NATURE OF REQUEST
John Shelly agent for Habitat for Humanity is requesting the above described minimum variance
request for the purpose of constructing two single family dwellings on two lots to be assembled and
reconfigured from three substandard lots located between 1-95 and N W 5th Street (see Exhibits
A and B" - LocatIon Maps)
BACKGROUND
The City of Boynton Beach has donated property to assist the Habitat for Humanity organization
establish operations in the City similar to their activity in Boca Baton and Delray Beach During the
previous SIX years this organization has built 29 houses for low- to moderate-income families In
South Florida The lots in question were reduced in size for right-of-way during the expansion of 1-
95 thereby reducing lot depth below a developable threshold. (See Exhibit C" - Site Plan)

The code states that zoning code variances cannot be approved unless the board finds the
following
a That special conditions and circumstances exist which are peculiar to the land, structure or
building involved and which are not applicable to other lands, structures or buildings in the
same zoning district.
b That the special conditions and circumstances do not result from the actions of the
applicant.
c That granting the variance requested will not confer on the applicant any special privilege
that is denied by this ordinance to other lands, buildings, or structures in the same zoning
district.
d That literal interpretation of the provisions of this ordinance would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the terms of
the ordinance and would w<;>rk unnecessary and undue hardship on the applicant.
e That the variance granted is the minimum variance that will make possible the reasonable
use of the land, building, or structure
f That the grant of the variance will be in harmony with the general intent and purpose of this
chapter [ordinance] and that such variance will not be injurious to the area involved or
otherwise detrimental to the public welfare
ANALYSIS
As part of evaluating a variance request, staff looks for alternatives that would minimize or negate
the need for a variance (as required by the criteria for granting a variance) Staff finds that the
requested variance is the minimum necessary to construct single family dwelling units at this
location Even if the configuration of the site were changed, there is insufficient depth to construct
single family dwellings as limited by the existing zoning regulations due to the shallow depth of
these lots (See Exhibit "D" - applicant's justification)
RECOMMENDATION
Based :In the above analysis staff recommends that this request by Habitat for Humanity for a
variance from the City of Boynton Beach Land Development Regulations, Chapter 2 -Zoning
Section 5 G 2 a as described herein for the purpose of constructing two single family dwellings be
granted (see Exhibit E" - Conditions of Approval)

Boynton Beach Variance Application Statement of Special Conditions:
A. The City of Boynton Beach donated these 3 lots to us to help us establish Habitat for
Humamty operations In Boynton as we have done 10 Boca Raton and Delray Beach for
the past 6 years In which time we have bUilt 29 houses for low Income familIes. These
lots were reduced In size by the nght-of-way for 1-95 construction. With current RI
setbacks of 25' front and rear It would be Impossible to build a house on these propertIes.
We have consulted with the Boynton Beach Building Department In develop 109 our
proposal to bUIld 2 on the ongmal 3 propertIes (PCNs 08 43 45 21 34 044 0190, 0200,
and 0210) as per the attached site plan.
B These specIal conditions were the result of the construction ofI-95 and not the apphcant.
C Granting this vanance will allow us the same abilIty to construct houses on our lot hke
other home m the area, which were not affected by the 1-95 construction.
o Enforcing the 25' front and rear setback would insufficIent depth (10 to 20 feet) to build a
house
E The vanance requested IS the reasonable mlmmum required to build our 2 houses on the
3 lots
F The grantmg of this variance wIll Improve the neighborhood, mcrease the tax base and
prOVide homes for 2 famlhes who would otherwise not be able to buy a smgle famIly
