ISSUE
Can CarMax build pursuant to humcane standards in effect at the time of site plan
approval or must CarMax build according to standards m effect at the time of
permltting?
SHORT ANSWER. CarMax must comply with the Hurricane Standards of the Standard
Building Code that are m effect at the time of permltting.
FACTS
On November 19, 1996, the site plan for CarMax at Quantum Park was approved by the
City of Boynton Beach City COmmlssion. At that meetmg, the representative for the developer
questioned the status of the pending LDR reVisions, and Tambri Heyden, Planning and Zoning
Director mdicated that the premises could be constructed according to the LDR proviSIOns in
effect at the time the site plan was approved.
In the meantime, through information received from Actmg DITector of Development, AI
Newbold, in October, 1996, the Humcane Standards as set forth m the Standard Building Code
were amended effective January 1, 1997
On or about January 15, 1997, the developer attempts to obtam pefmlt(s), and the
Development Department informs the developer that it must comply with the Standard Building
Code, as It eXists at the time of permltting.
On January 21, 1997, the amendments to the Land Development RegulatIons are adopted
by the City of Boynton Beach.
DISCUSSION
Section 553 73, Flonda Statutes requITes each local government to adopt one of the State
minimum building codes as its building code. ThIs code shall govern the construction, alteration,
repair or demolition of any building for which the local government has building constructIon
regulation responsibility The City of Boynton Beach has adopted the Standard Building Code,
1991 Edition, as amended from time to time. See Part III, Chapter 20, Article 1, Section 3 of the
City of Boynton Beach Code of Ordinances. Sections 553 79(2), Flonda Statutes further requITes
that the City's Department of Development must be able to certify compliance With the Standard
Building Code before a permlt IS Issued.
As one can discern from eXaIDlmng the chronology above, the LDR reviSions were not
adopted until after CarMax applied for the permit, and accordmgly, would not apply to CarMax.
However, the amendments to the Standard Building Code regarding hurricane construction
standards were not part of the LDR reViSions. The City, through Ordinance 96-40, effective
September 4, 1996, adopted the amendments to the Standard Building Code, and included therein
are the humcane standards at issue.
Accordingly, the more stnngent hurricane standards had already been adopted by the City
and were not part of the City's reViSion of portlOns of ItS Land Development Regulations. Due to
the duties and responsibilities of the City's building department pursuant to state statutes, CarMax
must comply With the hum cane construction standards m effect at the time of application for
permIt.

In reVIew of the Development Order and the CommISSIOn Meetmg Minutes, no mentIOn IS made
pertaimng to the conSIderatIOn to allow parkmg configuratIOns to deVIate from the standards
establIshed m the Land Development RegulatIOns. Comments regardmg these Issues have been
forwarded to the applIcant WIth no response to date ThIS matter wIll prevent us from ISSUIng
permIts untIl resolved.
I have been mformed by staff that your pOSItIOn relates to the fact that smce the parkmg
configuratIOn m questIOn IS for "storage" of vehIcles and not publIc parkmg, It should not have to
comply WIth LDR Standards. That questIOn was raIsed at a TRC meetmg and objected to by
Development DIrector HukIll. Furthermore, Chapter 23, SectIOn 4 ofthe LDR states that all
areas for parkmg or storage must meet mmImum CIty reqUIrements.
Surely, If such Code provlSlons are to be amended for thIS project, that actIOn must be taken by
the CIty CommISSIon as per Chapter 23, SectIOn 2 of the LDR, after presentatIOn and
deliberatIOn.
If the plan as shown has ment, I strongly suggest that we meet WIth the CIty Manager to
determme a course of actIOn m thIS regard.

The following is a list of comments and recommendations regarding the second review
of the above-referenced project. It should be noted that the comments and
recommendations identify unresolved issues either from the first review or new
problems that have emerged as a result of the second review
All comments and recommendations can be rectified on the plans at time of permitting if
the site plan request is approved The applicant must understand that additional
comments may be generated upon review of the documents and working drawings
submitted to the Building Division for permits for the proposed project.
SITE PLAN REVIEW COMMENTS
1 Off-street parking requirement for PID zoned properties is one and one-half
(1 1/2) parking spaces for each two (2) employees on a maximum shift. In
addition, visitor parking adequate to serve the needs of the dealership operation
needs to be provided The submitted site plan contains calculation based on
square footage of the building Amend the parking calculations appropriately
2 Modify the site monument signs to comply with the master sign program or
process a separate site plan approval request to modify the approved sign
program. Place a note on the plan indicating that all signs located on the site will
require a separate site plan approval
3 Provide elevations of the building showing the roof top equipment and the
required screening (all reduced to a small scale) and draw in on these elevations
the lines-of-sight connecting the highest point of the equipment with the eye level
from a distance of 600 hundred feet from the building

approval process has been followed on the recent site plan approvals within the
Quantum projects The administrative approval is only requested when the wall
signage is shown on the submitted plans, as it is the case with the Carmax
submittal

masonry wall painted on both sides at least six (6) feet in height shall be
located within the required side and/or rear yards except with respect to
comer lots, said buffer walls shall be required only on interior lot lines.
Said buffer walls shall not abridge any easement rights or be constructed
over any existing utilities in any easement area and shall be set back two
(2) feet from adjoining property lines. "
Provide a buffer wall as required, or submit to the Planning and Zoning
Department a zoning variance application from this requirement.

unacceptable to the PublIc Works Department for the follOWIng reasons
A) The entrance way to the dumpster IS shown to be fifteen feet wide, with two
way traffic ThIS would not allow our truck and another vehicle to pass In the
alley
B) There IS no room for the truck to turn around which means the truck would
have to back down a narrow alley that's 140 feet long through a control gate,
thIS IS not acceptable

The following is a list of 1 st review comments regarding the site plan review of the plans
for the above-referenced project. The applicant shall understand that all documents and
plans submitted for site plan review are subject to additional comments. I recommend that
the applicant/agent contact me regarding questions related to the comments If the
applicant is not intending to correct code deficiencies, he should contact me regarding the
procedures, application forms, fees and submittal deadline dates for seeking relief from the
code requirement.
1 The minimum width of the two-way driveway is 20 feet. The proposed east-west
driveway to the dumpster area is only 15 feet in width Increase the driveway width
to meet the city's required design standard for the width of two-way driveways
2 Indicate traffic control markings within the entire vehicular use area as required by
LOR, Chapter 4 - Site Plan, Section 7 8.2
3 Delineate a traffic turn-around from the area between the presentation lanes and
the service area
4 Proposed signs must meet the setback requirements of 10 feet (provide necessary
dimensions) Also, provide elevation drawings of the signs and specify their height,
size and colors The proposed signage requires a submittal of a revised master sign
program for the Quantum Park PID If the latter is not approved prior to this site
plan being forwarded to the Commission, it is recommended that the signs be
deleted and submitted at permitting for review administratively provide they comply
with the approved revised master sign program
5 Any roof top equipment will have to be screened from view at a distance of 600 feet.
If such equipment is planned, indicate its location and the height of the equipment
above the roof level Provide elevations of the structure showing the roof top
equipment and the required screening (all reduced to a small scale) and draw in on
these elevations the lines-of-sight connecting the highest point of the equipment
with eye level from a distance of 600 hundred feet from the building
6 Parking spaces located on the sales lot area do not comply with the City's design
standards Redesign the parking within this area to comply with the code If it is not
a parking lot, then it is a storage lot and must comply with the maximum of 15
percent of lot area permitted for outside storage areas in PIDs
7 Dumpster and service areas have to meet design standards as described in LOR,
Chapter 75, Article II, Section 5 J , and Chapter 9, Section 10 C Amend the
drawings to meet the requirements

8 Chapter 2 of the LDR - Zoning, Section 7 D requires that all parcels/lots being
developed as one project within the PID zoning district shall be under the control
of the applicant. Provide a unity of title for the lots being assembled in connection
with the development of the site plan (Forms are available in the Building Division)
9 On the Landscape Plan, Sheet 11 of 14, amend the tabular summary ofthe planting
material to include a "landscape material required by the code" category Also,
provide relevant calculations for this category For the landscape buffer adjacent
to the right-of way, provide perimeter distances of the parcel for which the
landscape buffer material is being calculated
10 Incorporate the above calculation into the tabulation of the landscape material
provided for the site All native species shall be distinguished from non-native
species with a recognizable symbol
11 Indicate the spacing proposed for trees and shrubs Note that the required trees in
landscape buffers adjacent to right-of-ways shall be spaced a maximum of
40 feet 0 c.
12 Remove trees, other than palms, from utility easements
13 A continuous hedge shall be provided in all landscape buffers adjacent to rights-of
way A part of the buffer along the eastern property line, just behind the Quantum
Corporate Park sign, is missing
14 Provide an access and maintenance easement from the Carmax property to the
existing Quantum Corporate Park sign
15 Lot 77 is abutting a residential district to the east. The width of the landscape buffer
on this lot shall be increased to 40 feet. Increase the width of the buffer as required
by the code or submit an application to the Board of Zoning Appeals for a variance
from this requirement. On the Landscape Plan, Sheet 11 of 14, how proposed
landscape material within the required peripheral greenbelt.
16 Although the PID greenbelt plans application has yet to be formally submitted for
staff to comment, it is recommended that the greenbelt landscaping shown on the
Carmax drawings be supplemented to include a more substantial amount of
planting The landscaping proposed satisfies merely the landscape code
requirements for parking lots
17 With respect to environmental review' a) revise pages 3 and 4 of the application to
include MSDS (material safety data sheets) for all chemicals used and stored on
site and the quantities, b) provide further detail regarding references on the
application to "a normal auto dealership" and c) show on the site plan resubmittal
the location of the bulk storage of tires (new and used), all chemicals used and
stored (to be provided in a containment area separate from the rest of the
operations for safety reasons) and the proposed spray booth
18 According to the development order for Quantum Park PID dated July 2, 1996,
comment number 6, the loading/unloading area and the staging are combined
together are considered to be an exterior storage area and limited to no more than
15 percent of the total size of the site Provide relevant calculations indicating that
the combined staging and loading/unloading areas do not exceed 15 percent of the
total site acreage

19 Provide a detail drawing of a vinyl clad woven mesh fence to determine whether it
meets the intent of the Planning and Development Board's condition of a 6 foot tall

project stays on line with the review time frame, I request that the plans and exhibits be
reviewed and formal written comments transmitted to the Director of the Planning and
Zoning Department no later than 5:00 P.M. on September 13. 1996. Do not return plans

Adhering to the following review guidelines will promote a comprehensive review and enable
the applicant to efficiently obtain Technical Review Committee approval
1 Use the review standards specified in Part III, Land Development Regulations, Chapter
4, Site Plan Review, Section 8 of the Code of Ordinances to review and formulate
comments
2 The documents submitted for the project were determined to be substantially complete
based on the submittal requirements identified in Section 7 of the Site Plan Review
Ordinance However, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards
or the documents show code deficiencies, additional data and/or corrections should be
requested by the reviewer through the Planning and Zoning Department.
3 Each comment shall reference the section of the code that is incorrectly depicted on the
documents
4 Technical Review Committee member(s) shall identify in their comments when the plans
depict or when the location and installation of their departmental required improvements
may conflict with other departmental improvements
5 When a TRC Member finds a code deficiency that is outside of his/her review
responsibility, the comment and the specific code section may be included in their review
comments with the name of the appropriate TRC Member that is responsible for the review

Zoning Department for distribution to the applicant. Please include the name and phone number
of the reviewer on this memo Jerzy Lewicki will be the Planning and Zoning Department staff

The Planning and Zoning Department will send the applicant a cover letter which includes the
comment(s) and directions to amend the plans to comply with the comments and the procedures
