SUBJECT: Isles at Hunters Run PUD
Response to Kilday and Associates request of Jan. 9, 1996
In their memorandum, the representatives from Kilday and Associates state their
client's objection to our condition prohibiting the placement of large, canopy-type
trees either m or overhangmg the eXIstmg utihty easement along the eastern property
line of their project. Please be advised that we stand by our origmal
recommendation for the followmg reasons
1) The large tree specIes in question, LIve Oaks, were selected for then abIlity to
provide screening to the new development. LIve Oaks are well known for their
WIdespread canopy The proposed locatIon for the trees would extend that canopy
over the utIlIty easement, and prohibit the use of our backhoes without severely
pruning the trees SImilarly, the trees' root systems also spread laterally, and would
encroach into the easement, eventually going over, under, or around the force main.
ThIS would severely damage the mam m the event the tree IS blown over during a
hurncane or other storm event, and result in a large scale sewage spIll
2) The easement m questIon is partIcularly senSItIve, for it contams the sewage
force main that carnes all of the City's sewage (approxImately 8 mIllion gallons per
day) to the Regional Wastewater Treatment Plant. Any damage to the force mam
at the project locatIOn would Immediately discharge large quantIties of sewage mto
the project, and Congress A venue
For both of the reasons CIted above, we continue to recommend the trees be
relocated away from the easement, or replaced with various species of palms so as
to achieve a similar effect

Proposed
Development
A court order entered May 10, 1973 between the City of
Boynton Beach and Summit Associates Ltd designated the
property as commercially zoned The city's 1989
comprehensive plan changed the land use of the property
to a less intensive commercial designation On June 3,
1994, Palm Beach County Circuit Court (Case no 91-7257
AN) ratified the May 10, 1973 court order and required
the land use of the property to revert to the
property's land use designation prior to the 1989
comprehensive plan On November 9, 1995 the City
entered into a settlement agreement with Summit
Associates Ltd The approval of the agreement was
subject, in part, to the following
A Rezone the property to a planned unit development
(PUO), limited to single-family usage and a LUI
rating of 4 00
B Amend the land use designation to low density
residential
C Approve the master plan subject to the conditions
set forth in the development order
As previously stated the master plan consists of 56
lots for single-family detached zero-lot-Iine units
The lots shall front on a private road Platting is
currently in progress This request for site plan
approval is for common area improvements that include
landscaping in open space tracts and around lakes, a
site wall along Congress Avenue and approximately 66%
of the north property line starting at the Congress
Avenue corner, project signage and a 215 square foot
guardhouse building (see Exhibit "B" - proposed site
plan and master plan)
Concurrency:
Traffic Palm Beach County Traffic Division has
determined that the project meets the requirements of
the Traffic Performance Standards
Drainage - Insufficient drainage information has been
submitted for the Engineering Division to certify
compliance with the City's drainage levels of service
at the time of site plan approval, when it is required
The Engineering Division is recommending that this be
postponed to time of permit review However, during
the platting process drainage will also be reviewed
Driveways:
Access to the proj ect from Congress Avenue is via
Summit Drive and Westlake Drive which are private roads
located within Hunters Run Westlake Drive is to be
extended into Isles At Hunters Run and the portion
located in Isles At Hunters Run is a private road and
part of the Isles At Hunters Run property Westlake
Drive has a cul-de-sac at each end and all 56 lots
front on this 50 foot wide private right-of-way
Parking Facility:
Not Applicable
Landscaping
The proposed landscaping consists of trees and
hedge/shrub material located in open space common areas
located east and north of the single-family lots
Littoral zone planting is shown around the two lakes
The open space and lake areas are to be tracts

The architecture of the guardhouse resembles a spanish
design with an "S" tile roof and stucco walls with
raised bands around the cornice and windows The walls
of the building are an earth tone color and the color

identification sign located at the intersection of
Summit Drive and Westlake Drive A project monument
sign is also proposed south of the guardhouse near the
south property line of the project
RECOMMENDATION:
The Planning and Zoning Department recommends approval of this site plan
request, subject to the comments included in Exhibit C - Administrative
Conditions The deficiencies identified in this exhibit shall be corrected
on the set of plans submitted for building permit

DESCRIPTION The above request for Isles at Hunters Run has been
submitted by Kilday & Associates, Inc , agent for Home Development
Corporation Isles at Hunters Run is to be a 56 unit, single
family dwelling proj ect located at the west side of Congress
Avenue, approximately 500 feet north of Summit Drive Site plan
approval is requested for the common area improvements that include
landscaping in open space tracts and around lakes, a site wall
along Congress Avenue and approximately 66% of the north property
line starting at the Congress Avenue corner, project signage and a
215 square foot guardhouse building
RECOMMENDATION The Planning and Development Board, with a
unanimous vote, recommended approval of this request, subject to
staff comments in Exhibit IICII, with the following revisions to
comment 2, 7 and 23
2 No trees are permitted within utility easements, however
overhang of large trees will be permitted, rather than
prohibited, within utility easements
7 Sidewalks are required on both sides of all local and
collector streets, unless a sidewalk waiver is requested
and granted by the Technical Review Committee
23 A handicap space located at the guardhouse is required
unless verification is provided that the Isles at Hunter
Run is a part of the Hunters Run PUD master property
owners' association
Staff accepts the revisions to comment 7 and 23, however the

Plan seems to be on SIX separate sheets whIch, In total, don't cover the entire sIte. We are unable
to locate the reqUIred draInage planes) but assume the Master Plan approval satIsfied all draInage
reqUIrements. Complete InfOrmatIOn about paVIng also was not on the documents we receIved,
so we assume all such InfOrmatIOn will be provIded with the Plat applIcatIOn.
About the only comment we can make IS that SIte plan approval and plat recordIng are pre-
requisItes to the Issuance of bUildIng permIts other than excavatIOn and fill, cleanng and
grubbIng, temporary facIlIties and dry models.

Find attached for your review the plans and exhibits for the
above-referenced project Site Plan Review approval for this
project will be granted by the City Commission To ensure that
the project stays on line with the review time frame, I request
that the plans and exhibits be reviewed and formal written
comments transmitted to the Director of the Planning and Zoning
Department no later than 5:00 P.M. on December 11, 1995. Do not
return plans and exhibits Retain same for the review of the
amended plans (second review)
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval
1 Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 of the Code of Ordinances to review and formulate
comments
2 The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the Site Plan Review
Ordinance However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards or the
documents show code deficiencies, additional data and/or
corrections should be requested by the reviewer through the
Planning and Zoning Department
3 Each comment shall reference the section of the code that is
incorrectly depicted on the documents
4 Technical Review Committee member{s} shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements

5 When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with the
name of the appropriate TRC Member that is responsible for the
review specified
6 If a TRC member finds the plans acceptable, he/she shall
forward a memo, within the time frame stated above, to the
Planning and Zoning Director stating that the plans are
approved and they do not have any comments on the plans
submitted for review and recommend the project be forwarded
through the approval process
All comments shall be typed, addressed and transmitted to the
Director of the Planning and Zoning Department for distribution to
the applicant Please include the name and phone number of the
reviewer on this memo Michael E Haag will be the Planning and
Zoning Department staff member coordinating the 1st review of the
project
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and the procedures for
resubmission When the Planning and Zoning Department receives the
amended plans, they will distribute the plans with a cover memo to
all TRC Members for review and approval
