In follow-up to my prevIOus letter prepared to mdIcate the CIty'S position relatIve to the current use options eXIsting on lots #32 through #38 of the Quantum Park PID, and in response to your letter dated September 28, 1999, I am providmg you WIth addItional facts whIch JUStIfy our position. Amendment #7 Ordmance No 96-65, representmg the seventh amendment to the DRI, adds both the "Industrial" and "Research and Development" (R&D) use optIOns to lots #32 through #38 At the tIme of the amendment, those lots already included "Office" use. At the time when Amendment #8 was filed, the use options for lots #32 through #38 included "Office" Amendment #8 The staff report (Memo No 97-213) for Amendment #8 listed all requested lot use modIfications including the deletion of the " Office" use from lots #32 through #38 The same report contained a staff recommendatIOn that the "Office" use should be retamed on lots #32 through #38 The mmutes of both the May 13, 1997 Planning and Development Board Meetmg, and May 20, 1997 City CommIssIOn meetmg, and the mitial draft of Ordmance No 97-20 all confirm that the request mcluded the deletion of the "Office" use option on lots #32 through #38 Amendment #8 originally included the request to omit "Office" from the list of use options for lots # 32 through #38, and the staff opposed this modification. The turning point m thIS process occurred between first readmg and second reading of Ordinance No 97- 20, when a deciSIOn was made by the applicant to accept certam staff recommendatIons includmg retaining the "Office" use option on the subject lots. ThIS deciSIOn is supported by a document prepared by the applIcant consenting to changes to the applicatIOn, handwrItten reVlSlons to the original draft Ordinance No 97-20, the final Ordmance No 97-20, and correspondence from the applIcant accepting the revisions made to, and the final version ofOrdmance No 97-20 America's Gateway to the Gulfstream 100 East Boynton Beach Blvd., P.O. "Industrial" use is now a broader designation and includes "Research and Development" as indicated in the NOpe, filed on March 17' 1997 Amendment #9 Neither the NOPC, staff report, nor Ordmance No 99-005 proposed, described or affected lots #32 through #38 The master plan submitted with the apphcation for Amendment #9 was in error by showmg only the "Industrial" use option on lots #32 through #38 Your client error in this regard cannot take the place of the formal amendment process. The facts stated herem provide clear eVIdence that the "Office" use option was not omitted from the subject lots by Amendment #8 to the Quantum Park DR!, despite what may be represented by data tables WhICh may not be consistently mamtained. The master plan, without a proper NOPC application, legal notice, and ordinance, was changed to show lots #32 through #38 without the "Office" use option. Therefore, WIthout the legal steps taken to offiCIally amend the master plan, the use options currently available on lots #32 through #38 remain "Office" and "IndustrIal" The CIty is therefore obligated to revise the current master plan to reflect Its official status. According to Ordinance No, 96-65, adopted on June 3, 1997, the subject lots are designated" Office/Industrial" The subsequent modification to the DRI, which just preceded the most current modification processed as Amendment #9, was processed by Ordinance 97-20 and did not modify the subjects lots, As Amendment #9 did not affect lots 32 through 38, the use options should currently remain as "Office" and "IndustrIal" I am certain that staff overlooked this error on Amendment #9 as our attention was focused on those specific lots affected by the application rather than those many other lots and use designations that should have remained unaltered by this recent amendment. A notIficatIOn of proposed change (NOPC) to the Quantum Park development of regional Impact (DRI) was submItted to Council by James G Willard on March 17, 1997 The NOPC proposes to reVIse the master plan to simplify the land use designatIOns on lots wIthin the DRI reducmg the number of categories of approved uses, place multIple uses on the unsold lots to provide more flexibility for better marketing, provide for the potentIal redevelopment of lots 22 through 31 and 6 through 11 in conjunction with the abandonment of Quantum Boulevard contIguous to these lots, and revise the development order as It relates to traffic monitoring The applicant provIded a traffic analysis to rebut the presumption mformation to show that the changes will not create any additional regIOnal impacts which would require substantIal deviatIOn reVIew Council responded with a letter dated April 16, 1997 with comments and concerns with the traffic study Council has received the response from Mr Steven G Godfrey of Kimley-Horn and Associates dated May 2, 1997 regarding Council's comments on the proposed change to the Quantum Park DRI and have the following comments/concerns. 1) The previous reVIsed traffic study done for the Quantum Park DRI (Amendment No 6) assumed a total of 1,430,000 square feet of gross floor area (GFA) of office development. However, the Master Plan included 1,687,772 GFA for office development. If the tnp generatIon potential of the project IS to contInue to be included in the master plan the p,m, peak hour trip generation should also be Included. 4) The proposed development order language is not acceptable because it precludes those parcels on Gateway Boulevard that are beIng proposed for commercial use and does not allow the state or the region to review the updated traffic study if one IS necessary Given the proposed large flexibIlIty of land use allocation WIthIn the project, the development order condition should reqUIre annual monitonng at the intersectIon of Gateway Boulevard and Park RIdge Road. The monitoring WIll determIne what and when improvements are needed to maIntaIn the facility at the adopted level of service. Per our conversatIon concernIng condition number 23 of the original development order for the Quantum Park DR!. Council recommends that the applicant either comply WIth the condItIon or submit a traffic analysis which shows that the Improvement IS not necessary Please call If you have any questions. I noticed that the City has include the maximum intensities for each land use category and the total number of daily vested trips in the notes on the Master Plan This will assist in determining if the approved intensities or the approved traffic are exceeded in the future The traffic study discusses the abandoning a section of Quantum Boulevard The study assumes that increased traffic from one group of parcel will be offset by diverted traffic from another group of parcels.
