October 2, 1996 and determined that it meets the requirements of Chapter 163 Part II, Florida
Statutes, for compliance, as defined in Subsection 63 3184(1)(b) The Department is issuing a
Notice of Intent to find the plan amendment In Compliance The Notice of Intent has been sent

1. Subject to the provisions for nullification as set forth
in paragraph 3 below, the real property owned by SUMMIT ASSOCIATES,

Florida Statutes. have been conducted after the notices required
by Paragraphs 163.3184(15)(b) and (c), Florida Statutes. Upon
adoption the local government shall transmit to the Depart-
ment a copy of the ordinance and the required notices;
(f) The comprehensive plan shall be evaluated and up-
dated as required by Section 163.3191, Florida Statutes, and
this chapter. A copy of the adopted report required by Section
163.3191, Florida Statutes, shall be transmitted to the De-
partment at the time of the governing body's transmittal of
related amendments pursuant to Subsection 163.3191(4),
Florida Statutes; and
(g) 1 comprehensive plan, element, or plan amendment
applicable to a designated area of critical state concern shall
not become effective until reviewed and approved as provided
in Section 38005 Florida Statutes, and any rules promul-
gated pursuant to that section.
(h) A comprehensive plan or plan amendment applicable
to the Wekiva River Protection Area, in addition to meeting
the requirements for compliance pursuant to Section 163.3 184,
Florida Statutes, must meet the requirements of Section
369.301, et seq., Florida Statutes, the Wekiva River Protec-
tion Act.
(i) Local governments may enter into and are encour-
aged to enter into joint planning agreements as provided in
Chapter 163, Florida Statutes.
(j) A local government may include, as part ofits adopted
plan, documents adopted by referf'nce but not incorporated
verbatim into the plan. The adoption by reference must iden-
tifY the title and author of the document and indicate clearly
what provision or edition of the document is being adopted.
The adoption by reference may not include future amendments
to the document because this wou':! violate the statutory pro-
cedure for plan amendments and frustrate public participa-
tion on those amendments. A local government may include
a provision in its plan stating that all documents adopted by
reference are as they existed on a date certain. Unless docu-
ments adopted by reference comply with Rule 91-5.005(2)(g),
F.A.C., or are in Florida Statutes, Florida Administrative Code,
United States Code, or the Code of Federal Regulations, cop-
ies or summaries of the documents shall be submitted as sup-
port documents for the adopted portions of the plan or plan
amendment.
(9) Recognition of Private Property Rights and Vested
Rights. The Department recognizes private property rights
created by law and guaranteed by the State and Federal Con-
stitutions and the existence of legitimate and often competing
public and private interests inland use regulations and other
government action. Local governments may include appro-
priate provisions in their plans for the recognition of statutory
and common law vested rights.

9J-5.0053 Evaluation and Appraisal Reports and
Evaluation and Appraisal Amendments.
(1) PURPOSEANDINTENT It is the intent of the Leg-
islature that each unit of local government required to adopt a
comprehensive plan pursuant to Chapter 163, Part II, F.S.,
periodically update its comprehensive plan through the prepa-
ration and adoption of an evalUltion and appraisal report
(EAR) and adoption of an evaluation and appraisal report-
based plan amendments in accordance with Section 163.3191,
F.S. This Rule establishes the procedures and criteria for the
preparation, transmittal, adoption and sufficiency review of
local government comprehensive plan evaluation and appraisal
reports and evaluation and appraisal report-based plan amend-
ments submitted pursuant to the Local Government Compre-
hensive Planning and Land Development Regulation Act,
Chapter 163, Part II, F.S., and Chapters 91-5 and 91-33, F.AC.
The purpose of the evaluation and appraisal report is to assess
and evaluate the success or failure of the local government's
comprehensive plan. including the validity of the projections,
the realization of the goals and objectives, and the implemen-
tation of the plan's policies. The report shall also address
changes in local conditions, changes in state and regional poli-
cies on planning and growth management and through adop-
tion of related amendments, to update the local government's
comprehensive plan to address the issues raised in the report.
(2) TRANSMITTAL REQUIREMENTS FOR PRO-
POSED EVALUATION AND APPRAIS \L REPORT
(a) In accordance with the sched: le established in Rule
91- 33, EA.C., the local planning agency shall prepare and
transmit a proposed evaluation and appraisal report to the lo-
cal governing body for review and adoption, and contempora-
neously send a copy to the Department. At a minimum, the
format and content of the proposed report will include a table
of contents; numbered pages~ element headings; section head-
ings within elements; a list of included tables, maps and fig-
ures; titles and sources for all included tables, maps and fig-
ures; where applicable, maps shall include major natural and
man-made geographic features, city, county and state lines;
maps shall contain a legend indicating a north arrow, map
scale and date; a preparation date; and the name of the preparer.
(b) The proposed evaluation and appraisal report will
assess and evaluate the success or failure of the local
government's adopted comprehensive plan, including the va-
lidity of the projections, the realization of the goals and objec-
tives, and implementation of the plan's policies. The pro-

(c) Upon completion of its sufficiency review, the De.
partment will notify in writing the local governing body of its
sufficiency determination.
(d) If the Department determines that the adopted report
or addendum sufficiently addresses the requisite provisions of
Section 163.3191, F S., and this Rule Chapter, the local gov-
ernment shall proceed with adoption of plan amendments nec-
essary to implement the recommendations in the report or
addendum, and may proceed with plan amendments in addi-
tion to the evaluation and appraisal report-based plan amend-
ments.
(e) If the local planning agency fails to transmit its evalu.
ation report or addendum to the Department by the established
transmittal date, or if the local governing body fails to adopt
the evaluation and appraisal report by the established adop-
tion date, the local governing body is prohibited from amend-
ing its comprehensive plan until such time as the local gov-
erning body adopts and submits an evaluation and appraisal
report or addendum that the Department determines suffi-
cientlyaddresses the requisite provisions of Section 163.3191,
F.S., and this Rule Chapter. If the Department determines
LUlt the adopted report or addendum is not sufficient because
it fails to address the requirements of Section 163.3191, F.S.,
and this Rule Chapter, the local governing body is prohibited
from amending its comprehensive plan until such time as the
local governing bQdy adopts and submits an evaluation and
appraisal report or addendum that the Department detennines
sufficiently addresses the requisite provisions of Section
163.3191, F.S., and this Rule Chapter, except for plan amend-
ments to implement recommendations in the adopted evalua-
Don and appraisal report or addendum.
(f) If local governments are prohibited from amending
the comprehensive plan pursuant to Rule 9J-5 0053(4)(e),
F.A.C., then during the time period of the prohibition starting
subsequent to the submission date specified in Rule 9J-33,
F.A. C., amendments will not be processed by the Department,
and will be returned to the local government except for plan
amendments to implement recommendations in the evalua-
tion and appraisal report. In order to secure review thereafter,
the local government may resubmit the amendments in accor-
dance with the requirements of Sections 163.3184, 163.3187
and 163.3189, F S., following a determination that the local
government's evaluation and appraisal report or addendum is
sufficient.
(5) ADOPTION OF EVALUATION AND APPRAISAL
REPORT AMENDMENTS.
(a) Except when a local governing body submits its
amendment simultaneously with its evaluation and appraisal
report, within one year of adoption of an evaluation and ap-
praisal report, and within one year of adoption of an adden-
dum to the earlier report, the local government shall amend
its comprehensive plan based upon the recommendations con-
tained therein unless a six-month extension is granted by the
department
(b) All evaluation and appraisal report-based plan
amendments, including amendments adopted pursuant to an
addendum, shall be adopted in accordance with the proce-
dures contained in Sections 163.3184,163.3187, and 163.3189,
F.S., and shall be subject to compliance review as that term is
defined in Section 163.3184(1)(b), F.S.
(c) Notwithstanding the requirements of subsection (1)
of this section, a local government may adopt its evaluation
and appraisal report-based plan amendments simultaneously
with the adoption of its report or addendum. An evaluation
and appraisal report adopted simultaneously with the local
government's adoption of the report-based plan amendments
shall be adopted in accordance with Sections 163.3187(5) and
163.3191, F.S., and this Rule Chapter, including the require-
ments for public notice and public hearings. The adoption of
a report simultaneous with the adoption of report-based plan
amendments shall not act as a bar to, or limitation on, the
effect of the Department's sufficiency review of the adopted
report, nor may the Department waive its responsibilities for
review of such report. Evaluation and appraisal report-based
plan amendments adopted simultaneously with the local
government's adoption of its report shall be adopted in accor-
dance with Sections 163.3184, 163.3187, and 163.3189,F.S.,
and shall be subject to compliance review.
(6) EVALUATION AND APPRAISAL REPORT MINI-
MUM CRITERIA.
(a) The evaluation and appraisal report shall include an
evaluation and assessment of the success or failure of the lo-
cal government's adopted comprehensive plan, including the
validity of the projections, the realization of the goals and
objectives, and the implementation of the plan's policies. The
evaluation and appraisal report shall also address changes in
local conditions; the effect on the comprehensive plan of
changes to: the state comprehensive plan, Chapter 163, Part
II, F.S., Chapter 9J-5, F.A.C., and the appropriate strategic
regional policy plan; changes needed to update the compre-
hensive plan, elements, or portions thereof; reformulated or
additional goals, objectives, policies, maps, schedules, and
procedures; and through adoption ofreport-based plan amend-
ments, update the local government's comprehensive plan to
address the issues raised in the report; and otherwise address
the requirements specified in Section 163.3191, F.S., and this
Rule Chapter. The report shall contain appropriate statements,
including data, analysis and conclusions, using words, maps,
illustrations, schedules, or other graphic formats that address
the following:
1. Condition of Each Element at the Time of Adoption,
which shall include summaries of data and analysis from each
element of the existing adopted plan.
2. Condition of Each Element at the Date of Report
a. Summaries of each element describing current con-
ditions;
b. A summaI)' of all land use text and map amendments
and all other major text amendments made to the plan;
c. A new existing land use map and table of existing
land uses for current conditions as of the date of the report;

163.3187 Amendment of adopted comprehensive
plan.-
(1) Amendments to comprehensive plans adopted
pursuant to this part may be made not more than two
times during any calendar year, except:
(a) In the case of an emergency, comprehensive plan
amendments may be made more often than twice dunng
the calendar year if the additIOnal plan amendment
receives the approval of all ofthe members of the
governing body "Emergency" means any occurrence or
threat thereof whether accidental or natural, caused by
humankind, in war or peace, which results or may result
in substantial injury or harm to the population or substan-
tial damage to or loss of property or public funds,
.J (b) Any local government comprehensive plan
amendments directly related to a proposed development
of regional Impact, including changes which have been
determined to be substantial deviations and including
Florida Quality Developments pursuant to s. 380 061,
may be mitiated by a local planning agency and consid-
ered by the local governing body at the same time as the
applicatIOn for development approval using the proce-
dures provided for local plan amendment in this section
and applicable local ordinances, without regard to
statutory or local ordinance lImits on the frequency of
conSideration of amendments to the local comprehensive
plan. Nothing in this subsectIon shall be deemed to
require favorable consideratIOn of a plan amendment
solely because it is related to a development of regional
impact.
(c) Any local government comprehensive plan
amendments directly related to proposed small scale
development activities may be approved without regard to
statutory limits on the frequency of consideration of
amendments to the local comprehensive plan. A small
scale development amendment may be adopted only
under the following conditions.
I The proposed amendment involves a use of 10
acres or fewer and.
a. The cumulative annual effect of the acreage for all
small scale development amendments adopted by the
local government shall not exceed.
(I) A maximum of 120 acres in a local government
that contains areas specifically designated in the local
comprehensive plan for urban mfill, urban redevelop-
ment or downtown revitalization as defined in s.
,
163.3164, transportation concurrency exceptIOn areas
approved pursuant to s. 163.3180(5), or regional activity
centers and urban central business districts approved
pursuant to s. 380 06(2)(e); however, amendments under
this paragraph may be applIed to no more than 60 acres
annually of property outside the designated areas listed in
this sub-sub-subparagraph.
(II) A maximum of 80 acres in a local government
that does not contain any of the designated areas set forth
in sub-sub-subparagraph
b The proposed amendment does not involve the
same property granted a change within the prior 12
months.
c. The proposed amendment does not involve the
same owner's property within 200 feet of property
granted a change within the prior 12 months.
d. The proposed amendment does not involve a text
change to the goals, policies, and objectives of the local
Government's comprehensive plan, but only proposes a
~ .
land use change to the future land use map for a slte-
specific small scale development activity
e. The property that is the subject of the proposed
amendment is not located within an area of critical state
concern.
f. If the proposed amendment involves a residential
land use, the residential land use has a density of 10 units
or less per acre, except that this limitation does not apply
to small scale amendments described in sub-sub-subpara-
graph a.(I) that are designated in the local comprehensive
plan for urban Infill, urban redevelopment, or downtown
revitalizatIOn as defined in s. 163.3164, transportation
concurrency exception areas approved pursuant to s.
163.3180(5), or regional activity centers and urban central
business districts approved pursuant to s. 380 06(2)(e).

a. A local government that proposes to consider a
plan amendment pursuant to this paragraph is no~ .
reqUired to comply with the procedures and publIc notice
requirements of s. 163.3184(1 5)(c) for such plan amend-
ments if the local government complies WIth the provi-
sions in s, 125.66(4)(a) for a county or in s. 166 041(3)(c)
for a municipality If a request for a plan amendment
under thiS paragraph is initiated by other than the local
government, public notice is required.
b The local government shall send copies of the
notice and amendment to the state land planning agency,
the regional planning council, and any other person or
entity requesting a copy This information shall also
include a statement identifying any property subject to the
amendment that is located within a coastal high hazard
area as identified in the local comprehensive plan.
3 Small scale development amendments adopted
pursuant to this paragraph require only one public h:aring
before the governing board, which shall be an adoptIOn
hearing as described in s. 163.3184(7), and are not subject
to the requirements of s. 163.3184(3)-(6) unless the local
government elects to have them subject to those require-
ments.
(d) Any comprehensive plan amendment required by
a compliance agreement pursuant to s. 163.3184(16) may
be approved without regard to statutory limits on the
frequency of adoption of amendments to the comprehen-
sive plan.

(e) A comprehensive plan amendment for location of
a state correctional facility Such an amendment may be
made at any time and does not count toward the limitation
on the frequency of plan amendments.
(2) Comprehensive plans may only be amended in
such a way as to preserve the mternal consistency of the
plan pursuant to s. 163.3177(2). Corrections, updates, or
modifications of current costs which were set out as part
of the comprehensive plan shall not, for the purposes of
this act, be deemed to be amendments.
(3)
(a) The state land planning agency shall not review
or Issue a notice of intent for small scale development
amendments which satisfy the requirements of paragraph
(l)(c) Any affected person may file a petition with the
Division of Administrative Hearings pursuant to ss.
120.569 and 120.57 to request a hearing to challenge the
compliance of a small scale development amendment
with this act within 30 days following the local
government's adoption of the amendment, shall serve a
copy of the petition on the local government, and shall
furnish a copy to the state land planning agency An
administrative law judge shall hold a hearing in the
affected jurisdiction not less than 30 days nor more than
60 days following the filing of a petition and the assign-
ment of an administrative law judge. The parties to a
hearing held pursuant to thiS subsection shall be the
petitioner, the local govem'nent, and any intervenor In
the proceedmg, the loc~l government's detennination that
the small scale development amendment is in compliance
IS presumed to be correct. The local, government's
determination shall be sustained unless it is shown by a
preponderance of the evidence that the amendment is not
m compliance with the requirements of this act. In any
proceeding initiated pursuant to this subsection, the state
land planning agency may intervene.
(b)
1 If the administrative law judge recommends that
the small scale development amendment be found not in
compliance, the administrative law judge shall submit the
recommended order to the Administration Commission
for fmal agency action. If the administrative law judge
recommends that the small scale development amendment
be found in compliance, the administrative law judge
shall submit the recommended order to the state land
planning agency
2. If the state land planning agency detennines that
the plan amendment is not in compliance, the agency
shall submit, Within 30 days following its receipt, the
recommended order to the Administration Commission
for final agency action. If the state land planning agency
determines that the plan amendment is in compliance, the
agency shall enter a fmal order within 30 days following
its receipt of the recommended order
(c) Small scale development amendments shall not
become effective until 31 days after adoption. If chal-
lenged within 30 days after adoption, small scale develop-
ment amendments shall not become effective until the
state land planning agency or the Administration Com-
mission, respectively, issues a fmal order determining the
adopted small scale development amendment is in
compliance.
(4) Each governing body shall transmit to the state
land planning agency a current copy of ItS comprehensive
plan not later than December 1, 1985 Each governing
body shall also transmit copies of any amendments it
adopts to its comprehensive plan so as to continually
update the plans on file with the state land planning
agency
(5) Nothing in this part is intended to prohibit or
limit the authority of local governments to require that a
person requesting an amendment pay some or all of the
cost of public notice.
V(6) No local government may amend its comprehen-
sive plan after the date established by rule for submittal of
its evaluation and appraisal report unless It has submitted
its report or addendum to the state land planning agency
as prescribed by s. 163.3 191, except for'
(a) Plan amendments to implement recommenda-
tions in the report or addendum
(b) Plan amendments described m paragraph (1)(b).
(c) Plan amendments described in s.
163.3184(16)(d) to implement the terms of compliance
agreements entered into before the date established for
submittal of the report or addendum.
When the agency has determined that the report or
addendum has sufficiently addressed all pertment
provisions of s. 163.3191, the local government may
proceed with plan amendments in addition to those
necessary to implement recommendations in the report or
addendum.
(7) The state land planning agency shall consider an
increase in the annual total acreage threshold for small
scale amendments, particularly with regard to the unique
characteristics among the various local governments, and
shall report its review to the Governor, the Speaker of the
House of Representatives, and the President of the Senate
on or before January 15, 1996

163.3189 Process for amendment of adopted compre-
hensive plan.-
(1) The procedure for amendment of an adopted
comprehensive plan or plan element which has been
found to be in compliance shall be solely as prescribed by
this section.
(2) A local government which has a comprehensive
plan that has been found to be in compliance may amend
its comprehensive plan as set forth in s. 163.3184, with

WHEREAS, the City Commission of the City of Boynton
Beach, Florida has adopted a Comprehensive Future Land Use
Plan and as part of said Plan a Future Land Use Element by
Ordinance No 89-38 in accordance with the Local Government
Comprehensive Planning Act; and
WHEREAS, Quantum Associates or James G Willard, owners of
the property more particularly described hereinafter, has
requested the above mentioned Land Use Element amendment; and
WHEREAS, the procedure for amendment of a Future Land Use
Element of a Comprehensive Plan as set forth in Chapter 163,
Florida Statutes, has been followed; and
WHEREAS, after public hearing and study, the City
Commission deems it in the best interest of the inhabitants of
said City to amend the aforesaid Element of the Comprehensive
Plan as adopted by the City herein
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: Ordinance No 89-38 of the City is hereby
amended to reflect the following
That the Future Land Use of the following described land
shall be designated as Industrial
Said land is more
particularly described as follows
Lots 80, 81 and 82 as per the plat of PCD
Center, Plat Book 60, Pages 106 and 107,
Public Records of Palm Beach County,
Florida
Section 2: That any maps adopted in accordance with the
Future Land Use Element shall be amended accordingly
Section 3: All ordinances or parts of ordinances in
conflict herewith are hereby repealed

THIS CAUSE came on to be heard on the Joint Stipulation of the
CITY OF BOYNTON BEACH, Plaintiff and SUMMIT ASSOCIATES, LTD.,
Defendant.
The Court havinq considered the stipulation of the
parties and beinq otherwise fully advised in the premises orders:
1. Subject to the provisions for nullification as set forth
in paraqraph 3 below, the real property owned by SUMMIT ASSOCIATES,
LTD., which is the subject ot this litiqation is:
A. Provided a land use desiqnation of low density
residential.
B. Zoned Planned Unit Development (POD), limited to
8inqle family usaqe with a LUI of 4.00.
2. The Master Plan attached to the Stipulation for Entry of
Aqreed Order as Exhibit nB", subject to the Development Order in
connection therewith, is hereby approved and shall be bindinq on
the CITY, the Defendant, SUMMIT ASSOCJ:ATES, LTD. I their successors
or assiqns, subject to later modification as is otherwise
authorized by the CITY OF BOYNTON BEACH Land Development
Requlations.

3. In the event that the real property which i. tbe subj ect
of this litigation is not conveyed by Defendant, SUMHIT ASSOCIATES,
LTD., to Home Development Corporation of South Florida, a Florida
corporation on or betore June 30, 1996, this Agreed Order shall be
null and void and have no force and effect and this action shall
continue with the zoning and land use remaininq unchanged, and the
master plan and related Development O~er ot no force or effect.
4. If closing occurs on or before June 30, 1996, and,
.
following notice thereof as required by this Order, ~s action
shall be dismissed with prejudice with each party to bear its own
costs and attorney fees.
5. The CITY further agrees to accept a surety bond in lieu
of a letter of credit as security to assure that the subdivision
improvements , with respect to the real property which 1s the
subject of this litigation, will be completed and paid for.
6. Counsel for Plaintiff and Defendant are orclered to submit
a joint notice to the Court intorminq the Court if the closinq of
the transaction occurred or did not occur.
