County, was conveyed by Quantum Associates to Publix
Super Markets, Inc. on January 22, 1988 (a copy of P.I.D.
Plat No. 5 is attached, which shows the subject lot
55 and its size).

As part of the annual report required under Section 380.06 (18). Florida
Stat~tes. the developer shall provide a list of all industrial tenants.
including a description of their activities and the four digit standard
Industrial Classification Codeapplicable to the operation. A copy of this
list shall be provided to the Department of Environmental Regulation. the
South Florida Water Management District, the City of Boynton Beach. and the
agency delegated the authority for maintaining. updating, and verifying the
master files for hazardous waste generators in Palm Beach County

The development activity for calendar year 1988 consisted of
improvements toward the completion of the site infrastructure in
accordance wi th the Master Plan, as well as development acti vi ty

industrial use, within Quantum Park at Boynton Beach.
A) Goodkin Research's analysis of the supply and demand
determinants for warehouse and industrial space in Palm
Beach County indicated that these uses constitute
significant real estate demand (investment) opportunities
at the site The demand for warehouse space is strong, and
although several new industrial parks are competing in the
marketplace the subject property offers a close-in and
highly visible location
The relatively rapid growth of the population within the
park's Primary Market Area has resulted in the construction
and planning of a significant supply of new shopping center
space. This, in turn, increases the demand for wholesale
and distribution space in the area, in order to meet the
needs of the expanding retail base. Many of these
distributors, (e g., food warehouses, appl iance
distributors, department store warehouses, general
warehouses) require rail, and can therefore be
strategically located within the subject property The
high volume traffic generated by these tenants makes the
use of trucks, as their major means of transportation,
uneconomical Interviews with Seaboard Coastline Railroad
indicated that these types of distributors are relatively
large and occupy, on average, 50,000 to 100,000 square
feet, with the most popular buildings containing about
60,000 to 70,000 square feet
B.) The tenant mix will be quite varied depending upon eventual
demand and as such is difficult to estimate. However,
Goodkin Research suggests that the following tenant mix is
reasonable and attainable

The proposed plan redistributes the land uses of the former approved plan in
order to accommodate the layout of a proposed distribution user that requires
a large parcel with rail access In so doing, the commercial parcels were
arranged along a frontage road, consistent with the desires of the City's
Planning Department
Diagram "A" indicates the area of the plan that has undergone reconfiguration
As shown, these reconfigurations have occurred only in the very center of the
park, and within the southern loop roadway Outside of this area minor use
variations (Industrial land changed to R & 0, etc.), without change in parcel
configuration, have occurred in order to maintain a nearly identical land use

It is no surprise to Goodkin Research that a major quality, highly visible tenant
like Publix chose to make its home here. And the fact that they are the flagship
tenant suggests that the quality of the park at buildout will be even higher than
originally foreseen. This is because quality tends to breed quality; high quality tenants
tend to cluster
Distribution, by its very nature, employs fewer employees-per-square foot than
do some of the more "intensive-use" industrial tenants detailed in the original DR! -
electronics, medical, engineering/planning and the like. Simply put, the distribution
function was part of the original employment forecast. And because it is the first
tenant, as opposed to the tenth, for example, is not cause to worry that the original
employment forecasts cannot be achieved.

In 1984, the Goodkin Research Corporation completed the original economic
analysis for what was then known as the Boynton Beach Park of Commerce. The park
at that time was in its planning infancy The analysis completed then was likewise
based on a conceptual plan and the resulting economic analysis and forecasts were
heavily couched in Palm Beach countywide averages for employees per square foot,
construction costs, wage and salary levels, and the like.
In 1985, the park was purchased by Quantum Associates and was renamed
Quantum Park At Boynton Beach. Today the park is more than a concept; "live"
tenants are negotiating for "real" space. The development of what is South Florida's
most advantageously located, high quality business park is a reality
Goodkin Research was recently retained to take another, more qualitative, look
at the Quantum Business Park and the way it was initially beginning to build its tenant
base Some concern has been expressed about the impact that the first tenant, Publix,
would have on the overall employment forecast completed in the original DRI. Several
points should be stressed along these lines
1) The original DR! applied countywide employee-per-square foot averages to
the then proposed land uses. These forecasts then became baselines used
to evaluate the economic impact of the park at buildout. Like any forecast
based on averages, the mid-term results are likely to deviate some through
build~ut as averages become reality To hold those forecasts as rigid
"law" at every point during build~ut does not account for what must be a
reasonably flexible development plan in an ever changing market.
2) Distribution functions were always seen as an integral use within the park.
The original market analysis and the DR! recognize distribution functions
as a natural for a park located contiguous to major north-south rail and
rubber tire transport arteries (not to mention the major West Palm Beach
Airport).

Traffic Analysis Update
Dear Mr Zimmerman:
As requested by you, we have updated the traffic analysis for the above referenced
project to reflect the most recent site plan changes (plan dated June 23, 1986) these
changes reflect an internal roadway network change south of NW 22nd A venue Our
review also included the specific use for a 55 0 acre industrial parcel
(Warehouse/Distribution Center) also south NW 22nd Avenue
The traffic generated by the updated site plan was assigned to the revised roadway
system (No change in traffic distribution would result from the plan revisions) the
external impacts had no change but the intersections along NW 22nd Avenue within
the project will have some minor lane use changes. The peak hour traffic volumes and
the intersection needs for the revised network are depicted on the attached sketch.
Also enclosed with this letter are the critical path capacity analysis computer printouts
showing the level of service at each intersection.
Regarding the warehouse/distribution center, it should be noted that this is a
use assumed within the industrial category reflected by the ITE traffic generation rates.
Therefore the use was already considered by the traffic studies and updates which have
been completed, including this update,

TRAFFIC IMPROVEMENTS
RITECO PROPOSAL
PHASE I
Construct 22nd Avenue (4 lanes), plus all intersections from
Congress Avenue to Seacrest Avenue, excluding four-laning the
bridge over 1-95 This improvement will be constructed when
warranted, but completed no later than five years from the
issuance of the development order
Congress Avenue and Boynton Beach Boulevard Interchanqe Riteco
will, upon approval of the development order, commence the
preparation of construction plans and right-of-way maps to provide
for the construction of double left-turn lanes on the east and
west approaches of the intersection Also, Riteco will contribute
$100,000 for the construction of turn lanes and for the purchase
of rights-of-ways
Upon the approval of the development order, Riteco will commence
feasibility studies required for the approval of an interchange
of 1-95 with N W 22nd Avenue, the cost not to exceed $100,000
This Phase I package of improvements is $41,000 less in value
than the amount discussed at our previous meeting It is the
City Manager's position that this $41,000 be added into the cost
of purchasing rights-of-ways at the corner of Boynton Beach Blvd
and Congress Avenue
PHASE II
After discussion with the City Manager, it is recommended that
Riteco, owing to the fact that they will at the time of con-
struction of an intersection at 1-95 and NW 22nd Avenue, consume
29% of the interchange capacity at peak hour, assume 20% of
the cost to construct the interchange at current dollar value,
not to exceed $2,000,000, current dollar value If government
constructs this improvement sooner than five years of the
approval of the development order, this dollar commitment will
not be be triggered until five years have elapsed
Phase II of the Park of Commerce cannot go forward without a
commitment for the construction of the interchange of 1-95 and
NW 22nd Avenue, if, for instance there is a definite 'no' from
the DOT with respect to the interchange, the Phase II agreement
will have to be renegotiated

RIGHT-OF-WAY DEED
THIS INDENTURE Made this ~ day of March, 1985, between
RITECO DEVELOPMENT CORPORATION, a Florida corporation, having its
principal place of business in Palm Beach County, Florida, as Party
of the first part, and COUNTY OF PALM BEACH, IN THE STATE OF
FLORIDA, as Party of the second part.
WITNESSETH, that the Party of the first part, for and in
consideration of the sum of One Dollar ($1.00) and other valuable
considerations paid, receipt of which is hereby acknowledged, does
hereby grant, remise, release, quit claim and convey unto the Party
of the second part, its successors and assigns forever the
following described land (hereinafter referred to as "the
Property"), situate, lying and being in the County of Palm Beach,
State of Florida, to-wit
See Exhibit "A," attached hereto and made a part hereof.
TO HAVE AND TO HOLD THE SAME, together with all and singular
the appurtenances thereto belonging or in anywise incident or
appertaining, and (subject to the matters set forth below) all the
estate, right, title, interest, and claim whatsoever of the Party
of the first part, in law or in equity, to the only proper use,
benefit and behoof of the said Party of the second part, its
successors and assigns.
The Property is being conveyed to the Party of the second part
for the ultimate right-of-way of N. W. 22nd Avenue, and Party of
the first part, for itself and its successors, assigns, employees,
agents and business invitees, hereby reserves a perpetual easement
over and across the Property for ingress and egress to said
N. W. 22nd Avenue

In the event the Property should ever be abandoned or should
ever not be used for the right-of-way of N. W. 22nd Avenue, then,
by operation of law, the title to said Property shall revert to
Party of the first part, its successors and assigns. This interest
of Party of the first part, its successors and assigns shall be
deemed to be a possibility of reverter.
IN WITNESS WHEREOF, the Party of the first part has caused

Vice-President on the date first above written.

The application for Development Approval (ADA) for the Boynton Beach Park
of Commerce Development of Regional Impact (DRI) submitted May 21, 1984 has
been reviewed by Council staff for informational sufficiency. The ADA
contains insufficient information for the Council to perform the regional
impact assessment required under Section 380.06(11), Florida Statutes The
attached report indicates the information which is being requested in order
to complete the application.
Within five working days, the applicant must notify us of his intentions
with respect to providing the requested information and, if the information
is to be provided, it must be submitted within 120 days. When we determine
that the application and supplemental information are sufficient or we
receive notice from the application that no additional information will be
provided, we will notify you so that the public hearing date may be set.

information for the Treasure Coast Regional Planning Council to
discharge its responsibilities under Subsection 380 06(11), Florida
Statutes.

Question 12, Project Description
A. Please explain the phasing of the development in more detail,
especially the 5-year and 10-year periods shown in phase I in
Table 12-13-1
B. Please indicate how many square feet of each kind of use are anti-
cipated Also, indicate the projected number of hotel rooms.
Map H appears to indicate that one office parcel and one indus-
trial parcel have alternative hotel uses However, the text indi-
cates that hotel rooms will be provided in the commercial area.
Please provide additional information on where and how many hotel
rooms are planned
Question 16, Wetlands
A It is proposed to convert much of the wetland habitat on-site to
lake or pond habitat. What depths are proposed in these lakes?
Are they being excavated in part to provide fill?
B How many linear feet of lake edge are proposed for this project?
Question 18, Vegetation and Wildlife
A It appears that the understory of the Sand Pine Scrub area west
of High Ridge Road, in the southwest portion of the property, has
recently been removed Provide documentation as to 1) when the
understory was removed, 2) why it was removed, and 3) by whom it
was removed
B Please indicate on a map what upland habitat, including intact
canopy, understory and groundcover, will be set aside as habitat
preserve area by the developer
C Provide an estimate of the sizes of Gopher Tortoise and Burrowing
Owl popUlations which occur on-site
D To what extent will native vegetation be used in providing
landscaping for the project?
Question 20, Economy
A. The application should include an estimate of the percent of
expenditures (by type) which will be spent within the region
This information has been omitted Although the market analysis
looks at Palm Beach, Broward and Dade Counties, the response
should specifically address the Treasure Coast Region and not the
market region
B The actual cost of construction for the proposed project was
marked up 15 percent to obtain the assessed value of the project
What assumption was made regarding the choice of 15 percent?
C The application states that 20 percent of the nonconstruction
permanent employees are to be drawn from outside of the region in
the market survey The market study, however, used Palm Beach,
Broward and Dade Counties as its region What percent of the non-
construction permanent employees are expected to come from within
the Treasure Coast Region?
Question 21, Wastewater
A Provide sources for all wastewater flow estimates, and explain
how "Industrial Waste Allowances" are derived.
B What types of wastewater Pollutants are typical of the industry
types expected to be located at this site?
C How does the City of Boynton Beach's South Central Wastewater
Treatment Plant dispose of its treated wastewater effluent? Is
spray irrigation water provided by this plant?
Question 22, Drainage
A. Typically, the Treasure Coast Regional Planning Council recom-
mends that stormwater management systems be of retention type or
provide filtration prior to discharge to surface waters if deten-
tion type systems are used The proposed system appears to be a
detention type without filtration and, therefore, may be found to
be unacceptable Are there any engineering constraints peculiar
to this site that would preJent the develo~er from providing
retention for the first one inch of stormwater runoff~ or
detention with filtration?
B Provide a detailed description of stormwater best management
practicess such as bermings use of swales~ and sweeping of
parking lotss that will be incorporated into this project to
assure that maximum water quality and habitat value are provided
within the surface water management system lakes Wherever pos-
sibles quantify the effectiveness of each proposed "best
management practice."
Question 23~ Water Supply
A. Provide sources for all water demand estimatess and explain how
commercial and industrial demands were derived.
B For many of the soil types found on this property~ irrigation
demand projections may be underestimated. Estimates should be
based on soil type and landscaping types to be used Provide
detail regarding the extent and type of landscaping material to
be used If irrigation demand has been significantly under-
estimateds recalculate projected demand. It should be noted that
Council encourages extensive use of natives "adapted" vegetation
in landscapings specifically for the purpose of reducing
nonpotable water demand
C. Are there any sources of wastewater effluent in the area of this
project that could be used to meet irrigation demand?
Question 24~ Solid Waste
A. What types of hazardous or toxic materials or wastes are expected
to be handleds stored or used in processing? What special provi-
sions will be made for such materials? In particular, what steps
will be taken to assure that contamination of ground and surface
waters does not occur?
Question 31, Transportation
A. The table of projected trip generation on page 31-7 appears to
have incorrect values for phase I~ light industrial and phase II
light industrial and commercial. Also~ the amount of commercial
uses does not match that given in Table 12-8-1 or shown on Map H

The following information is needed to complete the District's assessment for the
above referenced Development of Regional Impact Application for Development
Approval;
Question 22a
Design discharge capacities for those Lake Worth Drainage District facilities,
located within the South Florida Water Management District's Canal 16 [C-16]
Drainage Basin, have been modified by the LWDD. The LWDD is using a standard 70
csm [70 cubic feet per second per square mile] rate for calculating allowable
discharge rates. The applicant calculated the discharges submitted in the ADA
using the LWDD discharge curves, which were voided b,y the L'illD in June, 1984.
Although the applicant was granted SF~ID Permit No, 50-00611-S/R, in 1978, that
permit must be reissued, based on current criteria and the new development
proposal. [Reference SFWMD Rule Chapter 40E.4.3.2.1. and 40E 4.3.3.1]. The
applicant should therefore submit revised calculations demonstrating that the
proposed surface water management system will operate in accordance with the 70csm
discharge limitations. In addition, the applicant should describe the anticipated
water quality of runoff generated in the industrial portions of the site, and
discuss how it would be treated prior to discharging to the on-site lake system.

The application for DRI for Boynton Beach Park of Commerce
has been placed in the City Council Office for review. This
application for DRI (Department of Regional Impact) covers
the land owned by the Riteco interest on both sides of N.W.
22nd Avenue and generally east of Motorola. The application
has been formally received and will now be processed through
all of the required regulatory review agencies including
Treasure Coast Regional Planning Council.
The Planning Department is preparing a schedule of review
and Public Hearing dates and that schedule will be presented
to the City Council as soon as it is available.
Additional copies of the DRI application are in the Planning
Department and individual copies will be distributed to mem-
bers of the Planning & Zoning Board and the City Council as
the development process moves along from agency to agency.
If you would like your individual copy now, please let

Dear Mr Annunziato
In accord with Chapter 380, Florida Statutes, we are
pleased to submit herewith our Application for Develop-
ment Approval of a Development of Regional Impact for the
proposed Boynton Beach Park of Commerce
This submittal includes the required copies of the ADA and
maps as well as a check in the amount of $10,000 made pay-
able to the Treasure Coast Regional Planning Council to
cover its application fee requirement
We are requesting the Treasure Coast Regional Planning
Council to place this ADA/DRI on its August 17, 1984
agenda for Board review We realize this will require
timely action by all agencies involved To help expedite
their reviews, I have requested our consultants to make
themselves immediately available to you, Howard Muise, or
anyone else to discuss any portion of the ADA The con-
sultants have also been instructed to provide additional
information necessary for finding the ADA sufficient with-
in thirty days of May 21, 1984
As requested by Mr Muise, we will deliver the ADA to the
various County/State agencies which provide input to the
Council
