On behalf of the owner, Quantum Associates, use approval is
hereby requested for the proposed Tri-Rail Commuter Rail Station on
a portion of Lot 90 in Quantum Corporate Park The legal
description of the expanded commuter rail station is contained on
the attached Exhibit "A" Two copies of the proposed Master Plan
are being sent to you by overnight courier by Mr Joe Hadley of
Craven Thompson & Associates, Inc , engineers for the Tri-County
Commuter Rail Authority
Pursuant to Section 7 E of Appendix "A" (Zoning) of the
Code, please submit this use request for review by the
Planning and Development Board at its meeting scheduled for
12, 1994

Upon your review of the Master Plan, an administrative waiver
of the peripheral greenbelt requirement set forth in Section
7 H (17) of Appendix A is also requested This provision requires
a twenty-five (25) foot landscaped area on the East side of the
"project area" As you will see from review of the Master Plan
developed by Tri-Rail, the "project area" includes not only Tract
90 of Quantum Park, but also approximately sixty-five (65) feet of
right-of-way East of Lot 90 and West of the existing railroad
tracks Within this area Tri-Rai1 has proposed a landscape buffer
of varying width but which probably averages no less than twenty-
five (25) feet The size, location and nature of the landscape
buffer is required by Tri -Rail to accommodate commuter safety,
access and visibility concerns

We believe an administrative waiver is appropriate because of
the public use nature of the project and because there will, in
fact, be a landscape buffer within the "project area" After
closing of the sale from Quantum Associates to the Tri-County
Commuter Rail Authority, there will be unity of title between the
land purchased by Tri-Rail and the existing railroad right-of-way
thereby allowing you to count the landscaped area to be constructed
within the right-of-way as part of the "Project"
Please confirm that an administrative variance is available in
this circumstance It will avoid the cost and delay associated
wi th review by the Board of Adjustment and facilitate a timely
closing on the sale to the Tri-Rail Authority
