DESCRIPTION This is a request for relief from Article II -
Landscape Code, Section 7 5-35 (e) to omit landscaping along an
interior lot line used for vehicular use, located on the east side
of High Ridge Road and 460 feet north of Gateway Boulevard, within
Quantum Park, submitted by Joe Handley, Craven Thompson &
Associates, agent for the Tri-County Commuter Rail Authority
RECOMMENDATION The planning and Development Board, with a 7-0
vote, recommended approval of this request, subj ect to staff
comments, installation of the landscaping shown on the proposed
plan within Exhibit "B" of Planning and zoning Department

NATURE OF REQUEST
Joe Handley of Craven Thompson & Associates, agent for the Tri-
County Commuter Rail Authority, is requesting approval to appeal
Article II, Section 7 5-35 (e), of the landscape code regarding
vehicle use area screening This request is in connection with
concurrent site plan approval for Tri-Rail' s proposed parking
facility and renovation to the existing Tri-Rail Station site (see
attached location map)
BACKGROUND
Article II, Section 7 5-35(e) of the landscape code requires
perimeter landscaping between vehicle use areas and abutting
properties The purpose of this section is to provide visual
screening, from abutting properties, of vehicles in vehicular use
areas Vehicular use areas include not only parking spaces, but
also access aisles and driveways Mr Handley is requesting relief
from this requirement where the parking facility and sidewalks
cross the east property line (see Exhibit "A" - applicant's letter
of request)
ANALYSIS
The property abutting the east property line of the proposed
parking facility is the existing Tri-Rail station which is being
renovated The renovation includes the installation of trees,
shrubs and ground cover This landscaping will be installed
between the Tri-Rail station and the east side of the proposed
parking facility (see Exhibit "B" - landscape plan showing the
material proposed for the Tri-Rail station site)
Properties that are under common ownership that are unified by
physical improvements are normally required to be unified to create
one property If the new parking facility were to be unified with
the existing Tri-Rail station site, which will share driveways and
access aisles, a landscape appeal would not be needed because the
shared driveways and access aisles would not be vehicular use
areas that abut an adjacent property However, since the existing
station is located within the Seaboard Airline Railway right-of-way
and the proposed parking facility is located on a "true" parcel
within Quantum Park, the parcel would have to become right-of-way
or vice versa, which is not practicable Moreover, the right-of-
way and the parking facility will be owned and funded by somewhat
different agencies Therefore, Tri-Rail has stated that the right-
of-way and parking facility parcel cannot be unified in title

RECOMMENDATION
staff recommends approval of this appeal, subject to the
installation of the landscaping shown on the proposed plan within
Exhibit "B" The basis for this recommendation is due to the
impracticability of unity of title due to ownership and funding,
and oWing to the fact that the properties function as one site,
negating the need for screening along the interior property line

As agent for the owner, please accept this letter on their behalf as our
formal request for rehef from two reqUIrements of the Landscape Code
of Boynton Beach.
The first request IS regardIng the reqUIrement of a landscape stnp
between the vehicular use area and the property hne. The eastern
boundary of this site adJoIns the Southeast Flonda Rail Corndor In
which the actual Tn-Rail Station IS located. SInce these two properties
must function as one site and are owned by the same entity for all
practical purposes, we respectfully request that this site does not have to
prOVide the landscape stnp along the eastern boundary
The second request IS regardIng the reqUIrements of a penmeter hedge
and trees between the vehicular use area and property hne. Along the
north and northwest property lIne we are proVidIng a landscape buffer
With a mInimum Width of 40 feet This buffer consists of natural native
vegetation left Intact or transplanted from the InterIor of the site We
beheve that the eXistIng understory and transplanted pInes and oaks Will
prOVide the landscape screenmg Intended by the perImeter hedge and tree
reqUIrement. Also, the hedge and trees reqUIred along the eastern
property lIne cannot be prOVided due to the conditIOn deSCrIbed In the
first request of this letter In addition, even though the access parcells
Included m the site plan It IS held In separate ownership Therefore we
have prOVided the perImeter hedge and tree reqUIrement adjacent to our
southern property lIne (north Side of the access road) The area adjacent
to the southern Side of the access road would be landscaped when the
adjacent parcel IS developed.
