7H 17 of the City's Zoning Code This Section pertains to
peripheral greenbelts within Planned Industrial Development
Districts Due to the importance of this matter to Quantum
Associates, I would like to resolve this issue before it goes any
further
Very briefly, Quantum Associates owns the fee simple title to
a portion of the Lake Worth Drainage District E-4 Canal along the
western boundary of Quantum Park between the Miner Road
r ight-of-w3.jl and N W 22nd Avenue (the width of the E-4 Canal
right-af-way owned by Quantum Associates within Quantum Park is
approxi1"1ately 87 5 feet) In addition, Quantum Associates owns
the fee s_mple title to a portion of the Boynton C-16 Canal along
the sout~ern boundary of Quantum Park (the width of the
right-of-way of the C-16 Canal owned by Quantum Associates within
Quantum Park ranges from 119 58 feet to 144 58 feet) Quantum
Associates has full and complete ownership rights to these
rights-of-way within Quantum park, subject to the easement rights
of Lake Worth Drainage District and South Florida Water Management
District, respectively

The City staff has taken the position that the peripheral
greenbelt requirement cannot be satisfied by utilizing these canal
rights-of-way within Quantum Park, regardless of the fact that
Quantum Associates owns the fee simple title to such rights-of-way.

In my opinion, the staff's position is clearly incorrect In
light of the width of these canal rights-of-way within Quantum
park (87.5 feet to 144.58 feet), and the water a~d natural
vegetation therein, the required peripheral greenbelt is clearly
satisfied by utilizing the subject canal rights-of-way My
opinion is buttressed by the established legal principle that
zoning regulations are in derogation of private rights of
ownership, and should be interpreted in favor of the property
owner, and the words used should be given their broadest meaning
absent a clear intent to the contrary. Hoffman v. Brevard County
ad of Comm'rs, 390 So. 2d 445 (Fla 5th DCA 1980)
As I stated before, this matter is of extreme importance to my
client, and it is imperative that it be resolved as soon as
possible.

It would be my opinion that we should be concerned about accessing the E-4
and the C-16 canal's, with Crane equipment, which is used on occasion for the
cleaning and dressing of the canal's, {ie} and what happens to the trees, foliage and
grass in this greenbelt area when this machinery comes in
Based on all previous greenbelt areas, we have always had trees, shrubs, and
grass areas in them Keeping this in mind, it appears to me this would be a problem
to allow the easement to be utilized for the greenbelt area I most certainly can
see a future code enforcement problem with this type approval

In response to your memo dated October 31, 1988 regarding
peripheral greenbelts at Quantum Park, I offer for your consider-
ation, comments as follows
1 The Planned Industrial Development regulations when
drafted did not contemplate a situation wherein the
property line would be located in the middle of a
waterway
2 It is clerly the intent of the greenbelt regulations
to have, provided by the land developer, a landscaped
area which will exist in perpituity,of such design so
as to visually screen conflicting land uses from one
another
3 Our most recent experience in this regard is Boynton
Commerce Center, where the greenbelt as approved must
attain a 75% opacity by utilizing trees, shrubs,
groundcover and berms
4 Upon review of the approved master plan documents, it
is unclear as to the proposed location of the greenbelt
5 At a minimum,20' of land would be required to plant a
viable landscape buffer, predicated upon species type,
quantity, and quality of plant material
6 The extent of planted materials in the landscaped buffer
should vary, depending upon the adjoining land use
All landscape buffer plans must be reviewed by the
Community Appearance Board, and approved by the City
Council

Objective
The objective of this meeting was to coordinate the construction of
High Ridge Road, the rail spur crossing, the City.s Certificate of
Occupancy requirements regarding the completion of the Publix rail
spur, and access to Gould Plastics, Inc and Curt G Joa, Inc
A I summarized the problems with a review of the construction
schedule and the following target dates
New High Ridge Road completion - December 20, 1988
Rail Spur @ existing High Ridge Road - Start - October 1, 1988
Publix C 0 - December 17, 1988
B Carmen Annunziato summarized his position as previously
discussed with me Although the rail spur is identified on
the Publix site plan, the City has no objection to issuing a
C 0 conditional upon the rail spur being completed at a
specified date Dale Goldsmith stated that the rail spur was
not critical for Publix operation at the time of C 0 and
agreed to accepting a C 0 conditional upon the completion of
the rail spur at a later date Bud Howell also agreed
C In order to provide access to Joa and Gould, I agreed to leave
existing High Ridge Road open for public access until the new
High Ridge Road was completed This was a concern of both Tom
Clark and D Crockett John Sunderman indicated that this
condition was not a problem and Dale Goldsmith further agreed
D Both George Gould and Tim Kenney agreed with the plan to
provide access to their respective facilities
E 22nd Avenue The issue of the schedule for 22nd Avenue was
brought up by Tom Clark, I indicated the completion was
scheduled for November 15 as previously discussed John
Sunderman confirmed the schedule

F Gould Plastics Water, Sewer I further discussed the
conflict with George Gould regarding the construction of
utilities and the security fence George Gould was concerned
that the sanitary sewer service was not located where
originally discussed with Ric Rossi Ric indicated that the
service could be relocated to tie-in at the same location as
the septic tank Ric will review the plans and make the
appropriate revisions and review with George Gould It was
further agreed that if the fence requires removal, a temporary
fence would be installed to provide security to the facility
Water and Sewer Connections
Both Gould and Joa wanted a date which they could connect to the
system Ric Rossi indicated water connections could not be made
until the sanitary sewer was operable John Sunderman indicated
that the lift stations would not be functional until FP & L can
provide service to the lift stations
This concludes the minutes of the meeting held on August 5, 1988

Re Removal of fill material - Quantum Park
Dear Carmen
In accordance with our discussion of nearly one month ago, we have tried to
establ ish a number of different ways to dispose of excess fill materials that
have been generated on the Quantum Park site One of the major sources of
excess fill material has been the allocation of spoils previously generated by
excavation of the E-4 Canal, and the additional material excavated as part of
the Publix development In order to accomplish disposal of some of the excess
material, we have increased the elevations of the lake bottom to the highest
elevations permissible by South Florida Water Management We have also
investigated the possibility of placing fill materials that may be needed for
the future 1-95 Interchange, however, such placement of fill material has
proven infeasible
At this time, we wish to move forward with the sale of fill material and
removal from our site This is needed in order to complete our work in
accordance with the approved drawings and specifications for the project Our
contractor is prepared to remove this material from the site in a manner that
least impacts the City and is fully consistent with City regulations governing
such procedures
The final amount of fill is not exactly known at this time due to a final
calculation of shrinkage that will occur based upon compaction However, it
is believed that we will need to remove between 100,000 and 150,000 cubic
yards We would like to begin this removal as soon as possible, therefore, I
hereby request a meeting with yourself, Tom Clark,and the contractor, to
discuss the procedural details of this removal Thank you for your prompt
consideration of this request

The following topics were discussed
1. Ryan Eastern would coordinate with the City of Boynton Beach
Fire Department to develop emergency access roads and to
obtain proper permits for burning debris on site.
2. Indentifying protected scrub areas from various forms of con-
struction utilizing a surveyor's color coded system of staking
(see attached color code)
3 Requirements of South Florida Water Management District for
de-watering operations
4. Clearing and Excavation permit limited to site grading only
and does not include excavation of lake areas and adjacent
canals until permits from the regulatory agencies have been
obtained by the Developer.
5. Plan of action should construction activities reveal the
existence of site-indigenous species as they are discovered
in accordance with D.R I Appendix 18 A-I, Page 30 and Page
42, also Ordinance No 84-51, Page 4, Sections 6A,B & C and
Page 5, section 8 Dr Richardson stated that it was his
responsibility to coordinate with the Developer and his
sub-contractors to identify, tag and relocate into the
habitat areas animal species as they are discovered (See
attached Ordinance)
6. Dr. Richardson also suggested five (5) gallon pails be pro-
vided for each piece of equipment used during the clearing
phases so they may be used as a temporary receptacle for
species as they are encountered. Animals to be stored in a
cool shaded area while Field Superintendents notify Dr.
Richardson as promptly as possible.

Licence prior to clearing phase

include work within N.W. 22nd Avenue.
9 Identified responsibilities of Mr Rossi's Field Rep to
schedule permit inspections through the Building Department
at 734-8111, extension 241 with 24 hours notice
10. Control turbidity of waterways during construction with
silt screens
11 Lot 55 may be brought to Rossi/Malavisi plan grade elevation
+12 5. Fill in excess of that elevation would require
separate Building permits for the 200,000 yds. 3 (approx.
as determined by R Rossi) of fill needed to establish mini-
mum floor elevations

Table 2 which are listed as species of special concern by Florida state
authorities. These are the Burrowing owl (Speotyto unicularia). the
Gopher Tortois (Gupherus i.j~lyphemus). and the Indigo Snake (Drymarchan
corais). Four Burrowing Owl nests were found in the disturbed field at
the northeast corner of the property while only one Gopher Tortoise
burrow was found in the disturbed field near the junction of the
drainage canal and the E-4 Canal and only one Indigo snake was found
in the scarified sand pine area north of N. W. 22 Avenue (Map 4). These
species must have decreased dramatically in numbers because of cattle

(3) Clearing of specific building sites shall not commence
prior to the phase in which the site is scheduled for development.
(4) During land clearing and site preparation, wetting
operations or other soil treatment techniques appropriate for
controlling unconfined emissions shall be undertaken and imple-
mented by the developer to the satisfaction of the Palm Beach
County Health Department, Florida Department of Environmental
Regulation, and the City of Boynton Beach.
(5) In the event of discovery of any archaeological artifacts
during project construction, the developer shall stop construction
in that area and immediately notify the Bureau of Historic Sites
and Properties in the Florida Department of State. Proper
protection, to the satisfaction of the Bureau, shall be provided by

activities in waters of the State within the limits of your
jurisdiction Section 403 911, Florida Statutes, as amended by
the 1984 session of the Florida Legislature, requires the
Department to notify the local government within 10 days of
receipt of an application for a dredge and fill permit The local
government has 14 days from the time it receives the notification
for a short-form application and 60 days from the time it receives
the notification for a standard-form application to file
objections to the application Furthermore, the local government
may participate as a party to the procedure and may request a
hearing pursuant to Section 120 57, Florida Statutes, within 14
days after receiving notice of the Department's intent If the
local government does not file objections within the designated
time period or request an intent letter, the Department will
assume that the local government does not wish to receive a notice
of intent.
