Enclosed you will find five (5) copies (individual copies have been
simultaneously sent to the Treasure Coast Regional Planning Council,
the FDOT-District Four, the South Florida WMD, and the Department of
Environmental Protection) of the required documents for the above-
referenced map amendments This set of adopted amendments consists of
one map amendment for 14 acres of property (from Office Commercial to
Industrial) processed in connection with a Notice of Proposed Change
to the Quantum Park DRI, and one map amendment for a 30-acre parcel
(from Local Retail Commercial to Low Density Residential) as required
pursuant to a court order and known as The Isles at Hunter's Run
With respect to dates of adoption, the Quantum Park item was adopted
by the City on October 2, 1996, and the court action effectuating the
amendment on The Isles of Hunter's Run parcel occurred on June 17,
1996
Regarding provision of the Plan to other agencies, the Plan and
adopted support documentation has been provided to the reviewers They
were informed that their copy would be updated, rather than replaced
by subsequent amendments (new versions of the map will be provided)
With respect to the remaining submittal requirements outlined in the
amended Rule 9J-11 011, the following has also been provided,

WHEREAS, the City Commission of the City of Boynton
Beach, Florida has adopted a Comprehensive Future Land Use
Plan and as part of said Plan a Future Land Use Element by
Ordinance No 89-38 in accordance with the Local Government
Comprehensive Planning Act; and
WHEREAS, Quantum Associates or James G Willard, owners of
the property more particularly described hereinafter, has
requested the above mentioned Land Use Element amendment; and
WHEREAS, the procedure for amendment of a Future Land Use
Element of a Comprehensive Plan as set forth in Chapter 163,
Florida Statutes, has been followed; and
WHEREAS, after public hearing and study, the City
Commission deems it in the best interest of the inhabitants of
said City to amend the aforesaid Element of the Comprehensive
Plan as adopted by the City herein
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: Ordinance No 89-38 of the City is hereby
amended to reflect the following

THIS CAUSE came on to be beard on the Joint Stipulation of the
CITY OF BOYNTON BEACH, Plaintiff and SUMMIT ASSOCIATES, LTC.,
Defendant.
The Court havinq considered the stipulation of the
parties and being otherwise fully advised in the premises orders:
1. Subj ect to the provisions for nullification as set forth
in paragraph 3 below, the real property owned by SUMMIT ASSOCIATES,
LTD., which is the subject of this litigation is:
A. Provided a land use desiqnation of low density
residential.
B. Zoned Planned Unit Development (PUD), limited to
single family usage with a LOI of 4.00.
2. The Kaster Plan attached to the Stipulation for Entry of
Agreed Order as Exhibit RS", subject to the Development Order in
connection therewith, is hereby approved and shall be binding on
the CITY, the Defendant, SUMMIT ASSOCIATES, LTD., their successors
or assiqns, subject to later modification as is otherwise
authorized by the CITY OF BOYNTON BEACH Land Development
Regulations.

3. In the event that the real property which 18 tbe subj ect
of this litigation is not conveyed by Defendant, stJMKXT ASSOCIATES,
LTD., to Home Development Corporation of South Plorida, a Florida
corporation on or before June 30, 1996, this Agreed Order shall be
null and void and have no force and effect and this action shall
continue with the zoning and land use remaining unchanged, and the
master plan and related Developm8n~ Order o~ no force or etfec~.
4. If closing occurs on or before June 30, 1996, and,

following notice thereof as required by this Order, this action
shall be dismissed with prejudice with each party to bear 1ts own
costs and attorney fees.
5. The CITY further agrees to accept a 8urety band in lieu
of a letter of credit as security to assure ~at'. 1:I1e subdivision
improvements , with respect to the real property which is the
subject of this litigation, will be completed and paid for.
6. Counsel for Plaintiff and Defendant are ordered to submit
a joint notice to the Court intorminq the Court if the closinq ot

Enclosed you will find six (6) copies (individual copies have been simultaneously sent to the
Treasure Coast Regional Planning Council, the FDOT-DlstrIct Four, the South Flonda WMD,
and the Department of Environmental ProtectIon) of the required transmittal documents for the
above-referenced map amendments. The proposed amendment COIlSlSts of one map amendment
for 14 acres of property that IS bemg processed m connectIon with lhe forthcoming NotIce of
Proposed Change to the Quantum Park DR! (which IS being amended to allow commercial and
mdustnal uses on the subject site) Based on the projected mimmalunpact of thiS proposed
amendment, and since It IS consIdered to be consIstent WIth surrounding land uses as well as
WIth all goals, objectives and policies of the CIty'S ComprehensIve Plan, the City IS requesting
that this amendment not be reviewed.
WIth respect to the adopted amendment, The Isles at Hunter's Run PUD, thiS amendment has
occurred pursuant to a court-ordered amendment of an ongmal (1973) court order WhICh
stIpulated commercial land use and zomng designations on this 30-acre parcel The results of
the histonc lItIgation between the City of Boynton Beach and SUlDIDlt Associates Ltd. IS
documented within Appendix "D" of the Comprehensive Plan Future Land Use Suppon
Document and referenced by footnote on the Future Land Use Map The necessary legal
proceedmgs were finalized on June 17, 1996, whIch effectuated the amendment of the Future
Land Use Map to Low Density ResIdential land use Smce the DCA did not have an
opportumty to review the Isles at Hunter's Run amendment as a "proposed amendment",

standard for dlstnct parks, 2 5 acres per 1,000 persons, this surplus will serve an
additional 5,504 residents It should be noted that BEBR estimated that the City's
permanent populatIon grew by 237 persons between 1994 and 1995 Even If post-1995
growth IS accounted for, the total increase in population is likely less than 400 persons
The 56 addItional units (or 140 persons) related to the adopted amendment are
inSIgnificant given the current surplus in district park acreage

The Palm Beach County Traffic Division has reviewed the traffic
impact study entitled Ana1vsis of Hiah Ridae Road and Gatewav
Bou1 evard, pursuant to the Traffi c Performance Standards in
Article 15 of the Palm Beach County land Development Code This
study does not meet the requirements of the Traffic Performance
Standards of Palm Beach County for changing the uses of the PCD
Center from office to retail Such a study would need to show
that the area roadways wi 11 operate at the adopted 1 eve 1 of
service standard, with the additional traffic from the retail
uses, at the build-out of the project
It appears that this study was prepared in order to address an
intersection operation analysis requirement of the 1994 Quantum
Park DRI Development Order The study makes some assumptions
without any information as to why these assumptions are
accurate The assumptions include
- The study states, -although additional land is being added, no
additional traffic demand will be created since approved
development entitlements will be shifted to these sites from
other portion of the development - There is no documentation
showi ng how the development wi 11 be sh i fted There is no
documentation that there will be no increase in traffic
Shifting the development could result in shifting the traffic
impacts There is no analysis of the change in traffic impact
at critical roads and intersections
- The study states that the trip generation analysis for the
undeveloped sites were done in a conservative individual basis
This is true for the 5 office sites (495 trips vs 350 trips)
This -conservative- approach was not used for the 2 commercial
sites (694 trips vs 911 trips)
- There are trip generation rates for industrial uses based on
both the number of acres and the amount floor area The study
uses 418 trips based on the 57 63 acres Based on the 1,004,145
square feet of floor area, there would be 1,084 trips

The total estImated domestic water demand for the proposed use IS US 958 GPO versus
67,353 G-PD for the previous approved use.
Based on a 12 hour demand period and a peak factor of 2, the peak hourly demand for the
proposed domestic use is 378 OPM. Total peak demand for domestic and fire flow is \828
GPM.
There is an existing 10 mch ductile iron water main along Park Ridge Road providing
domestic water and fire protectIOn to the proposed lots. TIle 10 inc..h water main was flow
test~d at the eXlStlOg Publix Distribution Center ill early 1996, and the results are as follews

The available flow of 4,407 GPM exceeds the proposed water demand of 3,828 GPM.
Th~refore, the existIng system is adequate to serve the proposed uses.
There IS an 8 inch diameter graVIty sewer along Park Ridge Road avallable tc- serve the
proposed lots. The gravity sewer is capable of providing approXlmatel) 360 OP'.'! of sev. a
flow, which exceeds the 328 GPM peak flow anticIpated for the proposed uses.
Conclusion
The existing sewer and water roams wlL'1in Park Ridge Road are adequate to provIde sewer
and water service for the proposed commercial uses based on peak hour demands. There is
approXImately 8 percent excess capacity of sewer and 13 percent excess capacitv for water

Dear Mr Weisberg:
This office is processing a land use amendment/rezoning request for the above-referenced
project, which is located on a 14 acre site at the southeast corner of Gateway Boulevard
and High Ridge Road. For your information, this application has been submitted by
Quantum Associates In connection with an amendment to their DRI which adds this 14
acres to the DRI boundaries. However, you will note that since this 14 acres is platted,
it was vested by the City for 287,250 square feet of office (3,165 trips) that was never
constructed! Please review the attached traffic impact study for conformance with the
County's TPS ordinance.
