PROPOSAL SUMMARY
Contained herein IS a descnptIOn of the subject project The site IS sItuated on 1.34 acres of prevIOusly developed
property, zoned M-l, Industrial Dlstnct, and located at 1421 Neptune Dnve On site there IS currently one, one-
story building; the site IS fully landscaped and enclosed by a SIX (6) foot hIgh chain link fence and a landscape
buffer The applicant proposes to add 4,050 square feet of warehOUSing/cold storage space to the eXIsting faCIlity

SectIOn 11.2.D of the Land Development RegulatIOns contams the followmg standards to which condItIonal uses
are reqUired to conform Followmg each of these standards IS the Plannmg and Zonmg DIvISIOn's evaluatIOn of the
applicatIOn as It pertams to standards.
The Plannmg and Development Board and City CommiSSIOn shall conSider only such condItIonal uses as are
authonzed under the terms of these zoning regulations and, m connectIOn therewIth, may grant conditIonal uses
absolutely or condItIOned upon the condItIOns mcludmg, but not limited to, the dedication of property for streets,
alleys, recreatIOn space and Sidewalks, as shall be determmed necessary for the protectIOn of the surroundmg area
and the citizens' general welfare, or deny condItIOnal uses when not In harmony With the mtent and purpose of thIS
sectIOn. In evaluatmg an applicatIOn for condItIOnal use, the Board and CommiSSIOn shall conSider the effect of the
proposed use on the general health, safety and welfare of the commumty and make written findings certIfymg that
satIsfactory proviSIons have been made concernmg the followmg standards, where applicable.
Ingress and egress to the subJect property and proposed structures thereon, With particular reference to
automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or
catastrophe
The subject property has two (2) points of ingress and egress located on Neptune Drive. The proposed
expansion of facilities will not involve changes in the number of ingress/egress points or significant
changes in volumes of pedestrian and automobile traffic in the neighborhood Traffic circulation on site
will meet the requirements for emergency access after the Building Department comments are
incorporated
2. Off-street parkmg and loadmg areas where reqUired, With particular attention to the Items m subsectIOn 1
above, and the economiC, glare, nOise, and odor effects the conditIOnal use will have on adjacent and nearby
properties, and the CIty as a whole

Required parking is calculated to be twenty-six (26) spaces, based on square footage of the different
components within the proposed use. The site plan exceeds this requirement. There are currently thirty-four
(34) parking spaces on the property including two (2) designated as handIcapped- accessible, and tll-'O (2)
loading spaces No new parking
spaces will be added The proposed project wIll not mcrease the intensIty of parking or promote additional
glare. noise or odors.
3 Refuse and service areas, With particular reference to the Items In subsectIOn I and 2 above
The roll-out refuse containers are provided by the city and trash is removed on a standard schedule. Solid
waste is not anticipated to increase significantly as a result of proposed expansion of facilities
4 UtilitIes, With reference to locatIOns, availability, and compatIbility
The Utility Department comments have been incorporated, utilities are available and provided, consistent with
Comprehensive Plan policies and city regulations
5 Screening, buffering and landscaping With reference to type, dimensIOns, and character
The screening. buffering and landscaping will conform to the Code requirements after the Planning and
Zoning Division s comments are incorporated The site is fully landscaped with palm (Palmetto and
Coconut) tree (J.\1ahogany Live Oak and Gumbo Limbo) and shrub species, and properly maintained The
property is enclosed by a six (6) foot high chain linkfence and a landscape buffer No new landscaping will
be added except for required buffering around the dumpster
6 Signs, and proposed exterior lighting, WIth reference to glare, traffic safety, economic effect, and compatibIlity
and harmony WIth adJacent and nearby propertIes
No additional signs are proposed at this time No additional exterior lighting will be placed on site.
7 ReqUired setbacks and other open spaces.
The site meets the setback requirements for the 1'1,1-1 zoning district.
8 General compatibility With adJacent property and other property In the zOnIng district.
The proposed expansion offacilities has been preceded by the recent approval of the owner s request to amend
the 1\1-1 zoning regulations to allow the existing use of the site, previously legal but nonconforming, to be a
conditional use in M-1 The use, described as the cutting of sub-primal portions of meat and pre-cut poultry
into serving portions. including packaging and shipping is generally compatible with the surrounding
industrial uses. Visually the proposed addition has been designed to be compatible with the existing structures.
Surface treatments and colors will be typical of industrial warehouse type facilities specifically the addition
will receive a grey stucco base and a white stucco finish to match the existing buildings.
9 Height of bUilding and structures, With reference to compatibility and harmony to adJacent and nearby
properties, and the City as a whole

The ma.-cimum height of the one-story building addition will be 25 feet. The addition is within the ma.-cimum
height requirement of 45 feet for the Af-1 zomng district.
10 Economic effects on adJacent and nearby properties, and the City as a whole
Berry Veal Corporation has been in operation at the subject location since 1985 The addition of a large
new storage/cool room area will allow the business to better serve its customers and thus increase its
efficiency but overall economic effects of the proposed expansion on adjacent and nearby properties, and
the city (marginal tax impact) will be negligible. The operation, as witnessed by staff is very clean and in
strict compliance with the federal control regulations, enforced by a resident USDA inspector so no
negative impacts will be generated
I I Conformance to the standards and reqUirements which apply to site plans, as set forth m Chapter 19, Article II
of the CIty of Boynton Beach Code of Ordmances. (Part III Chapter 4 SIte Plan ReView)
With incorporation of staff comments, the proposed project will comply with all requirements of applicable
sections of city code.
12. Compliance WIth, and abatement of nUisances and hazards m accordance WIth the performance standards wlthm
SectIon 4 of the zonmg regulations; also, conformance to the City of Boynton Beach NOise Control Ordmance.
With incorporation of all conditions contained herein, the use would operate in a manner that is in compliance
with the above-referenced codes and ordinances of the City of Boynton Beach.
RECOMMENDATION
Jaime M. Plana, the applicant for the owner, Berry Veal CorporatIon, IS requestmg conditIOnal use and maJor site
plan modificatIOn approval to construct a 4,050 square foot bUilding additIOn to a meat cuttmg and packagmg
bUSiness. The recently approved amendment to the M-l zoning district regulatIOns allows the eXIstmg use of the
Site, previously legal but non-conformmg, to be a conditIOnal use for M-l The use IS described as "the cuttmg of
sub-primal portions of meat and pre-cut poultry mto servmg portIOns, mcludmg packagmg and shIppmg"
Berry Veal has been operatmg m the CIty smce 1985 It IS m full compliance With federal control regulatIOns, which
IS momtored dally by a reSIdent USDA mspector Staff VISIted the site and witnessed cleanliness of the operatIOn.
Moreover, m compliance With Chapter 2, SectIon 8.A.3, of Land Development RegulatIOns, the mtenslficatIOn of
the eXlstmg use will require that the applicant completes the EnVironmental ReView process and obtains the
EnVironmental ReView permIt.
Staff recommends that thiS request be approved contmgent upon satlsfymg all the conditIOns m Exhibit "C",
Includmg completIOn of the EnVironmental ReView process and submittal of the traffic statement, which has to be
reViewed for compliance With the Palm Beach County Traffic Performance Standards.

STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
Section 11.2.D of the Land Development RegulatIons containS the following standards to whIch condItIonal uses
are required to conform. FollOWing each of these standards is the PlannIng and ZOnIng DivisIOn's evaluatIOn of the
applicatIon as It pertains to standards.
The PlannIng and Development Board and CIty CommiSSIOn shall consider only such condItIonal uses as are
authonzed under the terms of these ZOnIng regulations and, In connectIOn therewIth, may grant condItional uses
absolutely or condItIOned upon the conditIOns including, but not lImIted to, the dedIcatIOn of property for streets,
alleys, recreatIOn space and SIdewalks, as shall be determined necessary for the protectIOn of the surroundmg area
and the cItIzens' general welfare, or deny condItIonal uses when not in harmony wIth the Intent and purpose of thIS
sectIOn. In evaluating an applicatIOn for condItional use, the Board and Commission shall consIder the effect of the
proposed use on the general health, safety and welfare of the communIty and make wntten findings certIfymg that
satisfactory prOVlSlons have been made concerning the follOWing standards, where applicable
Ingress and egress to the subject property and proposed structures thereon, wIth partIcular reference to
automobile and pedestrIan safety and convenience, traffic flow and control, and access In case of fire or
catastrophe.
The subject property has two (2) points of ingress and egress located on Neptune Drive. The proposed
expansion of facilities will not involve changes in the number of ingress/egress points or significant
changes in volumes of pedestrian and automobile traffic in the neighborhood. Traffic circulation on site
will meet the requirements for emergency access after the Building Department comments are
incorporated.
2. Off-street parking and loading areas where reqUired, with partIcular attentIon to the items m subsectIOn 1
above, and the economIC, glare, nOIse, and odor effects the condItIonal use wIll have on adjacent and nearby
propertIes, and the CIty as a whole

Required parking is calculated to be tlVenty-six (26) spaces, based on square footage of the different
components within the proposed use. The site plan exceeds this requirement. There are currently thirty-four
(34) parking spaces on the property including tlVo (2) designated as handicapped- accessible, and two (2)
loading spaces. No new parking
spaces will be added. The proposed project will not increase the intensity of parking or promote additional
glare, noise or odors.
3 Refuse and servIce areas, WIth particular reference to the Items In subsection 1 and 2 above.
The roll-out refuse containers are provided by the city and trash is removed on a standard schedule. Solid
waste is not anticipated to increase significantly as a result of proposed expansion of facilities.
4 UtilitIes, wIth reference to locations, availability, and compatibIlIty
The Utility Department comments have been incorporated, utilities are available and provided, consistent with
Comprehensive Plan policies and city regulations.
5 Screening, buffering and landscaping WIth reference to type, dimenSIOns, and character
The screening, buffering and landscaping will conform to the Code requirements after the Planning and
Zoning Division s comments are incorporated. The site is fully landscaped with palm (Palmetto and
Coconut), tree (Mahogany Live Oak and Gumbo Limbo) and shrub species, and properly maintained. The
property is enclosed by a six (6) foot high chain linkfence and a landscape buffer No new landscaping will
be added except for required buffering around the dumpster
6 SIgns, and proposed extenor lighting, with reference to glare, traffic safety, economic effect, and compatibility
and harmony with adJacent and nearby propertIes
No additional signs are proposed at this time No additional exterior lighting will be placed on site.
7 ReqUIred setbacks and other open spaces.
The site meets the setback requirements for the M-J zoning district.
8 General compatibIlity wIth adJacent property and other property In the zomng distrIct.
The proposed expansion of facilities has been preceded by the recent approval of the owner s request to amend
the M-J zoning regulations to allow the existing use of the site, previously legal but nonconforming, to be a
conditional use in M-J The use, described as the cutting of sub-primal portions of meat and pre-cut poultry
into serving portions, including packaging and shipping is generally compatible with the surrounding
industrial uses. Visually the proposed addition has been designed to be compatible with the existing structures.
Surface treatments and colors will be typical of industrial warehouse type facilities, specifically the addition
will receive a grey stucco base and a white stucco finish to match the existing buildings.

The maximum height of the one-story building addition will be 25 feet. The addition is within the maximum
height requirement of 45 feet for the M-1 zoning district.
10 Economic effects on adjacent and nearby properties, and the city as a whole.
Berry Veal Corporation has been in operation at the subject location since 1985 The addition of a large
new storage/cool room area will allow the business to better serve its customers and thus increase its
efficiency but overall economic effects of the proposed expansion on adjacent and nearby properties, and
the city (marginal tax impact) will be negligible. The operation, as witnessed by staff is very clean and in
strict compliance with the federal control regulations, enforced by a resident USDA inspector so no
negative impacts will be generated.
11 Conformance to the standards and requirements which apply to SIte plans, as set forth in Chapter 19, Article II
of the CIty of Boynton Beach Code of Ordmances. (Part III Chapter 4 SIte Plan ReVIew)
With incorporation of staff comments, the proposed project will comply with all requirements of applicable
sections of city code.
12 Compliance with, and abatement of nUisances and hazards In accordance with the performance standards wIthm
SectIOn 4 of the zOning regulations; also, conformance to the CIty of Boynton Beach NOIse Control Ordmance
With incorporation of all conditions contained herein, the use would operate in a manner that is in compliance
with the above-referenced codes and ordinances of the City of Boynton Beach.
RECOMMENDATION
JaIme M. Plana, the applicant for the owner, Berry Veal CorporatIOn, IS requesting condItIonal use and maJor SIte
plan modIfication approval to construct a 4,050 square foot buildmg addition to a meat cuttmg and packaging
busmess. The recently approved amendment to the M-1 ZOnIng district regulations allows the existing use of the
SIte, preVIOusly legal but non-conforming, to be a condItIonal use for M-l The use IS described as "the cutting of
sub-pnmal portIOns of meat and pre-cut poultry mto servmg portIOns, including packagmg and shIppmg"
Berry Veal has been operating in the CIty since 1985 It IS m full compliance WIth federal control regulatIons, WhICh
IS monitored daIly by a resident USDA mspector Staff VISIted the site and wItnessed cleanliness of the operatIOn.
Moreover, m compliance with Chapter 2, Section 8.A.3, of Land Development RegulatIOns, the intensIfication of
the eXIsting use will reqUire that the applIcant completes the EnVIronmental ReVIew process and obtainS the
EnVIronmental ReVIew permIt.
Staff recommends that thIS request be approved contingent upon satIsfying all the conditions In Exhibit "C",
including completIon of the EnVironmental ReVIew process and submIttal of the traffic statement, whIch has to be
reviewed for compliance WIth the Palm Beach County Traffic Performance Standards.

WHEREAS, the City Commission of the City of Boynton Beach, Florida
has determined that it is in the best interests of the citizens and residents of the
City to amend certain sections of the Code of Ordinances to allow as a
conditional use the cutting of sub-primal portions of meat and pre-cut poultry
into serving portions, including packaging and shipping, and to clarify the list of
prohibited uses, and
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Chapter 2, Zoning, Section 8.AA e. is hereby amended by
adding the words and figures in underlined type, and by deleting the words and
figures in struck-through type, as follows
8.A. 4 (e) Cutting of sub-primal portions of meat and pre-cut poultry into
serving portions including oackaging and shipping where pre-cut portions
(entering the facility) will not exceed 10 oounds and waste generated will not
exceed 1 % of ore-cut oroduct.
Section 2. Chapter 2, Zoning, Section 8.A.S.a(S) is hereby amended by
adding the words and figures in underlined type, and by deleting the words and
figures in struck-through type, as follows
