Variances from the City of Boynton Beach Land Development Regulations Chapter 2 -Zoning Section 5 E 2 a - to allow a 4 7 foot reduction from the required 25 foot front yard setback to 20 3 feet and a 9 8 foot reduction from the required 25 foot rear yard setback to 15 2 on lot 19 and portion of lot 20, and allow a five foot reduction from the rear setback from 25 feet to 20 feet on the remaining portion of lot 20 and lot 21 for the purpose of constructing two single family dwellings in the R-1 zoning district, within the Rolling Green Ridge Second Addition Subdivision NATURE OF REQUEST John Shelly agent for Habitat for Humanity, is requesting the above described minimum variance request for the purpose of constructing two single family dwellings on two lots to be assembled and reconfigured from three substandard lots located between 1-95 and N W 5th Street (see Exhibits "A" and "B" - Location Maps) BACKGROUND The City of Boynton Beach has donated property to assist the Habitat for Humanity organization establish operations in the City similar to their activity in Boca Baton and Delray Beach During the previous six years this organization has built 29 houses for low- to moderate-income families in South Florida. The lots in question were reduced in size for right-of-way during the expansion of 1- 95, thereby reducing lot depth below a developable threshold. (See Exhibit "C" - Site Plan) The following is a description of the zoning districts and land uses of the properties that surround the property. North South East West Single family home (city infill project), zoned R-2 Former waste water plant site, zoned Public Usage Single family homes zoned R-1 Interstate 95 right-of-way ( Page 2 HabItat for HumanIty FIle No ZNCV 98-007 The code states that zoning code variances cannot be approved unless the board finds the following a. That special conditions and circumstances exist which are peculiar to the land structure or building involved and which are not applicable to other lands, structures or buildings in the same zoning district. b That the special conditions and circumstances do not result from the actions of the applicant. c That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district. d That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would work unnecessary and undue hardship on the applicant. e That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure f That the grant of the variance will be in harmony with the general intent and purpose of this chapter [ordinance] and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare ANAL YSIS As part of evaluating a variance request, staff looks for alternatives that would minimize or negate the need for a variance (as required by the criteria for granting a variance) Staff finds that the requested variance is the minimum necessary to construct single family dwelling units at this location Even if the configuration of the site were changed, there is insufficient depth to construct single family dwellings as limited by the existing zoning regulations due to the shallow depth of these lots (See Exhibit "0" - applicant's justification) RECOMMENDATION Based on the above analysis, staff recommends that this request by Habitat for Humanity for a variance from the City of Boynton Beach Land Development Regulations, Chapter 2 -Zoning, Section 5 G 2 a as described herein for the purpose of constructing two single family dwellings, be granted (see Exhibit E" - Conditions of Approval) S'\projects\Habitat For Humanity\ZNCV\staffreport A ~.^ ox n '" ->' ~.
