roundwater Monitoring Well
We have reviewed your request to abandon the on-site monitormg well, and determined that the well was
installed as part of City Development Order, for the purpose of establIshIng baseline information and also
for on-going monitonng
We request that the well be left in place, WIth proper modifications for bearing traffic, so that it may be
used to monitor the groundwater in the future The availabilIty of baseline data at that location makes the
well particularly valuable for determining the extent of any contaminatIon. We will require no additional
sampling from the well unless the potential for groundwater contaminatIOn occurs in the Park.

In response to our phone conversatlon on November 16.1995, concemini monitoring weJJ
#9, there is DO objection to discontinuing monitoring and plugging this well. However, this
well and monitoring wells 1-8 are being monitored in accordance with the city of Boynton
Beach's Developmem Order, Ordinance No 84-51. prior approval from the City ofBoymon
~ in this mattr:r, is m:ommeDded.
Also, the surface water management system was evaluated to determine if this site would
cause or contribute to a violation of state water quality standards. 1be results of the water
quality analyses provided to lhis District show no indication me surface water discharge
degrades the receiving waterS.
The recommendation is to discontinue surface water quality monitoring within the project
area, as speciflC'd in the above stated permit. This letter serves as notice that Special
Condition Number 19, water quality monitoring, has been satisfied. However. water quality
monitoring data may be required in the futuIe if water quality concerns arise.

The attached package will be presented to the Planning and
Development Board on April, 11, 1995 (see attached agenda) and then
to the City Commission the following week (April 18, 1995)
The applicant must understand that the permit plans shall be
amended to comply with the attached staff comments and that
addi tional comments may be generated by staff following their
review for technical compl iance of permit documents that are
required to be submitted for development of the project
For the applicant's convenience, attached is a list of documents
required for permit submittal
An approval of the aite plan by tne City CQmmi$sion shall be valid
for one (1) year, unless a building permit from the Building
Department is secured If the applicant fails to secure a building
permit in that time, all previous approvals shall become null and
void

As agent for the owner, please accept thiS letter on their behalf as our
formal request for rehef from two reqUIrements of the Landscape Code
of Boynton Beach.
The first request IS regardIng the requirement of a landscape strIp
between the vehIcular use area and the property lIne. The eastern
boundary of thiS site adJOInS the Southeast FlOrIda Rail CorrIdor III
which the actual Tn-Rail StatIOn IS located. SInce these two properties
must function as one site and are owned by the same entity for all
practical purposes, we respectfully request that thIS site does not have to
proVide the landscape stnp along the eastern boundary
The second request IS regardIng the reqUIrements of a perImeter hedge
and trees between the vehIcular use area and property lIne. Along the
north and northwest property lIne we are prOVidIng a landscape buffer
With a minImum Width of 40 feet. ThiS buffer consists of natural native
vegetation left Intact or transplanted from the Intenor of the site. We
beheve that the eXistIng understory and transplanted pInes and oaks Will
prOVide the landscape screenIng Intended by the perImeter hedge and tree
reqUIrement. Also, the hedge and trees reqUIred along the eastern
property lIne cannot be proVided due to the condItion described In the
first request of thIS letter In addItIon, even though the access parcellS
Included In the site plan It IS held In separate ownership Therefore we
have prOVIded the penmeter hedge and tree requirement adJacent to our
southern property lIne (north SIde of the access road) The area adJacent
to the southern Side of the access road would be landscaped when the
adJacent parcells developed.
