility With adJacent property and other property In the zOnIng district. The proposed expansion offacilities has been preceded by the recent approval of the owner s request to amend the 1\1-1 zoning regulations to allow the existing use of the site, previously legal but nonconforming, to be a conditional use in M-1 The use, described as the cutting of sub-primal portions of meat and pre-cut poultry into serving portions. including packaging and shipping is generally compatible with the surrounding industrial uses. Visually the proposed addition has been designed to be compatible with the existing structures. Surface treatments and colors will be typical of industrial warehouse type facilities specifically the addition will receive a grey stucco base and a white stucco finish to match the existing buildings. 9 Height of bUilding and structures, With reference to compatibility and harmony to adJacent and nearby properties, and the City as a whole Berry Veal - COUS 00-003 Page 4 Memorandum No PZ 00-221 The ma.-cimum height of the one-story building addition will be 25 feet. The addition is within the ma.-cimum height requirement of 45 feet for the Af-1 zomng district. 10 Economic effects on adJacent and nearby properties, and the City as a whole Berry Veal Corporation has been in operation at the subject location since 1985 The addition of a large new storage/cool room area will allow the business to better serve its customers and thus increase its efficiency but overall economic effects of the proposed expansion on adjacent and nearby properties, and the city (marginal tax impact) will be negligible. The operation, as witnessed by staff is very clean and in strict compliance with the federal control regulations, enforced by a resident USDA inspector so no negative impacts will be generated I I Conformance to the standards and reqUirements which apply to site plans, as set forth m Chapter 19, Article II of the CIty of Boynton Beach Code of Ordmances. (Part III Chapter 4 SIte Plan ReView) With incorporation of staff comments, the proposed project will comply with all requirements of applicable sections of city code. 12. Compliance WIth, and abatement of nUisances and hazards m accordance WIth the performance standards wlthm SectIon 4 of the zonmg regulations; also, conformance to the City of Boynton Beach NOise Control Ordmance. With incorporation of all conditions contained herein, the use would operate in a manner that is in compliance with the above-referenced codes and ordinances of the City of Boynton Beach. The recently approved amendment to the M-l zoning district regulatIOns allows the eXIstmg use of the Site, previously legal but non-conformmg, to be a conditIOnal use for M-l The use IS described as "the cuttmg of sub-primal portions of meat and pre-cut poultry mto servmg portIOns, mcludmg packagmg and shIppmg" Berry Veal has been operatmg m the CIty smce 1985 It IS m full compliance With federal control regulatIOns, which IS momtored dally by a reSIdent USDA mspector Staff VISIted the site and witnessed cleanliness of the operatIOn. Moreover, m compliance With Chapter 2, SectIon 8.A.3, of Land Development RegulatIOns, the mtenslficatIOn of the eXlstmg use will require that the applicant completes the EnVironmental ReView process and obtains the EnVironmental ReView permIt. The site plan exceeds this requirement. There are currently thirty-four (34) parking spaces on the property including tlVo (2) designated as handicapped- accessible, and two (2) loading spaces. No new parking spaces will be added. The proposed project will not increase the intensity of parking or promote additional glare, noise or odors. 3 Refuse and servIce areas, WIth particular reference to the Items In subsection 1 and 2 above. The roll-out refuse containers are provided by the city and trash is removed on a standard schedule. Solid waste is not anticipated to increase significantly as a result of proposed expansion of facilities. 4 UtilitIes, wIth reference to locations, availability, and compatibIlIty The Utility Department comments have been incorporated, utilities are available and provided, consistent with Comprehensive Plan policies and city regulations. 5 Screening, buffering and landscaping WIth reference to type, dimenSIOns, and character The screening, buffering and landscaping will conform to the Code requirements after the Planning and Zoning Division s comments are incorporated. The site is fully landscaped with palm (Palmetto and Coconut), tree (Mahogany Live Oak and Gumbo Limbo) and shrub species, and properly maintained. The property is enclosed by a six (6) foot high chain linkfence and a landscape buffer No new landscaping will be added except for required buffering around the dumpster 6 SIgns, and proposed extenor lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adJacent and nearby propertIes No additional signs are proposed at this time No additional exterior lighting will be placed on site. 7 ReqUIred setbacks and other open spaces. The site meets the setback requirements for the M-J zoning district. 8 General compatibIlity wIth adJacent property and other property In the zomng distrIct. The proposed expansion of facilities has been preceded by the recent approval of the owner s request to amend the M-J zoning regulations to allow the existing use of the site, previously legal but nonconforming, to be a conditional use in M-J The use, described as the cutting of sub-primal portions of meat and pre-cut poultry into serving portions, including packaging and shipping is generally compatible with the surrounding industrial uses. Visually the proposed addition has been designed to be compatible with the existing structures. Surface treatments and colors will be typical of industrial warehouse type facilities, specifically the addition will receive a grey stucco base and a white stucco finish to match the existing buildings. 9 HeIght of building and structures, wIth reference to compatibIlIty and harmony to adJacent and nearby properties, and the CIty as a whole. The addition is within the maximum height requirement of 45 feet for the M-1 zoning district. 10 Economic effects on adjacent and nearby properties, and the city as a whole. Berry Veal Corporation has been in operation at the subject location since 1985 The addition of a large new storage/cool room area will allow the business to better serve its customers and thus increase its efficiency but overall economic effects of the proposed expansion on adjacent and nearby properties, and the city (marginal tax impact) will be negligible. The operation, as witnessed by staff is very clean and in strict compliance with the federal control regulations, enforced by a resident USDA inspector so no negative impacts will be generated. 11 Conformance to the standards and requirements which apply to SIte plans, as set forth in Chapter 19, Article II of the CIty of Boynton Beach Code of Ordmances.
