Under Section 3 of the License Agreement, either party has the riqht to terminate the License Agreement at any time, and for any reason, by giving thirty (30) days written notice to the other specifying the date of termination Further, under Section 6 of the License Agreement, notice given by the attorney for either party shall be effective as if given by said party Since Quantum Associates, the successor in interest to Riteco Development Corporaton, is now the fee simple owner of the property formerly known as the City's police firing range, there is no longer any purpose or reason for the License Agreement Therefore, pursuant to Section 3, Quantum Associates, through it!'> undersigned attorney, hereby gives written notice to the City that the subject License Agreement shall be terminated as of March 10, 1988 Sincerely, :J>cuJL-~~- David S P.1-6ss1y DSP/dl cc Steven W. Box 310 Boynton Beach, Florida 33435 Re Removal of fill material - Quantum Park Dear Carmen: In accordance with our discussion of nearly one month ago, we have tried to establish a number of different ways to dispose of excess fill materials that have been generated on the Quantum Park site One of the major sources of excess fill material has been the allocation of spoils previously generated by excavation of the E-4 Canal, and the additional material excavated as part of the Publlx development In order to accomplish disposal of some of the excess material, we have increased the elevations of the lake bottom to the highest elevations permissible by South Florida Water Management We have also investigated the possibility of placing fill materials that may be needed for the future 1-95 Interchange, however, such placement of fill material has proven infeasible At this time, we wish to move forward with the sale of fill material and removal from our site This Is needed in order to complete our work in accordance with the approved drawings and specifications for the project. Our contractor is prepared to remove this material from the site in a manner that least impacts the City and Is fully consistent with City regulations governing such procedures. The final amount of fill is not exactly known at this time due to a final calculation of shrinkage that .will occur based upon compaction. However, it is believed that we will nee~ to remove between 100,000 and 150,000 cubic yards We would like to begin this removal as soon as possible, therefore, I hereby request a meeting with yourself, Tom Clark,and the contractor, to discuss the procedural details of this removal. These issues were raised during preliminary discussions held bet- ween the applicant and the City's technical staff in October of last year, and again at the Technical Review Board (TRB) meeting of October 9, 1984. On both occa- sions the applicant was referred to the City's Canprehensive Plan Energy Element which is based, in part, on the Treasure Coast Regional Planning Council's Regional Energy Plan. OONSISTENCY WITH OJMPREHENSIVE PLAN ~ EI>>1ENT. As noted in the 'K:RPC's DRI Assessrrent Report, the application indicates that the developer is carmitted to the implementation of energy conservation measures In that regard, the application is generally consistent with the Canprehensive Plan Energy Element. Specific areas of consistency are as follows 1. The utilization of "natural" energy systems such as the preservation of existing trees, wetlands and habitat; the use of native vegetation; and the use of energy-conscious landscaping techniques 2 provisions for the utilization of energy-efficient transportation alternatives such as rrass transit, ridesharing and van pcx:>1ing, as well as access for pedestrians and cyclists; and carmi tments for efficiency improvements to adjacent roadways 3. The incorporation of energy as a fundamental design consideration through the establishment of an architectural review carmi ttee for energy conservation rreasures The application qualifies the extent to which energy conservation rreasures rray be incorporated, however, as being based on 1) a favorable cost-effectiveness ratio relating to cost/sales price, and 2) acceptability within code requirements. -2- While the importance of the impact of first cost variables to the developer's cost-effectiveness ratio is recognized, the econanic significance of long-tenn operations and maintenance costs to the property ONI1ers association and tenants should not be overlooked. Life-cycle costing is an effective method for deter- mining the extent to which 0 & M costs - particularly that of energy expen- ditures -- can and should affect cost-effectiveness detenninations In the area of code acceptability, it should be noted that the City staff has been evaluating the extent to which its codes and ordinances pose impediments to the utilization of energy-conscious planning, design and construction alter- nati ves. To that end, any code requirements which might pose a barrier to the utilization of energy-efficient alternatives should be addressed with the City staff in the early ~ases of the project's developnent RF.XXM1ENDAT10NS. The follCMing recarmendations are provided in order to facilitate the incor- poration of energy-conscious techniques proposed by the applicant 1. Consider utili zing the services of a third-party van pool operator at the appropriate time. '!his service could be coordinated through the proposed property ONI1ers association or by the individual tenants, possibly in cooperation with adjacent ar;:>loyment centers such as Motorola and the Debartolo Mall. 1nfonnation about the Florida Department of Transportation sponsored "Share A Van" program is available from this office. 2. Consider the establishment of a designated "Park and Ride" facility in the vicinity of the proposed N W. 2200 Avenue and 1-95 interchange in coordination with the Florida Department of Transportation. 3 Consider a rrechanism to ensure the protection of solar access rights or "easements" for tenant sites opting to utilize this technology. (This could be coordinated through the architectural review carmittee). 4 Consider the use of high-efficiency lCM-pressure sodium vapor lighting in areas where the associated IIOnochranatic effects would not be a significant factor (i e , storage areas, loading docks, alleyways, etc. ) 5 Consider the utilization of recycling facilities and the secondary materials market to mitigate the negative impacts posed by solid and hazardous waste materials and their associated disposal requirements Agencies such as the Southeast Waste 1nfonnation Exchange (founded by the Florida O1amber of Carmerce) provide a clearinghouse for the reco- very and reuse of a variety of material that would otherwise pose serious disposal and/or treatment problems. -3- Also, the Energy Element requires the inclusion of language in support of the conservation and efficient nanagement of energy resources in applicable City ordinances, resolutions and proclamations. 'Iherefore, language to this effect should be included in the ordinance adopting the Developnent Order for the pro- posed Boynton Beach Park of Carmerce. It is noted that the 'lOUlC DRI Assessment Report (p. 111-7, Recarmendation #2) places the condition on the developer to implement the energy conservation measures endorsed and/or recarmended by the architectural review carmi.ttee, the guidelines for which shall be transmitted to the City and the 'lOUlC. This office stands ready to assist in this regard, and in the implementation of the above reccmnendations, and carmends the developer for the extent to which energy issues have been addressed by the project team c:~ 7) I} I tILL . f1J~ Cra1g Grabeel Special Project & Energy Control Officer CG:sr R 'r'r~"TT." ~"1MD ":", r~\i, "l.~ ~ ~}V ~- '- '--......._--J :;......c- -t._ ...U OCT j , ,OR~ MEMORANDUM PLAd"i, ... u,-?T October 10, 1984 TO Carmen Annunziato, City Planner RE Boynton Beach Park of Commerce, D R I The following comments are made relative to subject project Public Rights-of-way Landscape Installation & Maintenance 1 If N W 22nd Avenue is to have a median which the City will assume maintenance of, it is recommended that the type of plantings and irrigation systems be approved by the City prior to installation 2 If roadways within the park are public, recommend the Park Property Owners Association be responsible for landscaping and maintenance of landscaping of the public rights-of-way Reserve Acreage for Public Recreation A portion of this project borders the current FOP A site which is designated as a future public recreation area and currently houses the police shooting range The City's comprehensive plan is currently under review Initial anaylsis of the recreation & open space element reveals additional acreage needs for the future in north Boynton Beach The addition of acreage adjacent to the FOP A site would appropriately expand this current 12 acre site to a 20 to 30 acre site and would accomodate future development of a north district park site As large acreage tracts which can accomodate district size parks have all but disappeared, and as this project eliminates 540 acres of such potential acreage, it is recommended that the 17 6 acre pod of this project which is adjacent to the western property line of the FOP A site be considered for dedication to the City for public park purposes ~~ Charles C Frederick, Director Recreation & Park Department CCF pb CC Peter L Cheney John F Wildner MEMORANDUM 1fl ~ (-.- "r"....;"'1t ~----.. -=:.f'~. FROM Edward G Hillery, Jr Captain, Road Patrol Boynton Beach Police Dept SUBJECT Application for Development Approval Boynton Beach Park of Commerce As as result of yesterday's TRB meeting that dealt with the Boynton Beach Park of Commerce, the following recommendations from the Police Department are offered 1 That as in the past with any large project such as being contemplated at the Park of Commerce, security of the site and materials be considered by the builders as the Boynton Beach Police Dept is not geared to handle the construction phase security of large projects 2 That the city be made aware as soon as possible whether or not the Boynton Beach Park of Commerce developers intend to have a security force on duty after completion of the construction phases That if this is to be the case, then a central location or guard post be established and that all alarms that will be installed within the confines of the Boynton Beach Park of Commerce be directed to that location It has been our experience that intrusion alarms in areas similiar to the Boynton Beach Park of Commerce cause a constant problem with the police department with regard to their having to respond to numerous false alarms The police department would strongly suggest that one alarm vendor be utilized for the entire project and that a lot of research be conducted and care be taken when selecting that particular vendor From the description of the high tech industry to be located in the Commerce Park, it becomes apparent that alarms will be numerous These particular requests might be premature and might be considered at a later date; however, they are of extreme importance to the police department in carrying out its role in the community Yours truly, ~Q:~~~~ery. Jr Boynton Beach Police Department EH as M E M 0 RAN DUM TO Mr Carmen Annunziato, City Planner October 8, 1984 RE Boynton Beach Park of Commerce - DRI In reviewing the proposed system to serve water and sewer there are three (3) comments that should be imposed upon the developer of this park 1) The 16" water line should be looped over to High Ridge Road into the existing 16" water line on High Ridge Rd as part of the first phase of development 2) In reviewing the sewage collection system, the Engineers should address the feasibility of deepening the collection manhole in Phase I, and the gravity line going East and then North toward 22nd Avenue to see if the lift station that is presently proposed could be eliminated so that the Northeast area of the property could be served by gravity This department would rather see the monies involved in an additional lift station spent on a deeper gravity, and thereby eliminate the continual maintenance of a pump station forever if this is at all physically possible 3) In the Master Plan of Phase I some water lines are shown in areas not indicated as road right-of-ways This should be clarified so that all agree that these lines will be in road right-of-ways when development occurs G !l~ perry~essna, Director of Utilities cmc
