The undersi~ed hereby petitions the Planning and Zoning Board to
grant to the petitioner a variance to Article X "Parking Lots"
of Chapter 5, "Building, Housing and Construction Regulations";
of the code.of Ordinances of the City of Boynton Beach, Florida,
as it perta1ns to the property described in this application, and
for the reasons stated below:

Parking lots shall be designed to meet or exceed the
dimensional requirements for stalls, driveways and access aisles as

GENERAL INFORMATION FOR APPLICATIONS FOR
VARIANCES TO PARKING LOT REGULATIONS

All applications for variances to the Parking Lot
Regulations must be received and accepted by the Planning
Department at least six (6) weeks prior to the regular
meeting of the Planning and Zoning Board.
A1l variances which are requested in connection with the
construction of reconstruction of a particular parking lot
are covered by an application and filing fee (consult City
of Boynton Beach Land Development Fee Schedule). A separate
appl~cation must be completed for each specific design
requ~rement (Sec. 5-142) or permit application requirement
(Sec. 5-144) to Which a variance is requested (see note at
bot tom of page two).

An application for a variance may be processed at the same
time that an application for site plan approval or approval
of subdivision construction plans is submitted. However,
submittal deadlines vary for different applications.
Contact the Planning Department for further details.
All parking lot variance applications are reviewed by the
Technical Review Board (TRB) which consists of the
department heads or designated representatives of those city
departments concerned with land development. The TRB may
recommend to the Planning and Zoning Board that the variance
request be approved, approved with modifications, or denied.
The applicant is not required to attend the TRB meeting.
The applicant will be notified as to the modifications
recommended by the TRB. The applicant should be prepared to
respond to all TRB recommendations at the bearing before the
Planning and Zoning Board. A copy of the staff report and
recommendation is available from the Planning Department
prior to the Planning and zoning Board meeting.
All applications for var.iances are advertised for a public
hearing in a newspaper of general circulation. If possible,
the public hearing will be scheduled for the same Planning
and Zoning Board meeting that the site plan or subdivision
constructions plans are reviewed. At the public hearing
before the Planning and zoning Board, any person may comment
favorably or unfavorably on the variance request. The
applicant or his agent must attend the meeting.
The Planning and zoning Board gives final approva~ or denial
to parking lot variances, except those which are approved or
denied by less than a unanLmous vote of the entire Board, in
which case the app~ication ahall be forwarded to the City
commission for final disposition. The Planning and Zoning
Board or City commission may approve, approve with
modifications, or deny such variances.
Pr~or to obca~Ding a b~lding pe~it, all modifications
required by the ~1anning ~ Zoning Boar4 must be shown on
the site plan or subdivision construction plans.
A11 app~icant. with approved aite plans or subdivision
construction p1ans, or approved parking lot variances, which
at a later date request an additional variance, or variance
modifioation, will be required to submit a complete variance
applioation and filing fee, and will be s~j~ct to all Code
requirements in effect at the t~e the add~t~onal variance
is requested.
