Dear Mr Norris.
In follow-up to my prevIOus letter prepared to mdIcate the CIty'S position relatIve to the current use
options eXIsting on lots #32 through #38 of the Quantum Park PID, and in response to your letter dated
September 28, 1999, I am providmg you WIth addItional facts whIch JUStIfy our position.
Amendment #7
Ordmance No 96-65, representmg the seventh amendment to the DRI, adds both the "Industrial" and
"Research and Development" (R&D) use optIOns to lots #32 through #38 At the tIme of the amendment,
those lots already included "Office" use.
At the time when Amendment #8 was filed, the use options for lots #32 through #38 included
"Office"
Amendment #8
The staff report (Memo No 97-213) for Amendment #8 listed all requested lot use modIfications
including the deletion of the " Office" use from lots #32 through #38 The same report contained a staff
recommendatIOn that the "Office" use should be retamed on lots #32 through #38 The mmutes of both
the May 13, 1997 Planning and Development Board Meetmg, and May 20, 1997 City CommIssIOn
meetmg, and the mitial draft of Ordmance No 97-20 all confirm that the request mcluded the deletion of
the "Office" use option on lots #32 through #38
Amendment #8 originally included the request to omit "Office" from the list of use options for lots
# 32 through #38, and the staff opposed this modification.
The turning point m thIS process occurred between first readmg and second reading of Ordinance No 97-
20, when a deciSIOn was made by the applicant to accept certam staff recommendatIons includmg
retaining the "Office" use option on the subject lots. ThIS deciSIOn is supported by a document prepared
by the applIcant consenting to changes to the applicatIOn, handwrItten reVlSlons to the original draft
Ordinance No 97-20, the final Ordmance No 97-20, and correspondence from the applIcant accepting
the revisions made to, and the final version ofOrdmance No 97-20

Ordinance No. 97-20 was amended between first and final readings to revise, in part, the
amendment to omit the revision to lots # 32 through #38, therefore leaving them with the "Office"
and "Industrial" use options. "Industrial" use is now a broader designation and includes
"Research and Development" as indicated in the NOpe, filed on March 17' 1997
Amendment #9
Neither the NOPC, staff report, nor Ordmance No 99-005 proposed, described or affected lots #32
through #38 The master plan submitted with the apphcation for Amendment #9 was in error by showmg
only the "Industrial" use option on lots #32 through #38 Your client error in this regard cannot take the
place of the formal amendment process.
The facts stated herem provide clear eVIdence that the "Office" use option was not omitted from the
subject lots by Amendment #8 to the Quantum Park DR!, despite what may be represented by data tables
WhICh may not be consistently mamtained. The master plan, without a proper NOPC application, legal
notice, and ordinance, was changed to show lots #32 through #38 without the "Office" use option.
Therefore, WIthout the legal steps taken to offiCIally amend the master plan, the use options currently
available on lots #32 through #38 remain "Office" and "IndustrIal" The CIty is therefore obligated to
revise the current master plan to reflect Its official status. All documents referenced herein are attached
for your review and records.

Regional Impact Order Ordinance No 84-51, as amended (the "Development Order"),

Development Order allows the Quantum Associates a Florida general partnership or its
assigns to develop the real property subject to the Development Order project known as
Quantum Corporate Park at Boynton Beach Development of Regional Impact (the
"Project") in accordance with the terms and requirements of the Development Order
The purpose of this letter is request written confirmation to The Benenson Capital
Company and/or assigns, the proposed buyer of the Property, as to the following

Dear Mr McGillicuddy'
Regarding the attached master plan and correspondence from MFT Development, Inc dated July 12,
1999 which indicate that the use options for lots 32 through 38 are limited to "Industnal", I have reviewed
relevant documents and find contradicting information. According to Ordinance No, 96-65, adopted on
June 3, 1997, the subject lots are designated" Office/Industrial" The subsequent modification to the
DRI, which just preceded the most current modification processed as Amendment #9, was processed by
Ordinance 97-20 and did not modify the subjects lots, As Amendment #9 did not affect lots 32 through
38, the use options should currently remain as "Office" and "IndustrIal"
I am certain that staff overlooked this error on Amendment #9 as our attention was focused on those
specific lots affected by the application rather than those many other lots and use designations that should
have remained unaltered by this recent amendment.
Unless you possess documents that accurately contradict the findings stated herein, please assist me With
correcting this error by providing me with a revised master plan which I Will use to update the files held
by the City and the Treasure Coast Regional Planning CouncIl.

Subject: Quantum Park Development of Regional Impact
Review of Proposed Change
Dear Ms. Heyden.
A notIficatIOn of proposed change (NOPC) to the Quantum Park development of regional
Impact (DRI) was submItted to Council by James G Willard on March 17, 1997 The NOPC
proposes to reVIse the master plan to simplify the land use designatIOns on lots wIthin the
DRI reducmg the number of categories of approved uses, place multIple uses on the unsold
lots to provide more flexibility for better marketing, provide for the potentIal redevelopment
of lots 22 through 31 and 6 through 11 in conjunction with the abandonment of Quantum
Boulevard contIguous to these lots, and revise the development order as It relates to traffic
monitoring
The applicant provIded a traffic analysis to rebut the presumption mformation to show that
the changes will not create any additional regIOnal impacts which would require substantIal
deviatIOn reVIew Council responded with a letter dated April 16, 1997 with comments and
concerns with the traffic study Council has received the response from Mr Steven G
Godfrey of Kimley-Horn and Associates dated May 2, 1997 regarding Council's comments
on the proposed change to the Quantum Park DRI and have the following
comments/concerns.
1) The previous reVIsed traffic study done for the Quantum Park DRI (Amendment No 6)
assumed a total of 1,430,000 square feet of gross floor area (GFA) of office development.
However, the Master Plan included 1,687,772 GFA for office development. There was no
traffic analYSIS provIded for amendment number seven (7) Therefore, Council still
recommends that the master plan either be revised to include 1,430,000 GF A of office

development or a revised traffic study be done to show that the additional office development
WIll not create any additional traffic impacts.
2) The project currently allows the tradeoff of square footage of commerCIal development for
hotel rooms (268 SF/room) The original plan proposed two 2oo-room hotels for a maximum
of 400 rooms, Council still recommends that the master plan be revised to include a
maximum of 400 hotel rooms,
3) The proposed master plan indicates the project is vested for 63,752 average daily trips
Chapter 380 06, Florida Statutes, and Rule 9J-2.0255, Florida Administrative Code, are based
on p m, peak hour trip analysIs. If the tnp generatIon potential of the project IS to contInue
to be included in the master plan the p,m, peak hour trip generation should also be Included.

parcels on Gateway Boulevard that are beIng proposed for commercial use and does not
allow the state or the region to review the updated traffic study if one IS necessary Given the
proposed large flexibIlIty of land use allocation WIthIn the project, the development order
condition should reqUIre annual monitonng at the intersectIon of Gateway Boulevard and

The Palm Beach County Traffic Division has reviewed the traffic
information dated March 12, 1997 for Quantum Park Master Plan
Amendment 8 In you letter, you requested that I review the information
for conformance to the County's Traffic Performance Standards As
with the earlier master plan amendment, this amendment expands the
variety of uses on many of the parcel Many of the changes allow
commercial uses that were not included before Since commercial uses
generate more traffic than office or industrial uses, these changes
increase the trip potential for these parcels You will note that the
potential increase in document in Tables 3 and 4 of the traffic study
Given this that this flexibility has been added to the development order,
I do not believe it will be possible to determine compliance with Traffic
Performance Standards until the actual uses are determined, as
Quantum Park approaches build-out.
I noticed that the City has include the maximum intensities for each land
use category and the total number of daily vested trips in the notes on
the Master Plan This will assist in determining if the approved
intensities or the approved traffic are exceeded in the future
The traffic study discusses the abandoning a section of Quantum
Boulevard The study assumes that increased traffic from one group of
parcel will be offset by diverted traffic from another group of parcels.
The basic assumptions seem reasonable, although there is no
quantitative analysis to show that this will be accurate One issue that
the traffic study does not address is the impacts if the reconfiguration of
parcels 6 through 11 and 22 through 31 does not have access to both

We have reviewed the letter from James Snyder of the Treasure Coast Regional
Planning Council dated April 16, 1997 regarding the Quantum Park NOPC. The
following responds to the four revIew comments provided in the subject letter
1) The land use maximums specified on the plan are not being
changed as a pa1 of this NOpe. The current plan allows
1,685,772 square feet ot offic~ space. However for clarity we
have provided the fol Owing background information Tab,e 2D
reflects the land use c:onsistent with the ADA. it includes 443
million square feet of industrial, 426.888 square feet of
commercial, and 1 68 million SCluare feet of office. it also includes
400 hotel rooms. The total trips were 67 154 DUring t~e review
prOcess, it was determined that the ~otel use should be treated as
commercial with a trade-off of square footage of 2GB sqLJar~ f'il'ilt of
commercial per hotel room.
Therefore the hotel trips ar@ now included 11'1 the tot~l commel'ciai
trips. This resulted in 63 752 tatal vested tnps; (liee revised table

industria!, including R&D, to 2,784,354 square feet. Thus
industrial use was decreased by 988,'44 square feet. At the same
time the City !;mited industrial square footage, it set the limIt on
office at ',685,772 sQuare feet.
The amendment No, 7 study had actually used' ,416, 625 square
feet (the 1,430,000 square feet referenced in \Ar Snyder's letter is
from another table ref~renced in :he st:Jdy). Thus the approved
office is 269,147 square feet more than that contained in the study
This IS more tran offset by the reduced industrial referenced above.
The effect of these changes represented a1 increase of 339 PM peak
hou' office trips and a corresponding decreas.e of 655 PM peak
hour industrial trips. Clearly, the'e is le~s Impact with the current
plan.
2) The approved trade-off mechanism to convert hotel to commercial
ensures that the project impacts cannot be exceeded In addition,
all development proposals for Quantum Park require site plan
review and approval by the City for indiVidual land use
compatibility Since there is no danger of Increased impads and
the City has site plan approval control there does
not seem to be a need to place a rraxlITlurn on hotel development
The proposed cap may impose an unnecessary NOpe to review
I,....hat would be no increase i:l impact.
3) The daily vesting was included at the rl!qut;!st of the City due to the
fact that the Palm Beach County Traffic Perform;a.nc;@ Standards
monitor traffic on a daily basis. This gives them a v.lIue to monitor

revIewed the "NotificatIOn of a Proposed Change to a Previously Approved Development of
RegIOnal Impact (DR!)" (NOPC) for Quantum Park DRI dated March 17, 1997 submItted to
CouncIl by James G Willard on March 17, 1997
The NOPC proposes to revise the master plan to simplIfy the land use designatIons on lots
wahm the DRI reducmg the number of categones of approved uses, place multIple uses on
the unsold lots to provIde more flexibIlity for better marketing, provide for the potential
redevelopment of lots 22 through 31 and 6 through 11 in conjunctIon WIth the abandonment
of Quatum Boulevard contiguous to these lots, and reVIse the development order as it relates
to traffic momtonng
The applicant believes the changes meets the critena of Section 38006(19)(e)2., Flonda
Statutes (F S ) CouncIl does not agree and believes the change IS presumed to be a

1) The previous traffic study done for the Quantum Park DR! assumes a total of 1,430,000
square feet of gross floor area (GFA) of office development. However, the Master Plan
includes 1,687,772 GFA for office development. Traffic Impacts due to the additlOnal office
development has not been addressed in the traffic study The increase in office would create
unreviewed traffic impact. Therefore, the master plan should be revised to include 1,430,000
GF A of office development to be consIstent with the traffic study
2) The project IS currently allows the tradeoff of square footage of commercial development
for hotel rooms (268 SF/room) The origmal plan proposed two 200-room hotels for a
maximum of 400 rooms. The master plan should be revised to mclude a maXImum of 400
hotel rooms.
3) The proposed master plan indIcates the project is vested for 63,752 average daily tnps. If
the trip generation potential of the project is to continue to be included in the master plan the
pm peak hour tnp generatIon should also be included.
4) There IS an eXIstmg development order condItion which reqUIres monitoring of tnps for
every commercial site approved along Park Ridge Road. The momtonng is required to
Identify mtersection improvements at Gateway Boulevard and Park RIdge Road. However,
project traffic WhICh was anticipated along Park RIdge Road may occur somewhere else m
the project based on the proposed changes to the master plan, Given the proposed large
fleXIbIlIty of land use allocatIon WIthin the project, a new condition should be included m the
development order to perform annual momtonng at the mtersection of Gateway Boulevard
and Park Ridge Road. ThIS condItIOn should determme what and when Improvements are

The Department has reviewed the March 17, 1997, notIce of proposed change for the
Quantum Pa.rk development of regIonal unpact (DRI) As proposed, the change IS to amend the
development order (DO) to vacate a portion of Quantum Boulevard and reconfigure the adjacent
lots on the master plan. In additIon, the applicant has further proposed to clanfy the permitted
land use categones Wlthm the development at the request of the Treasure Coast RegIonal
PlannIng CounCIL and the City of Boynton Beach.

The Department believes that the proposed changes wdl not create any addinonal
regIOnal unpacts since the traffic distribution generated from the DRI would not tncrease.
Therefore, we have concluded that the proposed changes do not constimte a substantial devlanon
pursuant to the criteria specified In Subparagraph 380 06(19)(e)2, Florida Statutes, and the
Department wdl not object to the proposed change.

Dear Mr Miller
On May 26, 1993, my staff and I met with representatives of Melvin Simon, Inc., its consultants
(Keith & Schnars) and city staff concermng the developer's commitment to pay a portion of the
construction cost for the referenced project.
After much discussion, we agreed that FDOT would accept the documented cost of the
engineering design of the II1terchange (approximately $ 971,000) which was made by the
developer on behalf of the project. FDOT would also consider the value of any right-of-way
within the limited access hne of Interstate 95 111 excess of the three acres required by the
Development Order (DO) FOOT expects the developer to pay the difference between the $ 1 8
million contribution reqll1red by the DO and the calculated credit for the design and nght-of-
way The Melvin Simon representatives planned to research and document these costs and
report their results. We have not received any update on thiS matter since our meeting
We are looking to the City as the enforcement agency for the DO to assist us in resolving this
issue. Please adVise us of the status 01 thiS matter so that we can begll1 to prepare a payment
schedule for the contnbuted funds
