Dear Mr Lucky.
In reference to your letter dated October 22, 1999 requesting transition of Mr Pellerito's
business to Ms Villano, it is my understanding that only one food cart is allowed at any
time in the Shoppes of Woolbright P C D zoning district. Mr Pellerito's food cart
represents this use Therefore, any transition of this business use has to originate with
Mr Pellerito, who currently holds a valid occupational license for this location which
does not expire until September 30,2000
All other concerns of this matter rests solely between The Home Depot and
Mr Pellerito

Home Depot would expect you, at your expense, to obtain all necessary permIts and hcensmg. Home
Depot consents to your apphcatlOn(s) for that purpose
You would also be expected to operate m the same proper manner as you now do at the Home Depot
stores at West Boca Raton, Margate and Deerfield Beach.

receIve approval to operate a SIngle food vending cart at the Home Depot Store near
Woolbnght Road (OppOSIte Cracker Barrel)
Mr Pellento owns and operates a bUSIness prOViding food vendIng carts In front of Home
Depot stores In Palm Beach County and Broward County He has the exclUSIve
pernussIOn of Home Depot to do thIS He IS a sole propnetor He only pernuts family
relatIves to operate the carts.
He has wntten pernussIOn of Rome Depot to locate a cart at theIr store In your City
They consent to tlus applicatIon and theIr letter of consent is attached. They have
deternuned that thIS IS an amemty wluch would proVide a deSIrable benefit to theIr
customers.
Mr Pellento has been operatIng these carts for 4-5 years SInce the first one was placed at
the west Boca Raton store (Glades Rd. at S.R. 7). The other carts are located at the
stores In the CItIes of Margate, Deerfield Beach and DaVie.
Mr Pellento proposes to locate and operate the cart In the follOWIng manner

Approval of only SIngle cart IS requested,
It would only be present dunng Home Depot's bUSIness hours. TypICally though,
lus carts are at the stores from 10 a.m. to 5 p.m.
The cart IS self-contaIned. It needs no electnc or other connectIon. Its placement
reqUires no work to be performed.
The cart IS removed from the premIses daily, at the close of busIness.
The cart would be located at eIther

6 Per the enclosed sketch, It would be located under the covered canopy area of the
buildmg. The sidewalk area of the store IS about 25 feet deep The cart would be
located as close to the front wall of the building as practical, whIch means it would
be placed about 3 feet from the front of the building.
7 Mr Pellerito always provides a trash receptacle alongside the cart which he sets up
when he "opens" for busmess, and removes when he "closes" He keeps the area
free of debris and trash during his operations.
8 Food IS sold only at the cart. There IS no sale to any customer on any other part of
the Home Depot property (parkmg areas, etc.) The customer must be standing at
the cart to purchase and be handed the food. None IS carned to them.
9 Nearly all ofMr PellerIto's customers are customers of Home Depot. Nearly all
have gone there to shop at Home Depot and choose to make a food purchase at
the cart as a spur of the moment deCISion.
10 An occupatIOnal lIcense will also be obtained after approval IS granted.
