Re Removal of Walking/Jogging Path
Dear Mr MacDonald
It has come to our attention that the walking/jogging path located adjacent to Water Management
Tracts P and Q in Quantum Park has been removed Apparently the path was in disrepair do to
invasive tree roots that may have caused an accident. There are also a "No Trespassing" signs
posted indicating that the path has been closed It is my understanding that the POA will meet on
March 6, 2003 to discuss the walking/jogging path
Please be advised that the walking/jogging path is shown on the Quantum Park DRI Master Plan in
these locations and must be maintained Only the portions around Water Management Tract Q
adjacent to newly created Tracts 100 and 101 were approved for removal Both paths serve as the
sidewalk along Gateway Boulevard that is used by students attending the Boynton Beach High
School The residents of the Quantum Lake Villas apartments can also be expected to use the paths.
Accordingly, the paths should be reconstructed using a material that is consistent with Americans
with Disabilities Standards. The City's Forester/Environmentalist, Kevin Hallahan, recommends that
the tree root hazard be addressed with a root-pruning program and a product called "Biobarrier " If

Commissioners formalized the permit process for obtaining approval to connect to and use
Distnct facihtIes District facihtIes include the Primary SUlface Water Management System,
Quantum Boulevard, Quantum Lakes Drive. High Ridge Road (south of Gateway Boulevard)
and Park Ridge Road. Enclosed for your use are the following:
1 QCDD Boundary Map (11" x 17").
2 A cop of the QCDD Permit. This permit is also the application form and we
request that it be filled out completely and submitted With the proposed
construction plans and other documents as necessary
3 A brief outline of the QCDD permit process.
4 A listing of documents requested in support of the permit application.
We request the application be submitted to the Quantum Community Development Distnct at the
time of the building permit application is submitted to the City of Boynton Beach. As a
condition of the site plan approval by the City of Boynton Beach~ the Quantum Commumty
Development District permit must be obtained prior to issuance of the City's buildmg permit.

THIS PERMIT is granted this day of ,19_, by Quantum
Community Development District (hereinafter referred to as "QCDD"). 1401 Forum Way, Suite 101,
West Palm Beach, Florida 33401, to
(hereinafter referred to as the "Permittee") as a non-exclusive permit to
as shown on the plans and specifications identified as
attached hereto and made a part hereof
WITNES SETH.
1 In the event QCDD is not the fee title owner of the real property (the "Property") to which this
Permit is applicable, the Permittee agrees to obtain all necessary consents from the fee title owners of
the Property prior to commencement of the subject works.
2 Permittee hereby acknowledges that if this Permit is being issued for a connection to or
modification of a QCDD facility the permitted works are being approved by QCDD in reliance upon
and in accordance with the representations and documents provided by the Permittee. If, however, this
Permit is not being issued for a connection to or modification of a QCDD facility, this Permit is only
intended as a statement of non-objection but in any event the terms and conditions of this Permit shall
apply
3 This Permit does not constitute a waiver of the necessity by the Permittee to obtain such other
necessary and appropriate permits required by other governmental bodies or agencies, therefore, the
Permittee, prior to commencement, is required to obtain and. upon written request, provide copies to
QCDD of any and all other applicable federal, state, and local permits required in connection with
Permittee's use of the Property and agrees that at all times it will comply with the requirements of all
federal, state and local laws, ordinances, rules and regulations applicable or pertaining to the use of the
Property or implementation of the permitted works by the Permittee.
4 Permittee understands and agrees that the use of the Property pursuant to this Permit is
subordinate to the rights and interests of QCDD and, to the extent applicable, that of the fee title owner
of the Property Further, Permittee does hereby acknowledge and agree that the Permittee is not
relying upon any representations whatsoever by QCDD regarding QCDD'S right, title, interest. or
ownership as to the Property for which this Permit is applicable.
5 QCDD specifically reserves the right to install, construct, operate. upgrade. repair, replace and/or
maintain existing or future works, devices, and/or improvements on or within its real property interests
and the right to enter upon the Property at all times necessary to inspect or implement the terms and
conditions of this Permit. Permittee understands that in the exercise of such rights and interest,
QCDD may require Permittee to relocate, alter, or remove the Permittee's facilities and equipment or
other improvements made by Permittee pursuant to this Permit which interfere with or prevent
QCDD, in QCDD'S opinion. from properly and faithfully constructing, improving and maintaining its

facilities. If the Permittee should fail to relocate, alter, or remove the Permittee~s facilities, equipment
or other improvements made by the Permittee pursuant to this Permit within a reasonable time period
following receipt of notice from QCDD requesting same or the specified time if set forth in the notice,
then in that event QCDD shall have the right to enter upon the lands and make such relocation,
alterations or removal of the Permittee's facilities, equipment/or other improvements, all of which
shall be at the cost of the Permittee.
6 Permittee agrees that it will not use the Property in any manner which interferes with QCDD'S
use of the Property or causes a hazardous condition to exist.
7 QCDO assumes no liability. obligation or responsibility for the ownership, operation and/or
maintenance of the Permittee's facilities as herein permitted.
8 Unless otherwise set forth in the Supplemental Conditions to this Permit, the Permittee agrees
to backfill any excavation it makes within the Property and to pay for~ repair and/or replace any. (i)
affected below-grade facilities and features located therein, including but not limited to. water. sewer.
stormwater or irrigation facilities, structures or appurtenances and (ii) at or above-grade facilities and
features, including but not limited to structures, grasses and sod, sidewalks. and roadway improvements
(the term roadway improvements shall include but not be limited to landscaping, irrigation facilities,
lighting, striping, signage, curbing, roadway base, subgrade and asphaltic or concrete surfaces) which are
removed or damaged as a result of said excavation. Such repair or replacement shall restore these
features to a non-defective equivalent or better condition as existed prior to the event precipitating the
excavation.
9 All Permittee activity related to subaqueous utility, water and/or sewer lines, including
appurtenant facilities, shall be conducted in such fashion that the primary functional purpose of the
canal or waterway facility, specifically flood control, within which the activity is takmg place is not
adversely affected.
10 Permittee does hereby indemnify and hold harmless QCDD, its Board of Supervisors, officers,
personnel. staff and/or consultants against any penalties. fines, claims, losses, damages (including direct,
indirect or consequential), expenses, or legal fees (including appellate) that might derive, arise out of or
result from the implementation of the proposed project/work by the Permittee.
11 The Permittee shall be obligated at the time of submission of its Permit applIcation, to
provide a detail of any other existing improvements located over, under, upon or through the Property
and the Permittee's accompanying plans and specifications shall clearly indicate how the Permittee will
comply with required clearances between the requested permitted activity and existing improvements
located over~ under and upon the Property, mcludmg complIance with other permitted users duly
adopted and published standards.
12 That attached hereto are Supplemental Conditions to this Permit which are incorporated
herein and made a part hereof.
13 If Permittee should violate any of the terms or conditions of the Permit and shall not correct
or remedy same within ten (10) business days of receiving written notice of said violation from QCDD,
then in that event, QCDO may, at its option, revoke, cancel and terminate this Permit.
14 This Permit shall automatically expire and be of no further force and effect, if commencement
of the works which are the subject of this Permit has not occurred within 180 days from the date of
this Permit, unless a written request for an extension is received by QCDD prior to the expiration date
in which event an automatic 90 day extension is granted. However, only one such automatic extension
is available, after which thiS Permit expires and a new permit application must be submitted.

15 This Permit may not be assigned by the Permittee without the prior WrItten approval of QCDD
and if any of the works which are the subject of this Permit are conveyed, assigned, transferred, gifted
to any third party or are operated by a third party, then the Permittee shall be obligated to provide a
copy of this Permit and its conditions to said successor, assign or operating entity Further, such
successor, assign or operating entity shall be subject to and obligated to comply with all provisions of
this Permit.
16 This Permit shall continue in perpetuity unless it expires or is terminated as herein provided.
17 In any litigation, including breach, enforcement or interpretation arising out of this Permit, the
prevailing party to this Permit shall be entitled to recover all of its costs and expenses, including
reasonable attorneys fees and costs.

SUPPLEMENTAL CONDITIONS TO PERMIT NO.
A. GENERAL CONDITIONS
1 Forty-eight (48) hours prior to a pre-construction meeting if one is scheduled and before
commencement of the permitted activity, notification shall be given by the Permittee to QCDD'S
Engineer, Mock, Roos and Associates, Inc., at 561-683-3113 QCDD'S Engmeer shall establish points
of construction, if applicable, which will require inspection by QCDD'S Engineer prior to construction
of the permitted activity When the Permittee considers the permitted activIty complete, the Permittee
shall notIfy QCDD'S Engineer and schedule an on-site final inspection which shall be held in the
presence of a representative of the Permittee and QCDD'S Engineer
2 Implementation of the permitted works shall be carried out in full accordance with those plans
and specifications which have been submitted to and approved by QCDD and any deViation from such
plans and specifications shall require approval from the office of QCDD'S Engineer prior to
implementation. Further, QCDD reserves the right to revoke or amend this Permit if. following its
issuance, it is determined that the plans and specifications, as previously approved, require modificatlon
in order to protect the health, safety or welfare of the public or prevent adverse impacts to property
interests owned by QCDD or others.
3 The permitted activity shall be implemented, constructed and/or linstalled in full accordance
with the approved plans and specifications. Deviations from the approved plans or specifications shall
be coordinated with and approved by QCDD'S Engineer prior to implementation of any such
deviation.
4 When working in a QCDD road right-of-way, not more than one-half (I12) of the road or street
shall be closed and traffic shall be controlled so as to provide for the safety and minimum hindrance to
the public All traffic control operations shall conform to the most current issue of the Florida
Department of Transportation publication "Manual on Traffic Controls and safe Practices for Street and
Highway Construction, Maintenance and Utility Operations." -
5 QCDD'S Engineer shall be the final authority as to the quality and quantity of the material and
works required to satisfy the terms and conditions of this Permit as they relate to QCDD improvements
and facihties.
6 UPON COMPLETION OF THE PERMITTED ACTIVITY AND AFTER ITS FINAL
INSPECTION AND ACCEPTANCE BY QCDD'S ENGINEER THE Permittee SHALL DELIVER TO
QCDD'S OFFICE ONE COMPLETE SET OF THE FINAL "RECORD DRAWINGS" FAILURE TO
PROVIDE THE FINAL RECORD DRAWINGS MAY RESULT IN THE REVOCATION,
CANCELLATION AND TERMINATION OF THIS PERMIT
7 Roadway Pavement replacement shall be carried out in accordance with the City of Boynton
Beach and FOOT requirements.
8 If, within one (I) year after the date of QCDD'S acceptance of any pavement replacement
work. such work is found to be defective by QCDD, the Permittee shall promptly and, without cost to
QCDD and in accordance with QCDD'S written instructions, correct such defective work, or, if it has
been rejected by QCDD, remove it from the site and replace it with non-defective work. If Permittee
does not promptly comply with the terms of such QCDD instructions. or in an emergency where delay
may cause serious risk of injury, loss or damage, QCDD may~ if it so elects, have the defective work
corrected, or the rejected work removed and replaced, and all of the direct and indirect costs of such
removal, replacement or correction, including compensation for additional professional services, shall
be paid by the Permittee.
9 If any of the herein permitted works are to be constructed or implemented within an area over
which QCDD has a real property interest (Le., either fee tide or easement) the Permittee prior to

commencement or implementation of the permitted works shall be required to provide to QCDD an
insurance certificate in accordance with the attached "Insurance Coverage" requirements, whIch
coverage must be maintained until such time as the permitted works have been implemented or
constructed.
10 This Permit may be terminated or modified if the permitted works are located within an area
over which QCDD has a real property interest and QCDD'S real property interest is subsequently
conveyed to another governmental entity
11 The above Conditions shall be continuing obligations of the Permittee and shall be comphed
with in the event of any subsequent maintenance, repair, replacement or modification of the permitted
improvement.
B. UNDERGROUND IMPROVEMENTS - CONDITIONS
I All underground improvements (said term is defined to include but not be limited to utilities,
equipment of any nature whatsoever and structures) shall have a minimum cover of thirty (30) inches
below profile grade of QCDD roadways and minimum cover of forty-two (42) inches below bottom
elevation of waterways.
2 Unless otherwise approved by QCDD all underground facilities shall maintain a mimmum
clearance of twelve (12) inches, either over or under existing culverts, and, if required by QCDD,
protected.
3 Any affected QCDD works, facilities or improvements shall be left in a non-defective
equivalent or better condition as existed before construction. An inspection by QCDD'S Engineer and
Permittee shall be made of the road right-of-way located within the permitted construction area no
later than twenty-four (24) hours before commencement of the permitted work activity
4 All permitted activity and installations shall be implemented and constructed in a workmanlike
manner using best engineering and construction practices.
5 Trenches shall be refilled in a thoroughly compacted manner so that no future settling will occur
6 The Permittee shall, at the request of QCDD'S Engmeer or his duly authorized representative,
submit copies of density reports of density determinations by an independent testing laboratory If
density reports are requested, they shall be furnished pnor to final inspection.
7 The finished surface of any excavated area shall be replaced with the same type matenal as
existed when the work began, such as sod for sod; shell for shell. etc.
8 Where existing ground, slopes, shoulders and/or ditches are disturbed, they shall be stabilized, as
directed by QCDD or its duly authorized representative, in a manner that will afford protection against
erosion or settling.
9 All pavement crossmgs~ if made subsequent to final placement of base material and pavement
surface, shall, except as may be otherwise authorized by issuance of a special condition which if granted
shall be attached hereto, be made by jacking. boring or auguring, and shall contain an adequate casing if
required by QCDD'S Engineer
10 The above Conditions shall be continuing obligations of the Permittee and shall be complied
with in the event of any subsequent maintenance, repair, replacement or modification of the permitted
improvement.

C. SPECIAL CONDITIONS
1 If either of the following two situations is applicable, the attached Special NPDES Permit
Conditions shall apply, namely.
(a) The works that are intended to be implemented or constructed by the Permittee under
this Permit require coverage under an Environmental Protection Agency National Pollutant Discharge
Elimination System Permit, or
(b) The works which are the subject of this Penn it impact upon or affect works and
facilities of QCDD that are subject to the Environmental Protection Agency National Pollutant
Discharge Elimination System Permit (NPDES) Stonnwater Regulations.

SPECIAL NPDES PERMIT CONDITIONS
The following Special Conditions are applicable to the attached Permit No.
t If the works of the Permittee require the obtaining of an Environmental Protection Agency
NPDES Permit, then the Permittee shall be required to obtain the appropriate NPDES Permit and
provide a copy of the NPDES Permit and NPDES stormwater pollution prevention plan to QCDD prior
to commencement of the subject works.
2 The Permittee shall be required to, (a) implement a maintenance program for the permitted
works, (b) carry out an annual inspection of the permitted works and (c) following inspection, have an
inspection report prepared by a qualified professional. The Permittee shall be responsible for retaining
a copy of said inspection report and providmg a copy of same to QCDD by February t st of each year
3 If any of the works which are the subject of this Permit are conveyed, assigned, transferred,
gifted to any third party or are operated by a third party, then the Permittee shall be obligated to
provide a copy of this Permit and its conditions to said successor. assign or operating entity Further,
such successor, assign or operating entity shall be obligated to comply with all of the conditions of this
Permit including, without limitation, implementation of the above mentioned maintenance program and
the provision of the annual inspection report to QCDD
4 If any act of negligence, omission or commission by the Permittee or third party operator
should adversely affect QCDD'S obligations under QCDD'S NPDES Permit, then the Permittee within
forty-eight hours following receipt of written notice by QCDD of such act shall promptly cease or
rectify same otherwise this Permit shall be immediately suspended until such time as reinstated by
QCDD in writing.
5 If, following receipt of a QCDD written notice of violation of the above conditions, the
Permittee should fail to remedy same within ten business days from the-date of receipt of said notice,
then QCDD shall have the right but not the obligation to initiate such remedial activity as QCDD deems
necessary and appropriate. Any and all costs so incurred by QCDD shall be paid by the Permittee to
QCDD within ten business days following receipt of a QCDD invoice for same and if not paid QCDD
may thereafter revoke this Permit without further notice or hearing.

shall be delivered to Quantum Community Development Distnct prior to commencement of
construction of the permitted works.
