NATURE OF REQUEST
Jeff Lis, agent for Daniel Catalfumo, contract purchaser of lots 12
- 14 within Quantum Park, is requesting abandonment of a twelve
(12) foot wide drainage easement The center of the easement is
located at the property line of Quantum park, lots 13 and 14 The
abandonment is requested in connection with the proposed
development of lots 12-14 due to encroachment of a future building
over a portion of the easement Site plan approval of the proposed
building is running concurrently with this abandonment request
BACKGROUND
The easement was created when the property was platted in June of
1987 The easement is an exclusive easement for drainage purposes
and dedicated to the Quantum Park Property Owners Association, Inc
The drainage conveyed through the easement infrastructure is storm
water from Quantum Boulevard The storm water outfalls into a
drainage tract that is located at the west terminus of the
easement
ANALYSIS
The easement contains infrastructure piping that can be relocated
and still function properly The applicant is proposing to
dedicate a new easement and reroute the infrastructure to avoid
interfering with the proposed building The new location of the
infrastructure is shown on the drainage plans that are being
reviewed by the Development Department during the site plan review
of the proposed project
The City departments involved in review of a request for
abandonment and the parties that were given public notice of the
requested abandonment are identified below Public notice is given
to the property owners that abut the easement to be abandoned The
Engineering Department notifies the various utility companies that
have a potential interest in the easement
The applicant's reasons for an abandonment and the grounds that
support the request are shown on the enclosed copy of the last page
of the abandonment application form The legal description and
easement to be abandoned are shown on the attached Exhibit "A"

RECOMMENDATION
staff recommends approval of the abandonment of the drainage
easement shown and described on the attached Exhibit IIAII, subject
to the city receiving written documentation declaring that the
Quantum Park Property OWners Association, Inc , has no objection to
the abandonment and the attached comment from the Development
Department memorandum dated November 8, 1994 The requirement to
notify by mail the owners of the property abutting the property
sought to be abandoned (in this case, the Quantum Park Property
Owners Association, Inc ) was waived based on the anticipated
receipt of the referenced documentation from the property owners
association.

easements, and to the best of my knowledge and belief, those
easements are not being modified
