ABANDONING A CERTAIN UTILITY EASEMENT,
LOCATED ON LOT 47-B IN QUANTUM PARK, SAID
PROPERTY BEING MORE PARTICULARLY
DESCRIBED HEREIN, AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER FOR
SAID ABANDONMENT, PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA, PROVIDING AN EFFECTIVE DATE
WHEREAS, the applicant, Spring Engineering, agent for First Eagle
Developments, Inc., the property contract purchaser, has requested abandonment
of a utility easement, located on Lot 47-B in Quantum Park, and
WHEREAS, comments have been solicited from the appropriate City
Departments, and
WHEREAS, public hearings have been held before the City's Planning and
Zoning Board and the City Commission on the proposed abandonment, and
WHEREAS, based on the foregoing information, the said easement no

According to the Assistant to the City Manager's agenda memorandum, this year's
actuarial review will involve the determination of and estimate of the ultimate value of
losses and loss adjustment expenses incurred by the City as of September 30, 1996 for
each of the City's self-insured coverages. Based upon these estimates of ultimate losses
and expenses, Ernst & Young will determine the required reserves. An actuarial report will
be issued that will satisfy GASB 10 documentation requirements. Staff recommended
approval of Ernst & Young LLP to conduct an actuarial study on the City's self-insured
coverages and determine reserve funding at a cost of $14,000, inclusive

City Manager Parker advised that the applicant will not be present, but is in agreement with staff's
comments contained in the back-up. Mayor Taylor also confirmed that the applicant contacted him
by telephone today to apologize for not being able to be present.
Motion
Vice Mayor Jaskiewicz moved to approve the request to abandon a 15' wide utility easement located
in the western part of Lot 47B of Quantum Park subject to all staff comments. Commissioner
Bradley seconded the motion which carried unanimously
VII PUBLIC AUDIENCE.
Scott Ganza. 709 Buttonwood Lane, is a member of the Sandalwood Homeowners' Association.
He explained that when one of the children in his community ran out into Miner Road today, it made
him realize that because of the extension, Miner Road will become even more busy than it is now
There will be even less protection for the children because there is no buffer between the sidewalk
and the roadway He requested that the City install a hedge to create a buffer to keep the children
out of the road.
Mayor Taylor explained that Miner Road is a County road. He suggested that Mr Ganza ask the
County to install hedges even though he knows from prior experience that they do not do this.
James Miriana. 728 HE 8 Avenue, said he has appeared at several meetings to discuss the water
flooding problem on NE 7th Street from NE 7th Avenue to NE 9th Avenue. He said that over the
past weekend, he watched the Intracoastal flowing on 7th Street. It was necessary for him to wear
boots to walk up the street. Something needs to be done, and no one in the City does anything to
correct this situation. He has had Code Enforcement and the Engineering Department look at the
situation.

this Item Mr Lelonek said he will be submitting something to the City within the next two
weeks and he will get something in writing requesting a postponement within the next
couple of days Mr Haag asked him if there is going to be change in configuration where
