Corporate Dnve, which WIll serve as a shared driveway WIth the project adjacent to the south.

VARIANCES TO PARKING LOT REGULATIONS
1 All applications for variances to the Parking Lot Regulations must be received and accepted by the
Planning and Zoning Division on the date identified on the review schedule with the appropriate fee as
defined in City of Boynton Beach Resolution No R95-45
2. An application for a variance may be processed at the same time that an application for site plan
approval or approval of subdivision construction plans is submitted. However submittal deadlines vary
for different applications Contact the Planning Division for further details
3 All parking lot variance applications are reviewed by the Technical Review Committee(TRC) which
consists of the department heads or designated representatives of those City departments concernec
with land dev~lopment. The TRC may recommend that the variance request be approved approved
with modifications, or denied The applicant is not required to attend the TRC meeting The applicant
will be notified as to the recommendations proposed by the TRC The applicant should be prepared to
respond to all TRC recommendations at the hearing before the City Commission A copy of the staff
report and recommendation is available from the Planning and Zoning Division prior to the CIty
Commission meeting and where applicable the Planning and Development Board meeting
4 All applications for variances are advertised for a public hearing before the City Commission in a
newspaper of general Circulation At the public hearing before the City Commission, any person may
comment favorably or unfavorably on the variance request. The applicant or his agent must attend the
meeting
5 The City Commission gives final approval or denial to parking lot variances and directs the City
Attorney to prepare a development order that defines the final determination
6 Prior to obtaining a building permit or subsequent approvals all plans and documents shall reflect the
conditions of approval defined in the development order
7 All applicants with approved site plans or subdivision construction plans, or approved parking lot
variances, which at a later date request an additional variance, or variance modification, will be required
to submit a complete variance application and filing fee, and will be subject to all Code requirements in
effect at the time the additional variance is requested.

PARKING LOT REGULATIONS VARIANCE
JUST~CATIONSTATEMENT
The purpose of thIS apphcatIon IS to obtam reheffrom the proVISIOns of Chapter 23, ArtIcle 2, H7
of the CIty Code (parkIng lot regulatIons), to allow the proposed Lowe's Home Improvement
Center to be located at the southeast corner ofWoolbnght Dnve and Corporate Dnve to have three
dnveways rather than the normal hmlt of two We beheve that thJ.s request IS clearly JustIfied
because of the SIZe of the facilIty and the sIgmficant traffic volumes that will be usmg the dnveways
(6,390 total tnps per day) and due to the fact that the appltcant has deSIgned the project With no
dnveways on Woolbnght Road, to mImmIze traffic lIDpact on that roadway Further, It should be
noted that the southern most dnveway will be a shared dnve With the adjacent mdustnal project, and
that tlns dnveway would be Installed JUst a few feet further to the south to serve that adjacent project
alone, If the proposed shared arrangement were not permItted. Therefore, as a practtcal matter, It
can be sald that the project will have 2.5 dnveways and the approved project to the south wIll reduce
It'S number of dnveways by.5 Therefore, approval of thJ.s request will not result m an Increase In
the number of dnveways that would normally be permItted on Corporate Dnve However, the
proposed arrangement of dnveways will allow for a balanced dIstributIon of traffic and will
minImIZe the potentIal for exceSSIve stackmg at the dnveways and on Corporate Dnve waItmg to
get on or off of the sIte.
Approval of thIs vanance request will have no adverse Impact on Corporate Dnve or on the
surroundmg area. In fact, approval will enable Corporate Dnve and Woolbnght Road to functIOn
more smoothly Due to the SIze of the SIte, the proposed dnveways will be far enough apart that
they will not cause COnflIctS With each other
