It is to be used by professional planners, architects and engineers as a guide for preparation of development documents for projects to be constructed in Quantum Park. The QDR controls both the contents of this document and the various procedures identified herein, as authorized by the Declaration of Protective Covenants 1 1 INTENT This document establishes standards for the development of parcels within Quantum Park. It defines standards in addition to the basic codes, statutes, laws and ordinances of all governmental authorities having jurisdiction over the project. It does not attempt to re-establish nor re-define all of those other regulations controlling development of the property Its purpose is to establish the quality level of all development within Quantum Park. This document establishes standards that are to be applied uniformly throughout the park to regulate undeveloped parcels. initial development of parcels and the maintenance of parcels throughout their existence It applies to all parcels within Quantum Park from the time of a parcel's purchase through initial development and through all modifications to developed parcels 1.2 DESIGN CHARACTER It is the intent of this document to establish a design character based on the effective use of high-quality materials and structures in a lush and varied landscape setting All of the initial improvements made by Quantum Associates embody subtle yet sophisticated design and the imaginative use of water, rock, land forms and plantings Quantum . Park's design character is intended to provide each parcel owner with the opportunity to develop an exceptional and profitable project within the confines of a clear, attractive spatial and visual environment. Quantum Park's lush landscape areas of varied natural plantings, rock formations and waterscape features line the perimeters of all lakes and most parcels The landscape is further beautified by the 40 acre Sand Pine Preserve and City Park to the north, and by the canal frontages along the western and southern borders. Rights-of-way have been heavily landscaped with tree and shrub median plantings Street trees are used extensively at outer roadway edges Trees have been planted both within rights-of-way and along interior perimeters of development parcels Z2 Design Inc. July 20, 1988 5 ~ ~ All proposed development should embody the use of an abundance of water, dense landscaping, rock features and land forms, and should develop framed views and view corridors All architecture within Quantum Park should use high-quality natural or man-made finishes applied consistently to the entire exterior of cleanly designed structures Any architecture with a strong distinctive style should provide appropriate transition or accommodation of the overall visual character of Quantum Park's surrounding environment Form and color compatibility of all development is essential All structures should harmonize with adjoining structures and with the natural setting The excessive use of forms, designs or colors that provide sharp contrast to or conflict with the surroundings is discouraged 1.3 PRIORITY OF RIGHTS New development will be evaluated with respect to its compatibility to the existing surrounding development and to its conformity to these regulations In situations where the property rights of one parcel holder are in conflict with those of another, development that has been approved and completed will have priority consideration over development which is proposed The planning and development of a parcel may thus be greatly affected by the existing development of the parcels around it. The continuity of development and the consistency of quality within Quantum Park require that preexisting development become a part of the controlling design criteria. To achieve consistency and compromise in site development, the QDR has the right to require changes to a previously approved and constructed development Such changes will only be considered when the cost of the change is voluntarily borne by the parcel owner seeking a compromise or concession Such changes could include relocation of landscaping, revision of . grading along a common property line, combination of access ways, sharing of utility services, etc. 1 4 DEFINITIONS The following words, when used in this document, shall have the following meanings APPEAL- To formally request reconsideration of any action of the QDR in accordance with procedures defined in this document. AREA, BUILDING - In the case of single story structures, the total area occupied by a building, as measured to the extreme exterior surfaces of all perimeter walls and projections at ground level In the case of multi-story structures, the sum of the total building areas of each Z2 Design Inc. July 20, 188i 6 .. story ~ as measured above. .... : ~ . --..,. ..: AREA, LANDSCAPED - The total area of a parcel that is cccupied or intended to be occupied by live plantings, or by related items incorporated into plantings such as rocks, small water areas, decorative paths, etc. AREA, OPEN - The total area of a parcel that is occupied or intended to be occupied by landscape plantings, rockscapes, lawns and grasses, water, pathways, and pedestrian walks, terraces and patios. AREA, PARKING - The total area of a parcel that is occupied or intended to occupied by vehicular parking spaces, circulation drives, maneuvering areas, service and loading spaces, and drop-offs ARCHITECT - A professional architect duly licensed to practice in the State of Florida. BUFFER - Any land area devoted to creating a screening or distancing of one type of development from another or from rights-of-way Buffers are generally bermed, landscaped, fenced or otherwise treated to provide visual, sound or use privacy CONSTRUCTION - Any activity or process by which a site is altered or a structure erected, including the storing of materials or equipment to be used in such activities DESIGN CRITERIA - This document, in conjunction with all binding rulings of the QDR and QPOA relative to the design of improvements within Quantum Park. . DEVELOPMENT - The act or process of making any improvement to a parcel DEVELOPMENT ORDER (DO) - Ordinance No 84-51 adopted by the City of Boynton Beach which defines conditions for development of Quantum Park. See Appendix. ECOLOGICAL REPORT - The Ecological Report prepared by Quantum Associates and its consultants which governs certain ecological aspects of the development of Quantum Park. See Appendix EXOTICS - Any plants of the exotic species defined in the ECOlogical Report. Z2 Design Inc. July 20, 1980 7 FEES - Amo~nts to be paid by a parcel owner or owner's agent to the QDR to defray expenses _'f\..o. of review, approval and action HARDWOOD SWAMP - That area defined as Hardwood Swamp on the Master Site Development Plans, generally adjacent to lake edges and consisting of various species, as defined in the Ecological Report. HAZARDOUS MATERIAL RESPONSE PLAN -The Hardous Material Response Plan prepared by Quantum Associates and its consultants which governs means and methods of response to hazardous material contaminations, and controls materials that may be brought within Quantum Park. See Appendix IMPROVEMENT - Any construction, alteration or other action on a parcel, its land, water or landscaping, or on any structure building, paving, sign, lighting or utility Improvements include any subdividing, platting or replaWng of a parcel LITTORAL ZONE - The littoral Zone defined on the Master Site Development Plans, generally adjacent to lake edges and having features described in the Ecological Report. MASTER PLAN, MASTER SITE DEVELOPMENT PLAN - The Master Site Development Plan prepared by Quantum Associates and its consultants setting forth the overall controlling plan for Quantum Park and its components See Appendix. MECHANICAL EQUIPMENT - Any mechanical, electrical, plumbing, heating, ventilating, air-conditioning or process equipment appurtenant to a building, structure or related . improvement MONUMENTS - Those special entry and roadway intersection features defined on the Master Site Development Plan consisting of rockscape, water features, signage, landscaping and lighting OWNER - The record owner or owners of the fee simple title to a parcel within Quantum Park OWNER'S AGENT - Any duly authorized person acting in an Owner's interest or behalf PARCEL - An individual development lot as defined in the Master Site Development Plan. July 20, 1988 8 PLANS - Those drawings, renderings and other documents required to fully describe any proposed construction, structure or development on a parcel PLAT - Any document recorded with a governmental body defining legal, ownership or technical data regarding a parcel QUANTUM ASSOCIATES - The original developers of Quantum Park, declarant of the Protective Covenants of Quantum Park, and initial controller of the QPOA. QUANTUM COMMUNICATIONS INC - The corporation providing communication services to parcels within Quantum Park. QUANTUM DESIGN REVIEW COMMITTEE (QDR) -The committee authorized by the Declaration of Protective Covenants of Quantum Park to create and enforce this document, the Design Criteria for Quantum Park. QUANTUM PARK - The total development described as Quantum Park by the Master Site Development Plans and the Development Order, and any area or feature within its boundaries QUANTUM PROPERTY OWNERS ASSOCIATION INC (QPOA OR POA) - The association of Quantum Park property owners created and empowered by the Declaration of Protective Covenants. RIGHTS -OF-WAY - Those legally dedicated roadways and adjacent improvements within Quantum Park defined by the Master Site Development Plan and related documents. ROCKSCAPE - An improvement consisting of decorative rock formations, landscaping earthwork and/or water used as an aesthetic feature SAND PINE PRESERVATION AREA - That area set aside for maintenance of a viable Sand Pine ecosystem, as defined by the Master Site Development Plan and the Ecological Report. SETBACK - The zone adjacent to a right-of-way, property line, easement, lake edge, etc , within which construction, development and lor improvements are prohibited Generally I setback zones are measured perpendicular to the right-of-way, property line, easement, lake edge, etc., and continue parallel to it. SIGN - Any representation of words, figures, logos, or symbols or combinations thereof intended to convey information SITE FURNITURE - Outdoor amenities such as light poles, bollards, benches, fences, walls, planters, fountains, etc. STOP WORK ORDER - An order issued by the QDR that an owner cease any construction, development or improvement processes on a parcel. STREETSCAPE - The total composition of physical improvements within rights-of-way, and the rhythms, patterns and design character established by this composition. SURVEYOR - A professional surveyor duly licensed to practice in the State of Florida. SWALE - A ground depression, channel or low area used as a means of directing surface water runoff USE - The intended purpose or activity for a parcel, structure or improvement. Use includes not only the primary intended use, but also all incidental uses anticipated. VARIANCE - A specific case-by-case exception or allowance of relief from a requirement of these Design Criteria. WATER DETENTION - Thee process by which on-site water is slowed or detained in its drainage off-site WATER MANAGEMENT PLAN - The Water Management Plan for Quantum Park prepared by Quantum Associates and its consultants defining aspects of water drainage retention, detention, quality and maintenance See Appendix. WATER RETENTION - The process by which on site water is kept on site in some form of storage area or facility WETLANDS - An area to be maintained as a viable wetland, as defined and governed by the Ecological Report and Water Management Plan Z2 Design Inc. July 20, 1988 1 0 2.0 THE ADMINISTRATIVE PROCESS OF DESIGN AND CONSTRUCTION REVIEW On behalf of the QDR, the Quantum Property Owners' Association (QPOA) will administer the procedure for the approval of all development within Quantum Park. The QPOA will accept submittals, disseminate information and carry out directives for the QDR They will not, however, have authority to act in any approval capacity for the QDR. 2 1 RESTRICTED USE OF PARCEL PRIOR TO QDR APPROVAL. Prior to QDR approval, an owner may not use his property for any purpose Nursery, farming and other agricultural uses are not permitted, nor is occupancy of any kind. Ukewise. access to the property from the Quantum Park roadway network is denied until an access plan has been approved by the QDR Applications for temporary use of the parcel, when fully consistent with all governmental regulations having juriSdiction over the parcel, will be considered by the QDR Such applications must be submitted along with a complete description of the temporary use and its dates of duration to the QDR a minimum of forty-five days prior to the anticipated starting date of the use No modifications to the landscaping, grading or other natural character of the site will be permitted without QDR approval 2.2 INITIAL SUBMITTAL TO THE QDR. For initial QDR review, the owner of a parcel, or an agent acting in his behalf, must submit one reproducible copy plus eight copies or sets of the drawings listed below The maximum sheet size for drawings filed with the QDR shall be 30" x 42" Elevations and all signs shall be drawn to a minimum scale of 1/8" = 1 O' and site development plans must be drawn to a minimum scale of 1" = 30' Drawings shall illustrate the following 1 Site Plan, which must lnclude a site location plan, survey with topography and boundaries, all building locations, locations of all fences, walls and exterior equipment, setbacks from all property lines, site circulation and parking, and landscape and/or water areas. The site plan must also include a site data listing that clearly indicates the square footage to be constructed, the lot coverage, the green area, open space and landscape area. The site data must also include the projected number of employees and the amount and location of employee parking and guest parking The site plan must locate truck loading and service areas and trash, dumpster or compactor areas 2 Grading and Drainage Plans, which must illustrate existing and proposed grades, as well Z2 Design Inc. July 20, 1988 1 1 , as all water areas, swale areas and storm inlets. The grading and drainage plan must also clearly indicate a schematic drainage system for the entire site and its connection to the Quantum Park lake and drainage system At the option of the QDR, drainage calculations may also be required. 3 Water, Sewer and Utility Plans, which must illustrate the schef[1atic routing of all utilities and the.r connections to the Quantum Park utility systems 4 Exterior Lighting Plan, which must illustrate the photometrics, location, size and type of the parking lot lighting and entrance way lighting, and the location, size, and type of all decorative landscape lighting and building illumination It must also locale all existing right-of way street, sign and landscape lighting 5 Landscape Plan, which must provide complete counts of tree, shrub and ground cover plants, with species and size at the time of planting Also included shall be a description of all existing trees on the site that will be incorporated within the final landscape scheme The landscape plan shall define any required relocation of plantings previously installed in right-of-way landscaping It should clearly indicate those areas to be seeded vs areas to be sodded. Basic design, details and specifications of the irrigation system must be provided. 6 Exterior Elevations, which must include all buildings, walls and fences All materials and colors shall be clearly noted, as well as heights and other dimensions In addition, all elevations must show the size, shape and material of all equipment screens, either at ground level or on the roof Details of all exterior signs must be shown on the elevation drawings. . 7 Typical Wall Sections, which must show the typical construction of the building and/or other structures If a number of wall sections are required to adequately describe the building construction or configuration, they must be included 8 Roof Plan, which must show all proposed roof-mounted equipment in detail In addition to the one set of reproducible drawings and eight copies of drawings, two complete sets of the following must also be provided' 1 Complete color chips illustrating colors of the exterior finish of all exposed materials, all keyed to the exterior elevation drawings. Catalogue cuts picturing all equipment exposed to the exterior, rooftop and otherwise, all keyed to the site plan or roof plan, as appropriate 3 Elevations, dimensions, materials, colors and details of all proposed signs 4 Catalogue cuts of all exterior lighting 5 Two 8 x 10 color photographs of a full color perspective rendering of the proposed project 6 The Owner or Owner's agent must submit a document that clearly indicates the use of the project This must include a complete description of any proposed outdoor activities that may take place on the parcel. 2.3 TIME LIMITS AND SCHEDULE OF DESIGN, APPROVAL AND PERMITTING EVENTS The schedule of project review and approval by the QDR will add 45 days at most to the normal schedule for receiving governmental approvals prior to construction By special arrangement, QDR approval can be obtained simultaneously with governmental approvals In most cases, the documents required by the QDR are no more extensive than those required for Site Plan Approval by the City of Boy ton Beach. The QDR has no preliminary review process prior to initial submittal of documents If preliminary reviews are desired, they will be subject to additional filing fees, and they must be scheduled with the QDR at least 14 days in advance of the desired review date Initial submittal of documents to the QDR must take place 45 days prior to the submittal to the City of Boy ton Beach for Site Plan Approval Payment of a filing fee must be made at that time The aDR will respond within 30 days of submittal, thereby allowing 15 days for document revisions prior to a simultaneous submittal to the City of Boynton Beach and resubmittal to the QOR, if a resubmittal is required Resubmittal to the QDR is required if a submittal is not approved, or if major revisions are required In such cases, an additional filing fee will be charged and submittal to the City of Boynton Beach for Site Plan Approval may be delayed Prior to the completion of the infrastructure improvements (roadways, utilities, lakes, landscaping, etc.) and during the time in which the QPOA is controlled by Quantum Associates, no filing fees shall be charged Subsequently, filing fees shall be determined and levied by the Z2 Design Inc. July 20, 1938 1 3 CfDl\ Upon approval of a submission by the ODR, submittal shall be made to the City of Boynton Beach for Site Plan ApprovaL At thai time, the Owner shall submit to the QDR a statement certified uy a state licensed professional planning consultant that the proposed improvement is in compliance with codes and other pertinent regulations in accordance with subsection 2.52 below If the Owner wishes to file a variance request, it must also be submitted to QDR at that time The Owner must pay the variance fee and submit the variance request in accordance with subsection 2 6 below The QDR will answer a variance request within 30 days. Approval of all variance requests is required before a building permit can be issued. If the Owner wishes to appeal the action of the QDR, an appeal must be filed with the QDR and QPOA in accordance with subsection 2.7 below At that time the applicant must pay an appeal fee The QDR will respond within 30 days, and the QPOA within 45 days. Once approval has been obtained for Site Development, it is valid for a period of 6 months If a building permit is not issued within that period, the Owner must reapply for approval Upon application, one 6 month extension may be granted by the QDR for sufficient cause Site development approval must be followed by certification that the project has been constructed in full compliance with the approved documents. For this purpose, a certification provided by the architect of record and the surveyor of record must be submitted to the QDR 30 days prior to substantial completion of the project, along with payment-in-full of any applicable construction observation fees. Certifications must be submitted to the QDR prior to a request for an occupancy permit. . At the time of occupancy, the Owner must submit record documents in accordance with subsection 2.81 below and receive a final inspection and approval of the premises by the QDR Within six months after occupancy, the Owner must submit a landscape architect's certification in accordance with subsection 4 48 below 2 4 QDR COMMITTEE FINDINGS Any and all information submitted to the QDR for approval, and any and all information obtained by the QDR in its performance of authorized investigatory, review and approval duties shall constitute a QDR Committee Finding Such findings may be used by the QDR in the normal performance of its authorized duties without restriction Such findings may also be used by the QPOA in the normal performance of its authorized duties, or in the normal performance of actions undertaken at the request of the QDR, without restriction Z2 Design Inc. July 20, 1988 1 4 Such findings may become items of public information, if deemed required or appropriate by the QDR. 2.5 QOR APPROVALS The QDR retains the right to approve or disapprove any improvement or structure of any kind These include without limitation, any building, fence, wall sign, site paving! grading, parking, screen enclosure, sewer, drain, disposal system, landscaping, landscape device or object, building, decorative building, building additions, alterations, or other improvement or change or modification thereto, the construction, erection, performannce or placement of which is proposed upon any parcel in Quantum Park This right includes approval or disapproval of any modifications or alterations therein or thereon All decisions of the QDR shall be submitted in writing to the QPOA. Any party aggrieved by a decision of the QDR shall have the right to make a written request to the QPOA within 30 days of such decision for a review thereof. The determination of the QPOA upon reviewing any such decision shall in all events be dispositive All pertinent requirements of public agencies shall be followed in the development of any parcel, and all plans shall be approved by the City of Boynton Beach This document is based on code and regulation information obtained from sources considered reliable, however the QDR assumes no responsibility for its accuracy Each Owner must verify code requirements at the time of purchase and development. Although based on local zoning and subdivision regulations, this document may be more restrictive in land use, site development standards, landscape requirements, or in other matters In every case in which this document's criteria are at variance with public agency requirements, the more restrictive regulation shall govern 2.51 MANDATORY SUBMITTALS AND APPROVALS Approval by the QDR of properly submitted plans and documents is required prior to the undertaking of any construction, development, or improvement of any parcel, including storing of materials of equipment, access to the parcel, clearing, grading, paving, landscaping, utility services, construction of buildings, structures or signs, alterations to any such item, parcel platting or replatting, parcel consolidation or subdivision Approval by all city, county state or local agencies having jurisdiction over the parcel or its improvements is also required prior to the undertaking of any of the above The parcel owner shall bear all responsibility for proper and timely submissions to both the QDR and agencies governing the parcel 2.52 CERTIFICATION OF COMPUANCE WITH THE DEVELOPMENT ORDER AND OTHER PERTINENT REGULATIONS The owner shall submit to the QDR certification that any proposed development submittal is in full compliance with the Development Order and with any and all other pertinent Z2 Design Inc. July 20 1988 1 5 regulations. Such certification shall be submitted with the initial submittal documents 2.521 COMPLIANCE WITH THE ECOLOGICAL REPORT The owner's submittal certification shall embrace full compliance with the Ecological Report. In the event the parcel or its proposed development is likely to impact sensitive ecological factors (i e viable Sand Pine scrub, endangered species habitats, hardwood swamps, wetlands, littoral zones, etc), the QDR may request or require certification of compliance with the Ecological Report by a qualified ecological or environmental specialist 2.522 COMPLIANCE WITH THE HAZARDOUS MATERIALS RESPONSE PLAN The owner's submittal certification shall embrace full compliance with the Hazardous Materials Response Plan In the event the parcel or its proposed development is likely to involve hazardous or questionable materials, the QDR may request or require certification of compliance with the Hazardous Materials Response Plan by a qualified materials handling specialist. 2523 NOTIFICATION OF ALL VARIANCES RECEIVED OR SOUGHT FROM GOVERNMENTAL AUTHORITIES At the time of submittal of documents to the QDR for approval, the owner shall notify the QDR of all variances received or sought from any regulatory or governmental authorities The owner shall likewise promptly notify the QDR of all variances received or sought from regulatory or governmental authorities at any time after initial submittal of documents. 2.53 BASIS OF APPROVAUDISAPPROVAL. Review and approval will be based on this document in conjunction with past actions of the QDR and with the nature of pre-existing development within Quantum Park. Plans will be reviewed not only for the quality of the specific proposal, but also for the development:s effect and impact on its neighbors and on the general surroundings Evaluation will be made of spatial relationships among buildings and between buildings and other surrounding elements Careful concern will be given to location and treatment of utility and service facilities with the intent of minimizing detrimental visual or physical impact. Site igress and egress may be limited to permit efficient flow of traffic on abutting streets 2.54 INTERPRETATION AND WAIVER The QDR's interest in reviewing and approving submittals is to assure that a high quality of compatible development is consistently achieved Where questions of judgement or interpretation arise, the decision of the QDR is final subject only to the Appeal procedures defined herein The QDR reserves the right to allow variances of certain requirements as circumstances dictate Any variance so granted is not considered to be Z2 Design Inc. July 20 1988 1 6 precedent-setting, as it is being made on a case by case basis with the welfare of overall development in mind 2.55 CONDITiONS AND STIPUu\TIONS OF THE QDR In its review and/or approval of submittals, the QDR may attach any reasonable conditions or stipulations to approval it may deem necessary or proper in the interests of Quantum Park and its tenants Such conditions and stipulations shall become binding as if part of this document, subject to the Appeal and Variance Procedures defined herein Any such condition or stipulation is not considered to be precedent setting 2.56 ARCHITECT'S AND SURVEYOR'S CERTIFICATIONS The owner shall provide the QDR with certifications by both the architect of record and the surveyor of record of any proposed development or improvement that, 1) the design and engineering of all improvements are in full compliance with all plats and all applicable regulations, and 2) at the conclusion of development, all improvements are in compliance with plans, specifications, submittal documents, and any variances, conditions or stipulations 2.57 PHASED CONSTRUCTION Should an owner intend to develop or improve a parcel by way of phased construction, he shall submit sufficient plans and specifications in his initial submittal to fully define the proposed eventual development. Generally, such documentation shall include a fully detailed eventual site plan, eventual building elevations, phasing plans and a schedule of the phased construction. Depending on the specific proposal, the QDR may request or require submittal of more extensive documentation 2.58 CHANGES IN Pu\NS The owner shall promptly submit to the QDR any subsequent changes in plans, specifications or other documents contained in any submittal Any changes undertaken after initial submittal to the QDoR may delay or prevent QDR approval, or may prompt further required changes or submittals to secure approval. The QDR shall not be liable for any additional expense or hardship borne by an owner due to delays in or lack of approval of any submittal that has been subsequently modified in any way 2.59 ASSESSMENT AND PAYMENT OF FEES The QDR retains the right to adopt, maintain and modify a schedule of reasonble fees for processing submittals of requests for approval of proposed improvements Such fees shall be payable to the QPOA in cash at the time submittal is made In the event such fees, as well as any other costs or expenses of the QDR and or QPOA pursuant to any other provisions of this document are not paid by the owner, they shall become a lien of the QPOA on the parcel property Z2 Design Inc. July 20, 1988 1 7 2.6 Vft.RIANCE PROCEDURE: 2.7 APPEAL PROCEDURE. 2.8 ONGOING COMPUANCE. 2.81 MAINTENANCE OF RECORD DOCUMENTS: 2.9 REMEDIES 2.91 STOP WORK ORDER 2.92 CAUSE TO RESTORE. The QDR retains the right to approve or disapprove any construction change, modification or alteration to any improvement or structure as herein above described, and plans and specifications. if any, upon which such change, modification or alteration is based, prior to commencement of such construction. change. modification or alteration If any improvement or structure as aforesaid shall be constructed, changed. modified or altered without prior approval of the QDR or such change. modification or alteration. and the plans and specifications therefor, if any. then the Owner shall upon demand cause the improvement or structure to be restored to comply with the plans and specifications, originally approved by the QDR, and shall bear all costs and expenses of such restoration including costs and reasonable attorneys' fees of the QDR 3.0 REQUIREMENTS FOR DEVELOPMENTS' 3.1 CONSISTENCY WITH PLATS AND MASTER PLAN' 311 SUBDIVISION OF PARCEL. 3.12 COMBINATION OF PARCELS: 3.2 USE REGULATIONS Permitted land uses and building uses within Quantum Park are defined by the applicable zoning codes of the City of Boynton Beach. the binding ADNDRI and Development Order for Quantum Park. and the latest Master Site Development Plan for Quantum Park. See Appendix. 3.3 MINIMUM LAND AREA Each parcel within Quantum Park shall consist of a minimum of two Z2 Design Inc. July 20, 1988 1 8 and one-half (2.5) acres No parcel shall be subdivided without the prior written approval of the QDR. 34 REGULATIONS CONCERNING REZONING Notwithstanding anything to the contrary contained in this document, all or any portion of Quantum Park may be rezoned as a Commercial Zone or as a light lndustrual Research Park District. In the event any portion is so rezoned, it may be submitted to any use and developed in any manner in compliance with applicable zoning regulations and this document. 3.5 ROADS N'JD ACCESS. 3.51 NEW ROADS 3.52 REMOVAL OR MODIFICATION OF EXISTING ROADS 4 0 SITE DEVELOPMENT CRITERIA. The following criteria shall apply to the site planning, design and development of all parcels within Quantum Park. In cases where these criteria are at variance with the local, city or county zoning and building codes governing the project, the more stringent requirement shall be met. 4 1 PLANNING STANDARDS These planning standards shall govern the site planning and design and the building design of any development proposed on any parcel within Quantum Park. 4 11 PARCEL ACCESS Access to every parcel within Quantum Park shall be directly from roadway rights-of-way only The number of parcel access points shall be limited to those approved by the QOR. 4 111 MEDIAN CUTS Median cuts are located along the medians of Northwest 22nd Avenue, Quantum Boulevard, High Ridge Road, Quantum Circle, and Lake Park Boulevard These facilitate left turn access into parcels abutting those rights-of~way Requests for additional median cuts to those already constructed, or for modifications to median cut locations, will not be approved by the QDR 4 112 CURB CUTS Curb cuts providing access to parcels shall be limited, particularly along the Northwest 22nd Avenue right-of-way Curb cuts shall be spaced a minimum of 250 feet from center-line to center-line They shall be located a minimum of 100 feet from the nearest right-of way of an intersecting roadway Curb cuts shall be a maximum of 24 feet in width Z2 Design Inc. July 20, 1988 i 9 exclusive of any median or internal island. Common curb cuts providing access to two or more adjacent parcels are permitted and encouraged. Driveways with landscaped medians shall be considered as a single driveway Each direction of flow within a curb cut and its drive shall provide a minimum width of 12 feet. Cross-access between parcels across common property lines is permitted and encouraged 4 12 PARCEL COVERAGE The percentage of the area of a parcel covered by building, structures or improvements shall be no greater than that permitted by the applicable regulations of the City of Boynton Beach as they are amended from time to time However, in no event shall the area of a parcel covered by such improvement exceed 40 percent without the prior written approval of the QDR. 4 121 BUILDING AREA The maximum total building area permitted on any parcel within Quantum Park shall be as listed below, however, it shall not be greater than that permitted by applicable city, state, and/or county building and zoning codes tor a building's intended use, occupancy, type of construction, height and configuration. Club parcels Commercial parcels Hotel parcels Industrials parcels Office parcels Research and Development Industrial parcels XX,OOO sf/acre XX,OOO sf/acre XX,OOO sf/acre XX,OOO sf/acre XX,OOO sf/acre XX,OOO sf/acre 4 122 OPEN AREA Each parcel shall contain a minimum of -- percent of total area as maintained open area. To the greatest extent possible, such open area shall be concentrated in sizable perimeter buffers, view corridors, transition areas, pedestrian spaces, etc. See Appendix for plat drawings which may contain information on required setbacks, easements or view corridors for specific parcels 4 123 PARKING AREA. The total area required to accommodate vehicular parking, drives, loading, service and trash facilities for a parcel's intended use shall be provided entirely on the parcel in a properly developed and maintained parking area. All parking areas shall be paved. Paving materials, design and drainage considerations shall be in full compliance with municipal regulations of the City of Boynton Beach All related parking area improvements or construction shall be of suitable materials, design, drainage considerations and use characteristics The total number of parking spaces provided on a parcel, and the mix of Z2 Design Inc. July 20, 1988 20 regular, compact and handicapped spaces, shalf be in compliance with municipal parking regulations of the City of Boynton Beach All parking areas shall be configured to provide the greatest ease and safety of access, maneuvering, loading, service and egress. Automobile parking and truck parking shall be separated when their use characteristics differ (i e automobiles for visitors and office workers, trucks for shipping, and receiving) 4 124 LANDSCAPED AREA. A minimum of 20 percent of the total areal of a parcel shall be landscaped area. To the greatest extent possible, such landscaped area shall be concentrated in sizable perimeter buffers, view corridors, transition areas, pedestrian spaces, screenings, etc. Refer to other sections of this document for specific requirements for landscaping of parcel perimeters, parking area perimeters, service area screening, lake edges, roadway intersections, building walls or features, etc. Refer also to other sections of this document for preservation of existing landscaping (particularly Sand Pine scrub), treatment of exotics, and compliance with the Ecological Report. 4 125 SAND PINE PRESERVATION AREA. Any parcel containing existing Sand Pine scrub vegetation shall preserve a minimum of 30 percent of such vegetation in its original natural state If the configuration of the existing Sand Pine scrub vegetation area would prevent economical parcel or building development, then the parcel owner may fulfill this requirement by creating a replanted Sand Pine scrub preservation area anywhere on the parcel, equal in area to at least 30 percent of the original Sand Pine scrub vegetation Such preservation areas shall be maintained as viable Sand Pine scrub ecosystems, as defined in the Ecological Report. 4 13 BUILDING HEIGHT AND SEPARATION Maximum building height, maximum number of building stories and the minimum separation among buildings or between a building and a parcel property line shall be as set forth in the applicable city, state and/or county zoning and building codes For purposes of overall design consistency and aesthetic quality of Quantum Park, the QDR may require or request that proposed building locations on a parcel be adjusted. 4 14 SETBACKS The minimum setbacks of buildings or other parcel improvements from parcel property lines, rights-of-way, easements, canals or other land features shall be as set forth in applicable city, state and county regulations Where such setbacks are at variance with those set forth herein, the more stringent requirement shall govern 4 141 PARKING AREAS All parking areas shall be set back a minimum of twenty feet (20') from all rights-of-way and from any property line which serves as the primary frontage of a parcel All parking areas shall be set back a minimum of five feet (5') from any side, rear or Z2 Design Inc. July 20, "1988 :2 1 other internal parcel property line Parking areas shall also be set back a minimum of five feet (5') from the mean high water level of any water area, and from any hardwood swamp, littoral zone, wetland or Sand Pine Preservation area. 4 142 BUILDING SETBACKS All buildings, projections and appurtenances shall be set back a minimum of thirty feet (30') from all rights-of-way and from any property line which serves as the primary frontage of a parcel. They shall be set back a minimum of ten feet (10') from any side, rear or other internal parcel property line They shall also be set back a -minimum of ten feet (10') from any Sand Pine Preservation area. No building, projection or appurtenance may extend into any easement area, except projections such as decks or overhangs over water areas Buildings may directly abut water areas, hardwood swamp areas, littoral zones and wetlands as specifically approved by the QDR. The QDR may specifically approve submittals wherein existing or proposed water areas, swamps, littoral zones or wetlands are to be reconfigured to allow more creative parcel land use and design 4 143 SPECIAL LANDSCAPED SETBACKS Parcels adjacent to landscape and graphic monuments, view corridors, particular common areas, rail sidings and roadway intersections may be required to provide additional special landscaped setbacks Such setbacks are defined in the latest Master Site Development Plan and/or in individual parcel plat drawings 4 15 PARKING REQUIREMENTS Parking areas for the parking of all automobiles, trucks and any other vehicle required by or normally incidental to the use or business operation of a parcel shall be provided totally within the parcel No parking is permitted on any roadways or other rights-of-way throughout Quantum Park. Parking and loading spaces shall be provided for the full number of vehicles required by applicable city, state and/or county parking regulations Parking spaces shall include ttie proper numbers, mix, sizes and locations for normal vehicles, compact vehicles and handicapped access, as defined by applicable regulations. Full parking and loading space data indicating compliance with applicable regulations shall be provided on any parcel development documents submitted for aDR approval Landscaping shall be provided within parking areas as defined in 4 44 The perimeter of all paved parking, loading and service areas, and the perimeters of any internal landscaped islands, medians or tree wells, shall have a continuous combination curb-and-gutter Wheel stops may be provided in lieu of curbing at the closed end of parking spaces. 4 151 DRIVES AND ACCESSWAYS The design and configuration of all drives and accessways on a parcel shall conform fully with all applicable city, state and county regulations, as to lane numbers, lane widths, turning radii, tapers, intersections, pavement profiles, etc. The Z2 Design Inc. July 20, 1988 22 perimeter of all drives or other pavement areas, and the perimeters 'of any internal medians or other landscaped areas, shall have a continuous combination curb and gutter Drives and accessways shall be kept to the minimum configuration required to provide safe and practical vehicular acess into and within a parcel 4 16 DRAINAGE AND WATER RETENTION/DETENTION Quantum Park has been designed to achieve a high degree of water conservation, through the use of water retention lakes with overflow zones In compliance with current regulations of the South Florida Water Management District, Quantum Associates has prepared a Stormwater Management Plan Each individual development shall conform to this plan A drainage and water retention plan shall be submitted for each parcel as part of the initial development submittal to the aDR To the extent the Stormwater Management Plan and these design criteria are based on regulations of the South Florida Water Management District, they are subject to modification as a result of District actions or revisions of those regulations For purposes of drainage, water retention and groundwater recharge, each parcel shall be developed as a drainage basin, with a water retention area equal to approximately ten percent (10%) of gross parcel area Drainage shall be generally directed as indicated on the Master Site Development Plan for Grading Particular parcels shall be designed to accept site drainage from, and provide site runoff for, adjacent parcels or common areas, when so indicated on the Master Site Development Plan for Grading The temporary accommodation of drainage through or across a parcel during its development or construction shall be clearly shown on plans initially submitted When planned in combination as a total development, two or more parcels may be combined into a single drainage basin. This practice of combining drainage basins is encouraged Subdivision of any parcels shall be conducted so that each eventual subdivided parcel drains to the water retention areas in an appropriate manner 4 161 GRADING REQUIREMENTS The grading of parcels and the creation of land forms shall be designed to balance the following objectives 1} satisfactory drainage of land areas in ~ conformance with the Water Management Plan, 2} maximum preservation of existing landscaping, particularly Sand Pine, specimen trees and mature stands, 3} minimum soil erosion and siltation, 4} enhancement of site development, building architecture and the visual character of Quantum Park, and 5} general conformance to the Master Site Development Plan for Grading All grading and land forming shall be accomplished by smooth and gradual contouring similar to that found naturally throughout South Florida. Severe grading transitions at parcel edges are discouraged. The following measures shall be taken to reduce soil erosion and sediment deposition in downstream areas 1} remove no more vegetation than necessary for development and construction activities, 2} install temporary mulching on areas to be left bare Z2 Design Inc. July 20, 1988 23 of plant material for any extended period of time, 3) provide desilting basins to remove all sediment from runoff water during development and construction, and 4) instatl permanent landscaping as soon as possible. 4 17 USE OF OUTDOOR AREAS The initial development submittal to the QDR shall clearly indicate all uses of outdoor activities anticipated on a parcel. The initial submittal shall also indicate all means of screening, enclosing, landscaping, lighting or otherwise mitigating such activities, as well as all physical improvements to be made in support of such activities. Uses of outdoor areas of parcels are limited to activities normally directly incidental to the uses and activities housed in parcel structures These generally include such uses as truck loading and unloading, trash removal, employee and visitor parking, terraces and patios, employee lunch areas, walks and drives 4 171 LOADING All loading and unloading activities and areas required by the business operations on a parcel shall be accommodated totally within the parcel development. All access, maneuvering, parking, staging and handling areas shall be provided on the parcel, and shall be so designed as to completely screen activities from visibility from public rights-of-way, common areas, neighboring parcels, and areas normally used by the public and visitors. 4 172 SERVICEfTRASH REMOVAL. All service and trash collection and removal areas shall be completely screened Screening may consist of any QDR-approved combination of land forms, landscaping, rockscaping, walls and/or fencing 4 173 OUTDOOR STORAGE Outdoor storage of materials, supplies, equipment and vehicles is prohibited However, such items as tanks, motors, special industrial equipment or other permanent appurtenances required by parcel uses and operations may be permitted to remain outside of a building if totally screened from visibilty from public rights-of-way, common areas and neighboring parcels and if approved by the QDR 4 174 PROHIBITED ACTIVITIES Prohibited activities and uses of outdoor areas of parcels include, but are not necessarily limited to, the placement or storage of building equipment (except as specifically approved under 4 173), permanent or long-term parking, storage of materials or products, manufacturing or assembly processes, sales, advertising, any business operations or activities, structured recreational activities, public meetings and any special events not receiving prior written QPOA approval The QDR reserves the right to prohibit any activity not directly incidental to the use of a parcel that it deems inappropriate to the uses and character of Quantum Park. 12. Design Inc. July 20, 1988 24 4 18 UTILITIES All utility lines, systems and equipment shall be concealed from view to the greatest extent possible Water, sewer, storm drainage, and fuel systems shall be underground or completely enclosed Electrical power and telecommunication transmission lines shall be installed and maintained underground, except for transformers, major trunk lines or transmission lines required by the utility company J safety considerations or practical usage to be above ground. 4 181 PLACEMENT AND SCREENING OF EQUIPMENT Transformers, transmission lines and other components of utility systems that must necessarily be above ground shall be placed at or routed to the rear or other inconspicuous face of buildings, in a manner that minimizes their visibilty from public rights-of way, common areas and neighboring parcels. Such components shall be screened by land forms, landscaping, fences and/or walls. 4 182 QUANTUM COMMUNICATION, INC Quantum Communication, Inc. shall provide communication services, such as cable television, computer data transmission and telephone service, to parcels within Quantum Park. Such services shall be provided by means of Quantum Coomunicatios' utility lines located in roadway rights-of-way and terminating at each parcel frontage The initial development submittal to the QDR shall indicate the extent and nature of Quantum Communication services desired by the development. 4 19 TEMPORARY CONSTRUCTION Any proposed temporary construction of any nature on a parcel shall receive prior QDR approval The owner shall submit to the ODR sufficient documentation to fully describe the proposed temporary construction, its intended duration, mitigative or restorative work to be performed upon removal of the temporary construction and any other pertinent data. In gr1mting approval, the ODR shall indicate permitted duration and any conditions or stipulations of the approval, the temporary construction and/or its removal. 4 191 CONSTRUCTION TRAILERS Placement of a construction trailer on a parcel must receive prior QDR approval. To secure approval, an installation date and a removal date must be stated Trailers shall be placed on the parcel so as to minimize visibility from the public rights-of-way, common areas and neighboring parcels 4 192 TEMPORARY UTILITIES Any proposed temporary utilities on a parcel shall receive prior QDR approval Such utilities must be shown clearly on a site plan and submitted to the ODR for review and approval. Septic tanks are not permitted as temporary utilities Z2 Design Inc. July 20, 19Bb 25 4.2 USE OF MATERIALS AND EQUIPMENT All proposed development on any parcel within Quantum Park shall be limited to use of certain materials and equipment. Some such limitations establish minimum performance levels for certain characteristics of use Other limitations establish minimum quality levels of finish, appearance and aesthetics The QDR reserves the right to waive any of the limitations of use of materials and equipment, at its sole discretion, should it deem such waiver in the interest of the betterment of Quantum Park. 4.21 PAVING AND STRIPING. All pavements shall conform to applicable city, state and county regulations as to material, mix composition, thickness, profile, gradients, finish, detailing and appearance All pavements that connect to roadways, public walks or paths, or other construction beyond parcel boundaries shall be designed to provide a smooth, gradual and safe transition in geometrics, profiles, gradients, materials, finishes and appearance Pavement striping of lanes, lane markings and traffic control markings shall comply with city, state and county regulations. Pavement striping of parking stalls and other markings within the parcel boundaries shall be durably painted in locally accepted materials and types. 4.211 SIDEWALKS All sidewalks shall conform to all city, state and county regulations as to material, mix composition, thickness, profile, gradients, finish, detailing, appearance and handicapped accessibility All sidewalks connected to sidewalks beyond parcel boundaries shall be designed to provide a smooth transition in all respects Minimum sidewalk width shall be three feet (3') 4.212 BIKE PATH A continuous bike path system shall be provided throughout Quantum Park consisting of common open space with a combination pedestrian walkway/bike path and landscaping The path shall be constructed of a minimum four-inch (4") thickness of asphalt a minimum of six feet (6') wide · As the path is intended to offer both recreational opportunity and alternative means of pedestrian transportation, it shall 1) be separated from motor vehicle traffic by distance, buffer and/or landscaping, 2) provide street crossing at normal traffic intersection points, 3) provide a continuous, integrated system, 4) connect to important destinations such as recreation areas, shopping, bus or rail stops, park entry points, etc., and 5) be contiguous to visual features and amenities such as lake edges, buffer zones, forested areas, etc. for pedestrians, the following criteria shall be incorporated 4.22 CURBING All curbing shall conform to all applicable city, state and county regulations, and shall be of a material, type and design suitable to its intended use Curbing which meets curbing in public rights-of-way or other areas beyond the parcel boundaries shall provide a smooth transition in all respects Z2 Design Inc. July 20, 1988 26 4.23 SITE FURNITURE All site furniture, including exterior light fixtures and any appurtenances or buiding equipment proposed on a parcel shall receive prior QDR approval Any site furniture or building equipment Visible from a public right-of-way, common area, neighboring parcel or area normally used by the public or visitors shall be considered as building design elements and treated accordingly 4.24 SIGNS AND GRAPHICS All signs and graphics within Quantum Park shall comply with applicable city, state and county regulations as to maximum number, maximum size, type, placement, materials, colors, and lighting Where these criteria are at variance with such regulations, the more stringent requirement shall govern. No signs or graphics are permitted that contain advertising copy, messages, identification of any entity other than the primary parcel business(es}, or slogans, symbols or messages that are objectionable, obscene or may be confuse with safety or governmental notices No signs or graphics are permitted that flash, blink, make any noise, rotate, move, change in any way, or simulate same All signs should incorporate or be compatible with surrounding landscaping, ground cover or land forms All signs shall be clearly and readily visible and legible To establish a clear, strong visual identity and directional control, the following hierarchy of signs shall be maintained 1) Special entry and intersection signs, with landscaping and other embellishment, at several key orientation points throughout Quantum Park, these shall be installed and maintained by Quantum Associates and/or the QPOA, 2) Parcel identification/directional signs and roadway signs, with landscaping, at all roadway intersections, these shall also be installed and maintained by Quantum Associates and/or the QPOA, 3) One or more parcel identification signs on the parcel, these shall be installed and maintained by the parcel owner. These signs shall be of standard horizontal design as defined in the Quantum Park sign package, of a maximum copy panel area of approximately twenty-one (21) square feet, shall contain only the business name and address, and shall be of non-illuminated vinyl graphics on alucobond panels, of colors specified in the Quantum Park sign package No parcel shall have more than one such sign without prior QDR approval 4) One wall-mounted building sign on each building face, of a maximum size of forty-five (45) square feet, in horizontal orientation, containing only the business name and address, to be installed and maintained by the parcel owner 5) One door-mounted sign each on any specifically requested and QDR-approved exterior doors, of a maximum size of four (4) square feet, in horizontal orientation, containing only the business name and address, to be installed and maintained by the parcel owner 6) Additional traffic control, directional, safety or identification signs in parking areas or Z2 Design Inc. July 29, 1988 27 on buildings or other improvements as specifically requested and QDR-approved, to be installed and maintained by the parcel owner 4.25 ROCKSCAPE Rockscaping, consisting of rock formations with integrated landscaping, land forms and/or water, may be substituted for up to five percent (5%) of a parcel's required landscape area. The use of rockscaping near buildings. at building entries. adjacent to water areas. at parcel entry drives and at parcel identification signage is encouraged. 4.26 LIGHTING All lighting of proposed parcel development shall receive ODR approval prior to installation Initial submittal to the QDR shall include complete information on all proposed lighting types, locations, fixtures and isometrics. including all exterior lighting, landscape lighting. signage and accent lighting All lighting on a parcel shall be contained within the parcel boundaries and shall be. directed inward. No lighting on a parcel shall create a condition of glare or objectionable lighting on any public rights-of-way, common area or neighboring parcel Overall high light levels are prohibited. light levels shall be no greater than necessary for traffic and pedestrian safety Lighting shall be low-key, with higher intensity accents at features or entry areas To minimize the number of required light poles, overflow lighting from building walls or interiors should be used where feasible All lighting shall be maintained per 5 9 4.261 DECORATIVE BUILDING LIGHTING Building lighting should not only illumine entries and other pedestrian areas for security and safety. but also enhance the architecture and heighten the visual character of the development. The sensitive use of decorative building lighting types, fixtures and colors is encouraged. . 4.262 PARKING AREA LIGHTING Parking area lighting shall be designed to minimize the number of poles, while maintaining acceptable pole heights, lighting cutoff angles, and overall lighting appearance, color and light quality Parking area lighting shall be compatible with building lighting, decorative lighting and right-of-way lighting 4.263 LANDSCAPE AND PEDESTRIAN LIGHTING Landscape and pedestrian area lighting shall provide adequate light levels for security and safety, and shall enhance the architecture of buildings and the appearance of landscaping and land forms. Secondary pedestrian ways and bike paths shall receive lighting treatment consistent with that of primary pedestrian ways and entrances. Decorative landscaping lighting of landscape features and views is encouraged. 4.27 FENCES Fences and grade walls shall be constructed of high quality materials and shall be Z2 Design Inc. July 20. 1988 28 of finishes, colors and textures consistent with those of the adjacent architecture. Fences and walls shall be landscaped per 4 472. 4.28 DUMPSTER/COMPACTION EQUIPMENT All dumpster, trash collection and storage and compaction equipment shall be fully enclosed, screened and/or landscaped from visibility from any public rights-of-way, common areas" neighboring parcels or areas normally used by ~he public or visitors Such equipment and areas shall be properly maintained and regularly cleaned so as to prevent objectionable debris, sights, sounds and odors. 4.29 TANKS, PUMPS, TRANSFORMERS AND MISCELLANEOUS EQUIPMENT Tanks, pumps, transformers and other such miscellaneous equipment essential to the conduct of business operations that cannot be enclosed within a structure shall be fully enclosed, screened and/or landscaped from visibility from public rights-of way, common areas, neighboring parcels or areas normally used by the public or visitors Such equipment and areas shall be properly maintained and regularly cleaned to prevent any unsightly or objectionable effects. 4.3 BUILDING DESIGN STANDARDS The following building design standards are intended to afford the greatest possible aesthetic creativity and variety, while maintaining a very high quality image and identity for Quantum Park and its owners All proposed structures and improvements shall conform to the intent of these standards In reviewing architectural design submissions, the QDR reserves the right, at its sole discretion, to waive any part of these standards for the betterment of the whole of Quantum Park. 4.31 USE OF MATERIALS Only high quality new materials shall be used in the construction of any proposed building or improvement on any parcel. Natural materials, such as wood and stone, metals and metallics, and glasses of varying types are strongly recommended as primary exterior materials. Synthetic materials may be used provided they embody textural qualities and are appropriately colored per 4.35 The architectural design of buildings and other improvements should provide a subtle and sophisticated aesthetic image 4.32 COMPATIBILITY WITH NEIGHBORS All proposed buildings shall be designed to be compatible and complementary to neighboring developments, and to the design character of Quantum Park and its common areas and facilities. Where feasible, buildings shall also be designed and located to respect any existing views, view corridors, major land forms and landscaping massings on neighboring parcels, rights-of-way and common areas 4.33 EQUAL TREATMENT OF BUILDING ELEVATIONS The architectural design and detailing of Z2 Design Inc. July 20, 1988 29 proposed buildings shall be applied equally and consistently to all building faces or elevations, and to all appurtenances or incidental structures 4.34 SHIELDING OF ALL BUILDING EQUIPMENT All buiding equipment or appurtenances of any kind shall be completely enclosed in construction, screened or shielded from visibility from public rights-of-way, neighboring parcels, park common areas or areas normally used by visitors or the public. Such enclosure, screening or shielding shall be by construction integrated with the architectural design of parcel structures, compatible screening or fencing, landscaping or land forms 4.35 USE OF COLOR Coloration of all proposed buildings, structures, appurtenances, signs and site furniture is restricted to low-to-medium intensity shades of natural earth tones, metallics, and clean primary and secondary colors. The use of vibrant colors, tertiary colors and vivid pastels is discouraged. Colors used in Quantum Park identification and directional signage, and in parcel identification signage are discouraged for use on any items within parcels. 4.36 DESIGN TRANSITION FROM STREETSCAPE Proposed building designs and site configurations shall provide appropriate transition from the roadway streetscape and surrounding development onto and within the parcel. Every attempt should be made to provide smoothed and gradual transitions in massing, scale, visual rhythm, color and aesthetic, rather than abrupt changes among contrasting or discordant elements 44 LANDSCAPING STANDARDS All parcel areas not covered by buildings or pavings shall be landscaped with lawns, grasses, ground covers, shrubs, trees, decorative plants and f1orals, or shall receive other embellishment with rockscaping or water areas Landscape plans defining the complete parcel landscape oesign scheme shall be prepared by a duly licensed professional landscape architect, and shall be submitted to the QDR with the initial submittal for approval prior to the start of work. These landscaping standards set forth guidelines for evaluation and preservation of existing vegetation, design of landscaping and related items, coordination of landscaping to surrounding elements, minimum plant materials, distribution of plant materials, landscaping of particular building or site features, and maintenance of landscape areas. 4 41 EXISTING VEGETATION Where existing landscaping and vegetation consist of mature or specimen plants, or constitute well-established and substantial stands, attempts should be made to preserve them through incorporation into the proposed landscape design scheme Existing vegetation that is poorly established, sparse, unattractive or constituted primarily of species Z2 Design Inc. Any viable Sand Pine vegetation shall be preserved or replaced as specified in 4 421 and 4 453 Existing vegetation to be preserved may be credited against parcel landscaping plant quantities required in 4 45 4 42 LANDSCAPE PRESERVATION Substantial quantities of mature. desirable landscaping cannot quickly. easily: or inexpensively be replaced. All proposed parcel development shall preserve existing landscaping to the greatest extent possible. both to provide a more mature. natural and stable environment and to limit the necessary degree of replacement of existing plant materials Preservation of Sand Pine. mature trees, specimen trees and natural hammocks is strongly encouraged. as is the use of natural water areas. rock and land forms within the landscape design The landscape design of a parcel should recreate and preserve a natural and indigenous environment. 4 421 SAND PINE AREAS Any parcels situated within designated Sand Pine areas. as shown in the Ecological Plan for Quantum Park. or on which viable stands of Sand Pine vegetation are encountered. shall be required to preserve all or part of the Sand Pine encountered, based on the parcel location, size and quantity of Sand Pine In the event parcel development is unduly hampered by the location of the Sand Pine, the owner may request approval of the QDR to replace the Sand Pine with a viable Sand Pine stand of equal area elsewhere on the parcel. 4422 PLANTED LITTORAL ZONE AND HARDWOOD SWAMP Lakes within Quantum Park have been designed to serve as water management areas. visual amenities and elements of a larger ecosystem Crucial to the ongoing viability of these lakes are the planted littoral zones and hardwood swamps at their perimeter These areas shall be developed and maintained as set forth in the Ecological Plan. the Water Management Plan and the Master Landscape Plans Any parcel owner intending to develop along a lake edge shall incorporate into his proposed landscape plans measures to maintain, relocate or replace planted littoral zones and hardwood swamps to comply with the intent of the lake design. The owner may also bear the responsibility of maintaining. relocating or replacing any bicycle path or other common area improvement associated with these areas 4 423 PRESERVED WETLANDS Two preserved wetland areas have been established in Quantum Park. of sizes and locations as defined in the Ecological Plan These areas shall be continuously maintained and preserved as set forth in the Ecological Plan. No parcel owner may have access to, alter or in any way affect a preserved wetland 4424 LANDSCAPE ENTRANCE MONUMENTS (GWZ. Are these the same as 4 432 Landscape and ZZ Design Inc. July 20. 1988 31 Graphic Monuments?) 4425 RIGHT-OF-WAY PLANTINGS ADJACENT TO PARCELS (STREET TREES) Shade trees shall be planted in regul."r formal patterns along roadway rights-of-way Trees shall be planted at a minimum size of one-and-one-half inch (1-1/2-) caliber and at a maximum spacing of thirty feet (30') The landscape design of a parcel shall be complementary to and consistent with these street trees 4426 REMOVAL OF EXOTICS Any plants of exotic species, as defined in the Ecological Plan and the Development Order for Quantum Park, encountered on a parcel shall be removed prior to the start of site development, in accordance with procedures defined in the Ecological Plan and the Development Order Extra care shall be taken to minimize seed dispersal prior to or during the removal of such plants. 4 43 CHARACTER OF THE LANDSCAPE SCHEME. Quantum Park shall have a consistent landscape design character to unify and enhance the many parcels and uses The landscape design character shall maintain overall visual continuity throughout the park. All open unpaved space, including but not necessarily limited to front, side and rear setback areas, shall be planted and landscaped according to QDR-approved landscaping plans All plant materials (trees, shrubs, florals, ground covers, lawns and grasses) shall be selected from the Plant Materials List contained in 4 434 Landscape design shall also incorporate preservation of existing trees, preservation or replacement of existing Sand Pine, grading, earth forms, rockscaping and the use of water areas. Plant materials shall be used to complement the overall visual character of Quantum Park, its common areas, neighboring parcels and the architecture of existing and proposed structures Plantings shall be arranged to provide direction and emphasis to building entries, to soften building or wall masses, to frame views and view corridors, to create shade and shelter, and to provide human scale to the parcel development. 4431 ROADWAY RIGHTS-OF-WAY AND COMMON AREAS Roadway rights-of-way and common areas shall be planted and maintained by the Quantum Associates and/or the QPOA. The landscape scheme of rights-of-way includes both the regular placement of mature shade street trees in medians and along right-of-way edges, and the varied placement and design of landscape clusters to define intersections, parcel entries, framed views, access to common areas, etc. Common area landscape schemes vary by the location, configuration, use and surroundings of the common area. However, common area landscaping employs the same basic design principles and mix of plant types as rights-of-way and parcel guidelines ZZ Design Inc. July 20, 1988 32 4 432 LANDSCAPE AND GF ~PHIC MONUMENTS In a number of locations defined on the Master Site Development Plans, landscape and graphic monuments have been developed to provide dramatic entry statements to visitors, and .key orientation points within Quantum Parlr These monuments include signage identifying Quantum Park and orienting the viewer, as well as landscaping, rock and/or water features establishing the environmental design character of Quantum Park. Any parcel adjacent to these monuments shall have a landscape designs that is complementary to their character and design. 4433 ROCKSCAPING Within the landscape design for a parcel, an owner may, a. his discretion, include up to five percent (5%) of required landscape area in rockscaping Such rockscaping shall incorporate random formations of various types of rock interspersed with various plant types, to create a sculptural yet natural composition The incorporation of water and specimen plants into rockscape formations is encouraged 4 434 PLANT MATERIALS LIST (GWZ. Can you provide listings from your Landscape Architects?) 4 44 LANSCAPING OF PARKING AREAS Parking lot entry drives may consist of single or divided roadways, either serving individual parcels or providing combined access to multiple parcels Median landscaping is recommended for divided roadways. Parking lots shall be configured to provide landscaping both within and around the parking area. Interior landscaping may consist either of continuous landscaped separation islands or of tree wells located within the parking area. Perimeter landscaping shall blend into existing and surrounding landscaping, both on-site and off-site Existing trees on-site shalf be preserved within parking areas to the greatest extent feasible Where existing trees are to be preserved, existing ground shall not be regraded more than six inches (6") different than existing grades within the trees' branch drip line, and ground at the immediate base of trees shall not be disturbed in any way Attempts should be made to preserve groupings of young or specimen trees wherever possible, rather than older or widely scattered individual trees New trees should be of the same species as existing trees in the general vicinity Dry wells are recommended for recharge of the groundwater 4 441 PERIMETER BUFFERS Perimeter buffer landscaping should be generally denser than that on other areas of a parcel, and shall be so located as to provide sound, visual and use privacy between neighboring parcels It may also be used to accent or frame particular components of parcel development, and to complement the architecture of structures Particular design attention should be given to the proper buffering of objectionable areas, such as truck areas, service areas and trash areas Z2 Desi~n Inc. July 20, 198[; 33 4 442 PEDESTRIAN ZONES ADJACENT TO BUILDINGS' Pedestrian zones adjacent to buildings should be landscaped with a greater concentration of directional and visual control landscaping (such as hedges, sculpted tree forms, linear shrubs, etc.), and ornamental and decorative plantings (f1orals, unusual species, specimen trees, etc.) These zones should also contain hardier and more easily m~intained species, to provide greater resistance to abuse and more consistent attractive appearance 4 443 SWALES AND STORM INLETS: Swales and other grade contours used for water retention or detention or leading to storm sewer inlets shall be landscaped with informally arranged plantings in a soft and natural design theme Areas adjacent to lake edges shall be similarly treated. Care shall be taken to insure that plantings do not impede the drainage, retention or detention characteristics of such areas 445 QUANTITY AND SIZE OF LANDSCAPE MATERIALS On every development parcel, landscape materials shall be incorporated within the landscape design as set forth herein At the time of planting, a minimum of ten percent (10%) of all trees shall be of at least four-inch (4") caliper. and all remaining trees shall be of at least two-and-one-half-inch (2-1/2") caliper All shrubs shall be a minimum of two (2) gallon size 4 451 SHADE AND FLOWERING TREES Shade and/or flowering trees shall be provided at a minimum rate of twenty-four (24) trees per acre of parcel area not covered by building footprint 4 452 PALM TREES If Palm trees are to be included within the landscape design, they shall be provided at a minimum rate df two Palm trees for each required shade or flowering tree displaced 4 453 SAND PINE TREES If an existing Sand Pine area is to be preserved on a parcel, the existing Sand Pine trees only may be included within the tree count required by 4451 Neither Sand Pine scrub vegetation nor shrubs contained within the preservation area may be included in any required counts 4 454 SHRUBS Shrubs shall be provided at a minimum rate of twenty-four (24) plants per acre of parcel area not covered by building footprint. They shall be concentrated adjacent to pedestrian ways and along building frontages. Z2 Design Inc. July 20, 1988 34 4 455 DECORATIVE GRASSES, GROUND COVERS AND FLOWERING PlANTS. Decorative grasses, ground covers and flowering plants shall be incorporated within the landscape design scheme, and shall comprise a minimum of fifteen percent (15%) of the total landscape area 4456 LAWN (GRASS) AREAS All proposed lawn or grass areas within the first fifty feet (50') of parcel depth from the primary parcel frontage and from any right-of-way shall be sodded. All proposed lawn or grass areas within ten feet (10') of any neighboring parcel shall Qe sodded. Any remaining lawn or grass areas may, at the owner's disc;retion, be seeded, however any seeded areas not fully established ninety (90) days after seeding shall be re-seeded and/or mulched as appropriate 4 46 DISTRIBUTION OF LANDSCAPE MATERIALS Landscaping represents a significant portion of the visual environment of Quantum Park, both within common park areas and on individual parcels It plays a central role in establishing the visual character and the environmental quality of all areas Landscaping shall therefore be incorporated into any development submittal to the QDR, and shall provide much of the qualitative basis on which the QDR will review the submittal Landscaping shall be distributed in such a manner as to 1) complement the overall parcel development, site planning and architectural design, 2) continue and complement the design character of Quantum Park, its rights-of-way, common park areas and other parcels, 3) frame views and create view corridors to maximize the visibility and attractiveness of the park environment, 4) screen or embellish massive or objectionable components of parcel development, and 5) to preserve and maintain natural habitats and ecosystems defined in this document and its attachments Generally, landscaping along parcel frontages shall continue the right-of-way character and provide transition to the development's design Landscaping of parcel side, rear or other internal property lines shall screen objectionable or massive elements, frame views and complement the development's design Parking areas, drives, service areas, truck areas and trash areas shall all be screened by landscaping, earth forms, fences and/or walls Where earth mounding is used, it shall consist of smoothly graded rounded natural forms. Areas abutting canals, lakes or wetlands shall have hardwood swamp plantings, littoral zone plantings, shrub massing or other sensitive design treatment Paths, walks and other pedestrian areas shall have decorative and/or directional landscaping 447 LANDSCAPING OF ALL FIXED IMPROVEMENTS All fixed improvements shall be landscaped as specified herein The QDR may, at its sole discretion, waive any or all of these landscaping requirements, should they represent an undue hardship for a particular development, or should their waiver enable a more comprehensive or higher quality development. July 20, 1988 35 4471 BUilDING WAllS Any building wall of significant uninterrupted visual mass shall be embellished by landscaping to reduce its apparent mass as viewed from public rights-ot-way, neighboring parcels, common park areas or areas normally used by visitors or the public. Such landscaping embellishment shall also be used to complement the building design, assist in directing traffic and pedestrians, provide shade, frame views, etc. 4 472 FENCES AND WALLS Any exterior fence or wall of significant visual mass shall be embellished by landscaping to reduce its apparent mass as viewed from public rights-of-way, neighboring parcels, common park areas or areas normally used by visitors or the public. Any exterior fence or wall of conventional industrial materials (such as chain-link fencing, metal grillages, normal concrete block, metal panels, etc) shall be completely screened by landscaping from visibility to public rights-of-way, neighboring parcels, common park areas or areas normally used by visitors or the public. 4 473 SIGNS Any free-standing parcel identification, building identification, company or business identification, or advertising sign of any size shall be designed in conjunction with landscaping embellishment. Any directional sign of twenty (20) square feet or more of single face area shall also be designed with landscaping embellishment. Smaller directional signs, parking control signs and signs mounted to structures require no landscaping embellishment. Such embellishment may include framing shrubbery, raised planters, rockscape/landscape compositions, decorative florals, etc. The QDR encourages creativity and variety in the use of landscaping to embellish signs. 4 474 EQUIPMENT Any equipment or appurtenance to a building that is not contained or screened by a QDR-approved enclosure or wall shall by completely screened by landscaping . from visibility to public rights-of-way, neighboring parcels, common park areas, or to any area normally used by visitors or the public. 4 48 LANDSCAPE ARCHITECTS CERTIFICATION AU landscape design documents submitted to the QDR for approval shall have been prepared by a professional landscape architect duly licensed in the State of Florida, and shall bear the stamp and/or seal of the landscape architect. In addition, the QDR may request or require, at the completion of landscaping installation, the landscape architect's certification that installed landscaping complies with the QDR-approved documents. 5 0 MAINTENANCE Parcels, buildings, landscaping, pavings and all other improvements shall be continuously maintained from the time of initial access to the parcel to preserve a clean, Z2 Design Inc. July 20, 1988 36 " orderly and well-kept environment and appearance Improvements and landscaping in roadways, medians and the full rights-of-way shall be Installed and maintained by Quantum Associates and/or the OPOA. All items within Individual parcel boundaries shall be the total responsibility of the parcel owner The QPOA shall from time to time monitor maintenance of parcels and improvements within the park, and, if maintenance or appearance is deemed unsatisfactory. or if appearance of buildings or grounds prompts complaints, will notify the owner in writing Failure to correct any such lapses of maintenance or appearance, or to suitably address or respond to concerns raised in such notification, will be deemed sufficient cause for the apOA to order necessary remedial work at the parcel owner's expense 5 1 TRASH All trash and garbage shall be placed in designated containers, or within the owners's contained serv.ice area. All trash areas shall be screened and properly landscaped. The maximum size of trash containers shall be established by the QPOA. A schedule of regular trash removal shall be established, maintained and/or modified as necessary by the QPOA. All parcel areas shall be kept free of trash, leaves. dead landscaping, debris and miscellaneous materials 5.2 PARKING LOTS AND SIDEWALKS All parking lots, sidewalks, service areas and other paved or hard surfaces shall be regularly swept, cleaned and repaired to be kept free of dirt, mud, trash, cracks, spa lied areas, etc. Sunken, eroded or damaged parking areas shall be repaired or replaced in a timely manner Parking areas shall be resurfaced as and when required Bumper stops, curbs, planters or other site constructions shall be maintained, repaired or replaced as and when required All drainage inlets, storm sewers or other drainage elements shall be maintained at full operational capacity and in good repair at all times 5.3 LANDSCAPE AND ROCKSCAPE AREAS All landscape and rocks cape areas shall be continuously . maintained, including irrigation, fertilizing. trimming, mowing, replacement of diseased or dead plant materials, in a clean. tidy and safe manner All landscape materials shall conform in number, species. size at planting, mature size and condition to the QDR-approved landscape plans. and shall be maintained reasonably so All irrigation systems shall be underground, automatic, kept in good repair, and shall be so placed or designed so as not to discolor any wall. fence, sign or other structure 54 SAND PINE PRESERVATION AREAS All Sand Pine Preservation areas shall be continuously maintained in viable condition as described in the Ecological Report. No access is permitted into such areas, nor is any mowing. cutting. irrigation, fertilizing or replacement of diseased or dead plant materials, except as undertaken in a comprehensive Sand Pine management plan under the guidance of an ecological specialist. July 20, 198H 37 ~ 5.5 WATER AREAS, HARDWOOD SWAMPS, UTTORAL ZONES AND WETLANDS All water areas, hardwood swamps, littoral zones and wetlands shall be maintained by the South Florida Water Management District, which shall hold access and maintenance easements to and around such areas. The parcel owner shall be responsible for preventing inadvertent and undue damage to such areas to occur, and for preventing accumulation of trash or debris. No access is permitted into such areas. 5.6 BUILDINGS, WALLS, FENCES AND OTHER EXTERIOR SURFACES All buildings, walls, fences and other exterior surfaces shall be continuously maintained in their original QDR-approved state Regular periodic maintenance shall be undertaken to preserve the appearance and condition Repair of damage or weathering shall be done in a timely manner No exterior surface shall remain in an incomplete or unfinished state 561 NATURAL FINISH OR UNFINISHED MATERIALS All natural finish or unfinished materials shall be maintained in their original state, except for changes due to normal ageing, weathering or discoloration Such materials shall be replaced or restored if their structural integrity. weatherproofing characteristic, stability, safety or other key use factor is compromised 5 62 PAINTED OR FINISHED MATERIALS. All painted or finished materials shall receive regular periodic painting, staining, refinishing or other maintenance as necessary to preserve the material's original appearance and finish. 5 7 SIGNS All signs shall be continuously maintained in their original state, both in appearance and operation, by relamping, cleaning, repainting and/or refinishing . 5 8 SITE FURNITURE All site furniture (Le landscape lighting, bollards, light poles, benches, etc) shall be continuously maintained by means of cleaning, repainting, repair and/or replacement as required 5 9 LIGHTING All site and building lighting poles. fixtures, lamps, wiring and accessories shall be continuously maintained in proper working order and with suitable finish and appearance Lighting shall provide illumination of design intensity and configuration at all times All lighting shall be directed totally within and inward from parcel property lines at all times 6 0 APPENDIX.
