set aside for hardwood swamp, wetland and freshwater marsh mitigation as well as for sand pine
scrub preservation PIC88c confirm back to me in writing that Lots 7, 7 A, 8 and 8A do not falt
within the preservations areas which have been set aside for these purposes

Dear Ms. LImer.
As a follow-up to my zomng venficatlOn letter to you dated October 18, 1999, and m response to
your faxed letter dated October 21, 1999, please be advised of the following:
Ordinance No. 84-51, adopted by the City Commission on December of 1984, granted the
Development Order for the property then known as Boynton Beach Park of Commerce, now
known as Quantum Park PID The Development Order establIshed, among other requirements,
that
(6) The developer shall preserve m VIable condItIon a minimum of (40) acres of Sand
Pine Scrub canopy, understory and groundcover vegetation. And,
(9) The developer shall establish a vegetated littoral zone of hardwood swamp/freshwater
marsh habItat comprising a total of no less than 11 acres as part of the surface water
management system. And,
(10) In accordance with the follOWing provisIons, the developer shall provide and
maintain a buffer zone of native upland edge vegetation around wetland and
deepwater habItats wluch are preserved or constructed on-site. The buffer zone may
consist of preserved or planted vegetation but shall mclude canopy, understory and
groundcover of natIve species only
The forty (40) acres of Sand Pine Scrub requirement was satisfied by the creatIon of two (2)
Sand Pme Preserve areas totaling forty (40) acres. At some pomt there was a plan to also reqUIre
Sand Pine Scrub rmcrosites around from several lots; lots 7, 7 A, 8, 8A were not included m the
lists of lots subject to micrositmg. Regardless, the rmcrosIting reqUIrement has been reVIewed
and deemed unnecessary and inconSIstent With the Development Order by the Treasure Coast

In regard with the wetland matter, I reviewed the Plat for Quantwn Park. It shows that parcels
7 A and 8A are Identified as Tract "H", and are part of a dramage easement bemg also a part of
the adjacent lake, and IS the perpetual maintenance obligation of the Quantwn Park Property
Owners AssocIation, Inc. ( See Attachment B) I spoke with Mr Hallahan, the City's Urban
Forester, and he mentIoned that there is some vegetation already planted by the Quantwn Park
developer and that the AssocIation has the maintenance responsibility He also indicated that the
vegetation already m place complies With the requirement for hardwood swamp/freshwater
marsh and native upland species.

In the northwest por~IOn of the project. The development order was amended on Februaf\ 2
1988 WhICh aJlowed the creatIOn of two dISjUnct sand pIne scrub preserves of 25 7 acres and
143 acres for a total set aSIde of approxImately 40 acres
The development order reqUIred the development of a resource management plan for the sand
pIne scrub preserve The amended management plan dated December 13, 1988 IndIcates that
the amount of scrub habItat at each of the two preserve areas totals approxImately 27 acres
The reduced amount of scrub IS due to the fact that a portIOn of the northern preserve area IS
domInated by herbaceous vegetatIon Instead of scrub The development order states that 40
acres of scrub habItat IS to be preserved, therefore, the management plan states that an
addItIOnal 12 acres of sand pine scrub wIll be protected through mIcrO-SItmg at other
locatIOns on the project SIte
CouncIl staff has reVIewed thIS Issue and believes the Intent of the development order
reqUIrement for the set aSIde of approXImately 40 acres of sand pIne scrub vegetatIOn IS met
by the establIshment of the 25 7 -acre and 14.3-acre preserve areas. AddItIOnal mICrO-SItIng
of scrub habItat IS unnecessary for two reasons. First, the open herbaceous areas In the 25 7-
acre preserve area are expected to fill 10 and eventually become dommated by scrub

8A m Quantum Park. My client will be constructing an office/warehouse complex consisting
of approximately 35,000 square feet. Of the 35,000 feet, 4000 square feet will be ancillary
office space The facility will be used for the manufacture and distribution of greeting cards
My client will be closing a loan in connection with thts property and there are two items which
I am aware of at this time that will be required in order to close the loan.
First, please indicate the zoning designation for this property and provide me with a copy of the
appropriate section of the zoning code Second, this property . .
Included wlthtn your response to this request, I will need a statement indicating that construction
of a building of the type I've described IS in compliance with the development order and that
upon receipt of site plan approval and building permits we will be able to immediately commence
construction of the facility

Dear Ms. Lizner'
In response to your letter, dated October 5, 1999, please be advised that the property identified as lots 7 and 7 A
together with a portion of lots 8 and 8a, in Quantum Park, P .I.D., is currently zoned Planned Industrial
Development, P.LD., according to the Official Zoning Map for the City of Boynton Beach.
Also, please be advised that the Land Development Regulations for the City of Boynton Beach require that uses
within the P.LD. zoning district be approved by the City Commission. In fact, the City Commission approved
Amendment No.8 to the Quantum Park Master Site Development Plan by adopting the Ordinance No. 97-20 on
May 29, 1997, changing the master plan designation oflots 7 and 8, among other lots, from OFFICE to
OFFICFJINDUSTRIAL use.
Subsequently, the City Commission approved Amendment No.9 to the Quantum Park Master Site Development
Plan by adopting the Ordinance No. 99-05 on March 2, 1999, which did not affect the previously approved OFFICE/
INDUSTRIAL use for the subject property
Finally, please be advised that due to the lack of any survey showing the affected portions of lots S and SA, this
letter intent is strictly limited and related to the allowable uses for the subject property
It is construed that once your project receives site plan approval upon all city code regulations compliance, and the
subsequent approval of the necessary building permits, you will be in a position to start construction immediately
