DESCRIPTION This is a request for relief from Article II -
Landscape Code, Section 7 5-35(e) to omit landscaping along an
interior lot line used for vehicular use, located on the east side
of High Ridge Road and 460 feet north of Gateway Boulevard, within
Quantum Park, submitted by Joe Handley, Craven Thompson &
Associates, agent for the Tri-County Commuter Rail Authority
RECOMMENDATION The Planning and Development Board, with a 7-0
vote, recommended approval of this request, subject to staff
comments, installation of the landscaping shown on the proposed
plan within Exhibit "B" of Planning and Zoning Department

NATURE OF REQUEST
Joe Handley of Craven Thompson & Associates, agent for the Tri-
County Commuter Rail Authority, is requesting approval to appeal
Article II, Section 7 5-35 (e), of the landscape code regarding
vehicle use area screening This request is in connection with
concurrent site plan approval for Tri-Rail's proposed parking
facility and renovation to the existing Tri-Rail Station site (see
attached location map)
BACKGROUND
Article II, Section 7 5-35 (e) of the landscape code requires
perimeter landscaping between vehicle use areas and abutting
properties The purpose of this section is to provide visual
screening, from abutting properties, of vehicles in vehicular use
areas Vehicular use areas include not only parking spaces, but
also access aisles and driveways Mr Handley is requesting relief
from this requirement where the parking facility and sidewalks
cross the east property line (see Exhibit "A" - applicant's letter
of request).
ANALYSIS
The property abutting the east property line of the proposed
parking faCility is the existing Tri-Rail station which is being
renovated The renovation includes the installation of trees,
shrubs and ground cover This landscaping will be installed
between the Tri-Rail station and the east side of the proposed
parking facility (see Exhibit "B" - landscape plan showing the
material proposed for the Tri-Rail station site~
Properties that are under common ownership that are unified by
physical improvements are normally required to be unified to create
one property If the new parking facility were to be unified with
the existing Tri-Rail station site, which will share driveways and
access aisles, a landscape appeal would not be needed because the
shared driveways and access aisles would not be vehicular use
areas that abut an adjacent property However, since the existing
station is located within the Seaboard Airline Railway right-of-way
and the proposed parking facility is located on a "true" parcel
within Quantum park, the parcel would have to become right-of-way
or vice versa, which is not practicable Moreover, the right-of-
way and the parking facility will be owned and funded by somewhat
different agencies Therefore, Tri-Rail has stated that the right-
of-way and parking facility parcel cannot be unified in title

RECOMMENDATION
staff recommends approval of this appeal, subject to the
installation of the landscaping shown on the proposed plan within
Exhibit "B" The basis for ~his recommendation is due to the
impracticability of unity of title due to ownership and funding,
and owing to the fact that the properties function as one site,
negating the need for screening along the interior property line

of Boynton Beach.
The first request IS regardIng the requIrement of a landscape strIp
between the vehIcular use area and the property hne. The eastern
boundary of thIS sIte adjOInS the Southeast Flonda RaIl Corndor m
whIch the actual Tn-RaIl Statton IS located. SInce these two properties
must functIon as one site and are owned by the same entIty for all
practIcal purposes, we respectfully request that thIS site does not have to
prOVIde the landscape stnp along the eastern boundary

The second request IS regardIng the reqUIrements of a penmeter hedge
and trees between the vehIcular use area and property lIne. Along the
north and northwest property lIne we are prOVIdIng a landscape buffer
WIth a mInImum WIdth of 40 feet. ThIS buffer consIsts of natural nattve
vegetation left Intact or transplanted from the Intenor of the site. We
beheve that the eXlstmg understory and transplanted pInes and oaks Will
prOVIde the landscape screemng Intended by the penmeter hedge and tree
reqUIrement. Also, the hedge and trees reqUIred along the eastern
property lIne cannot be prOVided due to the condmon descnbed m the
first request of thIS letter In addmon, even though the access parcellS
Included In the site plan It IS held In separate ownership Therefore we
have prOVided the penmeter hedge and tree reqUIrement adjacent to our
southern property line (north Side of the access road) The area adjacent
to the southern Side of the access road would.be landscaped when the
adjacent parcellS developed.

The following is a list of comments regarding the second review of
the above-referenced project It should be noted that the comments
are divided into two (2) categories The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
bUilding Department for permits for the proposed project
I SITE PLAN REVIEW COMMENTS.
1 Show on the landscape plans the required vehicle use area
acreening along the east property line of the project
[Landscape Code, Section 7 5-35(e)] The landscaping is
required, unless the City commission approves the
Landscape Appeal in progress LAAP 95-002 Modify the
drawings to comply with the results of the appeal
2 Show on the plans the 40 foot wide peripheral greenbelt
required along the east property line of the PID
(Appendix A, Section 4L) The peripheral greenbelt is
required, unless the Board of Adju~tment approves the
variance request in progress (BOAV 95-005) Modify the
drawings to comply with the results of the variance
3 It is anticipated that the landscape material in the
micro-siting, reforestation and natural areas specified
on the plans will be able to be substituted for required
vehicle use area landscape screening The applicant has
agreed to place the following note on the landscape plan
in lieu of requesting relief from the landscape code
Following field inspections and a determination by
the City landscape inspector that the micro-siting,
reforestation and natural areas do not form the
required vehicle use area screening, additional
trees and/or shrubs shall be added to the plans and
installed on site to form the required screening
The additional material shall be a native specie
and comply with code specifications regarding size
and spacing

4 The maximum number of driveways allowed per site is two
(2) [Article X, Section 5-142(h)(7)], therefore, omit two
(2) driveways leading to the private road adjacent to the
site Only two driveways are allowed, unless the
Planning and Development Board and city Commission
approves the parking lot variance in progress, PKLV 95-
001 Modify the drawings to comply with the results of
variance
5 Indicate on the drawings with a distinguishable symbol
the location of the curbing that is required to protect
landscape areas that abut vehicles use areas Wheel
stops may be used to protect the landscaping at the front
of the parking stall The sides of a parking stall that
abut a landscape area shall have curbing and compliance
of City's Standards
6 The permit submittal for the project shall include,
separate permits and plans for the construction of the
private road, parking facility property, redevelopment of
the existing Tri-Rail station property, and any other
off-site improvements proposed
7 A modification to the Quantum sign program is required
for the on-site sign The sign program modification will
require separate submittal and approval by the Planning
and Development Board and City Commission
8 The City's height limitation is forty-five (45) feet
The height of all structures such as site lighting poles
above forty-five (45) feet shall be reduced to comply
with the height limitation
9 ~e minimum height for trees and palms is eight (8) feet
Aaend the landscape plans to specify the sabal palms are
no less than eight (8) feet tall after planting
10 Considering the public access to the Tri-Rail facility is
via a private dead-end street without a cul-de-sac turn
around, submit for review cross access easement agreement
that creates a public access to egress the dead-end
street The document shall be signed by the property
owner of the private road and the property owner of the
land where the access is being provided The agreement
shall describe an easement and specif~cations regarding
design and construction equivalent to the City's
requirements for a cul-de-sac The agreement shall be in
perpetuity and eliminate liability and maintenance
obligations regarding the public's use of the easement
The document shall be recorded in the records of Palm
Beach County folloWing review by city staff and the legal
department A copy of the recorded agreement is required
to be submitted to the Planning and Zoning Department
prior to the completion of the new and renovated
facility
11 Place a note on the drawings indicating that site plan
review is required for all improvements identified as
"Future" on the plans
II RECOMMENDATIONS
12 Recommend using melaleuca mulch instead of pine needle
and cypress mulch specified on the plan

hearing The new, recently adopted land development regulations
require a public hearing only before the Commission Since site
plans submitted in connection with parking lot variances are
required to be reviewed by the Planning and Development Board,
direction is desired as to whether the Commission would like
parking lot variances to be reviewed informally (without a public
hearing, but with a recommendation) by the planning and Development
Board or not reviewed by the Board at all If it is the desire to
not have the Board review variances at all, direction is desired as
to whether the commission wishes to set the policy that parking lot
variances must be acted on by the Commission, prior to the
associated site plan being reviewed by the Board

INTRODUCTION
Section 5-145(c)(4) of the code of ordinances requires that when a
variance to Section 5, Article X, Parking Lots, is requested, the
Technical Review Board (Technical Review Committee) must forward to
the Planning and Zoning Board (Planning and Development Board) a
recommendation that is to be made part of the public hearing
proceedings To that end, this memorandum is forwarded consistent
with the requirements of Section 5-145(c)(4)
BACKGROUND
Joe Handley of Craven Thompson & Associate, Inc , agent for the
Tri-County Commuter Rail Authority, is requesting a variance to
Chapter 5, Article X, Section 5-142 (h) (7) of the parking lot
regulations The variance is requested in connection with site
plan approval for a new parking facility located adjacent to the
existing Tri-Rail station, within Quantum Park (see attached
location map) The existing Tri-Rail Station site and private road
leading t. the station are being renovated as part of this site
plan approval
ANALYSIS
Section 5-142(h)(7) states
"No more than two (2) driveways shall be permitted from
any property Where properties abut more than one (1)
public or private right-of-way, additional driveways may
be permitted depending upon traffic volumes, but in no
instance shall the number of driveways exceed two (2) on
each street "
The site plan submitted in connection with this parking lot
variance (see Exhibit "A" - site plan) proposes four driveways onto
a right-of-way that stems off of High Ridge Road Through signage
and physical design, the four (4) driveways are designated for use
as follows
1 Ingress for bus and employee traffic,
2 Ingress for vehicles using commuter drop-off area,
3 Ingress/egress for commuters with vehicles and
4 Egress for busses, employees and vehicles using drop-off
area

applicant's justification for the variance (Exhibit B)

RBCOMMENDATION
On Tuesday, March 14, 1995 the Technical Review Committee (TRC),
met to review the plans and documents submitted and to formulate a
recommendation with regard to the variance requested After review
and discussion, the TRC unanimously recommended that the variance
request be approved as submitted Due to the type of use and the
difference and volume of traffic generated by the use, separation
of the four different types of traffic needs to be provided via
separate driveways for purpose of safety and efficiency of traffic
movements
